Judgment under challenge in these appeals is dated 13.08.2018 passed by learned Single Bench in a batch of writ petitions led by Writ-A No. 14395 of 2018. 
Learned Single Bench under the judgment impugned arrived at the conclusion that the petitioners (appellants herein) working as Assistant Teachers in aspirational districts have no right for inter-districts transfer and, as such, they are not having any enforceable legal right to ask for a writ in the nature of mandamus to transfer them from the aspirational district to some other district. 
The factual matrix of the case is that the appellants are working as Assistant Teachers in Primary Schools in the districts of Siddharth Nagar, Shrawasti, Behraich, Sonbhadra, Chandauli, Fatehpur, Chitrakoot and Balrampur. The districts aforesaid are known as aspirational districts in light of the Government of India policy for "Transformation of Aspirational Districts, 2018". The policy aforesaid prescribes a programme of the Government of India incurred by NITI Aayog steering the initiative in several districts of the country which are "Left Wing Extremism" affected. 
In the programme aforesaid, the Government is committed to raise the living standards of its citizens and ensuring inclusive growth of all. To avail optimum utilization of the potential available, the programme focuses closely on improving people's ability to participate fully in the vibrant economy. The other areas of focus under the Programme aforesaid are health and nutrition, education, agriculture and water resources, financial inclusions, skill development and basic infrastructure. 
The Government of Uttar Pradesh under its conscious decision communicated vide Circular dated 10.06.2018 that no transfer of Assistant Teachers shall be made to other districts from 08 aspirational districts, namely, Siddhartha Nagar, Shrawasti, Behraich, Sonbhadra, Chandauli, Fatehpur, Chitrakoot and Balrampur. Being aggrieved by the decision of the Government of Uttar Pradesh circulated under the Circular dated 10.06.2018 issued by the Secretary, Uttar Pradesh Basic Education Council, Allahabad, the appellants preferred petitions for writ those came to be dismissed under the judgment impugned. 
While questioning correctness of the judgment dated 13.08.2018, several arguments have been advanced mainly focusing to the scope and nature of the provisions of Rule 21 of the Uttar Pradesh Basic Education (Teachers) Service Rules, 1981 (hereinafter referred to as "Rules, 1981") that reads as follows:- 
"21. Transfer - There shall be no transfer of any teacher from the rural local area to an urban local area or vice versa or from one urban local area to another of the same district or from local area of one district to that of another district except on the request of or with the consent of the teacher himself and in either case approval of the Board." 
Suffice it to state that the Rules, 1981 were enacted by the Governor of Uttar Pradesh in exercise of the powers under sub-Section (1) of Section 19 of the Uttar Pradesh Basic Education Act, 1972 (hereinafter referred to as "Act, 1972"). The Rules, 1981 regulate recruitment and other service conditions of all the teachers employed in Basic Education in the State. 
As per Clause (c) of sub-Rule (1) of Rule 2, "Basic School" means a school wherefrom education from Class-I to Class-VIII are imparted. As per Clause (i) of sub-Rule (1) of Rule 2, "Local area" means the area over which a Local Body exercises jurisdiction and under Clause (l) of the Rule aforesaid, "Selection Committee" means the Selection Committee constituted under Rule 16. As per Rule 16, the Selection Committee for Selection of Candidates for Appointment to any post under the Rules, 1981 shall consist of (a) An officer of the rank of Additional District Magistrate nominated by District Magistrate - Chairman, (b) District Basic Education Officer - Member, (c) Principal, Government Girl's Intermediate College at the District Head Quarter - Member, (d) District Non-Formal Education Officer - Member, and (e) One specialist in Hindi, Urdu or other languages as the case may be; nominated by District Magistrate - Member. As per Clause (b) of sub-Rule (1) of Rule (2) the "Appointing Authority" to any post in service under the Rules, 1981 is District Basic Education Officer. 
Part II of the Rules, 1981 pertains to cadre and strength. Rule 4 of Rules, 1981 provides that there shall be a separate cadre of service under the Rules for each local area. The strength for a local area and the number of posts in the cadre shall be such as may be determined by the Uttar Pradesh Basic Education Board from time to time with previous approval of the State Government. 
The provisions aforesaid clearly indicates that cadre of different posts under the Rules, 1981 shall be at district level. The resultant conclusion is that service under the Rules, 1981 is constituted at District level and, as such, Members of service cannot be transferred from one district to other as that would amount to change of cadre and even the Appointing Authority. 
Rule 21 of the Rules, 1981 is an exception to above as that permits transfer of a teacher appointed under the Rules, 1981 from the rural local area to urban local area or vice versa or from one urban local area to another of the same district or from local area of one district to that of another district. Such transfer, however, can be made on request of or with the consent of teachers himself and in either case with the approval of the Board. 
Under the decision impugned, the Government of Uttar Pradesh has restrained application of the relaxation granted under the Rule 21 of Rules, 1981 for the aspirational districts. 
While challenging the decision aforesaid which has been upheld by learned Single Bench, the argument advanced on behalf of the appellants is that restriction imposed is highly discriminatory as teachers working in the districts or the local areas other than the aspirational districts shall be having opportunity to be transferred as per Rule 21, but the teachers working in the aspirational districts would be deprived of that. It is also stated that all the appellants are women and they are working in the aspirational districts from last several years and now when they want their transfer to the district of their choice as per the provisions of the Rules, 1981, the respondents have decided not to operate Rule 21 qua them, as such, the same is highly unjust and arbitrary too. It is also urged that Uttar Pradesh Basic Education (Teachers) (Posting) Rules, 2008 (hereinafter referred to as "Rules, 2008") shall prevail over the Rules, 1981 and Rule 8(2)(d) of the Rules, 2008 provides for inter-districts transfer and, as such, by a Government Order, application of Rule aforesaid could have not been dispensed with. It is also emphasized that Clause 6 of the existing Transfer Policy, the districts where vacancies against sanctioned posts are more than 15%, no inter-districts transfer of an Assistant Teacher shall be made. The Uttar Pradesh Basic Education Board under its letter dated 06.02.2018 notified 40766 vacancies of Assistant Teachers in Primary Schools and 6719 Headmasters of Primary Schools/Assistant Teacher of Higher Basic School. As per Clause 3 of the Transfer Policy, inter-district transfer is to be made to the extent of 25% of the available vacancy only, as such, the transfer that is to be made from aspirational district to other shall be too less and negligible and that would not effect implementation of the Programme of 2018 adversely. 
Heard learned counsels appearing on behalf of the appellants. 
On going through the provisions applicable, we do not find any merit in these appeals. At the threshold, it would be appropriate to state that Rule 21 of the Rules, 1981, on its face, does not create any substantive right in favour of the appellant-petitioners. Rule 21, as a matter of fact, provides a relaxation with necessary checks for transfer of a teacher from one district/local area to other district/local area, which is otherwise not permissible by statute. It is well settled that relaxation to rules in normal course cannot be claimed as a matter of right. 
In view of it, we are having no hesitation in affirming the finding given by learned Single Bench that Rule 21 of the Rules, 1981 does not create any legally enforceable right in favour of the appellants. However, the issue under consideration is that whether denial of such relaxation to the Assistant Teachers working in aspirational districts shall be justifiable when the teachers working in the other districts are having choice to claim relaxation for their transfer from one district/local area to other district/local area. 
In other words, precisely, the issue before us is whether the decision of the Government of Uttar Pradesh circulated under the Circular dated 10.06.2018 is irrational, arbitrary and discriminatory, being not founded on a reasonable criteria having nexus with the object sought to be achieved. As already stated, the aspirational districts are the districts identified by the Government of India to meet extreme left upsurge in several districts of the country including 08 districts in the State of Uttar Pradesh. As per the Programme, the State Government is required to have intensive operations in the field of education, health, nutrition, agriculture and water resources, financial inclusions, skill development and basic infrastructure. To have such operations, need of teachers is highly desirable. Pertinent to notice that as per the Programme of the Government, a huge budget is assigned to the field of education and a complete transformation of socio economic status of the area is required to be made. The transformation is desired to be satisfied upto the year 2022. The Ministry of Human Resource Development under the Programme aforesaid has rendered several schemes for the aspirational districts. The Government of Uttar Pradesh has also taken initiatives for aspirational districts by making District Action Plan. The District Action Plan relates to different identified sectors including the education. To execute the programme aforesaid, need of teachers is essential and, looking to that, the Government has decided not to extend relaxation as per Rule 2 to the teachers working in aspirational districts. The decision of the Government, as such, is based upon reasonable criteria and that does not suffer from any such wrong that may be termed and treated as unjust or arbitrary. 
At the cost of repetition, it would be appropriate to state that Rule 21 is only a relaxation clause and that in no manner creates any substantive enforceable legal right sufficient to issue a writ in the nature of mandamus. 
So far as Rule 8(2)(d) of the Rules, 2008 is concerned, suffice it to state that that too does not create any right in favour of the appellants. A plain reading of the Rule aforesaid makes it clear that this too is an exception to the general rule of not transferring a person from one district to other district in normal course. 
In light of whatever stated above, the appeals lack merit, hence the same are dismissed.

Army Public School Recruitment 2018 – Army Welfare Education Society (AWES) issued AWES APS Recruitment 2018-19 Notification for conducting AWES Combined Selection Screening Examination (CSSE Exam) 2018-19 for the recruitment of 8000 PGT, TGT, PRT Posts for the academic year 2018-19 for 137 Army Public Schools (APS) located all over India functioning under Army Welfare Education Society (AWES)

Army Public School Recruitment 2018 Vacancy Details
  • These schools are administered and managed by local Army authorities and affiliated to CBSE through Army Welfare Education Society (AWES). A List of these schools is placed at Annexure-1
  • There are approximately 8000 teachers on the rolls of these schools. Out of these, a large number get turned over every year due to various reasons.

  2. Trained Graduate Teacher (TGT)
  3. Primary Teacher (PRT)

Eligibility Criteria for Army Public School Recruitment 2018

Educational Qualifications
  • Minimum 50% marks
  • Post Graduate Teacher (PGT) – Post Graduation & B.Ed.
  • Trained Graduate Teacher (TGT) – Graduation & B.Ed.
  • Primary Teacher (PRT) – Graduation & B.Ed. / D.Ed. (2yr)
  • CTET/ TET conducted by state governments is mandatory for appointment as TGTs/ PRTs. Others found fit in all other respects may be appointed on ‘Adhoc’ basis only till attainment of qualification. However, CTET/ TET is not mandatory for appearing in CSB online Screening exam
Age Limit (as on 01st April 2019)
  • Fresh Candidates: Below 40 years (In the case of Delhi schools TGT/ PRT should be < 29 years & PGT <36 years)
  • Experienced Candidates: Below 57 years (Should have minimum 5 years teaching experience in the last 10 years)

Selection Procedure

  • Selection Procedure will be done in three stages:
Stage 1 – Screening Exam
  • Screening Exam will be conducted on 17 and 18 November 2018, for vacancies that will arise during the ensuing academic year. This shall be conducted on-line by an agency identified by HQ AWES centrally, to ensure uniform quality of teachers in all Army Public Schools.
  • Those who qualify in this stage will be given Score Cards which are valid for life provided the candidate picks up a teaching job within three years from the date of passing the screening exam in any CBSE affiliated school for a continuous duration of at least one year
  1. Holders of Score Cards who want to improve their scores.
  2. Those desirous of upgrading themselves. For E.g. a candidate holding Score
  3. Card of TGT may now want to obtain a card for PGT, having acquired additional qualification
Stage 2 – Interview
  • There may or may not be held at the location of the school. They may be held as per discretion of the local management
Stage 3- Evaluation of Teaching Skills & Computer Proficiency
  • For Language teachers, written test comprising Essay & Comprehension of 15 marks each will be held along with evaluation of teaching skills. Selection Committee may also hold Computer proficiency tests if they so desire

Army Public School Recruitment 2018 Application Form


  • Candidates are expected to Register Online for the Screening Exam by logging onto the Registration Portal http://aps-csb.in

  • The registration portal will be open from 01st Oct 2018 to 24th October 2018. Candidates can register from 09.00 AM on 01st October 2018 to 05.00 PM on 24th October 2018
  • Thereafter the portal will be closed for registration. The procedure to be followed will be as under:
  1. Log onto the web-site http://aps-csb.in and study the detailed instructions for Registration that will be available on the portal
  2. Fill up the personal information or the application form
  3. The system will then ask the candidates to pay the exam fee ONLINE. Payment options are Debit/Credit Cards/ Net banking. A payment gateway has been integrated with the web-site for the purpose and candidates will be guided through the payment process.
  4. After payment of fee, the candidates will be asked by the system to attached following documents
  1. Photographs and signatures
  2. Proof of date of birth
  3. Certificates of academic qualifications.
  • Once registration is completed, the candidates will get a confirmation that registration is successful. Candidates will also be informed through e-mail and SMS regarding the same
Application Fees
  • To apply for the 8000 PGT, TGT & PRT job in Army Welfare Education Society the candidates requested to pay the application fees by notified mode. The payment mode may be both online/offline. Here below the caste-wise application fee payment details are given below.
  • Application Fees – Rs.500/-
  • Pay the Examination Fee through Debit Card, Credit Card, Net Banking.
Costs of the Papers are as under
  • Part A – Rs 100/-
  • Part B – Rs 100/- (specific subject)
Admit Cards
  • Admit Cards will be available ONLINE. Candidates may download and print the same. The same should be produced for gaining entry to the Exam Centre. Candidates are advised to read the instructions appended to the Admit Cards carefully.
Exam Results
  • Will be put up on the AWES website www.awesindia.com. This being an online examination. No review of results shall be allowable

Those who qualify in this stage will be given Score Cards which are valid for life provided the candidate picks up a teaching job within three years from the date of passing the screening exam in any CBSE affiliated school for a continuous duration of at least one year. A Score Card will make candidates eligible to appear for the remaining stages of the selection process. In addition to fresh candidates, the following may also appear for the screening test:-
(i) Holders of Score Cards who want to improve their scores.
(ii) Those desirous of upgrading themselves. For E.g. a candidate holding Score Card of TGT may now want to obtain a card for PGT, having acquired additional qualification.

(b) Stage 2. Interview. There may or may not be held at the location of the school. They may be held as per discretion of the local management


(c) Stage 3. Evaluation of Teaching skills and computer proficiency. For Language teachers, written test comprising Essay & Comprehension of 15 marks each will be held along with evaluation of teaching skills. Selection Committee may also hold Computer proficiency tests if they so desire.

UPTET 2018: सातवें दिन भी नहीं सुधरी टीईटी की वेबसाइट, आवेदन की अंतिम तिथि बढ़ने की उम्मीद 




उत्तर प्रदेश शिक्षक पात्रता परीक्षा 2018 की वेबसाइट रविवार को भी ठप रही। लगातार सातवें दिन वेबसाइट के काम नहीं करने के कारण हजारों आवेदक परेशान रहे। इस प्रकरण की निगरानी सीधे बेसिक शिक्षा विभाग के अपर मुख्य सचिव डॉ. प्रभात कुमार कर रहे हैं। रविवार को भी उन्होंने एनआईसी के अफसरों से बात कर समस्या के बाबत जानकारी ली।

एक हफ्ते तक वेबसाइट ठप होने के कारण अब वरिष्ठ अधिकारी आवेदन की अंतिम तिथि बढ़ाने पर विचार कर रहे हैं। माना जा रहा है कि एक-दो दिन में इसकी घोषणा हो जाएगी। प्राथमिक स्तर की परीक्षा के लिए बीएड मान्य होने के कारण परीक्षा नियामक प्राधिकारी एलनगंज को उम्मीद थी टीईटी में इस बार 10 लाख से अधिक आवेदन मिलेंगे।

UPTET 2018: सुबह 10 बजे फार्म भरा, 3 बजे मिला ओटीपी, घंटों प्रयास के बावजूद upbasiceduboard.gov.in वेबसाइट पर फार्म नहीं भर पा रहे अभ्यर्थी

लेकिन वेबसाइट क्रैश होने के कारण उम्मीद से आधे लगभग पांच लाख अभ्यर्थी ही पंजीकरण करा सके हैं। इनमें से 2.35 लाख अभ्यर्थी अंतिम रूप से आवेदन जमा कर सके हैं। इस बीच पंजीकरण की अंतिम तिथि चार अक्तूबर करीब आने के साथ ही अभ्यर्थियों में बेचैनी बढ़ रही है। आवेदन शुल्क पांच अक्तूबर तक स्वीकार होंगे। पूर्ण रूप से भरे हुए ऑनलाइन आवेदन के प्रिंट लेने की आखिरी तारीख छह अक्तूबर शाम छह बजे तक है।

कोशिश करके हारे, अब सुधरने पर भरेंगे फार्म:सोमवार से टीईटी की वेबसाइट क्रैश होने के कारण तकरीबन ढाई लाख अभ्यर्थी अपना फार्म जमा नहीं कर सके हैं। इसके अलावा बढ़ी संख्या में लोग पंजीकरण नहीं करा पा रहे। एनआईसी और स्टेट डाटा सेंटर की गड़बड़ी के कारण आवेदन नहीं हो पा रहे।

सात दिन में दर्जनों बार फार्म भरने की असफल कोशिश कर चुके अभ्यर्थी अब हारकर बैठ गये हैं। रविवार को ओटीपी की समस्या में तो सुधार हुआ लेकिन वेबसाइट काम नहीं कर रही। करेली की फरहीन सिद्दीकी रविवार को करीब साढ़े दस बजे से सायबर कैफे में फार्म भरने गईं थी। 12.30 बजे ओटीपी मिला लेकिन पौने दो बजे तक फार्म जमा नहीं हो सका। अंत में सर्वर एरर बताकर साइट बैठ गई। हारकर फरहीन घर चली गईं। करेली हिना समरीन भी फॉर्म भरने के लिए पूरे दिन परेशान रहीं। लाखों अन्य अभ्यर्थियों का भी यही है। 

मोबाइल नंबर को लेकर बड़ी समस्या: एक बड़ी समस्या मोबाइल नंबर को लेकर है। एक बार फार्म भरने पर मोबाइल नंबर पंजीकृत हो जा रहा है। लेकिन अंतिम रूप से जमा नहीं होने के कारण दोबारा जब वही मोबाइल नंबर फीड कर रहे हैं तो लिखकर आ रहा है कि यह नंबर पहले से मौजूद है, कृपया दूसरा नंबर दें। अब समस्या यह है कि एक अभ्यर्थी कितने मोबाइल नंबर लेकर फार्म भरने बैठे। शनिवार की रात वेबसाइट बंद कर सुधारने की कोशिश की गई लेकिन सफलता नहीं मिली। वेबसाइट पर लिखकर आ रहा है कि आवेदन पत्र भरने में आ रही कठिनाइयों के निराकरण की कार्यवाही गतिमान है, कृपया धैर्य बनाएं रखें।


अभ्यर्थियों ने टीईटी-18 के आवेदन तिथि बढ़ाने की मांग की है। बीटीसी संयुक्त प्रशिक्षु मोर्चा के धर्मेन्द्र सिंह का कहना है कि एनआईसी, यूपी डेस्को और जहां भी संभव है आपत्ति दर्ज करवा चुके हैं लेकिन सब एक-दूसरे पर टाल रहे हैं। बड़ी संख्या में अभ्यर्थी पंजीकरण तक नहीं करा सके हैं। लिहाजा आवेदन की अंतिम तिथि बढ़ाई जाए। रविवार को कटरा के साइबर कैफे में टीईटी का फॉर्म भरने को परेशान अभ्यर्थी

This appeal questions the correctness of the impugned judgment dated 15th May, 2018 on several grounds, more particularly on the ground that the learned Single Judge while proceeding to consider the legal aspects has omitted to consider the clause specifying exemption in possession of minimum qualification for promotion in the notification dated 23th August 2010 as referred to in the notification dated 12th November, 2014 which has been made the basis of the impugned judgment. It is further submitted that the learned single judge has also omitted to consider paragraphs 66 to 70 of the full Bench Judgment in the case of Anand Kumar Yadav and others vs. Union of India and others 2015 (8) ADJ 338 which has been affirmed by the Supreme Court. 
The contention therefore in short is that the learned Single Judge should have taken into consideration the aforesaid statutory provision and the law before arriving at the conclusion and issuing a mandamus. 
The judgment relied on has been placed before us. On the other hand, Sri Dhananjay Awasthi, learned counsel for NCTE has invited the attention of the Court to the judgment of a learned Single Judge in a case of Subedar Yadav and 54 others in writ Petition No.16523 of 2018 that has been upheld by a Division Bench in Special Appeal No.737 of 2018 decided on 04.09.2018. 
Sri Khare, learned Senior Counsel for the respondents-petitioners contends that as a matter of fact, the eligibility and minimum qualifications in the case of promotions which is presently involved would equally apply with the same force keeping in view the notifications that have been referred to by the learned Single Judge. He submits that the continuance of the appellants by itself will not condone or give them any subsidy in the possession of minimum qualifications which now stands standardised and prescribed under the notifications of the NCTE as indicated by the learned Single Judge in the impugned judgment. He therefore contends that there is no error much less a legal error and consequently if the appellants do not posses the said minimum eligibility criteria for promotion to the post of Head Master, they cannot as a matter of right contend that the directions issued by the learned Single Judge suffer from infirmity. 
We have considered the submissions raised and we find that the appeal deserves to be allowed on the short ground of total non-consideration of the exemptions referred to for promotion regarding possession of minimum qualification under the notification dated 23rd August 2010 which finds reference in the notification dated 12th November, 2014 as well as the decision in the case of Anand Kumar Yadav. We also find that neither before the learned Single Judge nor before the Bench which affirmed the judgment in the case of Subedar Yadav (supra), the aforesaid contentions were examined nor any reference was made to paragraphs 66 to 70 of the full Bench judgment in the case of Anand Kumar Yadav and others vs. Union of India and others 2015 (8) ADJ 338 as affirmed by the Supreme Court in the case of State of U.P and another Vs. Anand Kumar Yadav and others 2017 (3) ESC 570. 
We are of the opinion that the aforesaid provisions and the decision referred to above ought to have taken notice of that was imperative before arriving at the conclusion that the appellants or the candidates similarly situate would not be entitled to any of the exceptions as provided for in the notification dated 12.11.2014 read with the notification dated 23.08.2010. Consequently, on this short ground alone, the appeal deserves to be allowed.

The appellants are permitted to get themselves impleaded in the writ petition No.11287 of 2018 which shall stand restored to its original number and shall be heard on merits. 
Sri Dhananjay Awasthi the learned counsel the for NCTE as well as the learned standing counsel are both directed to file their counter affidavits in the said writ petition within two weeks and one week for rejoinder. The matter shall be heard thereafter.
