जोधपुर/पाली। राजस्थान उच्च न्यायालय ने पंचायतीराज विभाग की तृतीय श्रेणी शिक्षक भर्ती परीक्षा-2012 को लेकर राज्य सरकार को कारण बताओ नोटिस जारी किए हैं। तीन सप्ताह में न्यायालय ने जवाब मांगा है कि क्यों नहीं परीक्षा द्वारा पूरी की गई चयन प्रक्रिया को निरस्त कर दिया जाए

जस्टिस गोविंद माथुर ने शुक्रवार को इस मामले में दायर एक रिट की सुनवाई के बाद यह नोटिस जारी किए।  पाली निवासी अभ्यर्थी बृजपाल सिंह चारण ने एडवोकेट पीपी चौधरी के मध्यम से हाईकोर्ट में रिट दायर कर प्रार्थना की थी कि पंचायतीराज विभाग द्वारा आयोजित तृतीय श्रेणी शिक्षक भर्ती परीक्षा-2012 में परीक्षा से लेकर संशोधित रिजल्ट जारी करने तक धांधलियां हुई हैं। लिहाजा चयन प्रक्रिया को निरस्त किया जाए।


प्रार्थी की ओर से सीनियर एडवोकेट पीपी चौधरी, एडवोकेट कुलदीप माथुर व अंकुर माथुर ने आग्र्यूमेंट    किए। चौधरी ने बताया कि सुनवाई के बाद न्यायाधीश ने आयुक्त व शासन सचिव ग्रामीण विकास एवं पंचायतीराज, सीईओ जिला परिषद पाली व अन्य नोटिस जारी कर जवाब प्रस्तुत करने के आदेश दिए हैं। मामले की अगली सुनवाई19 नवंबर को होगी।


रिट में कहा- हर स्तर पर हुई गड़बड़ी, न कोर्ट के आदेश माने, न नियमों का पालन किया
मामले में आग्र्यूमेंट    के लिए सीनियर एडवोकेट पीपी चौधरी उपस्थित हुए। उन्होंने भास्कर की खबरों का हवाला देते हुए कहा कि 2 जून 2012 को हुई परीक्षा के दौरान अभ्यर्थियों से प्रश्नपत्र वापस लेने के साथ ही यह चयन प्रक्रिया संदेह के दायरे में आ गई थी। इसके बाद न आंसर शीट जारी की गई।

अभ्यर्थियों को आरटीआई में भी आंसर शीट नहीं दिखाई गई। जो अभ्यर्थी हाईकोर्ट का आदेश लेकर पहुंचे उन्हें भी आंसर शीट की कॉपी नहीं दी गई। इसके बाद कई जिलों में दो-दो बार संशोधित रिजल्ट जारी किए गए। इनमें बड़े स्तर पर गड़बडिय़ां हुईं। टेट में फेल अभ्यर्थियों को भी नियुक्तियां दे दी गईं। अभ्यर्थियों के सवाल सही होने पर उन्हें गलत जांचा गया। एक्सपर्ट कमेटी के निर्णय भी संदेहास्पद हैं। संशोधित परिणाम के बाद बड़ी संख्या में नए अभ्यर्थियों को नौकरी मिली जबकि कई अभ्यर्थी मेरिट से बाहर हो गए। लिहाजा परीक्षा से लेकर पूरी चयन प्रक्रिया में गड़बडिय़ां हैं।



भास्कर ने उठाया था मुद्दा

दैनिक भास्कर ने सबसे पहले 5 अक्टूबर को तृतीय श्रेणी शिक्षक भर्ती परीक्षा-2012 में बड़े स्तर पर हुई गड़बडिय़ों का खुलासा किया था। इसके बाद 6, 7, और 21 अक्टूबर को सिलसिलेवार तथ्यात्मक खबरें प्रकाशित की थीं। न्यायालय में इन सभी खबरों की कटिंग रिट के साथ प्रस्तुत की गई है।


उधर, हाईकोर्ट ने रद्द की एपीपी भर्ती
हाईकोर्ट ने सहायक लोक अभियोजक (एपीपी) के 159 पदों की भर्ती धांधली के कारण रद्द करते हुए प्रक्रिया नए सिरे से कराने का निर्देश दिया है। अदालत ने आरपीएससी की कार्यशैली पर अफसोस जताते हुए कहा कि वह परीक्षा की पवित्रता व पारदर्शिता को बनाए रखने में विफल रहा है। हालत ऐसी है
कि आरपीएससी के अधिकतर मामले कोर्ट में आने की परंपरा सी बन गई है।  मुख्य न्यायाधीश अमिताभ रॉय व न्यायाधीश वीएस सिराधना की खंडपीठ ने यह आदेश कमलेश शर्मा व अन्य की अपील को स्वीकार करते हुए और राज्य सरकार व आरपीएससी की अपील को खारिज करते हुए दिया।

खंडपीठ ने एकलपीठ द्वारा 2 फरवरी 2013 की अंतिम चयन सूची को निरस्त करने के आदेश को सही माना। साथ ही एकलपीठ की उस राय को सही माना जिसमें एपीपी की भर्ती साक्षात्कार से करने की बजाय लिखित परीक्षा के जरिए करने के लिए कहा गया था।

सरकार, आरपीएससी व कमलेश शर्मा ने अपील में एकलपीठ के 31 मई 2013 के उस आदेश को चुनौती दी थी जिसमें 2 फरवरी 2013 की चयन सूची को निरस्त करते हुए प्रश्न संख्या 13, 18, 25 व 23 को हटाने और प्रश्न संख्या 77 का उत्तर बदलकर विकल्प एक को सही मानते हुए एबीसीडी सीरीज के प्रश्नपत्रों में बदलाव कर नई मेरिट सूची तैयार करने का निर्देश दिया था।

यह है मामला

आरपीएससी ने 26 मई 2011 को एपीपी के 159 पदों के लिए आवेदन मांगे थे। एक दिसंबर 2012 को स्क्रीनिंग में 9191 अभ्यर्थियों ने भाग लिया और आपत्तियों के बाद कुछ प्रश्नों को हटा दिया। भर्ती में अनियमितताओं के कारण परीक्षा का परिणाम तीन बार जारी हुआ। इसमें 502 अभ्यर्थी ऐसे थे, जो प्रथम परिणाम से लेकर अंतिम परिणाम तक चयन में शामिल थे। भर्ती में अनियमितता व प्रभावशाली अभ्यर्थियों के चयन को हाईकोर्ट में चुनौती दी गई

 लखनऊ। परिषदीय स्कूलों में बच्चों को अच्छी शिक्षा देने के लिए नया प्रयोग होने जा रहा है। इसके तहत परिषदीय स्कूलों के छात्रों को रिटायर हुए शिक्षक पढ़ाएंगे। इन शिक्षकों को हर माह 7000 रुपये फिक्स मानदेय दिया जाएगा। रिटायर्ड शिक्षक जिस गांव का होगा, उसकी तैनाती भी वहीं होगी। इससे फायदा यह होगा कि सरकार को नियमितीकरण के झंझट का सामना नहीं करना पड़ेगा। इसके लिए 30 जून, 2013 को रिटायर्ड हुए शिक्षकों का ब्यौरा एकत्र करा लिया गया है। ऐसे करीब 10,933 शिक्षक हैं। इन शिक्षकों की भर्ती प्रक्रिया नवंबर माह से शुरू हो सकती है। इस संबंध में 24 अक्तूबर को होने जा रही बेसिक शिक्षा अधिकारियों की बैठक में निर्णय किया जाएगा।

शासन स्तर पर हुई उच्चाधिकारियों की बैठक में यह मत बना है कि संविदा या फिर अन्य किसी तरह के शिक्षकों को रखने पर आगे चलकर उन्हें नियमित करने का दबाव होता है। इसलिए रिटायर शिक्षकों को फिक्स मानदेय पर रखकर बच्चों को पढ़वाया जाय। इन्हें 11 माह के लिए रखा जाएगा और आगे चलकर उनके स्वास्थ्य को देखते हुए सीमा विस्तार दिया जाएगा। इनका काम केवल बच्चों को पढ़ाना होगा। इनसे कोई दूसरा काम नहीं लिया जाएगा। गौरतलब है कि प्रदेश के परिषदीय स्कूलों में शिक्षकों की भारी कमी है। राज्य सरकार ने 72,825 प्राइमरी शिक्षकों की भर्ती के लिए आवेदन लिया था, लेकिन हाईकोर्ट में मामला जाने के बाद भर्ती प्रक्रिया पूरी नहीं हो पाई है। मौजूदा समय प्राइमरी में 2,36,398 और उच्च प्राइमरी में 55,508 पद रिक्त हैं

 ORDER Whereas, the Hon'ble High Court of Delhi vide order dated16.04.2013 in WPC No. 5270/2012 and CM No. 3271/2013 hasdirected as under: -

“Learned counsel for the petitioner states that he has instructions to withdraw the writ petition inasmuch as not oniythe petitioner but aiso the teachers are intending to file an appropriate representation with the Director of Educationunder Rule 97 of the Delhi Schooi Education Rules, 1973. On the representation being made either by the petitioneror by the concerned teachers, Director of Education is directed to take decision on the said representation within a period of eight weeks of the same being received. ” And whereas, vide order no. 330508 dated 03.08.2012 it wasordered as under - "Whereas, DTEA (Regd.) is a society which is running 07 schoois inDeihi, which are as foiiows :— DTEA, Lodhi Estate, New Delhi. DTEA, RK. Puram, New Deihi. DTEA, Pusa Road, New Deihi.DTEA, Moti Bagh, New Dehi.DTEA, Janakpuri, New Deihi.DTEA, Mandir Marg, New Deihi.DTEA, Laxmi Bai Nagar, New Deihi And whereas, vide notification of Directorate of Education No.F.4(6)(350)/E-iV/2011/621 dated 07/10/2011 in pursuance of sub-section (1) of section 23 of the Right of Chiidren to Free andCompuisory Education Act, 2009 (35 of 2009) the Nationai Councilfor Teacher Education (NCTE) vide Notification No. 215 F,No. 61— 03/20/2010/NCTE(N&S) dated 23/08/2010 iaid down one of the minimum essentiai quaiification for a person to be eiigihie for appointment as a teacher in class—I to IVI H in a school referred to inclause (n) of section 2 of the said Act that he/she should pass in the Teacher Eligibility Test (TET) conducted by the appropriate Govt in accordance with the guidelines framed by National Council for Teachers Education (NCTE) for the purpose. And whereas, vide notification no. F No. DE 4(6)(350)/E— IV/2011/18875-18924 dated 26/12/2011 regarding recognize only Central Teachers Eligibility Test (CTET) conducted by the CentralBoard of Secondary Education (CBSE) for appointment of teachers f0rclass I—V and class VI-VHI in the schools of Delhi in lieu of any StateTeacher Eligibility Test was circulated for information of allconcerned, And whereas, a clarification dated 29/02/2012 was issued by theDirector of Education reiterating that w.e.f. the aforesaid notificationonly CTET qualified teachers shall be employed by the Govt. AidedSchools as referred to in clause (n) of Section 2 of RTE Act, 2009. And whereas, the Secretary of DTEA (Regd.) Schools of Delhi sought clearance from the office of Directorate of Education for filling up 54 vacant posts including 10 posts of Trained Graduate Teachers and 06 posts of Asstt. Teachers by direct recruitment on 24/11/2011. And whereas, the Staff Selection Committee meeting was held on 01/02/2012, 04/02/2012, 13/02/2012 and 03/03/2012 under rule96(3)(b) of DSER, 1973, to appoint 10 TGTs and 06 Asstt. Teachersin DTEA Schools. And whereas, the crux of some of the orders given by the l-lon’ble Supreme Court of India and High Courts in regard to the irregularities committed in the selection of the candidates needs to be highlighted before coming to a logical conclusion and passing of an appropriateorder :-
(i) "Once the process of selection is found to be tainted, whatever had flowed consequent there to must also fall along with the process of selection. ” - Satpal V/s Union of India 1995, Sec (1) Suppl 206. 
(ii) “If on the date of selection, a particular candidate does not full fill the minimum qualifications, he is not entitled for appointment on the post.”

Dr. (Miss) Raj Kurnari Shanna V/s Chancellor MeerutUniversity, 1978, AU 831. (iii) "The selection and appointments of persons, made incontravention of ordinance 9 (2)(i) prescribed essential qualification is illegal. ” Dr. J. P. Kulshreshtha V/s Chancellor, Allahabad. And whereas, on noticing the discrepancies found in theaforesaid appointments, a show cause notice no. F.DE/DDE/SW—A/259—262 dated 30/06/2012 was issued to the Secretary DTEA schools. And whereas, the reply submitted by the Honorary President ofDTEA (Regd.) vide letter dated 09/07/2012 has been found unsatisfactory. Now, therefore, I AMIT SINGLA, Director of Education pass an order for cancelling the selection/ appointments of those candidatesas Trained Graduate Teachers and Asstt. Teachers who have not qualified the Central Teachers Eligibility Test (CTET), which is mandatory condition for appointment to the posts as these selections/appointments are in COntra vention/violation of the directions issued inthe above said notifications. ” And whereas, pursuant to the directions of the Hon’ble HighCourt dated 16.04.2013 in WPC No. 5270/2012 and CM No.3271/2013 a representation dated 08.05.2013 was received in the DIreCtOrate of Education from 09 TGT teachers, as detailed below,with the requests to exercise the powers under rule 97 of the DSEAR,1973 and relax the qualification of passing of CTET in their case and consequently release their salaries. . Mrs. Lalita . Mrs. Deepti . Sangeetha Vikramji V.V.. Mrs. SAvita Rani Mrs. Kajal Jaggi Mrs. S. Susa Mr. Ravishankar Meena Ms. Jyotsna Gosa Mrs. A. Maria Pushpalatha

And whereas, it is observed that the applicants have made theaforesaid request for relaxation under rule 97 of the DSEAR, 1973 onthe following grounds 
 1. Though the notification was issued on 07.10.2011 the officials ofthe Department neither informed this mandatory requirement of qualifying CTET nor incorporated the same in the advertisement. 
2. The availability of CTET qualified candidates was negligible since the pass percentage in these exams has been ranging from 0.45% to7.00% only. 
3. In a recent case bearing CA No. 1383f2013— Sushma and PushpaKhanduri and others Vs. Delhi Subordiante Services Selection Board(05555) and others, Hon’bie Judicial Member Dr. D. P. Sharma andSudhir Kumar have passed an order allowing the non CTET qualified candidates to take the teachers recruitment exam held by 05555,New Delhi under Section 23(2) of Right of Children for Free and Compulsory Education Act, 2009. It implies that passing of CTET forrecruitment of teachers under the Government of Delhi is relaxable. 
4. One of the applicant has cleared the CTET exam in November, 2012 and the others have applied for appearing in the CTET exam scheduleto be held in July, 2013. 

5. Due to acute shortage of CTET qualified teachers the government is deploying non CTET qualified candidates as Guest Teachers. And whereas, the contention of the applicants that the department had circulated the notification making CTET mandatory on 29.02.2012 only is misplaced and misfounded. The Directorate hadnotified passing of Teacher's Eligibiiity Test as one of the minimum essential qualification for appointment as a teacher in class I to VIII vide notification dated 07.10.2011. Further, notification dated 26.12.2011 whereby the Central Teacher’s Eligibility Test (CTET) conducted by the CBSE was recognized for appointment as teachers inclass I to VIII in schools of Delhi was also circulated for information of all concerned. The Circular dated 29.02.2012 stated by the applicantswas merely a clarification reiterating the previous notifications. And whereas, regarding the issue of non availability of CTET quaiified candidates it may be seen that the Hon’ble High Court ofDelhi vide order dated 22.04.2013 in WPC No. 2544/2013 titled as Ruchika Arora & Ors V5. UOI & Ors has observed as under —

“7. So far as the issue of there not being adequate numbers of Special Education Teachers is concerned, first of all I cannot believe such a self serving averment that there are not enough Special Education Teachers having CTET qualifications because there is no basis on facts and documents to substantiate the same. In my opinion, this is an issue which the appropriate authOrities will consider, including the authorities which are seeking employment for the Special Education Teachers.However, Courts cannot interfere in matters, merely on presumptive issues of there not existing adequate number ofteachers. ” And whereas, the matter regarding the order supposedly passedin OA No. 1383/2013 was also examined and it is seen that no copy ofthe said Orders have been annexed by the applicants with theirrepresentation. The applicants have simply annexed copy of anewspaper clipping which cannot be given much importance.However, it may be seen that the Hon'ble High Court of Delhi videorder dated 22.04.2013 in WPC No. 2544/2013 titled as Ruchika Arora & Ors Vs. UOI & Ors at para 3 & 6 has observed as under—
“3.The requirement of teachers, holding the otherqualification, of clearing the C TE T Test conducted by CBSE, wasas to bring about better education standards. Powers wereaccordingly exercised by the appropriate authority from timeto time under the Right of Children to Free and Compulsory Education Act, 2009. The National Council for Teacher Education vide its circular dated 11.02.2011 has issued the guidelines for conducting Teacher Eligibility Tests under the Right of Children to Free and Compulsory Education Act, 2009. CTET examinations are accordingly being conducted for the teachers ..... ..

6. In my opinion, the writ petition is clearly misconceived for the reason that his Court cannot sit in the place of the appropriate authority which decides qualifications for being employed as teachers. IN the present case, so far as theemployer is concerned, being the National Capital Territory ofDelhi, it has quite clearly been prescribed in the advertisementthat the Special Education Teachers must have CTETqualification. 1 do not think that there is any illegality orabsurdity in any employer asking that to seekappointment/employment as a teacher, he/she must have CTET qualification, and which qualification was to bring abouta higher standard of education. ”

And whereas, considering the request of the applicants that most of them are appearing in the forthcoming CTET exam scheduled to beheld in July, 2013, it is pointed out that as per rule the candidates are supposed to have the minimum qualifications at the time of initial recruitment and not obtain them subsequently. And whereas, regarding the claim of the applicant that even the government was deploying non CTET qualified candidates as Guest teachers due to acute shortage of CTET qualified teachers, it is pertinent to point out that the Directorate of Education is recruiting CTET qualified candidates only during the direct recruitment through DSSSB as well as during appointment of contract teachers under SSA.

As regards Guest Teachers it is infOrmed that they appointed on per period basis only. As such they are not covered under either the direct recruit category or the contract teacher category and are purely temporary on per period basis, as per requirement, unlike the case of these 

09 applicants who are seeking recruitment on permanent basis.However, it is worth mentioning that even in the case of guestteachers the Directorate of Education endeavours to appoint CTETqualified candidates only in the first instance. And whereas, the submissions of the applicant have been considered and it is observed that Rule 100 of the DSEAR, 1973 prescribes that no teacher shall be recruited by any school who doesnot fulfill the minimum qualifications prescribed by the RecruitmentRules. And whereas, Rule 97 of the DSEAR, 1973, provides that wherethe relaxation of any essential qualification for the recruitment of any employee is recommended by the appropriate selection committee,the managing committee of the school shall not give effect to suchrecommendation unless such recommendation has been previouslyapproved by the Director. And whereas, it is also observed that as per the provision of the Rule 97 & 103 of the DSEAR, 1973 the prior approval of the ‘Director’ for such relaxation has to be obtained by the Managing Committee ofthe school without which no appointments can be made. Thisprovision has also not been followed in the present case. Even otherwise the Right of Children to Free and Compulsory Education Act, 2009 prescribes that quality of teaching is to be maintained and forthis regard the minimum qualification as laid down by an academicauthority authorized by the Central Government by notification has tobe followed as laid down in Section 23(1) of the said Act. Thenotification mandating CTET to be compulsory has been madepursuant to the notification dated 23.08.2010 issued by the National Council for Teacher Education (NCTE), an academic authority authorized by the Central Government. Now, therefore, in view of the above facts and circumstances therequest of the 09 applicants for relaxing the qualification of passing CTET and consequently releasing the salary cannot be accepted and the application is rejected.

This order may also be considered as a warning to the Managing Committee of the concerned school for violating the provisions of DSEAR, 1973. Maharashtra State Council of Examination has released the notification for the Maharashtra Teacher Eligibility Test 2014 by inviting online applications from the eligible candidates. Candidates those who have interest should fulfill eligible criteria to apply for the MAHA TET 2014. candidates may apply through online from the Maharashtra TET main website at www.mahatet.in by submitting prescribed online application form on before last date 11/11/2013. The Admit Card for the Maharashtra TET 2014 will be issued from 26th November, 2013 to 14th December, 2013 and the Maharashtra Teacher Eligibility Test 2014 will be held on 15th December, 2013. More details are mentioned below.

Maharashtra State Council of  Examination invited application for Maharashtra State Teachers Eligibility Test 2013 for the appointing eligible candidates as primary teacher. The candidates eligible for the post can apply through prescribed format before 11 November 2013.

Qualifying Marks :-
Candidates those who score 60 percent or more in the TET examination will be considered as TET pass.
Candidates those who belong to SC,ST,VJ,NT,OBC, differently abled persons, score 55 percent or more in the TET examination will be considered as TET pass.

Maharashtra Teacher Eligibility Test ?
Maharashtra Teacher Eligibility Test which is an eligibility test conducted by MSCE. There will be two papers. Paper 1  will be held for Primary teacher (first class to fifth class) and Paper 2 will be conducted for upper primary teacher selection.

Educational Qualification :-
Teachers of classes I - V (Paper-1) : Intermediate / Class 12th with at least of 45% marks / 4 years full time Bachelor of elementary education / 2 years full time Diploma in education or elementary education / BA/ B.Sc with at least 50 percent marks and B.Ed from recognized university.

फतेहपुर, कार्यालय संवाददाता : उत्तर प्रदेश आदर्श शिक्षामित्र वेलफेयर एसोसिएशन ने दावा कि किया कि शिक्षामित्रों की तपस्या पूरी होने वाली है। नए वर्ष की शुरुआत में शिक्षामित्र मास्साब बन जाएंगे। ऐसे दावों को सुनकर शिक्षामित्रों मे हर्ष की लहर दौड़ पड़ी।

एसोसिएशन की बैठक बुधवार को नहर कालोनी मैदान में हुई। उन्होंने दावे की पुष्टि करते हुए कहाकि प्रदेश अध्यक्ष और मुख्यमंत्री के बीच वार्ता हो चुकी है। महज घोषणा बाकी है। नए साल में घोषणा होगी तब शिक्षामित्रों के घर-घर में दीपावली जैसा माहौल होगा।

जिला महामंत्री शिव कुमार यादव ने कहाकि दूरस्थ बीटीसी प्रशिक्षण की परीक्षाओं की तिथियां घोषित कर दी गई हैं। प्रथम बैच का बैक पेपर 28 अक्टूबर को, द्वितीय बैच का 29 को तथा द्वितीय बैच द्वितीय समेस्टर की परीक्षा 30 अक्टूबर को होगी। 31 अक्टूबर को प्रथम बैच के चतुर्थ सेमेस्टर की परीक्षा होगी। सभी के प्रवेश पत्र ब्लाक से दिए जाएंगे। सितंबर और अक्टूबर का मानेदय ग्राम शिक्षा निधि में शीघ्र भेजने का निर्णय लिया है। बैठक में चंद्रभूषण, अजय ंिसह, क्षत्रपाल, श्रीचंद्र, अजय तिवारी, सूघर सिंह, राजेश कुमार, मनोज कुमार, दुलीचंद्र आदि मौजूद रहे

Petitioners who are two in number have approached this Court with a request to quash the impugned advertisement dated 11.7.2013 and 27.8.2013 issued by the Principal Secretary Basic Education Government of U.P. in consonance with the Uttar Pradesh Basic Education (Teachers) Services (16th Amendment) Rules, 2012 regarding fixation of age.
As per advertisement in question, which has been so published, inviting application for consideration of candidature of candidates, for being appointed as teachers in the subject of Maths and Science, requisite age limit has been prescribed as� 21 years as on 1.7.2013 and not more 35 years as on 1.7.2013. Accepted position is that both the petitioners have crossed 35 years of age on 1.7.2013 and this has impelled the petitioners to be before this Court questioning the validity of aforementioned rule in question by contending that at various places, age has been extended upto 40 years, and in view of this such a� restriction for consideration of candidature of candidate only upto 35 years as on 1.7.2013 is bad and State should be directed to extend the age for consideration of candidature upto 40 years for being appointed as Assistant Teacher in Junior High School.
Request made by the petitioners cannot be accepted for the simple reason that once rule making authority has proceeded to frame rule known as U.P. Basic Education (Teachers) Services Rules, 1981, and in the aforementioned rules in question, once age which a candidate is required to possess has been provided for and thereafter, is in consonance with the same advertisement, has been published on 11.7.2013 and 27.8.2013 fixing minimum and maximum age of candidate has to have on 1.7.2013, then in case claim of petitioners is accepted, then same� would be in violation of Rules in question. Once validity of rules has not been questioned by the petitioners, and reason appears to be is obvious� as competence of authority� to frame Rules, perhaps can not be� disputed by the petitioners. Once rule making authority� has framed rule and has chosen to fix minimum and maximum age limit for appointment,� and in view of the same, petitioners are out of zone of consideration, then petitioners cannot� claim, that their claim should be� considered as a matter of right for extension of age.
Petitioners have tried to contend before this Court that in other government services, State Government has taken policy decision and has introduced the amendment known as Uttar Pradesh� Recruitment to Service ( Age Limit) (10th Amendment), Rules, 2012 and therein age prescribed as 35� has been extended to� 40 years and based on the same benefits be extended to them also. Said rule cannot be� pressed and invoked, said rules are applicable qua the� incumbents whose service rules are to be framed by the Governor under� the proviso of Article 309 of the Constitution, in view of this no benefit or advantage can be derived� by the petitioners of the� aforementioned Rule.

Once such is the factual situation that� selection/appointment is governed by statutory rules in question known as Uttar Pradesh Basic Education (Teachers) Services� Rules, 1981 as amended� till date� and minimum and maximum age limit has been prescribed,� therein in view of this,� once petitioners are not at all� falling within the zone of consideration then no relief or reprieve can be accorded to them, as law on the subject is clear that fixation of eligibility criteria and fixation of age limit� all are in the realm of policy making of State Government. 
Consequently, present writ petition is dismissed.

These three writ petitions have challenged the Government Order dated 11.7.2013, issued by the Principal Secretary, Basic Education, filed as Annexure-1 to the writ petition. By the said order the Government has taken a decision to fill up 29,334 vacant posts of Assistant Teachers of Science and Mathematics stream in Junior High Schools, managed and controlled by the Basic Education Board. The said Government Order further provides the procedure for making the selection to the said posts.
Writ Petition No.52521 of 2013 has been filed by a prospective candidate, who claims to possess the educational and other eligibility qualifications for being appointed as Assistant Teacher in a Junior High School in the Arts stream. According to learned counsel for the petitioner there is no separate gradation or cadre with regard to the Assistant Teachers of Junior High Schools of the Art or Science or Mathematics stream, the cadre is one and the same and, therefore, if the selections is made only for Science and Mathematics stream, the candidates who are eligible for other stream are put to loss. The following questions have been framed by learned counsel for the petitioner for consideration in the said writ petition :
(1) Whether the Government Order dated 11.7.2013 (Annexure No.1 to the writ petition) is against the Rules 15 and 17-A of the U.P. Basic Education (Teachers) Service Rules, 1981 ?
(2) Whether the State Govt. has committed illegality in issuing direction to Basic Education Authorities for filling up the vacancies of Assistant Teachers in Upper Primary School (Class 6 to 8) only for Science and Maths teaching subjects ignoring other teaching subjects while the Govt. has taken examination of Teachers Eligibility Test (T.E.T.) for all kind of teaching subjects candidates ?
Writ Petition Nos.50787 and 55925 of 2013 have been filed by the Assistant Teachers of Primary Institutions who claim to possess the qualifications and eligibility for being promoted as Assistant Teachers in Junior High Schools in Science and Mathematics stream. According to the petitioners the amendment in the Rules by providing for filling up 50% vacancies of Science and Mathematics stream by direct recruitment is detrimental to their interest inasmuch as their chance for promotion are drastically reduced. It is further their case that in so far as Assistant Teachers of Junior High Schools of the stream other than Science and Mathematics is concerned that is primarily Art stream the posts are to be filled up 100% by promotion and, therefore, Teachers in the same cadre as that of the petitioners working as Assistant Teachers in Primary Institutions but possessing qualifications for promotion as Assistant Teachers in Junior High Schools, Art stream would have better chance of promotion.
It is further case of the petitioners that although the relevant Rules provide for filling up the vacancies of Assistant Teachers in Junior High Schools in Science and Mathematics stream by direct recruitment but the same is subject to fulfillment of certain conditions and it is only when the Government comes to conclusion that either there is non-availability of Assistant Teachers in Primary Institutions for being promoted to the post of Assistant Teachers in Junior Hgh Schools in Science and Mathematics stream and there is need for such Teachers then open selection can be made to fill up such posts. He further submits that apparently no such exercise or decision has been undertaken by the State before amending the Rules for filling up 50% posts of Assistant Teachers of Junior High Schools in Science and Mathematics stream by direct recruitment.
Another submission raised by Sri R.K. Ojha, learned Senior Counsel for the petitioners in the aforesaid two writ petitions is that inclusion of the qualification of B.Ed. Degree is not in accordance to law inasmuch as the relevant Rules of 1981 applicable to the Junior High Schools, managed and controlled by the Basic Education Board does not provide B.Ed. as a necessary qualification as such by the Government Order such qualification cannot be inserted. This argument at the behest of the petitioners, who are already working as Assistant Teachers in Primary Schools, cannot be sustained. However, a candidate who may be interested in applying against the advertisement may raise such a point provided he fulfills all other qualifications other than B.Ed. As such this argument does not lie in the mouth of the petitioners in the present two writ petitions.
Sri A.K. Yadav, learned counsel appearing for the Basic Education Board and Sri S.C. Dwivedi, learned Additional Chief Standing Counsel appearing for the State-respondents may obtain complete instructions in the matter in the light of facts and grounds recorded above so that this matter may be finally thrashed out without causing any further interference in the selection process, which has already commenced.
In case instructions are not received by the next date from the Board and State Government, court will be left with no other option but to proceed to pass appropriate orders in the light of the submissions advanced.
Put up this case in the additional cause list on 30.10.2013. 
Copy of the order may be provided to Sri A.K. Yadav, learned counsel appearing for the Basic Education Board and Sri S.C. Dwivedi, learned Additional Chief Standing Counsel for the State-respondents free of cost within 24 hours for necessary compliance.

जूनियर हाईस्कूलों में गणित व विज्ञान शिक्षकों की भर्ती के लिए काउंसलिंग नवंबर में कराने की तैयारी है।

इसके लिए कटऑफ मेरिट माह के अंत तक या फिर नवंबर के पहले हफ्ते में जारी की जाएगी।

काउंसलिंग के लिए दोगुना अभ्यर्थियों को बुलाया जाएगा, ताकि टॉप मेरिट के अभ्यर्थियों के न आने पर दूसरों को मौका दिया जा सके।

मेरिट प्रदेश स्तर पर जारी की जाएगी और इसे फार्म भरने वाली वेबसाइट पर ही देखा जा सकेगा। काउंसलिंग के बाद 31 दिसंबर तक चयनितों को सहायक अध्यापक की नौकरी दे दी जाएगी।

बेसिक शिक्षा परिषद के जूनियर हाईस्कूलों में 58,666 गणित व विज्ञान शिक्षकों के पद खाली हैं। इसमें से 29,334 शिक्षकों की सीधी भर्ती के लिए 11 अक्तूबर तक ऑनलाइन आवेदन लिए गए।

सचिव बेसिक शिक्षा परिषद कार्यालय की मानें तो नेशनल इंफॉरमेटिक सेंटर से आवेदनों का पूरा ब्यौरा मांग लिया गया है।

एनआईसी से मिलने वाले ब्यौरे का परिषद कार्यालय में मिलान करने के बाद जिलों को भेजा जाएगा। इसके बाद मेरिट का अनुमोदन जिला समिति से कराते हुए इसे जारी किया जाएगा।

इस प्रक्रिया में कम से कम 8 से 10 दिन लगने का अनुमान है। इसके आधार पर ही नवंबर से काउंसलिंग कराने की तैयारी है

Rajiv Kumar Singh has got to his credit degree of Bachelor of Pharmacy (B. Pharma), and his submission is that for being appointed as Assistant Teacher in Senior Basic School in the subject of Science, his candidature in question should also be considered, as degree of various discipline, such as B.Sc.(Ag.), B.Sc.(Home Science), B.A.M.S., B.H.M.S. and B.U.M.S. have been entertained, but as far as degree of Bachelor of Pharmacy (B. Pharma) is concerned, it has been left out and requisite relief be accorded.
Fixation of elligibility criteria is the domain of the authority concerned and in the realm of policy decision, and once authority concerned in its wisdom has chosen not to include the Degree of Bachelor of Pharmacy (B. Pharma) for teaching Science subject in Senior Basic School, then this Court cannot come to rescue of the petitioner by directing the respondents to accept the degree of Bachelor of Pharmacy (B. Pharma) also for being appointed as Science Teacher in the Senior Basic School,
Consequently, writ petition is dismissed.

इलाहाबाद। उत्तर प्रदेश लोक सेवा आयोग प्रतियोगियों को दीवाली पर बड़ा तोहफा देने जा रहा है। आयोग इसी महीने दो बड़ी भर्तियों के लिए आवेदन मंगाने जा रहा है। इनके तहत 12 हजार से अधिक पदों पर भर्ती होगी। इनमें से साढ़े छह हजार से अधिक पद तो कृषि स्नातकों के लिए है। इन भर्तियों के लिए आयोग ने सूचना भी जारी कर दी है।
आयोग की भर्ती परीक्षाओं की तैयारी में जुटे प्रतियोगियों के लिए यह वर्ष काफी उम्मीदें लेकर आया है। लोअर सबऑर्डिनेट के पदों के लिए 2009 के बाद भर्ती होने जा रही है। खास यह कि इस दौरान रिक्त हुए पदों को भी 2013 की भर्ती में शामिल कर लिया गया है। बदले प्रारूप के अनुसार प्रारंभिक परीक्षा आठ दिसंबर को होगी। इसके अलावा समीक्षा अधिकारी / सहायक समीक्षा अधिकारी पदों की भर्ती भी 2010 के बाद होगी। इनके लिए प्रारंभिक परीक्षा इसी महीने हुई। इसी क्रम में आयोग ने अधीनस्थ कृषि सेवा वर्ग-3 के तहत 6628 प्राविधिक सहायकों की भर्ती की घोषणा की है। इनके लिए कृषि स्नातक आवेदन कर सकते हैं। चिकित्सा एवं स्वास्थ्य सेवा में एलोपैथिक चिकित्साधिकारी के 5251 पदों पर भर्ती की तैयारी है। इनमें से 12 पद बैकलॉग तथा 2371 पद विशेष चयन के तहत भरे जाएंगे। पालिका स्वास्थ्य सेवा में सफाई एवं खाद्य निरीक्षक के 128 पदों के लिए भी भर्ती की जाएगी। सभी के लिए 22 अक्तूबर को विज्ञापन निकाला जाएगा। बैंक में फीस जमा करने की आखिरी तारीख 18 नवंबर है, जबकि आवेदन 21 नवंबर तक किया जा सकेगा।

Learned Standing Counsel has accepted notice on behalf of the respondent no.1 and Sri B.P. Singh, Advocate has accepted notice on behalf of the respondent nos. 2 to 5. and Sri R.A. Akhtar, Advocate has accepted notice on behalf of the respondent no.6.
Each one of the respondent is granted six weeks time to file counter affidavit. Rejoinder affidavit may be filed within two weeks thereafter.

In the present case, petitioners are assailing the validity of Rule in question to the effect and extent, it proceeds to award marks in lieu of training qualification. Petitioners' submission is that under Appendix-12 of Rule 14 (3) of U.P. Basic Education Teacher (Service) Rules,1981, in lieu of Ist, IInd and IIIrd Division, in theory and practical different set of marks has been provided for i.e. in case incumbent has passed his B.Ed Examination in Ist Division, then he is entitled for 12 marks in theory and 12 marks in Practical. In case incumbent has passed his B.Ed Examination in IInd Division, then he is entitled for 6 marks in theory and 6 marks in Practical and� similarly if incumbent has passed his B.Ed Examination in IIIrd Division, then he is entitled for 3 marks in theory and 3 marks in Practical. Petitioners' submission is that in the State of U.P. there are various Universities established and in the said University in question, different parameters have been provided for awarding marks in Ist, IInd and IIIrd Division. Petitioners submission is that oince� Universities have fixed different parameter for awarding in Ist, IInd and IIIrd Division, then candidates who have pursued their course from the Universities, wherein higher percentage� has been� provided for higher division, would be� in disadvantageous situation. Petitioners have tried to� demonstrate before this Court, the parameters� fixed� by different Universities for awarding division in paragraph 10. 
In view of this, petitioners submit that said criteria� on the face of it is arbitrary and unreasonable� and criteria has been provided to compute marks in lieu of academic qualification� ought to have been adhered for bringing the� candidates on common equal pedestal. 
Prima facie looking into the arguments advanced all the respondents are directed to file counter affidavit within one month. Rejoinder affidavit may be filed within two weeks. It is made clear that selection and appointment be� made,� but same shall abide by final order to be passed by this Court.
