HC to govt: Clarify stand on TET-failed teachers


PATNA: The Patna high court on Friday directed the state government to clarify its stand on the continuation of service of primary teachers who did not clear the teacher eligibility test (TET) even after two attempts.

A division bench of chief justice L Narasimha Reddy and Anjana Mishra sought the government's reply while hearing an LPA filed by one Rizwana Khatoon, a Madhubani district teacher who was removed from service on the ground that she did not clear the TET in two attempts. She citied a government order on September 15 last year which said the provision of removing such teachers should be kept in abeyance.

The court observed unless the government passed a resolution allowing teachers to appear for the third time in TET, these teachers could not be removed as the government had come up with conflicting directives from time to time.

HC refusal to do away with AOR provision: The Patna high court on Friday ordered continuation of the provision of Advocate on Record (AOR). A full bench of chief justice L Narasimha Reddy, Justice Shivaji Pandey and Justice Sudhir Singhon disposed of the writ petition on AOR, saying it does not violate any provision of the statute.

However, the bench relaxed the rules for candidates appearing for AOR. A candidate was required to secure 60% in aggregate and at least 50% in each paper of AOR examination so far, but now those securing 50% in aggregate and 40% in each paper will eligible to be an AOR.

An AOR of the high court is the advocate without whose signature a case cannot be filed in the high court. It was introduced in 2010 by an amendment to the Patna high court rules.

The AOR rules also require an advocate to have professional experience of two years and subsequent training of one year under any AOR having at least 10 years experience.

Reply sought from backward classes panel: A division bench of the Patna high court comprising chief Justice L Narasimha Reddy and Justice Anjana Mishra on Friday directed the State Commission for Backward Classes to file its reply on August 3 on how Tamoli, Bairee and Teli castes were converted from backward to extremely backward class. The court also directed the petitioner to put a fresh notice in newspapers to invite observations.

The court was hearing a PIL which was filed by one Kishori Das.
