सूचना का अधिकार अधिनियम - सूचना छिपाई, तो खुद भरेंगे जुर्माना

संबंधित कर्मचारी ही भरेगा आर्थिक दंड
इलाहाबाद : सूचना का अधिकार अधिनियम के तहत मांगी गई जानकारी मुहैया न कराने पर संबंधित अधिकारी-कर्मचारी की जेब हल्की होना तय है। ऐसा बिल्कुल नहीं चलेगा कि गलती कोई करे और उसका खमियाजा अकेले जन सूचना अधिकारी भुगते। जो कर्मचारी सूचना उपलब्ध नहीं कराएंगे, उनसे ही आर्थिक दंड की राशि वसूल की जाएगी।
आरटीआइ के तहत विभिन्न विभागों के स्तर पर सूचनाएं मुहैया नहीं होने पर संबंधित व्यक्ति को राज्य सूचना आयोग में अपील करनी पड़ती है। सुनवाई के पश्चात आयोग सूचना मुहैया कराने का आदेश देता है। बावजूद इसके समय सीमा के भीतर सूचनाएं मुहैया नहीं कराई जाती हैं। नतीजा, आयोग जन सूचना अधिकारी के विरुद्ध आर्थिक दंड/जुर्माना लगा देता है। ऐसी स्थिति में संबंधित विभाग की छवि भी खराब होती है। चुनाव नजदीक हैं और सरकार अपनी छवि कतई खराब करने के मूड में नहीं है। शासन की इस मंशा के मद्देनजर खाद्य एवं रसद विभाग ने निर्देश जारी कर चेतावनी दी है कि सूचना के विलंब से अथवा नहीं उपलब्ध कराए जाने की स्थिति में यदि राज्य सूचना आयोग प्रतिकूल दृष्टिकोण अख्तियार करता है, तो इसके लिए संबंधित अधिकारी-कर्मचारी को ही जिम्मेदार माना जाएगा। यदि आयोग आर्थिक दंड/जुर्माना लगाता है, तो उसकी वसूली भी संबंधित उत्तरदायी कर्मचारी से ही होगी, जिसने सूचना विलंब से मुहैया कराई या सूचना नहीं दी।

क्यों नहीं डरते अधिकारी-कर्मचारी
असल में आरटीआइ कानून में जन सूचना अधिकारी के अलावा किसी और पर दंड का प्रावधान ही नहीं है। प्रथम अपीलीय अधिकारियों पर इसी वजह से उपेक्षा का भाव रहता है। समय पर सूचना न दिला पाने वाले जन सूचना अधिकारी पर 250 रुपये प्रतिदिन और अधिकतम 25 हजार रुपये जुर्माना लगाया जा सकता है।

प्रावधान और भी हैं
- सूचना का अधिकार कानून की धारा 19 में किसी व्यक्ति को हर्जाना दिलाने का अधिकार सूचना आयोग के पास है। हर्जाने के साथ फाइल में जिम्मेदारी तय करते हुए नोटिंग होने से अब प्रथम अपीलीय अधिकारी पर कानून के शिकंजे से डरने लगे हैं। मुख्य सचिव भी इस बाबत आदेश जारी कर चुके हैं। इसके बाद प्रथम अपीलीय अधिकारियों द्वारा सुनवाई न करना अनुशासनहीनता के दायरे में आ गया है।
- जन सूचना अधिकारी से सूचना न मिलने पर यदि आप प्रथम अपीलीय अधिकारी के पास नहीं जाना चाहते, तो आरटीआइ कानून की धारा 18 के तहत सीधे सूचना आयोग में शिकायत की जा सकती है।
