The petitioner claims that he possesses the essential qualification for
appointment as Assistant Teacher. He has also cleared his T.E.T.
Examination in 2011.
An advertisement was issued by the respondent no. 4 inviting applications
for appointment of the Assistant Teacher of Science/Mathematics in Senior
Primary Schools run by U.P. Basic Shiksha Parishad.
It is stated that the petitioner's mark is above the cut-off of marks of
671.36 for general category in the subject of mathematics. It is further
stated that the second counselling for the subject of mathematics was
conducted in July, 2014 and the cut off marks was 96.09 and the petitioner
has participated in the second counselling.
The grievance of the petitioner is that a communication has been issued on
16.8.2014 wherein the petitioner has informed that he could not secure
place in the select list and he has been advised to take back testimonials.
It is stated that from the cut off list which has been issued for the
district Bijnor, it is evident that the petitioner's quality points are
above the cut off marks.
From the record it transpires that the petitioner has made a representation
to the District Basic Shiksha Adhikari on 30.6.2015, which is on record as
Annexure-9 to the writ petition.
Having heard learned counsel for the parties, I am of the view that end of
justice would be served by issuing a direction to the District Basic
Shiksha Adhikari to consider the cause of the petitioner and pass
appropriate order in accordance with law.
In view of the aforesaid, the writ petition is accordingly, disposed of.
