Heard Sri S.P. Pandey, learned counsel for the petitioner, Sri Mrigraj Singh, learned counsel for the respondent nos.3 and 4 and Sri Vijay Kumar Singh, learned standing counsel for the respondent nos.1, 2 and 5.
This writ petition has been filed seeking a direction in the nature of mandamus commanding the respondents to issue appointment letter to the petitioner for the post of Assistant Teacher Science & Math and to permit her to join her duties.
According to the petitioner she had obtained a merit of 72.71 but appointment letters have been issued to persons of lower merit and the petitioner has been left out.
In respect of her claim, the petitioner is stated to have preferred a representation through registered post on 24.09.2015, copy of which has been filed as Annexure-8 to the writ petition but it is stated that no order has been passed thereon.
No useful purpose would be served in keeping the petition pending.
This writ petition is therefore disposed of with the consent of learned counsel for the parties with a direction to the respondent no.5-Principal, District Institute of Education Training, Jaunpur to consider and decide the pending representation dated 24.09.2015 in accordance with law within a period of one month from the date a certified copy of this order is received in his office.
The petitioner shall also provide a copy of the representation dated 24.09.2015 along with certified copy of this order to respondent no.5.
It is made clear that the Court has not adjudicated the claim of the petitioner on merits.
