राज्य ब्यूरो, इलाहाबाद : गर्मी की छुट्टी में गुपचुप तरीके से परिषदीय शिक्षकों का जिले के अंदर तबादले का बड़े पैमाने पर खेल चला। जिले से लेकर बेसिक शिक्षा परिषद मुख्यालय तक एक ‘तंत्र’ बन गया था, जिसने तबादलों को अंजाम दिया। संभल के बीएसए ने बिना अनुमोदन लिए 200 से अधिक तबादले कर दिए, सो वह निलंबित हो गए हैं, लेकिन प्रदेश में ऐसे कई बेसिक शिक्षा अधिकारी हैं, जिन्होंने मनमाने तरीके से फेरबदल किया है।

उनकी जांच तक नहीं हुई है। हालांकि अब शासन ने सभी बीएसए से जिले के अंदर हुए तबादलों की नए सिरे से रिपोर्ट मांगी है। बेसिक शिक्षा परिषद के शिक्षकों का तबादला एवं समायोजन हर साल होता है। हर बार के नियम भी बदलते रहते हैं। इस बार सभी का जोर अंतर जिला तबादलों पर रहा है, आम शिक्षक एवं शिक्षक संगठन यही रट लगाए थे। ऐसे में काफी देर से ही सही अंतर जिला तबादले का आदेश जारी हुआ। इसके पहले प्रदेश के सभी जिलों में जिले के अंदर तबादले की प्रक्रिया बिना किसी औपचारिक निर्देश के शुरू हो गई। एक महीने में हजारों की तादाद में तबादले कर दिए गए

रेगिस्तानी मैदान से एक साथ कई ऊंट अपने मालिक के साथ जा रहे थे। अंधेरा होता देख मालिक ने एक सराय में रुकने का आदेश दे दिया। निन्यानवे ऊंटों को जमीन में खूंटियां गाड़कर उन्हें रस्सियों से बांध दिया मगर एक ऊंट के लिए खूंटी और रस्सी कम पड़ गई। सराय में खोजबीन की , पर व्यवस्था हो नहीं पाई। तब सराय के मालिक ने सलाह दी कि तुम खूंटी गाड़ने जैसी चोट करो और ऊंट को रस्सी से बांधने का अहसास करवाओ।

यह बात सुनकर मालिक हैरानी में पड़ गया , पर दूसरा कोई रास्ता नहीं था , इसलिए उसने वैसा ही किया। झूठी खूंटी गाड़ी गई , चोटें की गईं। ऊंट ने चोटें सुनीं और समझ लिया कि बंध चुका है। वह बैठा और सो गया। सुबह निन्यानबे ऊंटों की खूटियां उखाड़ीं और रस्सियां खोलीं , सभी ऊंट उठकर चल पड़े , पर एक ऊंट बैठा रहा। मालिक को आश्चर्य हुआ – अरे , यह तो बंधा भी नहीं है , फिर भी उठ नहीं रहा है। सराय के मालिक ने समझाया – तुम्हारे लिए वहां खूंटी का बंधन नहीं है मगर ऊंट के लिए है।

जैसे रात में व्यवस्था की , वैसे ही अभी खूंटी उखाड़ने और बंधी रस्सी खोलने का अहसास करवाओ। मालिक ने खूंटी उखाड़ दी जो थी ही नहीं , अभिनय किया और
रस्सी खोल दी जिसका कोई अस्तित्व नहीं था। इसके बाद ऊंट उठकर चल पड़ा।
न केवल ऊंट बल्कि मनुष्य भी ऐसी ही खूंटियों से और रस्सियों से बंधे होते हैं जिनका कोई अस्तित्व नहीं होता। मनुष्य बंधता है अपने ही गलत दृष्टिकोण से , मिथ्या सोच से , विपरीत मान्यताओं की पकड़ से। ऐसा व्यक्ति सच को झूठ और झूठ को सच मानता है। वह दोहरा जीवन जीता है। उसके आदर्श और आचरण में लंबी दूरी होती है।
इसलिए जरूरी है कि मनुष्य का मन जब भी जागे , लक्ष्य का निर्धारण सबसे पहले करे। बिना उद्देश्य मीलों तक चलना सिर्फ थकान, भटकाव और नैराश्य देगा , मंजिल नही। स्वतंत्र अस्तित्व के लिए मनुष्य में चाहिए सुलझा हुआ दृष्टिकोण, देश , काल , समय और व्यक्ति की सही परख , दृढ़ संकल्प शक्ति , पाथेय की पूर्ण तैयारी , अखंड आत्मविश्वास और स्वयं की पहचान

एक गाँव में जिलाधिकारी महोदय नसबंदी के महत्व और उपयोगिता के बारे में ग्राम सेवकों की एक सभा में भाषण कर रहे थे। भाषण के बाद उन्होंने कहा कि अगर कोई सवाल पूछना चाहे तो पूछ सकता हैं।

एक गाँव में जिलाधिकारी महोदय नसबंदी के महत्व और उपयोगिता के बारे में ग्राम सेवकों की एक सभा में भाषण कर रहे थे।
भाषण के बाद उन्होंने कहा कि अगर कोई सवाल पूछना चाहे तो पूछ सकता हैं।

एक ग्राम सेवक खड़ा हुआ और हाथ जोड़ कर बोला - साहब माफ़ किया जाए एक अटपटा सवाल पूछ रहा हूँ.. पर यह मेरा सवाल नहीं हैं सारे गाँव वाले पूछते हैं।
जिलाधिकारी महोदय ने उसे सवाल पूछने की अनुमति दे दी।

ग्राम सेवक ने कहा - जी गाँव वाले पूछते हैं की क्या जिलाधिकारी महोदय ने नसबंदी कराई है..?
जिलाधिकारी महोदय ने कहा - नहीं मैंने नसबंदी नहीं कराई है।

ग्राम सेवक ने पूछा - सरकार गाँव वाले पूछते है की क्या कमिश्नर महोदय ने नसबंदी कराई है..?
जिलाधिकारी महोदय ने कहा - जहाँ तक मुझे जानकारी है कमिश्नर महोदय ने भी नसबंदी नहीं कराई है।

ग्राम सेवक ने पूछा - जी गाँव वाले पूछते है कि क्या मंत्रालय के सचिव महोदय ने नसबंदी कराई है..?
जिलाधिकारी महोदय ने कहा - मैं तुम्हारा सवाल समझ गया..!
देखो, हम सब पढ़े-लिखे लोग हैं..!
हम बिना नसबंदी कराए ही परिवार नियोजन करते हैं।

ग्राम सेवक ने कहा - तो हमें भी पढ़ाओ-लिखाओ, हमारे पीछे क्यों पड़े हो..?

याची शिक्षिका की नौकरी के लिए चयनित हो गयी , लेकिन टेट कवलिफिकेशन होने के कारण उसने 2 वर्ष की छूट मांगी ,
निचली अदालत केट ने क्लाज़ 4 को निरस्त कर याची को राहत दी , लेकिन शिक्षा विभाग फिर भी नहीं माना , तब दिल्ली उच्च न्यायलय ने याची को राहत दी

याची ने शिक्षिका बनने के लिए फॉर्म भरा , लेकिन साथ ही याची के सीटेट परिणाम आ गया जिसमे वो फेल हो गयी थी , परिणाम को देखते हुए भयवश
याची ने सी टेट पास करने के लिए दिल्ली शिक्षा विभाग से 2 वर्ष का समय माँगा , लेकिन कोई जवाब नहीं मिला ।

इसके बाद याची ने केंद्रीय प्रसाशनिक न्यायधिकरण में याचिका दाखिल की , और कोर्ट ने याची को राहत देते हुए NCTE गाइड लाइन 08 . 0 १। 2010 क्लाज़ 4 को निरस्त कर दिया ।

इसके बाद भी शिक्षा विभाग से राहत न मिलने पर याची ने दिल्ली उच्च न्यायलय में केस लड़ा , जहाँ उसे फिर से राहत प्रदान करते हुए टेट पास
न करने की छूट गयी ।

1. Challenge in this writ petition is to the order dated 12.02.2015 passed by
the Central Administrative Tribunal(hereinafter referred to for short as „the
Tribunal‟) by which the Tribunal while setting aside Clause 4 of the
Guidelines dated 08.11.2010 declined to allow other reliefs as sought by
the petitioner in the OA filed before the Tribunal.
2. The necessary facts to be noticed are that the respondents had issued an
Advertisement no.01/13(Post Code 01/13) for the post of Special Education
Teacher under Directorate of Education, Government of NCT of Delhi. In
response to the aforesaid advertisement, the petitioner applied for the post
of Special Education Teacher under the Directorate of Education. It is the
case of the petitioner that at the time of submission of the form, though her

result for the previous Central Teacher Eligibility Test(CTET) examination
was awaited, but being of the view that the petitioner would be able to clear
the same, she marked herself as „CTET-qualified‟ in the form. However,
on receiving her CTET result later on, she came to know that she had not
been able to clear the CTET Exam and missed the qualifying mark by a
few points.
3. The petitioner was issued an admit card for the exam for the Post Code
01/13 and she appeared in the exam held on 28.04.2013. It is the case of
the petitioner that as the petitioner apprehended that her candidature will be
rejected inasmuch as she was not CTET qualified at that point of time, she
made a representation to the respondents no.1, 3 and 4 requesting them that
the petitioner may be granted two year‟s time for acquiring CTET
qualification and, in the meanwhile, she may be considered for recruitment
to the post of Special Education Teacher in terms of the advertisement
no.01/13. However, no response to the aforesaid representation was
received by the petitioner.
4. Thereafter, the petitioner approached the Central Administrative Tribunal
seeking the following prayers:
“(i) Issue an appropriate order or direction thereby quashing the
clause 4 of the impugned guidelines dated 08.01.2010 of the
Ministry of Human Resource Development, respondent
no.4, whereby the said respondent no.4 in clause 4 thereof
has provided that the conditions of passing TET shall not be
relaxed by the Central Government, being arbitrary,
discriminatory, illegal, unconstitutional and violative of Art.
14,15,16,21 and 21-A of the Constitution of India and
contrary to the provisions of RTE Act, 2009 against Public
Interest and opposed to public policy.
(ii) Issue an appropriate order or direction thereby directing the
respondents no.1 and 2 to take up the matter with the
Central Government for grant of relaxation in the matter of
CTET qualification to the applicant for a period of 2 years
in terms of Section 23(2) of the RTE Act, 2009.

(iii) Issue an appropriate order or direction thereby directing the
respondent no.4/Central Government to consider the case of
the applicant for grant of relaxation in the qualification of
CTET upto March 31,2015.
(iv) Issue an appropriate order or direction thereby directing the
respondent no.3/DSSSB not to reject the candidature of the
applicant on the ground of non-qualification of CTET until
the disposal of the applicant‟s representation by the
respondents.”
5. The Tribunal has allowed the OA filed by the petitioners and quashed
Clause 4 of the Guidelines dated 08.11.2010. While disposing of the OA,
the following directions have been issued:
“In view of the aforementioned, we set aside Clause 4 of the
impugned guidelines issued vide No.1-15/2010-EE-4 dated
08.11.2010(Annexure A/1). It would be open to the respondents
to take up the matter for exercise of the powers conferred upon
the Central Government under Section 23(2) of the Right of
Children to Free and Compulsory Education Act, 2009, as per
procedure laid down in the aforementioned guidelines. The OA
stands disposed of.”
6. Counsel for the petitioner submits that, at this stage, the petitioner would be
satisfied if a time limit is fixed to enable the respondents to consider the
case of the petitioner under Section 23(2) of the Right of Children to Free
and Compulsory Education Act, 2009, as per procedure laid down in the
Guidelines.
7. Counsel for the respondents enter appearance on an advance copy.
8. We find the prayer of the counsel for the petitioner to be fair and just.
Accordingly, we direct the respondents no.1 and 2 to comply with the order
dated 12.02.2015. We also direct the respondents no.1 and 2 to consider
the case of the petitioner within a period of eight weeks from the date of
receipt of this order in accordance with law. This order is without
prejudice to the rights and contentions of the parties.

10. CM.APPL 762/2016 also stands disposed of.

मानसिक विकलांग डिसेबल्ड बच्चों इत्यादि के शिक्षक , और इन शिक्षकों के टेट पास करने के बारे में NCTE / RTE गाइड लाइंस में स्पष्ट रूप से कुछ कहा नहीं है , स्पेशल केटेगरी के शिक्षकों का सिलेबस भी टेट परीक्षा में क्लियर नहीं है

फ़िलहाल शिक्षिका बनाम बेसिक शिक्षा विभाग की अगली सुनवाई तक तलाक की अर्जी पर कोर्ट ने स्टे लगा दिया है

It is contended by the counsel for applicant that applicant is working as assistant teacher in a primary school in district Pratapgarh. Her husband has filed a divorce petition at Kanpur. It is stated that the institution where the applicant is posted, is a single teacher institution and when she goes to attend the proceedings at Kanpur, the institution has to be closed.
Issue notice to opposite party no. 2 returnable on 22.8.2018, indicating that he may file his reply on or before the next date fixed.

The registrations for Punjab TET (Teacher's Eligibility Test) are going on and the official notification regarding the same was released at the official website www.tetpunjab.com . Interested lot can submit their application on or before July 21 (up to 5 pm).
