आखिरकार प्रशिक्षु शिक्षकों को आंदोलन खत्म करने का निर्णय लेना ही पड़ा। सचिव बेसिक शिक्षा परिषद संजय सिन्हा ने प्रशिक्षुओं से साफ कह दिया कि 10 नवंबर के पहले उनकी मौलिक नियुक्ति नहीं करा सकते, अब जारी आदेश में कोई संशोधन नहीं होगा। प्रशिक्षु शिक्षकों ने दिन भर गरजने के बाद शाम को आंदोलन खत्म करने का निर्णय लिया। हालांकि कार्य बहिष्कार पर वह अब भी अड़े हैं। उनका कहना है कि वे सहायक अध्यापक बनने के बाद ही स्कूलों में पढ़ाएंगे।
बेसिक शिक्षा परिषद के विद्यालयों में तैनाती पाने वाले 43 हजार प्रशिक्षु शिक्षक प्रशिक्षण एवं मूल्यांकन परीक्षा पास करने के बाद मौलिक नियुक्ति के लिए दबाव बनाए थे। इसके लिए सोमवार से शिक्षा निदेशालय में सचिव बेसिक शिक्षा परिषद कार्यालय के सामने कार्य बहिष्कार कर बेमियादी धरने पर बैठे थे। यहां प्रदेश भर के प्रशिक्षु पहुंचे व तीन दिन बाद बुधवार दोपहर बाद सचिव बेसिक शिक्षा परिषद सिन्हा ने मौलिक नियुक्ति के लिए बेसिक शिक्षा अधिकारियों को आदेश जारी कर दिया। इसमें 25 अक्टूबर तक जिलों में विज्ञप्ति जारी करने एवं 10 नवंबर तक सारी प्रक्रिया पूरी करने का स्पष्ट निर्देश दिया गया है। इस आदेश के बाद भी प्रशिक्षु शिक्षकों ने एलान किया उनका धरना कार्य बहिष्कार जारी रहेगा, क्योंकि नियुक्ति की समयावधि काफी अधिक रखी गई है इसे घटाकर 31 अक्टूबर किया जाए। इसी आधार पर गुरुवार को भी निदेशालय में प्रशिक्षु शिक्षकों का धरना दिन भर चला और इस दौरान सचिव बेसिक शिक्षा परिषद पर समयावधि घटाने के लिए दबाव बनाया गया, लेकिन उन्होंने ऐसा करने से साफ इनकार कर दिया। साथ ही विज्ञप्ति जारी करने के लिए बेसिक शिक्षा अधिकारियों पर दबाव बनाया जाएगा।इस समय प्रदेश के सभी जिला शिक्षा एवं प्रशिक्षण संस्थान (डायट) में बीटीसी 2014 की काउंसिलिंग चल रही है। दूसरी ओर बेसिक शिक्षा अधिकारी कार्यालय पर विज्ञान व गणित शिक्षकों की काउंसिलिंग चल रही है। 26 अक्टूबर से 15 हजार शिक्षकों की भर्ती काउंसिलिंग शुरू होगी एवं चार नवंबर से काउंसिलिंग का दूसरा चरण शुरू होगा। इसी बीच 22 से 24 अक्टूबर तक दशहरा एवं मोहर्रम के अवकाश हैं। ऐसे में प्रशिक्षु शिक्षकों की काउंसिलिंग 10 नवंबर के पहले पूरी करा पाना संभव ही नहीं है।शिक्षा निदेशालय में मांगों को लेकर धरने पर बैठे टीईटी अभ्यर्थी

प्रशिक्षु शिक्षक लखनऊ रवाना

बिसौली। प्रदेश नेतृत्व के आह्वान पर सामूहिक कार्यबहिष्कार कर रहे प्रशिक्षु शिक्षक गुरुवार को ब्लाक संसाधन केंद्र से लखनऊ रवाना हुए। सभी प्रशिक्षु शिक्षक पहले ब्लाक संसाधन केंद्र पर एकत्र हुए और एक सामूहिक मीटिंग की। संघ के ब्लाक अध्यक्ष विनीत यादव ने कहा कि जब तक हमारी मांगे पूरी नहीं होंगी, तब तक सामूहिक कार्य बहिष्कार चलता रहेगा। प्रशिक्षु शिक्षकों का कहना था कि उन्हें कार्य करते हुए आठ माह बीत गए, लेकिन वेतन का भुगतान नहीं किया गया है। लखनऊ रवाना होने बालों में सीमा रानी, रितु, सविता, पूजा चौहान, परमेंद्र, योगेश, नवीन, मीनाक्षी, राजकुमारी रीना, हरवीर सिंह, निवेदिता राय, उरूज, विजय सक्सेना, विमला गौतम, सनोज कुमार, जाकिर हुसैन, प्राची गुप्ता, सुनील गौतम आदि मौजूद रहे

प्रशिक्षु शिक्षकों ने बीएसए दफ्तर पर दिया धरना

बदायूं। मौलिक नियुक्ति और मानदेय आदि की मांग को लेकर आज जिले के स्कूलों में तैनात प्रशिक्षु शिक्षकों ने जिला बेसिक शिक्षाधिकारी कार्यालय पर धरना दिया। उन्होंने अपनी मंगों से संबंधित निदेशक बेसिक शिक्षा परिषद को संबोधित ज्ञापन बीएसए को दिया।
कई दिनों से प्रशिक्षु शिक्षकों अपनी तीन सूत्रीय मांगों को लेकर कार्य बहिष्कार पर हैं। आज प्रांतीय आह्वान पर उन्होंने अपनी मांगों के समर्थन में बीएसए कार्यालय पर धरना दिया। उनके द्वारा दिए गए ज्ञापन में कहा गया है कि प्रथम चरण में आयोजित की गई परीक्षा का परिणाम घोषित हो चुका है। एक माह के अंदर मौलिक नियुक्ति की जानी चाहिए मगर अभी तक नहीं की गई है। जिन प्रशिक्षुओं ने छह माह का प्रशिक्षण कर लिया है उनकी परीक्षा का कार्यक्रम घोषित किया जाए। यह भी कहा है कि अक्तूबर माह तक का मानदेय तत्काल जारी किया जाए। यदि इन मांगों को जल्द पूरा नहीं किया गया तो प्रशिक्षु शिक्षक कार्य बहिष्कार और बेमियादी धरना-प्रदर्शन को बाध्य होंगे।

18 अक्तूबर को डीएम के साथ होगी वार्ता इसके बाद होगा फैसला

रामपुर। शिक्षामित्रों ने वेतन को लेकर बीएसए दफ्तर में शुरू की गई भूख हड़ताल अफसरों के मान मनौव्वल के बाद स्थगित कर दी। भूख हड़ताल स्थगित कराने के लिए अफसरों और शिक्षामित्रों के बीच आधी रात तक बातचीत चली। डीएम के आश्वासन के बाद हड़ताल स्थगित करने का ऐलान किया गया। अब शिक्षामित्रों की मीटिंग 18 अक्तूबर को डीएम के साथ रखी गई है। इसमें बेसिक शिक्षा विभाग के लेखाधिकारी और शिक्षामित्र अपनी मांगों को लेकर पक्ष रखेंगे।
शिक्षामित्र से शिक्षक बने शिक्षामित्रों का समायोजन हाईकोर्ट की ओर से रद कर दिया गया है। उन्हें अभी शिक्षक पीरियड का वेतन नहीं दिया गया है। वेतन को लेकर शिक्षामित्रों ने बुधवार को बेमियादी भूख हड़ताल शुरू कर दी थी। इससे विभाग के साथ ही प्रशासनिक अमले में खलबली मच गई थी। पंचायत चुनाव के बीच शिक्षामित्रों की भूख हड़ताल शुरू हो जाने से सरकारी अमले ने अपने स्तर से इस मसले को हल करने की कवायद शुरू की। सिटी मजिस्ट्रेट मदन गर्बियाल, एसडीएम सदर अरविंद कुमार मिश्रा और सीओ सिटी आले हसन भूख हड़ताल खत्म कराने के लिए बुधवार रात बीएसए दफ्तर पहुंचे। दो घंटे से भी ज्यादा समय तक मान मनौव्वल का दौर चला। कई दफा वार्ता बेनतीजा भी हुई। आधी रात में शिक्षामित्रों के नेताओं और अफसरों के बीच अंतिम वार्ता हुई। डीएम से भी वार्ता कराई गई। डीएम के आश्वासन के बाद भूख हड़ताल वापस लेने की घोषणा कर दी गई। आदर्श शिक्षामित्र वेलफेयर एसोसिएशन के जिलाध्यक्ष सैयद जावेद मियां ने बताया कि अफसरों ने वेतन को लेकर आवश्यक कार्रवाई का भरोसा दिया है। 18 अक्तूबर को डीएम के साथ मीटिंग रखी गई है। इसमें विभाग के लेखाधिकारी भी मौजूद रहेंगे। यदि इस वार्ता में भी वेतन को लेकर कोई निर्णय नहीं लिया गया तो शिक्षामित्र फिर से आंदोलन की राह पकड़ेंगे। इस मौके पर राजपाल सिंह मौैर्य, होरी लाल सैनी, अवधेश मिश्रा समेत अन्य शिक्षामित्र मौजूद रहे।

बीटीसी-2012 डिग्री धारकों को सहायक अध्यापक भर्ती में शामिल करने का आदेश
•इलाहाबाद(ब्यूरो)। प्राथमिक विद्यालयों में सहायक अध्यापकों के 15 हजार पदों पर भर्ती की प्रक्रिया में हाईकोर्ट ने बीटीसी 2012 के डिग्री धारकों को भी शामिल करने का आदेश दिया है। हालांकि इनका चयन अदालत के अंतिम निर्णय के आधीन होगा। फतेहपुर के ध्रुवलाल सिंह सहित अन्य लोगों ने याचिका दाखिल की है जिस पर न्यायमूर्ति पीकेएस बघेल सुनवाई कर रहे हैं। 15000 पदों पर भर्ती के लिए सरकार ने 2008 के बीटीसी उत्तीर्ण डिग्री धारकोें को शामिल किया है। इस बैच का परिणाम 19 अगस्त 2015 को जारी हुआ। इसी दिन वर्ष 2012 बैच का परिणाम भी जारी हुआ इसके बावजूद सरकार ने 2008 वालों को भर्ती में शामिल कर लिया और 2012 वालों को रोक दिया है।

शिक्षामित्र मामले की सुनवाई 2 नवंबर को

कानपुर। इलाहाबाद हाईकोर्ट से सहायक अध्यापक पद का समायोजन रद होने के बाद अब मामले की सुनवाई 2 नवंबर 2015 को सुप्रीम कोर्ट में होनी है। यूपी के प्राथमिक विद्यालयों में तैनात 1.34 लाख शिक्षामित्रों का समायोजन सहायक अध्यापक पद पर हुआ था। 34 हजार शिक्षामित्रों की ज्वाइनिंग जल्द होनी थी लेकिन इलाहाबाद हाईकोर्ट ने सबका समायोजन रद कर दिया था।
उत्तर प्रदेश टीईटी संघर्ष मोर्चा के महामंत्री दुर्गेश प्रताप सिंह ने बताया कि जून 2014 में मानव संसाधन विकास मंत्रालय से आरटीआई के तहत मिली सूचना का पूरा ब्योरा हलफनामे के साथ सुप्रीम कोर्ट में दाखिल किया गया है। आरटीआई के जवाब में मंत्रालय ने कहा है कि शिक्षकों की नियुक्ति की नियमावली या फिर अर्हता में किसी तरह का फेरबदल नहीं किया जा सकता। नियुक्ति की अर्हता नेशनल काउंसिल फॉर टीचर एजूकेशन (एनसीटीई) तय करती है। शिक्षक पात्रता परीक्षा (टीईटी) सहित अर्हता के अन्य मामलों में केंद्र सरकार सीधे छूट नहीं दे सकती। यह अधिकार सिर्फ एनसीटीई की पास है।

Heard learned counsel for the parties.

Inspite of opportunity having been given, the complete instructions have not been provided to the learned standing counsel.

The contention of learned counsel for petitioner is that he possesses the qualification of B. Pharma for the purposes of selection and appointment to the post of Assistant Teacher. He should be considered for appointment to the post of Assistant Teacher Math/Science but the opposite parties are not doing so. He relies upon the pronouncement of this Court dated 11.09.2015 in Writ-A No.39466 of 2014 (Satyendra Kumar Singh and others vs. State of U.P. and others).

In the facts of the present case, without adjudicating the merits of the claim of the petitioner, the writ petition is disposed of with liberty to the petitioner to submit a proper representation along with certified copy of this order before the opposite party no.4 i.e. District Basic Education Officer, Lakhimpur Kheri raising his claim within a period of ten days. In such an eventuality, the opposite party no.4 shall consider and decide the same within a period of next one month.

With the aforesaid observation, the writ petition is disposed of.

1. Heard learned counsel for the petitioners and perused the record.

2. The petitioners have sought following reliefs:-

"a. To, issue a writ order or direction in the nature of mandamus commanding the respondent authorities not to allow counseling to such professional degree holders, who are not eligible as per advertisement/notification dated 23.8.2013 as clarified by the Secretary Basic Education Board in its affidavit filed before the Lucknow Bench of this Hon. Court in Writ Petition No. 5348 of 2013.

b. To, issue a writ order or direction in the nature of mandamus directing the respondent authorities to exclude those candidates who are illegally allowed to appear in different districts in the counseling held on 7th , 8th, 23rd and 24th July, 2014 and the authorities may be directed not to consider their candidatures while finalizing the selection on the post of Assistant Teacher in Senior Basic School (Mathematics and Science subjects) and pass an appropriate orders within the stipulated period as fixed by this Hon'ble Court.

c. To, issue a writ order or direction in the nature of mandamus directing the respondent authorities to hold counseling in accordance with the Government Order dated 23.8.2014 and allow only those candidates who are eligible as per the aforesaid Government Order."

3. It is contended that the issue raised in this petition is squarely covered by Paragraph nos. 72 and 73 of the judgment of this Court passed in Writ Petition No. 57476 of 2013 Shiv Kumar Pathak and others versus State of U.P. and others, decided on 18.8.2015 which read as under:

"72. The sole writ petition in Group-D is Writ Petition No. 15541 of 2015. It has been filed by 5 petitioners, namely, Rohit Kumar, Arvind Kumar, Mukesh Kumar Yadav, Buddhi Lal and Shailendra Kumar, seeking a mandamus directing respondents not to allow counseling to such professional degree holders, who are not eligible as per advertisement/notification dated 23.8.2013, as clarified by Secretary, Basic Education Board in its affidavit filed before Lucknow Bench of this Court in Writ Petition No. 5348 of 2013 and to exclude such candidates from the zone of consideration. It is suggested that the candidates possessing degree of B.Sc. (Agriculture), B.Tech., B.C.A., B.B.A., BUMS, MHMUS and B.Pharma are not eligible to apply for the post of Assistant Teacher in Sr. P.S. since these are professional degrees and cannot be treated to be Science graduation degree so as to make them eligible to participate in the aforesaid selection. Names of some of candidates are given in Para 24 of the writ petition, though none of them has been made party in the writ petition.

73. I find basic submission absolutely fallacious and misconceived. Though degrees of B.Sc. (Agriculture), B.Tech., B.C.A., B.B.A., BUMS, MHMUS and B.Pharma etc. provide education in certain fields making the incumbents professional in a particular aspect, and, therefore, they are called "professional course", but it cannot be doubted at all that these all are bachelor degrees and, therefore, those, who possess these qualifications, are graduates in those disciplines. It, thus, cannot be said that when requirement is graduation, professional courses can be excluded. It is nothing but reading something which is not provided in the Rules, which, in my view, is neither permissible nor there is any compulsion to do so. In view thereof, this writ petition, in my view, lacks merits and deserves to be dismissed."

4. It is contended that the issue raised in this writ petition is covered by the aforesaid judgment, therefore, the writ petition should be dismissed.

5. Shri Shailendra, learned counsel appearing for petitioners contended that the issue raised is not the same as has been decided by this Court in Shiv Kumar Pathak and others (Supra). Therein the issue was, as to whether the candidates possessing degree in professional courses can be said to possess graduate degree or not and that was decided. However, in some of the professional courses the candidates did not have as a subject Science and Mathematics which was an essential qualification required to be possessed by a candidate in order to become eligible for appointment to the post of Assistant Teacher in Senior Basic Schools (Mathematics and Science subjects).

6. I find substance in what is submitted by Shri Shailendra. The issue raised in this petition was not raised in earlier petition and, therefore, it cannot be said that this writ petition is covered by the judgment dated 18.08.2015 passed in Shiv Kumar Pathak and others (Supra).

7. However, the short submission is that as per the advertisement in order to become eligible, the candidates must possess graduation degree with one of the subject (Mathematics and Science) in the said course.

8. It is contended that in some of the professional courses the subjects Mathematics and Science did not form part of syllabus and therefore, such candidates possessing such professional courses are not eligible.

9. In my view, this is a factual dispute and cannot be examined by this Court, at this stage, since it requires investigation of an individual case of the candidates called for counseling. Let this examination be made by the concerned authorities at the time of counseling or in any case before making appointment. I leave it open to petitioners to raise this plea before the respondents. Further, I direct the Competent Authority to examine the eligibility of each and every candidate possessing professional course degree as to whether, he is eligible in terms of advertisement or not, i.e., whether Science and Mathematics was one of the subject in graduation course, and, thereafter only it will allow counseling. In any case the same exercise would be done by the Competent Authority before appointment, if not already done, at the time of counseling and no person ineligible shall be appointed.

10. With the aforesaid direction, this writ petition is disposed of.

The petitioner is a candidate for appointment on the post of Assistant Teacher. It is stated that in response to an advertisement issued in the year 2011, for appointment on the post of Assistant Teacher in Primary School in district Allahabad, the petitioner was called for counseling and she has qualified in the third counseling but no further action has been taken for the appointment of the petitioner.�

From the record it transpires that petitioner has made a representation to the second respondent who has issued direction to the fourth and fifth respondent to consider the grievance of the petitioner. The said communication dated 29th September, 2015, has been brought on record as Annexure-6 to the writ petition. The petitioner without waiting for a reasonable time has rushed to this Court.

In view of the direction of the second respondent, I do not find any ground to interfere in the matter. The Court hope and trust that fourth and fifth respondent shall comply the direction of the second respondent expeditiously preferably within a period of six weeks from the date of communication of this order.

With the aforesaid observations the writ petition is finally disposed of.

No order as to costs.

In pursuance of the order dated 07.10.2015, learned counsel for the applicant has informed Sri A.K. Yadav but he is not present.

The present contempt application has been filed for punishing the Opposite Party for willful disobedience of the judgment and order dated 30.4.2015 passed by this Court in Writ-A No. 24818 of 2015 ( Santosh Kumar Mishra and others Vs. State of U.P. and others), wherein this Court has observed as under :-

"Heard Sri Anoop Trivedi, learned counsel for petitioner, learned Standing Counsel for respondent No.1 and Sri A.K. Yadav for respondent No.2.

The petitioners claim that they have been selected for appointment as Assistant Teacher in primary schools but they have not been issued any appointment letter.

A similar controversy by some other selected candidates had come up for consideration before learned single Judge in Writ Petition No.28686 of 2014 (Brahm Dev Yadav and others Vs. State of U.P. and others). It was decided vide judgment and order dated 29.5.2014 directing respondents-authorities to complete process of making actual appointments within a period of two months and ensure that appointed persons join their respective posts within a fortnight thereafter.

The aforesaid order has been upheld by the Division Bench in special appeal.

In view of the aforesaid facts and circumstances, with the consent of the parties, the writ petition is disposed of in same terms and conditions as contained in the judgment and order dated 29.5.2014 passed in the above referred writ petition."

The submission is that Opposite Party No. 1, U.P. Basic Education Board, Allahabad has already issued necessary order dated 15.9.2015 whereby it is directed that the eligible candidates should be issued appointment letter within a time bound period.

In view of the allegations made in the supporting affidavit to the contempt application, prima facie, a case for punishing the opposite party No. 2 for willful disobedience of the judgment and order dated 30.4.2015 is made out.

Issue notice to the opposite party No. 2-Basic Education Officer, Chitrakoot to show cause by appearing in person as to why charge be not framed for punishing him under Section 12 of Contempt of Courts Act for willful disobedience of the order dated 30.4.2015.

List on the date fixed by the office in the notice.
