UPTET -28 अक्टूबर को शिक्षक पात्रता परीक्षा 2018, दिसंबर में शिक्षक भर्ती परीक्षा >>17 सितंबर से ऑनलाइन पंजीकरण पांच अक्टूबर तक आवेदन ’>>29 अक्टूबर को आंसर की और रिजल्ट नवंबर के अंत तक राज्य ब्यूरो, लखनऊ : प्रदेश सरकार बेसिक शिक्षा परिषद के स्कूलों में सहायक अध्यापक भर्ती की दूसरी परीक्षा तैयारियों में जुट गई है। शासन तय समय से पहले दोनों परीक्षाएं कराने जा रहा है। उत्तर प्रदेश शिक्षक पात्रता परीक्षा यानी यूपी टीईटी 2018 की समय सारिणी जारी हो गई है। परीक्षा 28 अक्टूबर को दो पालियों में होगा। परीक्षा परिणाम नवंबर के अंत तक आने की उम्मीद है। परिषदीय प्राथमिक स्कूलों में सहायक अध्यापक भर्ती की लिखित परीक्षा में सफल 41556 को नियुक्ति पत्र पांच सितंबर को दिया जाना है। काउंसिलिंग शुरू होने से पहले ही शासन ने अगली भर्ती की प्रथम चरण की परीक्षा यानी यूपी टीईटी 2018 का विस्तृत कार्यक्रम जारी हुआ है। परीक्षा नियामक प्राधिकारी सचिव उप्र इलाहाबाद को जिम्मेदारी सौंपी गई है। टीईटी का विज्ञापन 15 सितंबर को और ऑनलाइन आवेदन 17 सितंबर अपरान्ह से शुरू होगा। पंजीकरण की अंतिम तारीख तीन अक्टूबर शाम छह बजे तक है। आवेदन शुल्क चार अक्टूबर तक जमा होगा। आवेदन पूर्ण करने और प्रिंट लेने की अंतिम तारीख पांच अक्टूबर शाम छह बजे तक है। 10 अक्टूबर तक जिला समिति परीक्षा केंद्रों का निर्धारण होगा। 12 अक्टूबर तक परीक्षा केंद्रों की साफ्ट कॉपी जारी होगी। प्रवेश पत्र 17 अक्टूबर को वेबसाइट पर अपलोड होंगे। परीक्षा 28 को होगी। पहली पाली में प्राथमिक स्तर की परीक्षा सुबह 10 से 12.30 बजे तक व दूसरी पाली में उच्च प्राथमिक स्तर की परीक्षा 2.30 से 5.00 बजे तक होगी। अगले दिन आंसर की जारी होगी। रिजल्ट नवंबर के अंत तक घोषित होगा।’
दिसंबर में शिक्षक भर्ती परीक्षा यूपी टीईटी का परिणाम से पहले ही शासन सहायक अध्यापक भर्ती की परीक्षा का आदेश जारी करेगा। बेसिक शिक्षा विभाग के अपर मुख्य सचिव डॉ. प्रभात कुमार ने बताया कि दिसंबर के पहले सप्ताह में परीक्षा होगी। दिसंबर अंत तक नियुक्ति प्रक्रिया पूरी कर ली जाएगी। आचार संहिता का ध्यान पहले यूपी टीईटी दिसंबर और लिखित परीक्षा फरवरी में कराने का कार्यक्रम तय था, उसमें यूपी बोर्ड की परीक्षा और लोकसभा चुनाव की आचार संहिता के कारण भर्ती प्रक्रिया प्रभावित हो सकती थी। ऐसे में शासन ने पहले ही दोनों परीक्षा कराकर नियुक्ति देने का निर्णय लिया है। मुश्किल में परीक्षार्थी, 28 अक्टूबर को पीसीएस-प्री की परीक्षा भी

And 4 Others Counsel for Petitioner :- Parmeshwar Yadav,Shri Ashok Khare Sr. Advocate Counsel for Respondent :- C.S.C.,Mohd Shere Ali Hon'ble Dinesh Kumar Singh,J. 1.� The petitioner has filed this writ petition under Article 226 of the Constitution of India impugning the order dated 29.05.2018 (Annexure-9 to the writ petition) passed by District Basic Education Officer (hereinafter referred to as "the BSA"), Maharajganj whereby it has been held that the petitioner who was appointed on 01.07.2007 was not qualified to be appointed as Assistant Teacher in the Primary School inasmuch as she did not have requisite qualification as per the existing provisions of The U.P. Recognised Basic Schools (Junior High Schools) (Recruitment and Conditions of Service of Teachers) Rules, 1978 (hereinafter referred to as "the 1978 Rules"). 2.� Bachelor of Education (hereinafter referred to as 'B.Ed.') was not one of the eligible qualifications prescribed as per the existing Rules for appointment of Teacher. The petitioner was appointed on the post having B.A. and B.Ed. Degrees. The BSA has also held that the aforesaid Rules got amended only in the year 2008 i.e. on 12.06.2008 and by that amendment B.Ed. has also been added as one of the eligible qualifications for appointment of Assistant Teacher in Primary Schools. BSA has taken the view that since the petitioner did not have requisite qualifications as per the existing Rules, therefore, the approval for appointment of the petitioner granted in the year 2004 is to be revoked. The impugned order has been passed after 14 years since the date of appointment of the petitioner on the post of Assistant Teacher. 3.� It is not in dispute that the petitioner has been working since her initial appointment i.e. of the year 2004 and her appointment was approved by the competent authority and she has been drawing her salary continuously without break. 4.� It is relevant to note that National Council for Teachers Education is a body constituted under the NCTE Act, 1993 a Central Legislation NCTE has framed Regulation in the year 2001 exercising the powers vested in it under the NCTE Act, 1993. These regulations were framed on 03.09.2001 which are called "National Council for Teacher Education (Determination of Minimum Qualifications for Recruitment of Teachers in Schools) Regulations, 2001". Regulation 2 of the aforesaid Regulations provides that the Regulations shall be applicable for recruitment of teachers in all formal schools established, run or aided or recognised by the Central or State Governments and other authorities for imparting education at the elementary (primary and upper primary/middle school), secondary and senior secondary stages. Regulation 3(i) provides that the qualifications for recruitment of teachers in educational institutions mentioned in Regulation 2 shall be as prescribed in the First Schedule for teaching school subjects. Regulation 4 provides that the existing recruitment Rules may be modified within a period of three years so as to bring them in conformity with the qualifications prescribed in the Schedules. Meanwhile, teachers appointed in accordance with the existing recruitment qualifications, subsequent to the issuance of the Regulations, would be required to acquire the qualifications as prescribed in the Schedules. The First Schedule to the Regulations includes a graduate with a degree of B.Ed. or its equivalent as a permissible qualification for appointing teachers to the upper primary (middle school section) "Note : 1. For appointment of teachers for primary classes, basic teachers' training programme of 2 years' duration is required. BEd is not a substitute for basic teachers' training programme. 2.Some of the States are having basic teachers' training courses of one year duration only, while in some other States students passing secondary level examination are admitted to primary level teacher training courses. Such States may, by 2005, conduct basic teachers' training programmes of a duration of not less than two years with admission being open to Senior Secondary/Intermediate pass candidates. In the meantime candidates who have undergone basic teachers' training courses of one year duration or were admitted to such training programmes after passing secondary level examination only may be given employment in the concerned States only." 5.� The NCTE while framing its Regulations was aware of the fact that there were existing Regulations/Rules enforced in various States of the country. NCTE, therefore, directed that the existing recruitment Rules may be modified within a period of 3 years so as to bring them in conformity with the qualifications in the Schedules. It is not in dispute that the NCTE Act and Regulations framed thereunder have overriding effect on the State legislation and Rules or Regulations framed thereunder. The NCTE Act and Regulations are Parliamentary legislations under entry 66-A of the list 3 of the 7th Schedule of the Constitution of India and therefore, the qualification prescribed under the Regulations for appointment of teachers in Primary Schools would have overriding effect on the legislations framed by the State. 6.� The NCTE, a statutory body constituted under the provisions of the NCTE Act, 1993 had directed the States to amend their Rules and incorporate the qualifications as prescribed under the Regulations for appointment of teachers in Primary Schools etc. The State of U.P. did not amend its Rules within a period of three years but it had taken more than 7 years to amend its Rules and it had amended its existing Rules in the year 2008 only to bring them in conformity with the NCTE Regulations. The petitioner's appointment was of the year 2004 and admittedly, as per the existing provisions in the Rules framed by 1978 Rules, B.Ed was not one of the essential qualifications. 7.� A Division Bench of this Court in the judgment dated 09.01.2009 rendered in Special Appeal No.1461 of 2005: Committee of Management versus State of U.P. and others, and another connected Special Appeals had set aside the appointment of teachers who had B.Ed qualifications and their appointments were made before 1978 Rules had amended in the years 2008 on the ground that B.Ed was not one of the essential qualifications prescribed under the Rules. A full Bench of this Court in the case of Ram Surat Yadav and others versus State of U.P. and others had affirmed the aforesaid view of the Division Bench. 8.� The teachers whose appointment was quashed by the Division Bench of this Court vide its judgment dated 09.01.2009 had approached the Supreme Court in Special Leave to Appeal (C) No(s) 14907/2009 along with Special Leave to Appeal (C) Nos.24549-24580 of 2011, 27396 of 2016, 26331 of 2009 and C.A. No.3904 of 2013 and the Supreme Court vide its final judgment and order dated 14.07.2017 had ordered as under:- "Heard learned counsel for the parties. Having regard to the fact that the petitioners have been in service for a long period, we are of the view that their appointments ought not be disturbed only on the ground of alleged lack of qualification which is contested by the petitioners. The facts of the present case are identical to the facts of the cases which went to the Supreme Court and the Supreme Court ordered not to disturb the services of the petitioners.� 10.� In view of the aforesaid judgment and order dated 14.07.2017 passed by the Supreme Court, the present petition is allowed. The respondents are directed not to disturb the services of the petitioner. Sri Vikram Bahadur Singh has appeared today on behalf of the opposite parties. He has placed on record the instructions received by him from opposite party No. 1, according to which the application of the applicant for transfer was considered, but her name does not figure in the order dated 30.6.2018 issued by the department in regard to the candidates, whose request for inter-district transfer was allowed. A perusal of the order of the writ Court reveals that thereunder the Board was required to issue a detailed advertisement in newspapers having wide publicity and thereafter consider request for inter-district transfer. It was also the intent and purport of the order passed by this Court that there could be no bar in seeking transfer on the grounds covered by Rule 8(2)(d), even if five years of service had not been completed at the present place of service. The instructions furnished does not reveal that while finalising the list for transfer, no claim has been excluded on the said ground. It is also not clear that if there are more applicants seeking transfer to a particular district, as compared to vacancies, what criteria was followed in finalising the list. Learned counsel for the opposite party is also unable to explain the same. In such circumstances, the opposite party No. 1 is directed to appear in person before this Court on 6.9.2018 along with detailed affidavit to show compliance of the order of the writ Court in letter and spirit. This petition has been filed seeking following reliefs: "i) a writ, order or direction of a suitable nature commanding the respondents to limit consideration of candidates for promotion as Headmaster of Junior Basic School and Assistant Teacher / Headmaster of Senior Basic School to candidates possessing TET (Primary level) / TET (Upper primary level) alone in pursuance to promotional exercise underway in pursuance to circular of Secretary, Board of Basic Education, U.P., Allahabad dated 28.03.2018. ii) a writ, order or direction of a suitable nature commanding the respondents not to accord any consideration for promotion as Headmaster - Junior Basic School and Assistant Teacher / Head Master, Senior Basic School of candidates not possessing TET (Primary level) / TET (Upper primary level)." Learned senior counsel for the petitioners places reliance upon clause 4 of the notification dated 12.11.2014 issued by the National Council for Teacher Education (in short, 'NCTE'), which reads as under: "4. Qualification for Recruitment:- (a) The qualifications for recruitment of teachers in any recognized school imparting Pre-primary, Primary, Upper Primary, Secondary, Senior Secondary or Intermediate Schools or Colleges imparting senior secondary education shall be as given in the First and Second Schedule(s) annexed to these Regulations. � (b) For promotion of teachers the relevant minimum qualifications as specified in the First and Second Schedule(s) are applicable for consideration from one level to the next level." Submission is that for the purposes of promotion to the post of Headmaster / Headmistress as well as to the post of Assistant Teacher, the requirement of obtaining certificates of TET (Primary level) / TET (Upper primary level) would be mandatory.� It is contended that the respondents cannot enlarge the zone of consideration while considering the claim of promotion, even to those who do not possess the aforesaid qualification.� While entertaining this petition, the petitioners were permitted to implead NCTE as a party - respondent and its counsel was allowed time to obtain instructions in that regard.� Following orders were passed in the matter on 08.05.2018: "Petitioners contend that by virtue of regulation 4(b) of the NCTE Notification dated 12.11.2014, the qualification for promotion is also prescribed. Contention is that the qualification prescribed in the first and second schedule to the notification would equally apply for direct recruitment and promotion. It is also stated that section 23 of the Act of 2009 talks of appointment which includes promotion also. Sri Dhananjay Awasthi, learned counsel appearing for the NCTE seeks short indulgence in order to obtain specific instruction from NCTE in that regard. Put up as fresh on 15.5.2018." Shri Dhananjay Awasthi, learned counsel representing respondent - NCTE, on the basis of the instructions, states that the requirement contained in clause 4(b) of the NCTE notification dated 12.11.2014 would have to be met by a candidate before he is considered for promotion to the post of Headmaster / Headmistress of junior basic school and Assistant Teacher / Headmaster of senior basic school. � Shri A.K. Yadav, learned counsel representing the respondent no. 3 as well as District Basic Education Officer, initially, tried to raise an objection with regard to maintainability of the writ petition at the instance of the present petitioners on the ground that they do not possess requisite eligibility for promotion to the posts in question and therefore, the writ petition, at their instance, be not entertained.� However, in view of the averments made in paragraph no. 10 of the writ petition as well as in view of proviso to rule 8(3), the objection of the respondents is not liable to be sustained; in as much as, in the absence of availability of requisite number of teachers with TET qualification, the respondents have the jurisdiction to relax the qualification prescribed under the relevant Rules.� Even otherwise, the petitioner no. 1 is shown to have completed three years working as Assistant Teacher.� So far as the petitioners' claim, on merit, is concerned, the respondents have not been able to dispute it, effectively.� No provision of law has been shown disputing the averments made on behalf of the petitioners.� In such view of the matter, this writ petition stands disposed of with a direction upon the respondents to act strictly in accordance with the clause 4(b) of the NCTE notification dated 12.11.2014 and to restrict the zone of consideration for promotion to Teachers / Headmaster / Headmistress who possess requisite TET qualification in terms of the clause 4 of the NCTE notification dated 12.11.2014.� It would further be appropriate to observe that in view of the Full Bench judgment of this Court in Shiv Kumar Sharma and Others Vs. State of U.P. and Others (2013 (6) ADJ 310), it is the qualification, contained in the NCTE notification, which would be relevant and would have to be scrupulously followed and the respondents cannot bank upon the provisions of the Uttar Pradesh Basic Education (Teachers) Service Rules, 1981 alone to consider the claim of promotion. UP News - प्रदेश में 5 हज़ार से ज्यादा फर्जी शिक्षकों की नोकरी खतरे में, पेन कार्ड की जांच से पता चला, कैसे होता है खेल देखें - एक शिक्षक की नोकरी लगने पर वह अपनी जगह दूसरे को भेज कर नौकरी करता है, खुद 2- 2 जगह नौकरी चल रही है, ऐसे लोगों की आय डबल शो हो रही है। कुछ लोगों ने फर्जी दस्तावेजों /दूसरे के दस्तावेजों को बनाकर नौकरी हथियाई है फर्जी मेडिकल सर्टिफिकेट बनवाकर नोकरियाँ हथियाई हुई हैं बेसिक में चल रहा बड़ी धांधली का खेल। एक और बात है कि लीव जन्मदिनांक रिकॉर्ड की जानकारियां ऑनलाइन न होने की वजह से लीव रिकॉर्ड गायब हो जाते हैं, आयु प्रमाण बदल दिए जाते हैं। अटेंडेंस बायोमेट्रिक न होने की वजह से और सेटिंग आदि से बगैर बेसिक स्कूलों में जाये, फर्जी शिक्षक दो दी नौकरी कर घर बैठे पगार लेते हैं। कायदे से लीव रिकॉर्ड सभी अधिकारी कर्मचारियों, शिक्षकों का ऑनलाइन दर्ज हो, लखनऊ इलाहाबाद के सर्वर में रिकॉर्ड हो, ABSA, BSA,शिक्षक आदि सभी की अटेंडेंस की जांच थर्ड पार्टी/किसी विशेष विभाग के हाथ मे पारदर्शी तरह से हो। कुछ ABSA, BSA भी कार्यालय से गायब रहते हैं, कोई मूवमेंट रिकॉर्ड नहीं कि कब कहाँ गए, विभाग के काम पर हैं या पर्सनल या कुछ और आज ऑनलाइन के जमाने में सभी कुछ ऑनलाइन होना चाहिए, लेकिन जब मंत्री खुद राज्य सभा, लोकसभा, विधानसभा में पर्याप्त हाजिरी नहीं करते, उनके नीचे नौकरशाह का कोई अटेंडेंस मूवमेंट रिकॉर्ड नहीं हो, और फिर उनके नीचे बैठे BSA/ABSA के कार्यालय में सीसीटीवी / अटेंडेंस/मूवमेंट रिकॉर्ड नहीं हो तो ये सब तो मलाई काटते ही हैं , फर्जी शिक्षक वर्ग भी बगैर जाए सेलरी ले रागे होते हैं, लीव रिकॉर्ड /आयु रिकॉर्ड गायब करा देते हैं। होना यह चाहिए कि सोलर पावर के जरिए सभी दूरदराज स्कूलों में बिजली पहुंचे CCTV कैमरे स्कूल, ABSA, BSA, मिनिस्टर कार्यालय सभी जगह लगवाए जाएं, बायोमैट्रीके अटेंडेंस ही। ABSA, BSA,पंचायत, minster, शिक्षकों को स्मार्ट मोबाइल with App दे दी जाए। इससे इनकी लोकेशन कार्यालय के समय आसानी से ट्रेक हो जाएगी, साथ ही तुरंत बात की जा सकेगी। ओला / उबेर टेक्सी के संचालन में लोकेशन/मोबाइल आसानी से ट्रेक हो जाती हैं, वो भी सर्विस दे रहे हैं, हिंदुस्तान में संतरी से लेकर मंत्री सब मलाई काट रहे हैं। गूगल मैप आजकल लाइव लोकेशन दे देता है, डेली रास्ते का रिकॉर्ड भी दे देता है। कई एप मोबाइल पर ही बॉयोमेट्रिक /रेटिना अटेंडेंस दर्ज करा सकती है, चेक वेरिफाई कर सकती हैं की व्यक्ति वास्तिविक रूप से सही है या कोई और। देश को वक्त है बदलने की। सरकारी सिस्टम पुराने ढर्रे पर चल रहा है। ******** अगर देश के सभी कर्मचारियों अधिकारियों की अटेंडेंस व अन्य रिकॉर्ड इस तरह से हों कि A विभाग की B विभाग के हाथ, B की C के हाथ, C की A के हाथ में हो या कोई अन्य एजेंसी के हाथ मे अटेंडेंस सिस्टम हो, और ऑनलाइन रिकॉर्ड्स दूर सर्वरों में रिकॉर्ड हों, तो वास्तव में सरकारी सेवाओं में बहुत सुधार आएगा।

The instructions are wholly unsatisfactory. From a perusal of the instructions it is manifest that the State Government has not taken into consideration the provisions of the Right of Children to Free and Compulsory Education Act, 2009 and the Schedule framed therein. State may proceed in accordance with law to issue a fresh policy for the year 2018-19. Petitioner's claim would be considered in accordance with the new policy.

Following prayers have been made in the writ petition:- "(a).� A writ order or direction in the nature of certiorari quashing the impugned order dated 13.6.2017 (Annexure -3 to the writ petition) passed by the Addl. Chief Secretary, U.P. Shashan, Lucknow, the respondent no.2, as well as, impugned order dated 17.6.2017 (Annexure-4 to the writ petition) passed by the Secretary, U.P. Basic Shiksha Parishad, Allahabad, the respondent no.3. (b).� A writ order or direction in the nature of Mandamus commanding the respondents to make transfer and posting of the petitioners as per RTE Act, 2009 and Rules framed thereunder and also as per Rules, 2011." This Court while entertaining the writ petition had granted following interim protection on 31.7.2017:- "This writ petition has been preferred by the five petitioners for the common cause of action and for the same relief. All the petitioners are working as Assistant Teachers in Junior Basic Schools and Senior Basic Schools conducted and managed by the U.P. Board of Basic Education under the U.P. Basic Eduction Act, 1972. They are aggrieved by the Government Order dated 13.6.2017 whereby a decision has been taken to transfer/ adjust the excess teachers working in Junior and Senior Basic Schools for the academic session 2017-18. It is contended on behalf of the petitioners that the Government order has not taken into consideration the provisions of the Right of Children to Free and Compulsory Education Act, 2009. It is submitted that Section 19 of the Act, 2009 lays down norms and standards for School, which have been specified in the Schedule framed thereunder. In the Schedule the teacher and student ratio is provided. It also lays down that there shall be at least one teacher per class (for sixth class to eight class) so that there shall be at least one teacher for (i) Science and Mathematics; (ii) Social Studies; and, (iii) Languages. It is also contended that the State Government has extended the last date of admission in the Basic Schools till 31.7.2017, thus without taking into consideration the correct number of students a large number of teachers are being declared surplus. I have heard Sri R.K. Ojha, learned Senior Advocate assisted by Sri Shivendu Ojha, learned counsel for the petitioners, learned Standing Counsel, and Sri A.K. Yadav, learned counsel for the third respondent. Sri A.K. Yadav has received instructions, which are on the record. On the strength of the instructions he submits that no last date has been fixed for admission. It is also mentioned that if in an institution there is only one Science Teacher he/she shall not be replaced. The instructions are wholly unsatisfactory. From a perusal of the instructions it is manifest that the State Government has not taken into consideration the provisions of the Right of Children to Free and Compulsory Education Act, 2009 and the Schedule framed therein. Sri Yadav has also submitted that in view of the subsequent development that the Supreme Court has found that the appointments of Shiksha Mitras are not valid, a fresh decision has to be taken considering the effect of the said judgment. He states that it will take some time to implement the impugned Government order. Learned Standing Counsel is granted two weeks' time to seek instructions in the matter. Put up this case on 21st August, 2017 in the additional cause list. Till then the teachers who have been declared surplus will not be relieved." It is not in issue that on account of interim protection granted by this Court in the instant writ, the State has not proceeded any further, except in relation to claim of female teachers where transfers are otherwise regulated by rule 8(2)(d) of� the Uttar Pradesh Basic Education (Teachers) (Posting) Rules, 2008. The academic session, which was intended to be regulated by the transfer policy dated 13.6.2017 is coming to a close. It is in this context that when the writ petition was taken up on 16.5.2018, following orders were passed:- "Petitioners have challenged the annual transfer policy issued in respect of teachers of institutions run by Basic Education Department. The petition was entertained in July, 2017 and was deferred from time to time. On 31.7.2017, a detailed order was passed in the matter and it was provided as an interim measure that teachers, who are declared surplus, will not be relieved. This interim protection has been extended from time to time and the writ petition has been listed today alongwith bunch of other petitions. Sri R. K. Ojha, learned Senior Counsel appearing for the petitioners submits that the year is coming to an end but no counter affidavit has been filed by the State in the matter so far. Even instructions have not been furnished in the matter by the State. It is stated that usually the transfer policy is issued for a year and is succeeded by fresh policy announced in the month of May/June of each year. Submission is that a new policy is likely to be announced in next few days. Argument is that the State Government by not filing a counter affidavit in the matter has allowed the proceedings to loose its sanctity. Large number of petitions raising similar grievance are pending before this Court and no counter affidavit has been filed till date. Sri P. K. Pandey, learned Additional Chief Standing Counsel appearing for the State is thus instructed to take specific instructions as to whether the State proposes to issue a fresh transfer policy in the near future, in respect of intra-district transfers of teachers working in the institutions run by the Basic Shiksha Parishad, and if so, by when? Let instructions in that regard be obtained by the next date. Put up in the additional cause list on 21.5.2018." Sri P. K. Pandey, learned Additional Chief Standing Counsel has produced a communication dated 18.5.2018 received from the State, which is taken on record. As per the communication, a new transfer policy is under contemplation and is likely be announced shortly. It is admitted to the parties that on account of aforesaid interim order, the State has not proceeded pursuant to the Government Order dated 13.6.2017 in respect of intra-district transfer.� In view of the stand taken by the State, no useful purpose would be served in keeping the writ petition pending inasmuch as the transfer policy dated 13.6.2017, insofar as it relates to adjustment of teachers, within the district, has not been implemented so far and the term of such policy is otherwise coming to a close. A new policy since is likely to be announced by the State, shortly. This Court, therefore, need not examine challenge to the Government Order dated 13.6.2017, on merits. However, the State may proceed in accordance with law to issue a fresh policy for the year 2018-19. Petitioner's claim would be considered in accordance with the new policy. It is clarified that the challenge in the present writ petition since is at the instance of male teachers, who have not completed 5 year service, it would have no concern with transfers of female teachers as per rule 8(2)(d) of the Posting Rules, 2008. The authorities of the State shall thus be at liberty to proceed in accordance with law to process claim of female teachers' transfer under rule 8(2)(d) of the Posting Rules, 2008.� With the aforesaid observations, this writ petition stands disposed of.
