Heard learned counsel for the parties. 
The petitioner is appeared in the selection for trainee teachers at Hardoi and was selected. She underwent the training and, thereafter, submitted documents for appointment as teacher in Primary School. But, the appointment letter was not issued. In the meanwhile, another advertisement was issued for selection and appointment as Assistant Teacher (Maths and Science) in the Senior Basic Schools, in pursuance to which the petitioner applied, she was selected and appointed on the said post in the senior Basic School on 21.9.2015. In pursuance to her appointment order, she joined service as Assistant Teacher in Senior Basic. In the meantime, an advertisement dated 7.10.2015 has been issued by the Basic Education Officer, Hardoi. All the candidates who had passed Teachers Training were called upon to return the original documents by 15.10.2015 otherwise their candidatures in District-Hardoi shall be cancelled. According to the petitioner she had collected her document from the Office of Basic Education Officer, Hardoi after completing the teachers training for the purposes of submitting the same for appointment as Assistant Teacher in Senior Basic School, in pursuance to selection held in Hamirpur where she has joined. Now she has been asked to deposit very documents at Hardoi for appointment as Assistant Teacher in Primary School. 
In these circumstances, she has approached this court challenging the aforesaid advertisement dated 7.10.2015 seeking direction to the opposite party not to cancel the appointment in the Primary School. She is ready to deposit the documents as and when made available. 
The petitioner should make up her mind where she wants to work and join. 
Considering the facts of the case it is provided that if the original testimonial have been verified for the purpose of appointment as Assistant Teacher, Senior Basic School then the same may be returned to the petitioner if there is no legal impediment in this regard. If any counseling for trainee teacher, in pursuance to the advertisement against which the petitioner was considered at Hardoi is still going on or is to be held in future then the petitioner may be considered in the same, subject to deposition of the said testimonials, if there is no legal impediment. 
The writ petition is disposed of in the aforesaid terms.

1. Heard Sri Vishnu Shanker Gupta, learned counsel for the appellants, learned Standing Counsel for the State of U.P. and perused the record.

These special appeals under Chapter VIII Rule 5 of the High Court Rules, 1952 have been preferred challenging the correctness of judgment dated 07.12.2004, passed by the learned Single Judge in Civil Misc. Writ Petition No. 35831 of 2004 - Dinesh Kumar Rawat and Others Vs. State of U.P. and Others. 
3. The relief sought by the appellants in the aforesaid appeals is to allow the appeals and set aside the impugned judgment and order with cost throughout. Since the relief sought in the aforesaid appeals is common, therefore, by the consent of learned counsel for the parties, all the appeals are heard and decided collectively by this judgment.  
4. This Court at the time of admission on 15.03.2005, had passed following order : 
"Last paragraph of the order under appeal is set out:- 
'For the aforesaid reasons, all the writ petitions are dismissed except writ petitions of candidates with B.Sc. (Agriculture) and B.Sc. (Home Science), who were treated in the arts category. These writ petitions are referred to the larger bench for determination of question as to whether the B. Sc. (Agriculture) and B. Sc. (Home Science) degrees for the purposes of selection in Special B. T. C. 2004 are degrees in Science, for the appointments as Assistant Teachers in Basic Schools as held in Kripa Shanker Dube's case (Writ Petition No. 32309/2003 decided on 13.4.2004).' 
The appeal might be put up for hearing after the referred cases are disposed of by the larger Bench."

Sri Vishnu Shanker Gupta, learned counsel for the appellants submits that the writ petition of the appellants being Writ Petition No. 35831 of 2004, was connected with the leading case being Civil Misc. Writ Petition No. 22141 of 2004, alongwith large number of other cases. In this case, vide impugned order the learned Single Judge had held as follows : 
"For the aforesaid reasons, all the writ petitions are dismissed except writ petitions of candidates with B.Sc. (Agriculture) and B.Sc. (Home Science), who were treated in the arts category. These writ petitions are referred to the larger bench for determination of the question as to whether the B.Sc. (Agriculture) and B.Sc. (Home Science) degrees for the purposes of selection in Special B.T.C. 2004 are degrees in Science, for the appointments as Assistant Teachers in Basic schools as held in Kripa Shanker Dube's case (Writ Petition No. 32309/2003 decided on 13.4.2004)."

Counsel for the appellants further submits that the matter was decided by the larger Bench, comprising Hon'ble Chandramauli Kumar Prasad, Chief Justice and Hon'ble Mr. Justice Pankaj Mithal, vide order dated 23.12.2009, passed in Civil Misc. Writ Petition No. 22141 of 2004 - Niranjan Singh and Others Vs. State of U.P,. & Others, alongwith other connected cases. The larger bench decided the reference in favour of the petitioners in the following manner : 
"The learned Single Judge in the aforesaid judgment observed as under : 
"...........court is of the opinion that there is no material for clubbing B Sc. (Ag) in Arts category and as such this condition, which has been sought to be imposed, appears to be unreasonable on the face of it. 
................... 
In this view of the fact, as the petitioner had filled up form for consideration of his candidature as Science category candidate and has undertaken the aforementioned examination in the aforementioned category as such it is hereby directed that petitioner shall be treated as Science category candidate and admission be accorded to him on merit by treating him as Science category candidate." 
It is further relevant here to state that the State Government by its order dated 10.07.2007 had decided that B.Sc. (Agriculture) and B.Sc. (Home Science) candidates shall be considered to be candidates belonging to science stream. 
The relevant extract of the aforesaid Government order is reproduced herein below :-

In view of the aforesaid, we hold that the candidates who had obtained their degree for B.Sc. (Agriculture) or B.Sc. (Home Science) be treated to be candidates belonging to the science stream for the purposes of admission to the Special BTC course 2004. 
Counsel for the petitioners state that a large number of seats are still available in the Special BTC course 2004 on which the candidates who have passed Bachelor of Science (Agriculture) and Bachelor of (Home Science) can be accommodated. 
We do not find any material to record a finding in this regard. In case seats/vacancies are available for admission, the respondents shall consider the cases of all those candidates who had passed B.Sc. (Agriculture) or B.Sc. (Home Science) treating them to be belonging to the science stream. Benefit of this order shall not only be confined to the writ petitioners but would be available to all the candidates who had applied and belong to aforesaid categories. 
All the writ petitions stand disposed of accordingly." 
7. Learned counsel for the parties agree that the matter in reference covers the facts of these cases and the judgment dated 23.12.2009, covers the factual and legal aspects of the controversy involved in these appeals.

Having heard learned counsel for the parties and after perusal of judgment dated 23.12.2009, we proceed to decide these appeals in terms of the judgment rendered by the Division Bench of this Court in Civil Misc. Writ Petition No. 22141 of 2004 - Niranjan Singh and Others Vs. State of U.P. and Others (alongwith 54 other connected matters), decided on 23.12.2009. 
9. Accordingly, aforesaid appeals are disposed of in terms of judgment dated 23.12.2009, rendered by the Division Bench of this Court in Civil Misc. Writ Petition No. 22141 of 2004 - Niranjan Singh and Others Vs. State of U.P. and Others (alongwith 54 other connected matters).

The petitioner is an Assistant Teacher in a Primary School, namely Purva Madhyamik Vidyalaya, Devnathpur, Harawa. Her date of birth according to her is 11.7.1953. The petitioner claims that she is entitled to continue in service till the end of academic session i.e. 31.3.2016. 
Learned Standing Counsel appears for respondent nos. 1 & 2, and Sri Nisheet Yadav,� learned Advocate has accepted notice on behalf of respondent nos. 3,4 and 5. 
Learned Standing Counsel has produced a Government Order dated 08th October, 2015 which has been issued in the compliance of the law laid down by this Court in the judgement dated 20th August, 2015 in Special Appeal Defective No. 360 of 2015 "State of U.P. & others v. Ramesh Chandra Tiwari and others". The Government Order is taken on record. 
The Government Order provides that a teacher whose date of birth falls between 1st April to 31st March (next year) shall be entitled to continue till the end of academic session i.e. 31st March, 2016. 
The Division Bench in Special Appeal Defective No. 360 of 2015 has held as under: 
"...However, a teacher who attains the age of superannuation during academic session 2015-16, as modified, and who has not taken the benefit of the proviso to Rule 29, would be entitled to continue in service until the end of the academic session which would be 31 March 2016. The Government Orders which have been issued from time to time, more particularly on 9 December 2014 and 29 June 2015 have to be necessarily brought in line with the mandatory requirements of the proviso to Rule 29. As we have observed earlier, the power to alter the academic year undoubtedly vests with the Government but having once altered the academic year, the consequence which is envisaged under the proviso to Rule 29 must ensue. The State Government cannot by a government order override the proviso to Rule 29. That is part of subordinate legislation which cannot be simply disregarded by an administrative order. 
On the facts of the present special appeal, the dates of superannuation of the four respondent teachers would respectively be 1 June 2015, 27 May 2015, 4 June 2015 and 30 June 2015. All these teachers worked in academic session 2015-16 commencing from 1 April 2015 in the normal course, without taking the benefits of the proviso to Rule 29. Since the dates of their retirement fell in the midst of the academic session, they would plainly be entitled to continue in service until the end of the academic session, as envisaged in the proviso to Rule 29. The Secretary, Basic Education, Government of U P, who decided upon the issue on 15 June 2015 has taken a view clearly contrary to the mandate of the proviso to Rule 29. ... " 
In view of the aforementioned decision and the Government Order dated 08th October, 2015, the writ petition is disposed of with a direction to the District Basic Education Officer, Varanasi to allow the petitioner to continue till the end of academic session subject to verification of� her date of birth. 
No order as to costs.

The only contention advanced on this petition is for the respondents being commanded to issue an appointment letter to the petitioner and appoint him on the post of Assistant Teacher pursuant to a selection held in 2013. 
The case of the petitioner was that he was duly shortlisted for the post of Assistant Teacher (Maths and Science) in terms of a recruitment process which took place pursuant to an advertisement dated 11 July 2013. It is his contention that in the above recruitment process, the petitioner was allocated 62.69 quality point marks. He contends that although the petitioner was permitted to participate in the counselling, no appointment order was made in his favour. In the meanwhile, a writ petition came to be preferred before this Court on behalf of some professional degree holders asserting therein that they were also entitled to be considered for selection and appointment. The above writ petition (Writ Petition No. 34944 of 2014 Satyendra Kumar Singh and others Vs. State of U.P. and others) came to be disposed of on 11 September, 2015 with a direction that professional degree holders be also considered for the purposes of appointment as Assistant Teacher. Referring to the pleadings contained in the impleadment application filed before the Court today, the petitioner contends that although he had obtained 62.69 quality point marks, one Kapil Pandey who has obtained 62.27 quality point marks had been selected and issued appointment letter. 
Learned counsel appearing for the third respondent submits that the candidature of the petitioner shall be revisited and reconsidered by the respondents bearing in mind the fact that he has obtained quality point marks of 62.69. It is further submitted that in case any person with lower quality point marks has been selected and appointed, the petitioner shall be accorded similar consideration. 
Accordingly and in light of the submissions so made, this writ petition shall stand disposed of with a direction calling upon the third respondent to consider the claim of the petitioner for the post of Assistant Teacher (Maths and Science). The above claim of the petitioner may be accorded consideration and appropriate orders be passed thereon expeditiously and preferably within a period of one month from the date of production of a certified copy of the order of the Court. 
Needless to state, this Court has not gone into the merits or otherwise of the claim laid by the petitioner and has proceeded only on the basis of the statements so made before it. Obviously, therefore, it shall be open to the respondents to verify the records and other particulars of the petitioner and thereafter proceed to rule upon his eligibility for being selected and/or appointed.

This is an application for modification of the order of this Court dated 04.11.2015. 
The following modifications are made: 
The petitioners are 15 in number. They have been selected� and are working as Assistant Teacher (Mathematics and Science) in Senior Basic Schools. Previously, they were selected as Trainee Teachers in Junior Basic Schools. They have completed their six months' training as Trainee Teacher/Assistant Teacher. 
The grievance of the petitioners is that the recruitment process pursuant to the advertisement dated 11.08.2013 is subjudice, therefore, they want to join as Trainee Teacher in the Junior Basic Schools. 
Learned counsel for the petitioners has placed reliance on a judgment of this Court passed in Writ-A No.61395 of 2015 (Manoj Kumar & 43 others v. State of U.P. & 19 others), wherein in the case of similarly placed person, the following order has been passed: 
"In the meantime, fourth round of counselling is going on for the Trainee Teachers wherein the petitioners have been directed to submit their original educational testimonials within 15 days, failing which, their selection as Trainee Teachers in the Junior Basic School shall stand cancelled. 
Learned counsel for the petitioner further submits that the original educational testimonials have been deposited with the authorities of the Senior Basic Schools, therefore, they are unable to produce it for their appointment as Trainee Teachers. 
It is submitted by Sri B.P. Singh and Sri A.K. Yadav, learned counsel for the respondents that in case any interim order is granted, it would cause serious prejudice to complete the selection of the Training Teachers in compliance of the order of Supreme Court. 
Learned counsel for the petitioner in rejoinder submits that there are still large number of vacancies of the Trainee Teachers even after completing the present counselling for the Training Teachers. 
Having regard to the facts and circumstances of the case, a direction is issued to respondents to complete the present counselling and the selection in compliance of the order of the Supreme Court but the petitioners shall be considered in the last round of the counselling, if the post remains vacant. 
Learned Standing Counsel is granted six weeks time to file counter affidavit. Rejoinder affidavit, if any, may be filed within a week thereafter. 
List after expiry of the aforesaid period. 
Till the last selection is completed, the claim of the petitioners shall not be cancelled."� 
Learned Standing Counsel does not dispute the said fact. 
Accordingly, the benefit of order quoted herein-above shall be extended to the petitioners also. 
The modification application stands disposed of.

शिक्षकों को पड़े वेतन के लाले , शिक्षा मित्रों को वेतन देने की बात तो आई , लेकिन 29334 गणित विज्ञानं व् 72825 प्राथमिक शिक्षक क्या सौतेले हैं ,जिसके वेतन की कोई खबर नहीं 


72825 प्राथमिक शिक्षक भर्ती मूलत : टेट अंको के आधार पर थी , जिसका रिकॉर्ड सरकार के पास है हलांकि अन्य अंक पत्रों / प्रमाण पत्रों का वेरिफिकेशन भी होना है 
लेकिन कम से कम जीवकोपार्जन / सब्सिस्टेंस अलाउंस को देखते हुए  शपथ पत्र लेकर  सेलरी का कुछ हिस्सा तो जारी कर ही सकती है 

29334 गणित विज्ञानं शिक्षक सितम्बर माह से पढा रहे हैं इनको भी अभी तक वेतन नहीं मिला है , इनके कार्य करने पर कोई रोक भी नहीं है तो 
इनको भी जीवकोपार्जन / सब्सिस्टेंस अलाउंस को देखते हुए  शपथ पत्र लेकर  सेलरी का कुछ हिस्सा तो जारी कर ही सकती है ।

रोज मर्रा के तमाम खर्चे आदि को देखते हुए अध्यापकों को बगैर वेतन तमाम मुश्किलों का सामना करना पड़ता होगा

जागरण संवाददाता, लखनऊ : निजी और मिशनरी स्कूलों में तो बच्चों के जन्म दिवस मनाने की परंपरा रही है, लेकिन अब सरकारी स्कूलों में भी बच्चों का जन्म दिवस मनाया जाएगा। मंडलायुक्त महेश गुप्ता ने सभी जिलाधिकारियों को निर्देश जारी कर इसका पालन सुनिश्चित कराने के निर्देश दिए हैं। 1शुक्रवार को समीक्षा बैठक के दौरान मंडलायुक्त ने कहा है कि प्राथमिक एवं उच्च प्राथमिक विद्यालय में माह के तीसरे शनिवार को उस पूरे माह के सभी बच्चों का जन्म दिन मनाया जाएगा। मंडलायुक्त का कहना है कि ग्रामीण इलाकों में अधिकांश बच्चों को जन्म दिवस याद नहीं रहता। ऐसा करने से बच्चों को कुछ अलग माहौल मिलेगा और उन्हें अपना जन्म दिवस भी याद रहेगा। वहीं डीएम राजशेखर ने बताया कि उस दिन बच्चों के लिए मिड डे मील से विशेष मेन्यू खीर या मिठाई मंगवाई जाएगी और सभी बच्चे एक दूसरे को ग्रीटिंग भी देंगे।1विकास कायरे में दिलचस्पी दिखाएं अफसर : मंडलायुक्त ने अफसरों को शासन द्वारा संचालित विभिन्न विकास कार्यो में दिलचस्पी दिखाने और निर्धारित समय पर कार्य पूर्ण कराने के निर्देश दिए। अगर कहीं पर लापरवाही मिली तो फिर सख्त कार्रवाई की जाएगी। शुक्रवार को मंडलायुक्त ने वर्ष 2013-14 व 2014-15 में चयनित डा.राम मनोहर लोहिया समग्र ग्रामों की प्रगति की समीक्षा की। कमिश्नर ने लोहिया समग्र ग्रामों में विकास कार्यो को समयानुसार पूरा कराने के निर्देश दिए। 1मंडलायुक्त ने समीक्षा के दौरान पाया कि वर्ष 2013-14 में आगनबाड़ी केंद्रों की निर्माण के अंतर्गत लखनऊ और रायबरेली में एक-एक ग्राम असंतृप्त है। वर्ष 2014-15 में चयनित डा.राम मनोहर लोहिया समग्र ग्रामों की समीक्षा के दौरान पाया कि संपर्क मार्ग के निर्माण में सीतापुर मे एक ग्राम, हरदोई में 2 ग्राम, उन्नाव में एक ग्राम, रायबरेली मे एक ग्राम असंतृप्त है। ग्रामीण विद्युतीकरण में सीतापुर में 17 ग्राम, उन्नाव में 09 ग्राम और लखनऊ में एक ग्राम असंतृप्त है। आंगनबाड़ी केदों के निर्माण मे खीरी में 03 ग्राम, सीतापुर में एक, उन्नाव में 6 ग्राम, लखनऊ में 06 ग्राम, असंतृप्त है।

प्राइवेट स्कूलों में तेजी से बढ़ रही छात्रों की संख्या, सरकारी में घट रही
जागरण ब्यूरो, नई दिल्ली : अब तक सरकार को यह पता ही नहीं है कि स्कूली बच्चों के नाम पर वास्तव में मिड डे मील कौन खा रहा है। इसलिए नियंत्रक और महालेखा परीक्षक (सीएजी) ने कहा है कि उन बच्चों की पहचान करने की पुख्ता व्यवस्था की जाए जो वास्तव में इसका फायदा नहीं लेना चाहते। साथ ही उनके नाम पर खर्च हो रहे धन को बंद किया जाए। इसी तरह पाया गया है कि अब सिर्फ मिड डे मील के नाम पर बच्चों को सरकारी स्कूलों की तरफ आकर्षित करना मुमकिन नहीं है। जहां सरकारी स्कूलों में बच्चों की संख्या लगातार घट रही है, वहीं निजी स्कूलों में यह बढ़ रही है।
सीएजी ने कहा है कि मिड डे मील योजना को प्रभावशाली तरीके से लागू करने और धन की बर्बादी को रोकने के लिए यह बेहद जरूरी है कि इसका फायदा उठाने वाले बच्चों की वास्तविक संख्या पता करने की पुख्ता व्यवस्था हो। अभी राज्य इसके लिए कुछ आंकड़े भेजते हैं, लेकिन वे विश्वसनीय नहीं हैं और ना ही उनकी कोई जांच होती है। इसके लिए लाभ लेने वाले बच्चों से किसी फार्म पर दस्तखत करवाने जैसा कोई उपाय किया जा सकता है ताकि उनके नाम पर होने वाली धांधली बंद हो।
अपनी पड़ताल में इसने पाया है कि मिड डे मील छात्रों को स्कूल तक लाने का एक प्रभावी जरिया तो रहा है, लेकिन खास तौर पर शहरी इलाकों में इसकी समीक्षा करना बेहद जरूरी हो गया है। जिन स्कूलों में यह योजना चलाई जा रही है, उनमें छात्रों की संख्या पिछले वर्षो में लगातार घटती गई है। वर्ष 2009-10 से 2013-14 तक देश भर में इन स्कूलों में छात्रों की संख्या 14.69 करोड़ से घट कर 13.87 करोड़ हो गई है। जबकि इसी दौरान निजी स्कूलों में छात्रों की संख्या में 38 फीसद का भारी इजाफा हुआ। यह संख्या 4.02 करोड़ से बढ़ कर 5.53 करोड़ पहुंच चुकी है।

राज्य ब्यूरो, इलाहाबाद 1प्रदेश भर के करीब 11500 प्रशिक्षु शिक्षकों को मौलिक नियुक्ति देने की घड़ी आ गई है। सचिव बेसिक शिक्षा परिषद संजय सिन्हा ने 15 दिन में मौलिक नियुक्ति देने का आदेश बेसिक शिक्षा अधिकारियों को दिया है। इससे नए साल के पहले हफ्ते में ही काउंसिलिंग एवं स्कूलों का चयन आदि की प्रक्रिया पूरी हो जाएगी। इस आदेश के साथ ही चार दिन से शिक्षा निदेशालय परिसर में चल रहा घेराव व आंदोलन शुक्रवार शाम को खत्म हो गया है।
प्रदेश के प्राथमिक विद्यालयों में तैनात प्रशिक्षु शिक्षकों के प्रशिक्षण का दूसरा चरण भी पूरा हो चुका है। सचिव परीक्षा नियामक प्राधिकारी परीक्षा परिणाम जारी कर चुकी हैं। इसके बाद प्रशिक्षु शिक्षकों ने शिक्षा निदेशालय में सचिव बेसिक शिक्षा परिषद के कार्यालय के सामने प्रदर्शन किया। उनकी मांग थी कि मौलिक नियुक्ति की प्रक्रिया इसी महीने पूरी कर दी जाए। ऐसा न होने पर वह अपने साथियों से वरिष्ठता में पीछे हो जाएंगे।
असल में 72825 शिक्षकों की भर्ती में जिन अभ्यर्थियों की पहले चरण में परीक्षा पूरी हो गई थी उन्हें परिषद की ओर से नियुक्ति दी जा चुकी है। दूसरे चरण के करीब 11500 अभ्यर्थियों को मौलिक नियुक्ति दिया जाना हैं।
सचिव परीक्षा नियामक प्राधिकारी उत्तर प्रदेश प्रशिक्षण परीक्षा में सफल अभ्यर्थियों की सूची एससीईआरटी लखनऊ एवं सचिव बेसिक शिक्षा परिषद को भेज चुकी हैं। शुक्रवार को मौलिक नियुक्ति पर शासन ने भी सहमति जताई। सचिव सिन्हा ने बीएसए को भेजे निर्देश में कहा है कि प्रक्रिया 15 दिन में पूरी की जाए साथ ही नियुक्ति की शर्ते पूर्व की भांति रहेंगी। इस आदेश पर मोर्चा अध्यक्ष सुजीत सिंह, इलाहाबाद अध्यक्ष मोहम्मद अली, बुंदेलखंड प्रभारी अनुराग तिवारी, अनिल वर्मा, प्रदीप सिंह विवेकानंद आर्या व प्रभाकर त्रिपाठी ने खुशी जताई है और आंदोलन खत्म करने का एलान किया है।
