The petitioners are three in number.� They are Assistant Teacher in a
Junior High School and imparts physical education in the concerned
institution.
It is contended on behalf of the petitioners that the Director of Basic
Education, U.P. Lucknow had issued a letter on 22.6.2011, to the Basic
Education Officers/Assistant Basic Education Officers, to provide salary of
the trained teachers to all the teachers who have obtained Certificate of
Physical Education (C.P.Ed.), during 1.1.1993 to 11.08.1997, from the date
of their initial training.�
Learned counsel for the petitioner has drawn the attention of the Court to
an order passed by the High Court of Uttaranchal at Nainital in Writ
Petition No. 646 of 2004(SS) (Kundan Singh Saun and 13 others v. State of
Uttaranchal and others), preferred by the similarly placed teachers of the
State of Uttarakhand for direction upon the State Government Uttarakhand to
make payment of salary to them in pay scale of 1100-1710 (revised
3600-5500) with admissible allowances. Their contention was that they are
working in various primary schools in the said State and they are holding
C.P.Ed. Certificate/Diploma and were appointed by the Basic Shiksha
Adhikari on a consolidated salary of Rs.850/- per month.
The Uttarakhand High Court considering the facts of the said case, held
that they are entitled for the regular pay scale from their initial
appointment. It is stated that in compliance of the order passed by the
Uttarakhand High Court, similarly placed teachers in Uttarakhand are
getting the salary in the aforesaid scale.
Sri V.K.Srivastava, learned counsel for the respondents submits that the
grievance of the petitioner may be considered by the appropriate authority.

From the record it transpires that� for the redressal of� his grievance the
petitioners� have made a representation to the fourth respondent.
Considering the facts and circumstances of the case, the writ petition is
finally disposed of with a direction upon the appropriate authority to
consider the grievance of the petitioner and pass appropriate order
expeditiously preferably within a period of four months from the date of
communication of this order.
No order as to costs.

The petitioners are three in number. They are candidates for the
appointment as Assistant Teachers. They are aggrieved by the order dated
10th October, 2015 issued by the third respondent, whereby he excluded the
petitioners from the zone of consideration.�
It is contended on behalf of the petitioners that vide Government Order
dated 09th December, 2014 a decision has been taken for the recruitment of
15000 Assistant Teachers in Primary Schools. In the said Government Order,
a detail schedule has been provided and the last date for submission of the
forms was fixed as 05th March, 2015.
It is stated that the petitioners have passed their two year regular BTC
Course and they have also cleared U.P. Teachers Eligibility Test (Primary
Level), thus they are qualified for the appointment on the posts of
Assistant Teacher (Primary School).
It is further contended on behalf of the petitioners that the last date was
extended twice by the respondents. It is submitted that second time the
last date was extended for those candidates who have obtained the Diploma
in Education (Special Education). The respondents have again, third time,
extended the last date in respect of the candidates who were within the
permissible age limit as on 1.7.2015 and who have passed Special BTC 2004,
2007 and 2008. The further direction has been issued for rejection of
remaining candidates. Consequent upon the said directions, the petitioners
shall be excluded from the zone of consideration.
It is stated that the petitioners' names find place in the mother list
prepared by the respondents as they have submitted their forms before the
last date i.e. 11th September, 2015.
Learned Counsel for the third respondent Sri B.P. Singh was
granted time to
seek instructions to verify the said fact. On the basis of instructions, he
submits that it is true that the petitioners' names are in the mother list.
Learned Counsel for the respondents may file counter affidavit within six
weeks. Rejoinder affidavit, if any, may be filed within a week thereafter.
List after expiry of the said period.
In view of the said submission the petitioners are allowed to participate
in the ensuing counselling, however, if they are selected, their
appointment shall abide by the result of this writ petition.
Having regard to the facts of the case, I find that in the interest of
justice, a general direction be issued upon the respondents as under:
(i) The similarly placed persons whose names are in the mother list, shall
be allowed provisionally to participate in the counselling; and,
(ii) In case they are selected, in their appointment letters it would be
clearly mentioned that their appointments shall be subject to the result of
this writ petition.�
The above general direction is issued with a view to save the invaluable
time of this Court from spate of the writ petitions on the similar grounds.

Selection and appointment of the petitioner on the post of Assistant
Teacher (Mathematics) has been cancelled on the ground that there were
three candidates with the same merit i.e. 65.60 and as there were only two
vacancies, therefore, those of higher age should have been appointed,
instead the petitioner was appointed, though she was having lessor age.
Contention of the learned counsel for the petitioner is that vacancies on
the post in question still exists. Further contention of the petitioner is
that one Rohit Pandey at Serial No.114 with the same marks has been allowed
to continue.
In these circumstances, though there is no reason to interfere with the
impugned order, it is provided that if there are vacancies on the post of
Assistant Teacher (Mathematics) having been advertised in the same
advertisement and the petitioner is within the cut-of-marks, then her
adjustment against the same shall be considered and requisite decision
shall be taken as per Rules within two weeks from the date a certified copy
of this order is produced before the opposite party no.4. the other
contention of the learned counsel for the petitioner regarding Rohit Pandey
shall also be considered by the opposite party no.4 while taking such
decision.
The writ petition is disposed of in the aforesaid terms.

The grievance of the petitioners is that they are appeared in the
examination of Trainee Assistant Teachers. In the meantime, they have been
offered appointment as Assistant Teacher in the Junior High School for
which the original documents are required to be deposited.
The petitioners seeks three months time to join on the post of Assistant
Teachers but this Court does not find any reason to grant the time,
instead, it is provided that the original documents shall be provided to
the petitioners within one week by the Basic Education Officer of the
concerned districts on the petitioners' appearance in the office of the
Basic Education Officer. Based thereon the petitioner shall submit their
joining on the next date by submitting their original documents failing of
which, they shall not be entitled to join on the post of Assistant Teacher
in Junior High School.
With the aforesaid observations, the writ petition is disposed of.

सुल्तानपुर (ब्यूरो)। बीते दिनों उच्च प्राथमिक विद्यालयों में नियुक्त गणित-विज्ञान के 31 शिक्षकों का वेतन आदेश जारी हुआ है। सभी शिक्षक पूर्व में प्राथमिक विद्यालयों में नियुक्त रहे हैं।
जिला बेसिक शिक्षा अधिकारी ने 31 शिक्षकों का वेतन आदेश जारी करते हुए कहा है कि पूर्व में ये शिक्षक प्राथमिक विद्यालयों में कार्यरत रहे हैं। इन सभी शिक्षकों के शैक्षणिक अंकपत्र एवं अन्य प्रमाण पत्र सत्यापित कराए जा चुके
हैं। 31 शिक्षकों में 30 इसी जनपद में स्थित प्राथमिक विद्यालयों में कार्यरत रहे हैं, जबकि एक शिक्षिका जौनपुर जनपद में प्राथमिक विद्यालय में कार्यरत थी।
नवनियुक्त अध्यापक जितेंद्र मौर्य, अजय विक्रम सिंह, अभिनव निखर, मनीष सिंह सहित कई शिक्षकों ने बताया कि इतने कम समय में वेतनमान देने वाला सुल्तानपुर
पहला जनपद है। गौरतलब है कि गत 20 सितंबर को उच्च प्राथमिक विद्यालयों में गणित एवं विज्ञान विषय में कुल 394 अभ्यर्थियों को नियुक्ति पत्र जारी हुआ था।
बीएसए रमेश यादव ने बताया कि उच्च प्राथमिक विद्यालयों में नियुक्ति पाए अन्य शिक्षकों के भी वेतन आदेश जारी करने के लिए शैक्षणिक प्रमाण पत्रों के सत्यापन का कार्य प्रारंभ है। सत्यापन के बाद शिक्षकों का वेतन जारी किया जाएगा।
