1. Heard Sri Anil Bhushan, learned Senior Advocate assisted by Sri Arpan Srivastava, learned counsel for appellants, learned Standing Counsel for respondent no. 1, Sri Dhananjay Awasthi for respondents no. 4 and 5 and perused the record.

This intra-Court appeal under Chapter VIII Rule 5 of Allahabad High Court Rules, 1952 (hereinafter referred to as "Rules, 1952") has arisen from judgment and order dated 01.08.2018 passed by learned Single Judge dismissing appellants' writ petition no. 16523 of 2018 by which order impugned therein dated 17.05.2018 was sought to be quashed. 
3. Dispute in this appeal is, whether appellants are required to pass Teachers' Eligibility Test (hereinafter referred to "TET") for being considered for promotion from Primary to Junior High School under the Regulations. 
4. Learned counsel for the appellant contended that requirement of passing TET is confined to direct recruitment and not for the purpose of promotion. 
5. We are of the view that requirement of passing TET is necessary for selection, promotion and for any other mode of appointment and it is not confined only to the selection from open recruitment. 
6. We, therefore, find no reason to restrain respondents from taking aforesaid test. The purpose of having a person passed TET is only to judge one's efficiency and performance of imparting education Primary School. In case teachers are not efficient to impart primary education to its students, the very purpose of providing basic standard education would be defeated. 
7. We, therefore, find no fault in the judgment of learned Single Judge, assailed in this appeal. 
8. Dismissed.

By order dated 6.2.2018, Writ-A No.4625 of 2018 filed by the applicant was disposed of in terms of the judgement rendered in Writ-A No.2868 of 2018 (Bibha Singh Kushwaha and 21 others Vs. State of U.P. and 2 others. 
The operative part of the judgement dated 6.2.2018 in Bibha Singh Kushwaha (supra) reads thus:- 
"9. Once the assurance has been given, then this Court hopes and trusts that in the light of the order dated 5.2.2018 and the consequential order dated 6.2.2018 the respondent authority would proceed in the matter and very soon the publication would be made in the widely circulated newspapers across the State of U.P. for enabling the candidates, who fall under Rule 8 (2) (d) of Rules of 2008 to make on-line applications for their inter-district transfer. In case any such application would be made by the incumbents, then the process would be ensured strictly in accordance with law. As it is alleged and there is apprehension that pick and choose policy would be adopted in the transfer. In such a situation the Court is of the considered opinion that for ensuring fair play and transparency, the Secretary (Basic Education), Government of UP, Lucknow as well as Secretary, U.P. Basic Education Board, Allahabad shall monitor the entire transfer process in this regard. In case there is any lapses, irregularities or partiality in this regard, they would be solely responsible. It is made clear that in case any discrimination is done in the transfer, then the higher authority would be at liberty to proceed against the concerned authority in this regard. 
10. With the aforesaid directions/observations, the writ petition is disposed of."� 
The applicant had sought transfer by filing online application on the ground that she is seriously ill and, therefore, she should be transferred from District Etawah to district Kanpur Nagar/Jalaun. 
On 27.8.2018, the following order was passed:- 
"Sri Vikram Bahadur Singh has appeared today on behalf of the opposite parties. He has placed on record the instructions received by him from opposite party No. 1, according to which the application of the applicant for transfer was considered, but her name does not figure in the order dated 30.6.2018 issued by the department in regard to the candidates, whose request for inter-district transfer was allowed. 
A perusal of the order of the writ Court reveals that thereunder the Board was required to issue a detailed advertisement in newspapers having wide publicity and thereafter consider request for inter-district transfer. It was also the intent and purport of the order passed by this Court that there could be no bar in seeking transfer on the grounds covered by Rule 8(2)(d), even if five years of service had not been completed at the present place of service. The instructions furnished does not reveal that while finalising the list for transfer, no claim has been excluded on the said ground. It is also not clear that if there are more applicants seeking transfer to a particular district, as compared to vacancies, what criteria was followed in finalising the list. 
Learned counsel for the opposite party is also unable to explain the same. 
In such circumstances, the opposite party No. 1 is directed to appear in person before this Court on 6.9.2018 along with detailed affidavit to show compliance of the order of the writ Court in letter and spirit. 
Put up as fresh on 6.9.2018."� 
In compliance of the said order, opposite party no.1 has appeared in person. He has also filed two affidavits and wherein the stand taken is that the request of the applicant for transfer from district Etawah has been rejected, as the applicant failed to substantiate her claim. It is pointed out that a Government Order was issued on 13.6.2017, according to which, the application seeking transfer was to be filed online on the designated portal alongwith evidence in support of the claim. The applicant had failed to substantiate her claim of illness, as she did not submit any document. It is also stated in the affidavit that under clause 6 of the Government Order, where the existing vacancies in any particular district was more than 15% of the total sanctioned strength in the cadre, no transfer was permissible. 
Sri Arun Kumar, learned counsel appearing on behalf of opposite party no.1 has placed reliance on a judgement of this Court dated 13.8.2018 in Writ-A No.14395 of 2018 Smt. Ruchi Vs. State of U.P. and 2 others with other connected matters, where this Court has upheld the aforesaid restriction placed by Government Order. 
It is further submitted by Sri Arun Kumar that no transfer application has been rejected solely on the ground that a teacher has not completed five years of service at the present place of posting. He further submitted that the claim for transfer has been considered in the light of Government Order dated 13.6.2017 as modified by Government Order dated 20.9.2017. According to the procedure prescribed under these Government Orders, the applications submitted online are subjected to a grading system and marks are awarded accordingly. The aforesaid exercise is carried out by the software developed by National Informatics Centre without any human interference, thus ruling out favouritism. The final orders of transfer have been passed on the basis of points obtained according to the grading system, keeping in mind the vacancies available in each district. The transfer orders could only be downloaded by the candidate himself from the website of National Informatics Centre.� 
This being the factual position, this Court is of the opinion that substantial compliance of the directions issued by this Court in Bibha Singh Kushwaha has been made. 
Accordingly, the notices issued to the opposite parties are discharged. The contempt application is consigned to record.

1. These petitions have been filed by the petitioners who have been declared as qualified for selection against 41,556 vacancies of Assistant Teachers in Primary Schools run by U.P. Basic Shiksha Parishad. 
2. It is not in dispute that the petitioners have committed some human inadvertent error while filling up online forms after declaration of the result. 
3. The submission of learned counsels for the petitioners is that if these qualified candidates are allowed to correct these minor mistakes in filling up online forms, neither selection process nor result would be affected in any manner. 
4. There is acute shortage of teachers in the State and under the Right to Education Act, 2009, the teacher student ratio has to be maintained as per the provisions of the Act and the Rules framed thereunder. The petitioners have committed some inadvertent human errors in filling up online forms. If the petitioners are allowed to correct these mistakes at the time of counseling or at any time as per convenience of the competent authority, this would not impact the result of any candidate or over all selection process. 
5. I find that one chance for correcting the mistakes to these candidates should be afforded at an appropriate stage by the  competent authority so that human errors/ mistakes of these candidates in filling up online forms are corrected. 
6. With these observations, the concerned authorities are directed to allow the petitioners to correct these inadvertent human mistakes in filling up online forms at appropriate stage and allow them to participate in counseling. 
7. These writ petitions, thus, are finally disposed of.

TET : प्राथमिक शिक्षकों की भर्तियों  मैं अब बी एड धारी पात्र , राज्य  केंद्र एवं देश भर के प्राथमिक शिक्षकों की भर्ती में मौका मिल सकेगा , लेकिन प्राथमिक लेवल टेट परीक्षा पास करनी होगी 

हिंदुस्तान भर के किसी भी स्कूल में बी एड अब प्राथमिक शिक्षकों के लिए भी योग्यता निर्धारित हो गयी है ,
इससे बी एड के सामने देश लाखों भर के लाखों शिक्षकों की भर्तियों में मौका मिल गया है , अकेले यु पी में 1 लाख प्राथमिक शिक्षकों की भर्ती होने जा रही है ,

केंद्रीय व सरकारी सहायता प्राप्त स्कूलों में भी मौका मिल गया है 

29 जुलाई 2011 के नोटिफिकेशन में सशोधन हो चुका है और प्राथमिक शिक्षक बनने के लिए टेट लेवल -1 परीक्षा के लिए अब B Ed धारी भी पात्र हैं |

No. NCTE-Regl 012/16/2018.—In exercise of the powers conferred by sub-section (1) of Section 23 of Right of Children to Free and Compulsory Education Act. 2009 (35 of 2009) and in pursuance of notification number S.O. 750(E), dated the 31st March, 2010 issued by the Department of School Education and Literacy, Ministry of Human Resource Development, Government of India, the National Council for Teacher Education (NCTE) hereby makes the following further amendments to the notification number F.N. 61-03/20/2010/NCTE/(N&S), dated the 23rd August, 2010, published in the Gazette of India, Extraordinary, Part III, Section 4, dated the 25th August, 2010, hereinafter referred to as the said notification namely:— (1) In the said notification, in para 1 in sub-para (i), in clause (a) after the words and brackets “Graduation and two year Diploma in Elementary Education (by whatever name known), the following shall be inserted, namely:- OR “Graduation with at least 50 % marks and Bachelor of Education (B.Ed.)” 2. In the said notification in para 3, for sub-para(a), the following sub-para shall be substituted namely:- “(a) who has acquired the qualification of Bachelor of Education from any NCTE recognized institution shall be considered for appointment as a teacher in classes I to V provided the person so appointed as a teacher shall mandatorily undergo a six month Bridge Course in Elementary Education recognized by the NCTE, within two years of such appointment as primary teacher”. गजट / राजपत्र नोटिफिकेशन को तत्काल प्रभाव से लागु किया जाता है , ऐसा के वी एस 2011 की भर्ती के मध्य में तत्काल प्रभाव से टेट को लागु करके भी हुआ था , और सभी सरकारी भर्तियों के मध्य में परिवर्तन कर टेट लागु हुआ था |

No. NCTE-Regl 012/16/2018.—In exercise of the powers conferred by sub-section (1) of Section 23 of Right of Children to Free and Compulsory Education Act. 2009 (35 of 2009) and in pursuance of notification number S.O. 750(E), dated the 31st March, 2010 issued by the Department of School Education and Literacy, Ministry of Human Resource Development, Government of India, the National Council for Teacher Education (NCTE) hereby makes the following further amendments to the notification number F.N. 61-03/20/2010/NCTE/(N&S), dated the 23rd August, 2010, published in the Gazette of India, Extraordinary, Part III, Section 4, dated the 25th August, 2010, hereinafter referred to as the said notification namely:— (1) In the said notification, in para 1 in sub-para (i), in clause (a) after the words and brackets “Graduation and two year Diploma in Elementary Education (by whatever name known), the following shall be inserted, namely:- OR “Graduation with at least 50 % marks and Bachelor of Education (B.Ed.)” 2. In the said notification in para 3, for sub-para(a), the following sub-para shall be substituted namely:- “(a) who has acquired the qualification of Bachelor of Education from any NCTE recognized institution shall be considered for appointment as a teacher in classes I to V provided the person so appointed as a teacher shall mandatorily undergo a six month Bridge Course in Elementary Education recognized by the NCTE, within two years of such appointment as primary teacher”. राज्य ब्यूरो, लखनऊ : प्रदेश सरकार बेसिक शिक्षा परिषद के स्कूलों में सहायक अध्यापक भर्ती की दूसरी परीक्षा तैयारियों में जुट गई है। शासन तय समय से पहले दोनों परीक्षाएं कराने जा रहा है। उत्तर प्रदेश शिक्षक पात्रता परीक्षा यानी यूपी टीईटी 2018 की समय सारिणी जारी हो गई है। परीक्षा 28 अक्टूबर को दो पालियों में होगा। परीक्षा परिणाम नवंबर के अंत तक आने की उम्मीद है।

परिषदीय प्राथमिक स्कूलों में सहायक अध्यापक भर्ती की लिखित परीक्षा में सफल 41556 को नियुक्ति पत्र पांच सितंबर को दिया जाना है। काउंसिलिंग शुरू होने से पहले ही शासन ने अगली भर्ती की प्रथम चरण की परीक्षा यानी यूपी टीईटी 2018 का विस्तृत कार्यक्रम जारी हुआ है। परीक्षा नियामक प्राधिकारी सचिव उप्र इलाहाबाद को जिम्मेदारी सौंपी गई है। टीईटी का विज्ञापन 15 सितंबर को और ऑनलाइन आवेदन 17 सितंबर अपरान्ह से शुरू होगा। पंजीकरण की अंतिम तारीख तीन अक्टूबर शाम छह बजे तक है। आवेदन शुल्क चार अक्टूबर तक जमा होगा। आवेदन पूर्ण करने और प्रिंट लेने की अंतिम तारीख पांच अक्टूबर शाम छह बजे तक है। 10 अक्टूबर तक जिला समिति परीक्षा केंद्रों का निर्धारण होगा। 12 अक्टूबर तक परीक्षा केंद्रों की साफ्ट कॉपी जारी होगी। प्रवेश पत्र 17 अक्टूबर को वेबसाइट पर अपलोड होंगे। परीक्षा 28 को होगी। पहली पाली में प्राथमिक स्तर की परीक्षा सुबह 10 से 12.30 बजे तक व दूसरी पाली में उच्च प्राथमिक स्तर की परीक्षा 2.30 से 5.00 बजे तक होगी। अगले दिन आंसर की जारी होगी। रिजल्ट नवंबर के अंत तक घोषित होगा।’



दिसंबर में शिक्षक भर्ती परीक्षा

यूपी टीईटी का परिणाम से पहले ही शासन सहायक अध्यापक भर्ती की परीक्षा का आदेश जारी करेगा। बेसिक शिक्षा विभाग के अपर मुख्य सचिव डॉ. प्रभात कुमार ने बताया कि दिसंबर के पहले सप्ताह में परीक्षा होगी। दिसंबर अंत तक नियुक्ति प्रक्रिया पूरी कर ली जाएगी।

आचार संहिता का ध्यान

पहले यूपी टीईटी दिसंबर और लिखित परीक्षा फरवरी में कराने का कार्यक्रम तय था, उसमें यूपी बोर्ड की परीक्षा और लोकसभा चुनाव की आचार संहिता के कारण भर्ती प्रक्रिया प्रभावित हो सकती थी। ऐसे में शासन ने पहले ही दोनों परीक्षा कराकर नियुक्ति देने का निर्णय लिया है।

Accordingly, the special leave petitions are disposed of by directing that the services of the petitioners be not disturbed on the above grounds.

1.� The petitioner has filed this writ petition under Article 226 of the Constitution of India impugning the order dated 29.05.2018 (Annexure-9 to the writ petition) passed by District Basic Education Officer (hereinafter referred to as "the BSA"), Maharajganj whereby it has been held that the petitioner who was appointed on 01.07.2007 was not qualified to be appointed as Assistant Teacher in the Primary School inasmuch as she did not have requisite qualification as per the existing provisions of The U.P. Recognised Basic Schools (Junior High Schools) (Recruitment and Conditions of Service of Teachers) Rules, 1978 (hereinafter referred to as "the 1978 Rules"). 
2.� Bachelor of Education (hereinafter referred to as 'B.Ed.') was not one of the eligible qualifications prescribed as per the existing Rules for appointment of Teacher. The petitioner was appointed on the post having B.A. and B.Ed. Degrees. The BSA has also held that the aforesaid Rules got amended only in the year 2008 i.e. on 12.06.2008 and by that amendment B.Ed. has also been added as one of the eligible qualifications for appointment of Assistant Teacher in Primary Schools. BSA has taken the view that since the petitioner did not have requisite qualifications as per the existing Rules, therefore, the approval for appointment of the petitioner granted in the year 2004 is to be revoked. The impugned order has been passed after 14 years since the date of appointment of the petitioner on the post of Assistant Teacher. 
3.� It is not in dispute that the petitioner has been working since her initial appointment i.e. of the year 2004 and her appointment was approved by the competent authority and she has been drawing her salary continuously without break. 
4.� It is relevant to note that National Council for Teachers Education is a body constituted under the NCTE Act, 1993 a Central Legislation NCTE has framed Regulation in the year 2001 exercising the powers vested in it under the NCTE Act, 1993. These regulations were framed on 03.09.2001 which are called "National Council for Teacher Education (Determination of Minimum Qualifications for Recruitment of Teachers in Schools) Regulations, 2001". Regulation 2 of the aforesaid Regulations provides that the Regulations shall be applicable for recruitment of teachers in all formal schools established, run or aided or recognised by the Central or State Governments and other authorities for imparting education at the elementary (primary and upper primary/middle school), secondary and senior secondary stages. Regulation 3(i) provides that the qualifications for recruitment of teachers in educational institutions mentioned in Regulation 2 shall be as prescribed in the First Schedule for teaching school subjects. Regulation 4 provides that the existing recruitment Rules may be modified within a period of three years so as to bring them in conformity with the qualifications prescribed in the Schedules. Meanwhile, teachers appointed in accordance with the existing recruitment qualifications, subsequent to the issuance of the Regulations, would be required to acquire the qualifications as prescribed in the Schedules. The First Schedule to the Regulations includes a graduate with a degree of B.Ed. or its equivalent as a permissible qualification for appointing teachers to the upper primary (middle school section) 
"Note : 1. For appointment of teachers for primary classes, basic teachers' training programme of 2 years' duration is required. BEd is not a substitute for basic teachers' training programme. 
2.Some of the States are having basic teachers' training courses of one year duration only, while in some other States students passing secondary level examination are admitted to primary level teacher training courses. Such States may, by 2005, conduct basic teachers' training programmes of a duration of not less than two years with admission being open to Senior Secondary/Intermediate pass candidates. In the meantime candidates who have undergone basic teachers' training courses of one year duration or were admitted to such training programmes after passing secondary level examination only may be given employment in the concerned States only." 
5.� The NCTE while framing its Regulations was aware of the fact that there were existing Regulations/Rules enforced in various States of the country. NCTE, therefore, directed that the existing recruitment Rules may be modified within a period of 3 years so as to bring them in conformity with the qualifications in the Schedules. It is not in dispute that the NCTE Act and Regulations framed thereunder have overriding effect on the State legislation and Rules or Regulations framed thereunder. The NCTE Act and Regulations are Parliamentary legislations under entry 66-A of the list 3 of the 7th Schedule of the Constitution of India and therefore, the qualification prescribed under the Regulations for appointment of teachers in Primary Schools would have overriding effect on the legislations framed by the State. 
6.� The NCTE, a statutory body constituted under the provisions of the NCTE Act, 1993 had directed the States to amend their Rules and incorporate the qualifications as prescribed under the Regulations for appointment of teachers in Primary Schools etc. The State of U.P. did not amend its Rules within a period of three years but it had taken more than 7 years to amend its Rules and it had amended its existing Rules in the year 2008 only to bring them in conformity with the NCTE Regulations. The petitioner's appointment was of the year 2004 and admittedly, as per the existing provisions in the Rules framed by 1978 Rules, B.Ed was not one of the essential qualifications. 
7.� A Division Bench of this Court in the judgment dated 09.01.2009 rendered in Special Appeal No.1461 of 2005: Committee of Management versus State of U.P. and others, and another connected Special Appeals had set aside the appointment of teachers who had B.Ed qualifications and their appointments were made before 1978 Rules had amended in the years 2008 on the ground that B.Ed was not one of the essential qualifications prescribed under the Rules. A full Bench of this Court in the case of Ram Surat Yadav and others versus State of U.P. and others had affirmed the aforesaid view of the Division Bench. 
8.� The teachers whose appointment was quashed by the Division Bench of this Court vide its judgment dated 09.01.2009 had approached the Supreme Court in Special Leave to Appeal (C) No(s) 14907/2009 along with Special Leave to Appeal (C) Nos.24549-24580 of 2011, 27396 of 2016, 26331 of 2009 and C.A. No.3904 of 2013 and the Supreme Court vide its final judgment and order dated 14.07.2017 had ordered as under:- 
"Heard learned counsel for the parties. 
Having regard to the fact that the petitioners have been in service for a long period, we are of the view that their appointments ought not be disturbed only on the ground of alleged lack of qualification which is contested by the petitioners.

9.� Once the Supreme Court has taken a view that the petitioners, who had B.Ed Degree and were appointed before 2008 i.e. before the date of amendment in the Rules, which came into existence in 1978, their appointment cannot be disturbed subsequently. The facts of the present case are identical to the facts of the cases which went to the Supreme Court and the Supreme Court ordered not to disturb the services of the petitioners.� 
10.� In view of the aforesaid judgment and order dated 14.07.2017 passed by the Supreme Court, the present petition is allowed. The respondents are directed not to disturb the services of the petitioner.

साथियो नमस्कार........
जैसा कि आप सभी विदित है कि RTE एक्ट का पूर्ण रूप से पालन न करते हुए प्रत्येक बर्ष बेसिक विभाग मे पदोन्नति की जा रही थी। जिसके विरुद्ध याचिका *11287/2018 Deepak sharma & others* माननीय हाइकोर्ट के एकल पीठ मे योजित की गई जिसके आदेश दिनांक 15 मई 2018 मे बिना टेट के पदोन्नति पर रोक लगा दी ।इस कोर्ट के आदेश के अनुक्रम मे *सचिव,बेसिक शिक्षा परिषद* ने आदेश जारी कर अगले आदेश तक सभी जनपदों मे पदोन्नति प्रक्रिया रोक दी।

इस प्रकार प्रदेश मे गलत तरीके से पदोन्नति पद को भरा जाना रुक गया।

इसके उपरांत *16523/2018 सूवेदार यादव & अन्य* ने एकल पीठ मे प्रमोशन मे टेट के विरुद्ध याचिका योजित की जिनका लक्ष्य बिना टेट के पदोन्नति प्राप्त करना था।परन्तु कोर्ट ने यह कहते हुए इनकी याचिका ख़ारिज कर दी कि याचिका 11287/2018 Deepak sharma & others मे पारित आदेश दिंनाक 15 मई मे कोई गलत नही है और कोर्ट ने finally प्रमोशन मे टेट लागू करते हुए सूवेदार यादव एवं अन्य की याचिका ख़ारिज की।.....
इस ख़ारिज आदेश के खिलाफ सूवेदार यादव एवं अन्य खण्ड पीठ(DB) मे गए जिसकी सुनवाई 4 सितम्बर लगी है।

इस *DB मुक़दमे* मे मुख्यता *याचिका Deepak Sharma & others* मे पारित आदेश को ही चैलेंज किया है,...

*अतः हमको भी इस मुक़दमे मे अपना पक्ष मजबूती से रखना है।*

विशेष:- 
*मोर्चा द्वारा योजित मुक़दमे 11287/2018 दीपक शर्मा एवं अन्य से पारित आदेश से गणित/विज्ञान शिक्षक/शिक्षिका साथियो को निम्न लिखित लाभ होंगे।*
