Hon'ble Rakesh Srivastava,J. Heard learned counsel for the petitioner and the learned Standing Counsel. It is alleged that on 2.12.2016 the petitioner made a surprise visit at Purva Madhyamik Vidyalaya, Ranjitpurwa where Smt. Chinta Singh, Head Mistress was present, but Pawan Kumar Yadav, Assistant Teacher was absent and in his place one outsider was imparting education to the students. On inquiry, the petitioner came to know that the outsider was imparting education to the students with the consent of Head Mistress. On 3.12.2016, the petitioner submitted a report in the office of respondent no.4 recommending strict disciplinary action against Amarjeet Singh, Incharge and Smt. Chinta Singh, Head Mistress. It is alleged that such kind of practice is prevailing in several school of the district. On coming to know about the said report the Uttar Pradeshiya Prathmik Shikshak Sangh, Gonda (in short 'Sangh') on 21.1.2017 made a complaint against the petitioner to the District Magistrate, Gonda in which it was inter alia stated that the petitioner was the original resident of District Gonda, and as such, he could not be posted in district Gonda. On the very next day i.e. on 22.1.2017, on the basis of the said complaint, the District Magistrate/ District Election Officer, Gonda passed an order directing the District Basic Education Officer, Gonda to write a letter to the Director of Education (Basic) U.P., and till the time the petitioner was transferred out of Gonda, he be attached in the office of the latter. In pursuance of the order dated 22.1.2017, the District Basic Education Officer on 23.1.2017 passed an order by means of which the petitioner was attached with the office of the District Basic Education Officer, Pant Nagar, Gonda. On 9.3.2017,� the District Basic Education Officer wrote to the Director of Education (Basic) wherein after referring to the complaint made by the Sangh it was stated that the Additional District Magistrate in his inquiry had come to the conclusion that the parental house and property of the petitioner was in District Gonda; that the attitude of the petitioner towards other teachers was not proper; his behaviour was indecent and the working of the petitioner was not like that of a government servant. It was further stated that the petitioner had accepted that Gonda was his parental home and had requested to continue him in Gonda on the ground of his disability, but looking into the seriousness of the matter on account of serious complaint and charges against the petitioner, it was expedient that the petitioner be transferred out of Gonda. It was further stated that after going through the inquiry report, and after obtaining legal opinion of the District Government Counsel, the District Magistrate/ District Election Officer, Gonda had directed that as Model Code of Conduct was in operation, the petitioner be immediately relieved and disciplinary inquiry be initiated against him after serving a charge sheet upon him. In the light of the above, it was stated that the petitioner was being relieved from District Gonda and recommendation was being made for initiating disciplinary action against the petitioner on the basis of the complaint received against him. Copy of the said letter was forwarded to the petitioner directing him to submit his joining in the office of the Additional Director of Education (Basic), Allahabad. In pursuance of the letter dated 22.1.2017 of the District Magistrate, Gonda and letter dated 23.1.2017 of the District Basic Education Officer, Gonda, the Additional Director of Basic Education, Directorate of Education, Allahabad passed an order on 30.5.2017 by means of which the petitioner has been transferred from the post of Block Education Officer, Gonda to District Kannauj on administrative grounds and in public interest. The order dated 30.5.2017 is under challenge in the present writ petition. Learned counsel for the petitioner has submitted that the impugned order of transfer dated 30.5.2017 has been passed in mala fide exercise of power inasmuch as without there being any transfer order the petitioner was relieved from Gonda and was attached with the office of the Additional Director of Education (Basic), Allahabad. It has been further submitted that recital in the letter dated 9.3.2017 of the District Basic Education Officer, Gonda that the petitioner had admitted that Gonda was his home town is absolutely incorrect. Learned counsel has vehemently submitted that home town of the petitioner is Basti and this is borne out from the service book of the petitioner, and even assuming that the home town of the petitioner was Gonda, as per transfer policy the petitioner being a physically handicapped person could be posted in his home town on his own report subject to availability of post. Learned counsel has submitted that transfer order has been passed by way of punishment and cannot be sustained in the eye of law. Learned Standing Counsel, on the other hand, has submitted that the transfer is an incident of service and has tried to justify the impugned order. We have heard learned counsel for the parties and gone through the record. Admittedly, complaint was made by the Sangh on 21.12.2016 and on the very next day the petitioner was attached with the office of the District Basic Education Officer, Gonda and without there being any order of transfer the petitioner was relieved from Gonda and attached with the office of Additional Director of Education (Basic), Allahabad. The home town of the petitioner recorded in the service book is Basti and the petitioner, being a handicapped candidate, as per policy of the State Government, even assuming his home town was Gonda, could be continued in Gonda. We are, prima facie, of the opinion that the undue haste and the manner in which the petitioner has been removed from the post of Block Education Officer, Gonda and ultimately has been transferred out of Gonda smacks of mala fide and is by way of punishment. Notice on behalf of the respondents has been accepted by the office of the learned Chief Standing Counsel. Learned standing counsel prays for and is granted four weeks' time to file counter affidavit. Petitioner, if so advised, may file rejoinder affidavit within two weeks thereafter. List this case after the expiry of the aforesaid period. Till the next date of listing operation of the impugned order dated 30.5.2017, contained in Annexure No.1 to the writ petition, passed by the Additional Director of Basic Education, Directorate of Education, Allahabad shall remain stayed and the petitioner shall be allowed to continue on the post of Block Education Officer, Gonda and shall be paid his salary. छात्र-शिक्षक अनुपात से रुकी बेसिक शिक्षा भर्तियों की बरसात जागरण विशेष बेसिक विद्यालयों की कई भर्तियां फिलहाल होने के आसार नहीं राज्य ब्यूरो, इलाहाबाद : बेसिक शिक्षा परिषद के विद्यालयों में छात्र-शिक्षकों के अनुपात ने भर्तियों की बरसात फिलहाल रोक दी है। सरकार ने बेसिक के स्कूलों में शिक्षकों की चयन करने के लिए नए बोर्ड का गठन ही नहीं रोका है, बल्कि जिन भर्तियों का शासनादेश जारी हो चुका है, उन पर भी ग्रहण लग गया है। हालत यह है कि परिषदीय स्कूलों के 65 हजार से अधिक अतिरिक्त शिक्षकों को कम शिक्षक वाले विद्यालयों में समायोजित करने की मुहिम चल रही है। परिषदीय स्कूलों में नए शिक्षकों के चयन के लिए पिछले साल 12460 और चार हजार उर्दू शिक्षक भर्ती का शासनादेश जारी हो चुका है। अभ्यर्थियों की काउंसिलिंग करके नियुक्ति के पहले ही सरकार ने शिक्षकों की तैनाती छात्र संख्या के अनुरूप करने का आदेश जारी किया। इससे पूरे प्रदेश में तय छात्र-शिक्षक अनुपात के तहत पद निर्धारण हुआ। इसमें 65 हजार से अधिक अतिरिक्त शिक्षक मिले हैं। तमाम विद्यालयों में शिक्षकों की तादाद छात्र संख्या के लिहाज से काफी अधिक मिली तो ऐसे भी स्कूल कम नहीं हैं, जहां काफी कम शिक्षकों की तैनाती है। इसी के बाद से नई भर्तियों को रोककर अतिरिक्त शिक्षकों का जिलों में समायोजन की प्रक्रिया चल रही है। भर्तियां रुकने का प्रकरण हाईकोर्ट पहुंच चुका है, जहां इसी माह सुनवाई होनी है, लेकिन मौजूदा स्थिति को देखते हुए नियुक्तियां होने की उम्मीद बहुत कम है। इसी तरह से उच्च प्राथमिक विद्यालयों में 32022 शारीरिक शिक्षा अनुदेशकों की भर्ती भी रुकी है, इसे शुरू कराने के लिए अभ्यर्थी आंदोलन कर रहे हैं। वहीं, 29334 हजार विज्ञान-गणित शिक्षक और 72825 शिक्षक भर्ती के भी कुछ पद रिक्त हैं। यह पद भरे जाएंगे या नहीं इस संबंध में अफसर कुछ भी बोलने को तैयार नहीं हैं। उनका दो टूक जवाब है कि शासन जैसा निर्देश देगा उसके अनुरूप कार्य होगा।

तैयारी जागरण संवाददाता, लखनऊ बीएड में खाली चल रही 62 हजार से अधिक सीटों को भरने के लिए सात जुलाई से शुरू हो रही पूल काउंसिलिंग में शामिल होने वाले अभ्यर्थियों को काउंसिलिंग लेटर अब छह जुलाई से मिलेंगे। 3.51 लाख रैंक से लेकर 4.15 लाख रैंक तक के अभ्यर्थियों को भी इस पूल काउंसिलिंग में शामिल किया जाएगा। साथ ही एक रैंक से लेकर 3.50 लाख रैंक तक के वह अभ्यर्थी, जिन्हें पहली काउंसिलिंग में सीट एलाट नहीं हुई थी, उन्हें भी मौका दिया जाएगा। बीएड की पूल काउंसिलिंग सात जुलाई से लेकर दस जुलाई तक चलेगी। इसके लिए प्रदेश भर में 30 काउंसिलिंग सेंटर बनाए गए हैं। समन्वयक प्रो. एनके खरे ने बताया कि दो ग्रुप में विद्यार्थियों को काउंसिलिंग में बुलाया गया है। इसमें सात जुलाई को एक रैंक से लेकर 130000 रैंक तक के अभ्यर्थी और पहली काउंसिलिंग में आमंत्रित नहीं किए गए 350001 रैंक से लेकर 366000 रैंक तक के अभ्यर्थियों को बुलाया गया है। इसी तरह आठ जुलाई को 130001 से लेकर 230000 रैंक तक और पूर्व में आमंत्रित नहीं किए गए 366001 रैंक से लेकर 383001 रैंक तक के अभ्यर्थियों को बुलाया गया है। वहीं, नौ जुलाई को 230001 रैंक से लेकर 300000 रैंक तक के अभ्यर्थियों को और पूर्व में आमंत्रित नहीं किए गए 383001 रैंक से लेकर 399000 रैंक तक के अभ्यर्थियों को बुलाया गया है। वहीं दस जुलाई को 300001 रैंक से लेकर 350000 रैंक तक और पूर्व में आमंत्रित नहीं किए गए 399001 रैंक से लेकर 415406 रैंक तक के अभ्यर्थियों को काउंसिलिंग के लिए बुलाया गया है।’
प्रवक्ता, स्नातक शिक्षक 2016 की लिखित परीक्षा अक्टूबर में माध्यमिक शिक्षा सेवा चयन बोर्ड उत्तर प्रदेश के सचिव ने किया तारीखों का एलान राज्य ब्यूरो, इलाहाबाद : प्रदेश के भर्ती आयोगों से इतर माध्यमिक शिक्षा सेवा चयन बोर्ड उप्र चल पड़ा है। बहुप्रतीक्षित प्रवक्ता व स्नातक शिक्षक 2016 की लिखित परीक्षा अक्टूबर में कराने का एलान हुआ है। चयन बोर्ड अध्यक्ष के एलान के बाद कार्यालय के सामने क्रमिक अनशन पर बैठे अभ्यर्थियों ने क्रमिक अनशन भी समाप्त कर दिया है। शाम को चयन बोर्ड की सचिव ने परीक्षा की तारीखों की भी घोषणा कर दी है। अभ्यर्थियों में अब खुशी की लहर है। अशासकीय माध्यमिक विद्यालयों के लिए प्रधानाचार्य, प्रवक्ता व स्नातक शिक्षकों का चयन उप्र चयन बोर्ड करता है। प्रदेश में भाजपा सरकार आने के बाद से आयोगों व चयन बोर्ड आदि में भर्ती प्रक्रिया ठप हो गई थी लेकिन, पिछले महीने हाईकोर्ट में याचिका दाखिल होने के बाद लंबित विषयों के परिणाम जारी हुए थे। उसके बाद से 2016 की लिखित परीक्षा को कराने लेकर कयास लगाया जा रहा था। इसी बीच अभ्यर्थियों ने विक्की खान की अगुवाई में चयन बोर्ड कार्यालय के सामने धरना और क्रमिक अनशन शुरू कर दिया था। आंदोलन के दूसरे दिन चयन बोर्ड अध्यक्ष हीरालाल गुप्त ने अभ्यर्थियों को बुलाकर वार्ता की और 2016 की लिखित परीक्षा अक्टूबर में कराने का वादा किया। शाम को बोर्ड सचिव रूबी सिंह की ओर से परीक्षा की तारीख 8, 15, 22 व 29 यानी अक्टूबर के चारों रविवार को इम्तिहान होगा। चयन बोर्ड ने पिछले वर्ष 2016 के लिए ऑनलाइन आवेदन मांगा था और करीब 12 लाख से अधिक अभ्यर्थियों ने दावेदारी की है। 2011 के रिजल्ट 15 जुलाई से चयन बोर्ड अध्यक्ष ने अभ्यर्थियों को यह भी बताया कि 2011 की लिखित परीक्षा की आंसर शीट जारी हो चुकी हैं और आपत्तियां भी ली जा चुकी हैं अब विषय विशेषज्ञों ने उनकी जांच कर ली है। 15 जुलाई के बाद से 2011 प्रवक्ता व स्नातक शिक्षक के रिजल्ट आना शुरू हो जाएंगे। उसी के साथ साक्षात्कार की तारीखें भी घोषित होंगी। माना जा रहा है कि इंटरव्यू अगस्त के अंतिम पखवारे या फिर सितंबर से शुरू होंगे, क्योंकि अभ्यर्थियों को साक्षात्कार की तारीख 21 दिन पहले बताये जाने का नियम है UPTET / टीईटी / TET - Teacher EligibilityTest Updates / Teacher Recruitment / शिक्षक भर्ती / SARKARI NAUKRI NEWS UP-TET 2011, 72825 Teacher Recruitment,Teacher Eligibility Test (TET), 72825 teacher vacancy in up latest news join blog , UPTET , SARKARI NAUKRI NEWS, SARKARI NAUKRI

सरप्लस शिक्षकों की सूची ने बढ़ाई उलझन जागरण संवाददाता, एटा : आखिर बेसिक शिक्षा विभाग में चिन्हित किए गए सरप्लस शिक्षकों की सूची कहां गायब हो गई। शिक्षक इसी उलझन में उलझकर रह गए हैं। जहां बेसिक शिक्षा के लेखा विभाग द्वारा संबंधित सूचियों को एनआईसी भेजा जाना बताया जा रहा है। वहीं एनआईसी ने सूची तो दूर संबंधित सूचना भी प्राप्त होने से इंकार किया है। शिक्षकों के स्थानांतरण और समायोजन को लेकर लटकी पड़ी प्रक्रिया और लगातार शासन से सरप्लस शिक्षकों की सूची अपलोड कराने के निर्देशों के बावजूद भी शिक्षक उलझन में ही हैं। लगभग एक पखवाड़े तक वेतन साफ्टवेयर में सरप्लस शिक्षकों का डाटा तैयार होता रहा है, लेकिन अभी तक सूची के दर्शन सार्वजनिक रूप से एनआइसी की बेवसाइट पर नहीं हो पा रहे हैं। बेसिक शिक्षा विभाग के वित्त एवं लेखाधिकारी द्वारा जहां शिक्षक संगठनों और अन्य को दो दिन पहले ही सभी विकास खंडों की सूचियां एनआइसी को उपलब्ध कराया जाना बताया जा रहा था। इसके बाद से स्थानांतरण और समायोजन की टेंशन में पड़े शिक्षक रोज ही एनआइसी की साइट खोलकर सूची देखने के प्रयास में हैं, लेकिन अभी तक सूची अपलोड नहीं है।
अपलोड हो भी कैसे, एनआइसी के अधिकारी विभाग की बात पर ही पलटवार करते हुए अभी तक सूची न मिलने की स्थिति बता रहे हैं। इस तरह दो विरोधाभासों को लेकर शिक्षक तो उलझे हुए ही हैं। वहीं यह प्रक्रिया भी और उलझती जा रही है। शिक्षकों का मानना है कि यदि पहले से ही अधिक शिक्षकों वाले स्कूल और रिक्त स्कूलों का ब्यौरा सामने आ जाता तो वह स्थानांतरण आवेदन के लिए विकल्प तैयार कर लेते। उधर यह भी चर्चा है कि शिक्षक संगठनों द्वारा सूचियों में हुईं त्रुटियां उजागर कर देने के बाद फिर से सूचियों में संशोधन कराया जा रहा है। जिला सूचना एवं विज्ञान अधिकारी संजय कुमार ने बताया है कि अभी उन्हें समायोजन या किसी अन्य तरह की प्रक्रिया के लिए कोई भी तरह का ब्यौरा अपलोड करने के लिए नहीं मिला है, यहां तक कि सूचना भी नहीं UPTET / टीईटी / TET - Teacher EligibilityTest Updates / Teacher Recruitment / शिक्षक भर्ती / SARKARI NAUKRI NEWS UP-TET 2011, 72825 Teacher Recruitment,Teacher Eligibility Test (TET), 72825 teacher vacancy in up latest news join blog , UPTET , SARKARI NAUKRI NEWS, SARKARI NAUKRI

टीजीटी-पीजीटी वर्ष 2016 की परीक्षा अक्तूबर में हिन्दुस्तान टीम, इलाहाबादUpdated: 4 जुलाई, 2017 4:38 PM सहायता प्राप्त माध्यमिक विद्यालयों में प्रशिक्षित स्नातक (टीजीटी) और प्रवक्ता (पीजीटी) भर्ती 2016 के नौ हजार से अधिक पदों के लिए अक्तूबर में परीक्षा होगी। उत्तर प्रदेश माध्यमिक शिक्षा सेवा चयन बोर्ड के अध्यक्ष हीरालाल गुप्ता ने मंगलवार को परीक्षा की तिथियां जारी कर दी। लिखित परीक्षा 8, 15, 22 और 29 अक्तूबर को होगी। हालांकि किस तारीख को किस विषय की परीक्षा होगी यह बाद में तय करेंगे। अध्यक्ष ने प्रतियोगी छात्रों को भरोसा दिलाया है कि टीजीटी-पीजीटी वर्ष 2011 के परिणाम और साक्षात्कार की प्रक्रिया 15 जुलाई से शुरू कर दी जाएगी। टीजीटी-पीजीटी 2016 के लिए 30 जुलाई 2016 तक ऑनलाइन आवेदन लिए गए थे जिसमें 10,71,382 प्रतियोगियों ने फार्म भरे थे। प्रशिक्षित स्नातक के 7950 पदों के लिए 6,55,304 जबकि प्रवक्ता के 1344 पदों पर 4,16,078 अभ्यर्थियों ने फार्म भरे थे। 2016 की शिक्षक भर्ती की परीक्षा तिथि और 2011 का परिणाम जारी करने की मांग को लेकर प्रतियोगी छात्र बारह लाख बीएड उत्थान जन मोर्चा एवं युवा अधिकार मंच के बैनर तले सोमवार से चयन बोर्ड के बाहर क्रमिक अनशन पर बैठ गए थे। इसके बाद अध्यक्ष ने परीक्षा तिथि जारी कर दी। प्रदर्शन करने वालों में मोर्चा के प्रदेश अध्यक्ष अनिल सिंह, विक्की खान, अभिषेक सिंह, सिकन्दर, उमा शंकर सिंह, संगीता, कंचन, शकुन्तला, अर्चना, अनिल सिंह, राजू, अशोक सिंह आदि शामिल थे UPTET / टीईटी / TET - Teacher EligibilityTest Updates / Teacher Recruitment / शिक्षक भर्ती / SARKARI NAUKRI NEWS UP-TET 2011, 72825 Teacher Recruitment,Teacher Eligibility Test (TET), 72825 teacher vacancy in up latest news join blog , UPTET , SARKARI NAUKRI NEWS, SARKARI NAUKRI

Heard Shri Ashok Khare, Senior Advocate assisted by Shri Siddharth Khare; Shri Sanjay Kumar Singh, learned Standing Counsel; Shri Jai Ram Pandey, Advocate representing third and fourth respondents and Shri Girijesh Tiwari, Advocate representing fifth respondent. Parwati Singh w/o Ram Ashrey Singh is before this Court assailing the order dated 17.04.2017 passed by learned Single Judge in Writ A No.15757/2017 (Parwati Singh vs. State of U.P. and others) wherein the learned Single Judge has disposed of the Writ Petition with following observations:- "Heard learned counsel for the petitioner and Shri Grijesh Tiwari, learned counsel for the respondent No.5 and Shri Jay Ram Pandey, learned counsel for the respondents No.2, 3 and 4 as well as learned Standing Counsel for the respondent No.1. The petitioner is a Primary School Teacher of an Institution run by the Basic Education Board. By order dated 04.01.2017, she has been transferred from Purva Madhyamik Vidhyalaya Raipuria, Block-Narayanpur, District-Mirzapur to Purva Madhyamik Vidhyalaya Jamuhar, Block-Rajgarh, District-Mirzapur. Both are within the same district. It is not disputed that the petitioner's post is a transferable post. Only grievance of the petitioner is that she is a handicapped person and therefore, she cannot be transferred. The transfer that has been made is within the same district, that is, from one development area to another development area. The transfer is an incidence of service. As such, I am reluctant to interfere in the same. However, it is always open for the petitioner to approach the higher authorities in case she has any grievance. With the aforesaid observation, the writ petition is disposed of." Shri Ashok Khare, Senior Advocate precisely submits that while disposing of the aforementioned Writ Petition, the Learned Single Judge has not considered the most relevant aspect of the matter whereas the petitioner-appellant is physically handicapped candidate and her rights are moreover protected under the Transfer Policy of the State Government that has been holding the field and the transfer order which was impugned before the Learned Single Judge has been passed at the instance of Smt. Punita Singh-fifth respondent and while considering the representation of Smt. Punita Singh at no point of time the rightful claim of petitioner-appellant has been considered and the entire action of the Authorities is just to accommodate Smt. Punita Singh and as such, this Court should come for rescue and reprieve of the petitioner-appellant. Per Contra Shri Sanjay Kumar Singh, learned Standing Counsel as well as Shri Girijesh Tiwari, learned counsel for respondents have vehemently opposed prayer that has been so made by petitioner-appellant and submits that scope of judicial interference in the transfer matters is very limited and as such, no interference is required in the matter and the Learned Single Judge has rightly proceeded to non-suit the claim of petitioner-appellant and even leave was also accorded to the petitioner-appellant to agitate before the Higher Authorities and as such no interference is required in the matter. Shri Girijesh Tiwari, Advocate has informed us that promotion of petitioner itself has been cancelled on 02.01.2016 We have proceeded to examine the record in question and what we find that fifth respondent Punita Singh had assailed the initial transfer order dated 07.10.2016 passed in Writ A No.56442 of 2016 (Punita Singh vs. State of U.P. and others) and the Learned Single Judge, in his turn, has proceeded to pass order dated 29.11.2016 setting aside the order dated 07.10.2016 and remitted the matter back to the Competent Authority to decide her claim by reasoned and speaking order considering the fact that Punita Singh has already been relieved from her present posting and before coming into existence the Government Order dated 30.08.2016. The order dated 29.11.2016 passed by learned Single Judge is reproduced hereunder:- "Heard Sri Grijesh Tiwari, learned counsel for the petitioner and Sri J.P. Pandey, learned counsel for the respondent no. 2 to 4. Contention is that the petitioner was initially transferred from Jamuhar to Sikandarpur on 29.06.2016 after getting approval of the Board. Subsequently, he was transferred from Sikandarpur to Chunar. Learned counsel for the petitioner submits that in pursuance of the said transfer order, the petitioner has been relieved on 07.10.2016 vide relieving order dated 07.02.2016, copy of which has been annexed as Annexure-4 to the writ petition. Thereafter, the transfer of the petitioner was cancelled vide impugned order dated 07.10.2016. Reliance has been placed on the Uttar Pradesh Basic Education (Teachers) Services Rules, 1981 clause 21 of which reads as follows: "21. Procedure for transfer.-There shall be no transfer of any teacher from the rural local area to an urban local area or vice versa or from one urban local area to another of the same district or from local area of one district to that of another district except on the request of or with the consent of the teacher himself and in either case approval of the Board shall be necessary." Learned counsel for the petitioner submits that even though the petitioner has been relieved from the place of her original posting and at present she has nowhere to go. It has been further contended that the post at Raipuria, Chunar is still vacant and thus the petitioner can be easily absorbed on that post as she has already been released from her parent department. Having heard learned counsel for the parties and looking to the controversy in issue, the writ petition is being disposed of finally with a direction that the claim of the petitioner for being appointed as Head Mistress in pursuance of initial order, which has been approved by the Board be considered by the authority concerned. Accordingly, it is directed that in case petitioner files a fresh representation before the respondent no. 3 raising all her grievances within a period of one month from today along with a certified copy of this order, the same shall be heard and disposed of by respondent no. 2 by means of a reasoned and speaking order after giving opportunity of hearing to the petitioner preferably within a period of three months thereafter. In view of aforesaid, the impugned order dated 07.10.2016 is quashed and the matter is remitted back for being reconsideration by respondent no. 3 who will passed a reasoned and speaking order considering the fact that the petitioner has already been relieved from her present posting and before coming into existence of the Government Order dated 30.08.2016. With the aforesaid direction, the writ petition is disposed off finally." In the garb of the order dated 29.11.2016, the District Basic Education Officer, Mirzapur has proceeded to pass order dated 04.01.2017, which was impugned in the Writ Petition, transferring and accommodating Smt. Punita Singh from Primary School Jamuhar to Primary School Raipuria and vice-versa petitioner-appellant has been transferred to Primary School Jamuhar whereas she was already working as Head Master at Primary Schools Raipuria. We have proceeded to peruse the impugned order dated 04.01.2017 and what we find that while disposing of the Writ A No.56442 of 2016 (Punita Singh vs. State of U.P. and others), the Learned Single Judge has clearly proceeded to set aside the earlier order dated 07.10.2016 and the matter was remitted to the Competent Authority for reconsideration and it has also been directed to him to pass a reasoned and speaking order considering the entire facts of the matter. The order dated 04.10.2016 passed by District Basic Education Officer, Mirzapur nowhere provides as to why petitioner-appellant has been transferred to Primary School Jamuhar from Primary Schools Raipuria except the fact that there has been the order of this Court dated 29.11.2016 asking the Competent Authority to reconsider the matter of Punita Singh and pass reasoned and speaking order. Thus, it is clearly reflected that there is no consideration by the Competent Authority in passing the order impugned in the Writ Petition and the claim of petitioner-appellant has not been considered in its correct perspective and as such, we are of the considered opinion that the order dated 04.01.2017 passed in compliance of the order dated 29.11.2016 is unsustainable. Accordingly, the same is set aside and the present Special Appeal is allowed asking the Basic Education Officer, Mirzapur to reconsider the claim of petitioner-appellant and pass reasoned and speaking order considering the entire facts of the case, and at the said point of time District Basic Education Officer should satisfy himself as to whether promotion in question is still subsisting or not, as before us it has been informed that promotion order itself has been cancelled by the order of Principal, DIET, Mirzaur dated 02.01.2016, preferably within a period of four weeks from the date of production of certified copy of this order, but certainly after providing opportunity of hearing to the parties concerned.
