The petitioners are three in number.� They are Assistant Teacher in a
Junior High School and imparts physical education in the concerned
institution.
It is contended on behalf of the petitioners that the Director of Basic
Education, U.P. Lucknow had issued a letter on 22.6.2011, to the Basic
Education Officers/Assistant Basic Education Officers, to provide salary of
the trained teachers to all the teachers who have obtained Certificate of
Physical Education (C.P.Ed.), during 1.1.1993 to 11.08.1997, from the date
of their initial training.�
Learned counsel for the petitioner has drawn the attention of the Court to
an order passed by the High Court of Uttaranchal at Nainital in Writ
Petition No. 646 of 2004(SS) (Kundan Singh Saun and 13 others v. State of
Uttaranchal and others), preferred by the similarly placed teachers of the
State of Uttarakhand for direction upon the State Government Uttarakhand to
make payment of salary to them in pay scale of 1100-1710 (revised
3600-5500) with admissible allowances. Their contention was that they are
working in various primary schools in the said State and they are holding
C.P.Ed. Certificate/Diploma and were appointed by the Basic Shiksha
Adhikari on a consolidated salary of Rs.850/- per month.
The Uttarakhand High Court considering the facts of the said case, held
that they are entitled for the regular pay scale from their initial
appointment. It is stated that in compliance of the order passed by the
Uttarakhand High Court, similarly placed teachers in Uttarakhand are
getting the salary in the aforesaid scale.
Sri V.K.Srivastava, learned counsel for the respondents submits that the
grievance of the petitioner may be considered by the appropriate authority.
From the record it transpires that� for the redressal of� his grievance the
petitioners� have made a representation to the fourth respondent.
Considering the facts and circumstances of the case, the writ petition is
finally disposed of with a direction upon the appropriate authority to
consider the grievance of the petitioner and pass appropriate order
expeditiously preferably within a period of four months from the date of
communication of this order.
No order as to costs.
