-जिन जिलों में आवेदन कर चुके हैं, वहां दोबारा शुल्क की जरूरत नहीं

-ऐसे जिलों में पुराने आवेदन-पत्र ही मान्य किए जाएंगे

उच्च न्यायालय ने सहायक अध्यापक भर्ती के लिए आवेदन करने वाले अभ्यर्थियों को थोड़ी राहत दी है। न्यायालय ने कहा है कि जिन्होंने पिछली भर्ती विज्ञापन के तहत आवेदन जमा किया था, उनसे न तो उन जिलों के लिए न नए आवेदन लिए जाए और न ही शुल्क लिया जाए

यह आदेश न्यायमूर्ति अरुण टण्डन ने अखिलेश त्रिपाठी व अन्य की याचिका पर दिया है। अदालत के सामने यह तथ्य लाया गया कि पिछली बार निकाले गए शिक्षक भर्ती आवेदन में अभ्यर्थियों को पांच जिलों में आवेदन की छूट दी गई थी। इसमें हजारों ऐसे अभ्यर्थी हैं, जिन्होंने पांचों जिलों में आवेदन शुल्क जमा करके फार्म भरा था। बाद में अदालत ने आदेश दिया था कि एक ही जिले में आवेदन शुल्क जमा किया जाए, डिमांड ड्राफ्ट की फोटोकॉपी अन्य जिलों में लगाई जाए तब सरकार ने आश्वस्त किया था कि जो छात्र पांच जिलों में आवेदन शुल्क जमा कर चुके हैं, उनका पैसा वापस किया जाएगा। यह पैसा आज तक वापस नहीं किया गया है। सरकार की और से बताया गया कि अभ्यर्थियों को वह पैसा वापस किया जाएगा। इस पर कोर्ट ने कहा कि वापसी की जरूरत ही क्या है, जिन जिलों में अभ्यर्थियों ने आवेदन शुल्क जमा किया है, उनसे अब शुल्क लिया ही न जाए। उनका पुराना आवेदन ही मान्य किया जाए। न्यायालय ने यह भी कहा है कि पहले आवेदन कर चुके अभ्यर्थी निदेशक एससीईआरटी लखनऊ को आवेदन भेज कर 31 दिसम्बर से पहले जानकारी दे दें न्यायालय ने अन्य मुद्दों पर सुनवाई के लिए अगली तिथि 9 जनवरी नियत की है। सुनवाई की अगली तिथि पर आयु सीमा में छूट आदि मुद्दों पर विचार किया जायेगा

न्यायालय ने निदेशक एनसीआरटी को आदेश दिया है कि पहले आवेदन जमा कर चुके अभ्यर्थियों की सूचना मिलने पर पुराने आवेदन निकालकर अभ्यर्थिता स्वीकार करें। यह भी स्पष्ट किया है कि यदि अभ्यर्थी अतिरिक्त जिलों में आवेदन करना चाहते हैं तो नए सिरे से आवेदन कर सकते हैं। एक अनुमान के मुताबिक लगभग ढाई लाख अभ्यर्थी टीईटी उत्तीर्ण हुए थे, जिन्होंने पांच जिलों में आवेदन शुल्क जमा किया था। उन्हें इस आदेश से राहत मिलेगी

Heard learned counsel for the parties. 
Mr. Neeraj Upadhyay, Advocate, has produced the letter of the State Government dated 20.12.2012 wherein it has been mentioned that the State Government has taken a conscious decision in the matter of charging of fee at the rate of Rs. 500/- per district as well as in the matter of determination of minimum and maximum age. Meaning thereby that the State Government is not in a position to dilute any of the said conditions as on date

Having regard to the order passed by this Court on 20.12.2012, the fact that the last date for submission of the application is 31.12.2012 and that the Court shall close tomorrow i.e. 22.12.2012 till 2.1.2013 for winter break, it has become necessary for this Court to make the following interim arrangement: 
All those candidates who had submitted their application in respect of the various districts in response to advertisement dated 30.11.2011, may file their application in response to the current advertisement dated 7.12.2012 by speed post without enclosing any bank draft addressed to the Director, State Educational Research and Training Council, Lucknow on or before 31.12.2012 in the proforma prescribed by speed post. The candidate shall disclose all necessary information as per the format provided for on the web site in respect of the current selections. They shall also specifically indicate the number of districts with their names for which they had submitted the application earlier in response to the advertisement of 2011
The Director, State Educational Research and Training Council, Lucknow shall accept all these applications and shall maintain a record in respect of each of the candidates along with the districts applied for. The issue as to whether these applications be considered along with the other applications received on-line in response to the advertisement in question dated 07.12.2012 shall be adjudicated on the next date. 
It is made clear that if any petitioner/candidate wants to make an application in respect of any other districts for which he had not applied in response to the advertisement of 2011 he is at liberty to do so after complying with all the conditions mentioned in the advertisement dated 7.12.2012. To be precise, it is clarified that the applications of all such candidates who had applied in response to the advertisement of 2011 shall be considered only in respect of the districts for which they had applied earlier. They have an independent right to apply afresh in terms of the advertisement in question for other districts. 
List on 9.1.2013.

What I found in today's hearing  there is not a single point about TET marks merit OR change in base of selection.

About fee submission, Court made an interim arrangement -

I felt - Candidates can apply in any number of districts without fee/draft as per format available on website for current selections and submit it through speed post on OR before 31st December 2012 to Director, SCERT, Lucnow (i.e Last date 31.12.2012)

However I am confused that without challan How a person enter in ONLINE Format. Therefore you should take necessary details through Helpline Numbers / Concerned Person about format.

Another Important Point is -
if any petitioner/candidate wants to make an application  in respect of any other districts for which he had not applied in response to the advertisement of 2011

Here court has clearly said complying conditions of advertisement dated 07.12.2012 (i.e selection base of academic as advertised. )

One of the contention raised on behalf of the petitioner is that the fixation of minimum and outer age limit under the fresh advertisement will render certain candidates, who were earlier eligible and who had applied in pursuance to the advertisement published on 30th November, 2011 stand disqualified. 
It is stated that the State Government on its own had dropped the selection proceedings in terms of the advertisement dated 30th November, 2011. 
It is further pointed out that under Rule-6, insofar as it pertains to trainee teachers, the power to determine the upper age limit only has been conferred upon the State Government. The determination of the minimum age at 21 years and 40 years as on 1st July, 2012 is illegal. Lastly, it is submitted that under fresh advertisement, every candidate is now required to furnish bank draft for a sum of 500/- for each district qua which he makes the application. Meaning thereby that if a person applies for all 75 districts, he will be required to pay to the State Government a total sum of Rs. 37,500/-. 
According to the petitioner, earlier the State Government had charged a fee of Rs.500/- for applying in any number of districts. It is their case that the fixation of fee at Rs. 500/- per district is arbitrary and exorbitant especially, having regard to the fact that the petitioners are unemployed educated youth. It is their case that the State Government cannot be permitted to make a profit out of this fee to be collected, at best it can recover the amount, which is spent for evaluating the applications and computation of the merit

It is has been pointed out to the Court that last date for submission of application in pursuance to the fresh advertisement is 31st December, 2012. The applications are to be made online. Therefore, unless the conditions prescribed are satisfied, online applications shall be rejected
The Court is to close for winter vacations tomorrow and it is not possible to adjudicate upon all the issues raised, in absence of a counter affidavit being filed by the State Government. 
Some interim arrangement is therefore required to be made. For the purpose, Sri Neeraj Upadhayaya, learned Additional Chief Standing Counsel may obtain instruction from the State by tomorrow i.e. 21st December, 2012. 
Put up this matter tomorrow i.e. 21st December, 2012

नई दिल्ली : बैंकिंग कानून (संशोधन) विधेयक तथा बैंकों के विलय योजना के विरोध में चार बैंक कर्मचारी संगठन गुरुवार को एक दिन की हड़ताल करेंगे।

अखिल भारतीय बैंक कर्मचारी संगठन (एआईबीईए) के महासचिव सी एच वेंकटचलम ने कहा कि मुख्य श्रम आयुक्त के समक्ष इंडियन बैंक एसोसिएशन के साथ बैठक का कोई नतीजा नहीं निकल पाने के कारण यूनियनों ने हड़ताल पर जाने का निर्णय किया है।

एआईबीईए के अलावा बैंक इंप्लायज फेडरेशन आफ इंडिया (बीईएफआई), आल इंडिया बैंक आफिसर्स एसोसिएशन (एआईबीओए) तथा नेशनल यूनियन बैंक इंप्लायज (एनयूबीई) देशव्यापी हड़ताल में शामिल हो रहे हैं।

ये संगठन बैंकिंग कानून (संशोधन) विधेयक का विरोध कर रहे है। इसे लोकसभा ने कल पारित कर दिया। (एजेंसी)

सरकारी, निजी एवं विदेशी बैंकों के देशभर के लगभग 700,000 कर्मचारी और अधिकारी गुरुवार को हड़ताल पर रहेंगे। एक बैंक अधिकारी ने यह जानकारी यहां सोमवार को दी।
ऑल इंडिया बैंक इप्लाइज एसोसिएशन के सचिव विश्वास उतागी ने बताया कि 27 सरकारी बैंकों, निजी क्षेत्र के 12 पुराने बैंकों और आठ विदेशी बैंकों में हड़ताल के कारण गुरुवार को कामकाज नहीं होगा।
उतागी ने मीडियाकर्मियों से कहा, "हम केंद्र सरकार द्वारा संसद में संशोधन के लिए लाए गए प्रस्तावित बैंकिंग कानून विधेयक का विरोध कर रहे हैं। हम भारतीय बैंक्स एसोसिएशन को हड़ताल की सूचना पहले ही दे चुके हैं।"
