WBTET : HC stays selection of teachers

SSC Petition alleges TET answers evaluated wrongly

The Calcutta High Court on Wednesday stayed the selection process to recruit teachers in the secondary and higher secondary schools by the School Service Commission (SSC) till March 21. The examination was held on July 29 last year to recruit teachers in secondary and higher secondary schools for filling up around 55,000 posts.

M D Kamruzzaman and 40 other candidates, who appeared in the SSC examination, filed a writ petition challenging the examination process. They alleged in the petition that the answer script of the Teachers Eligibility Test (TET) had been evaluated according to the wrong answers. The candidates who wrote the right answers on the basis of text books did not secure any marks. So the selection process should be stopped.

Hearing the allegation, Justice Debasish Kargupta referred the dispute to the principal of David Hare BEd College to look into the matter. The principal will verify the claim made by the candidates and file a report within three weeks.

The petition explained that the candidates had appeared for two written tests — one TET and another test on main subjects. On securing 60 per cent marks in the TET, their answer scripts of main subjects would be examined by the SSC. But the two written tests were taken on the same day. After publication of TET result, answer script of main subjects would be evaluated.

On December 1 last, the SSC published the result of TET and also disclosed the model answers of the questions of the TET on its website. The petitioners noticed that some answers in the model answers were different according to popular text books and the answer scripts were evaluated on the basis of the these model answers.

Advocate Bikash Ranjan Bhattacharjee, counsel of the petitioner argued that the candidates who wrote the right answers according to the text book, got zero and the candidates who wrote the wrong answers on the basis of the model answers secured got marks. As a result, he petitioner did not secure the requisite 60 per cent to qualify the TET, the petition alleged.

Though the results of the TET were published, the results of the main subjects are yet to some out. Justice Kargupta said that the result of the main subjects can not be published now for the stay order. The case will come up for hearing on March 21.

Teacher Recruitment in UP : एक और भर्ती के इंतजार में अभ्यर्थी

इलाहाबाद : प्रशिक्षु शिक्षक भर्ती पर इलाहाबाद हाईकोर्ट द्वारा रोक लगाए जाने के बाद अभ्यर्थियों को अंशकालिक अनुदेशकों की भर्ती शुरू होने का इंतजार है। प्रदेश में कुल 41307 अंशकालिक अनुदेशकों की भर्ती 25 फरवरी से शुरू होने जा रही है। इसमें कला शिक्षा, स्वास्थ्य एवं शारीरिक शिक्षा, कार्यानुभव में प्रत्येक के 13769 पद शामिल हैं।

छह से 14 साल के बच्चों को निश्शुल्क और अनिवार्य शिक्षा दिलाने के लिए एक अप्रैल 2010 से निश्शुल्क एवं अनिवार्य बाल शिक्षा का अधिकार अधिनियम 2009 लागू किया गया है। इस अधिनियम के अनुसार सौ से अधिक छात्र संख्या वाले उच्च प्राथमिक विद्यालयों में प्रति 35 छात्रों पर एक अध्यापक, एक प्रधानाध्यापक और कला, स्वास्थ्य एवं शारीरिक एवं कार्य शिक्षा के एक-एक अंशकालिक अनुदेशक तैनात किए जाएंगे। इसके तहत 13769 उच्च प्राथमिक विद्यालयों में 41307 अनुदेशकों के पद स्वीकृत किए गए हैं। इन्हें 11 महीने तक सात हजार रुपए प्रतिमाह मानदेय दिया जाएगा। यह मानदेय सीधे उनके खातों में भेजा जाएगा। संविदा पर तैनाती के लिए 30 अक्टूबर 2012 की छात्र संख्या के आधार पर सौ से ज्यादा छात्र संख्या वाले विद्यालयों का चयन किया गया है। ऐसे विद्यालयों की सूची दस फरवरी तक राज्य परियोजना कार्यालय में भेजी जानी है।

सबसे ज्यादा पद सीतापुर में

अंशकालिक अनुदेशकों के सबसे ज्यादा पद सीतापुर जिले में हैं। यहां 1695 पद घोषित किए गए हैं। हरदोई में 1380, लखीमपुरखीरी में 1269, आजमगढ़ में 1122, इलाहाबाद में 1059, सुल्तानपुर में 1020 और जौनपुर में 1014 पद घोषित किए गए हैं। इलाहाबाद में प्रत्येक वर्ग मे 353 पद रिक्त हैं।

25 फरवरी से होंगे आवेदन

तीनों पदों के लिए अलग-अलग आवेदन किए जाएंगे। अभ्यर्थी को अपने ही जिले में आवेदन करने की छूट दी जा रही है। सभी आवेदन सिर्फ ऑनलाइन होंगे। सामान्य अभ्यर्थी को दो सौ रुपये और अनुसूचित जाति व अनुसूचित जनजाति के अभ्यर्थियों को सौ रुपये का आवेदन शुल्क देना होगा। इसके लिए 25 फरवरी से विज्ञापन और आवेदन शुरू हो रहे हैं। ई-चालान द्वारा आवेदन शुल्क जमा करने की अंतिम तिथि 21 मार्च निर्धारित की गई है। 23 मार्च तक आवेदन किए जा सकेंगे। आठ अप्रैल को मेरिट सूची और तीस अप्रैल को काउंसिलिंग कराई जाएगी। 15 मई को तैनाती और 16 मई से 30 जून के बीच अंशकालिक अनुदेशकों को प्रशिक्षण दिलाया जाएगा। सभी अंशकालिक अनुदेशक एक जुलाई 2013 को विद्यालयों में कार्यभार ग्रहण कर लेंगे

आज जिस तरह से हिंदुस्तान पेपर में टी ई टी अनियमितता को लेकर न्यूज़ आयी उससे फिर ये बात प्रबल होने लगी है की टी ई टी मेरिट इस अनियमितता को दूर कर सकती है ।

हिंदुस्तान पेपर में छपा की कुछ प्रश्न गलत छपे थे और बार बार रिसल्ट संसोधित हुआ ।

इस अनियमितता को दूर करने के लिए सामान्य सा हल टेट मेरिट ही है ।
उदहारण के लिए , मान लीजिये की अनुज को टी ई टी परीक्षा में 87 मार्क्स मिले और मोहन को 110 मार्क्स ।
5 प्रश्न गलत थे और इस कारन सबको 5 मार्क्स अतिरिक्त दिए गए ।

अब अनुज (सामान्य श्रेणी) के मार्क्स बढकर 92 हो गए और वह इस प्रकार उसने भर्ती के लिए पात्रता हासिल कर ली ।
वहीँ दुसरी तरफ मोहन के मार्क्स बढ कर 115 हो गए ।

लेकिन इस अनियमितता को दूर करने के लिए अब चयन प्रक्रिया का बेस बदल जाता है - अकादमिक अंक
मान लीजिये कि अनुज के अकादमिक गुणांक 72 हैं और मोहन के 65
तो नयी प्रक्रिया में मोहन को तो सीधा नुक्सान है ।

अगर इस अनियमितता के प्रभाव को नगण्य करने के
लिये टी ई टी मेरिट का सहारा लिया जाता है तो दोनों को मिले अतिरिक्त अंक का कोइ प्रभाव इस चयन पर नहीं पडेगा ।

हालाँकि अभी कुछ कहा नहीं जा सकता की धांधली / अनियामित्तात्यां और भी हैं की नहीं, किस प्रकार की धान्ध्लीयाँ / अनियमितताएं और हैं । धांधली में कितने लोग संलिप्त हैं , और क्या धांधली हटाई जा सकती है की नहीं ।

ये सब बातें भी भर्ती प्रक्रिया पर प्रभाव डालेंगी ।
नियोक्ता सरकार है और न्याय कोर्ट को देना है ,
सभी लोग धेर्य रखें और आगे बढने के प्रयास (अन्य कोई परीक्षा की तयारी / नोकरी ) जारी रखें

The following is list, in order of merit of 506 candidates, who have qualified on the basis
of the results of the Written Examination held by the Union Public Service Commission in
April, 2012 and the subsequent Interviews held by the Services Selection Board, of the
Ministry of Defence for admission to the Army, Navy and Air Force wings of National Defence
Academy for the 129th Course and Naval Academy for the 91st Indian Naval Academy Course

UPTET - टीईटी : बचाव पक्ष को मिला अंतिम मौका

कानपुर: टीईटी मामले में गुरुवार को सुनवाई शुरू हुई तो अपना पक्ष रखने के बजाय बचाव पक्ष के अधिवक्ता ने फिर समय मांगा। अदालत ने अंतिम सुनवाई के लिए 19 फरवरी की तारीख तय की है।

देहात जिला जज धर्मवीर सिंह की अदालत में टीईटी मामले के आरोपी बिजनेस पाल की ओर से हाजिरी माफी का प्रार्थना पत्र दिया गया। उनके अधिवक्ता अब्दुल सलाम ने अपना पक्ष रखने का एक और मौका दिए जाने की अपील करते हुए तारीख मांगी। इस पर जिला शासकीय अधिवक्ता शंभूनाथ यादव ने आपत्ति जतायी और कहा कि मामले पर सभी आरोपियों को अपना पक्ष रखने का पूरा मौका पहले दिया जा चुका है। न्यायालय ने दो दिन का समय भी दिया लेकिन वह फिर समय मांग रहे हैं, जिससे स्पष्ट है कि वह जानबूझ कर मुकदमा लंबित कर रहे हैं। अभियोजन अधिकारी के मुताबिक अदालत ने भी उनकी बात पर सहमति जता पक्ष रखने का अंतिम मौका देते हुए सुनवाई के लिए 19 फरवरी की तारीख तय कर दी। इस मामले में टीईटी के सभी आरोपियों को अदालत में पेश किया गया

   The enclosure is the list, in order of merit, of the candidates who have been
recommended for appointment to medical posts in the Railways, Indian Ordnance Factories Health
Service, Central Government Health Services, Municipal Corporation of Delhi and New Delhi Municipal

   Appointments to the various posts will be made according to the number of vacancies
available and subject to the candidates fulfilling all the prescribed eligibility conditions and all
verifications, wherever due, being completed satisfactorily.
2. In accordance with Rule 13 & 14 of the Rules of the Combined Medical Services Exam., 2012,
the Commission is maintaining a consolidated Reserve List of 82 candidates which includes 41 General,

3. U.P.S.C. has a “Facilitation Counter” near Examination Hall Building of its campus. Candidates
can obtain any information/clarification regarding their result on working days between 1000 hours to
1700 hours in person or over telephone Nos. 23098543/23385271/23381125 from this Counter. Result
will also be available on the U.P.S.C Website i.e. http//www.upsc.gov.in. However, marks on the
website are likely to be available after 15 days from the date of declaration of result.

4. In case, any candidate desires to obtain printed/hard copy of his/her mark‐sheet of the above
mentioned examination, he/she should forward a request to the Commission along with self‐addressed
stamped envelope within a period of thirty days from the date of publication of the result.

समान अपील वाले इस बंच (ढेरी ) में , हमने विद्वान काउन्सिल को सुना और प्रदेश के विद्वान अतिरिक्त महाधिवक्ता को भी सुना ।
इस अपील को दोबारा 20 फरवरी को अन्य बंच केसेस के साथ लिस्ट किया जाये ।
और इस दोरान रेस्पोंदेंट (जवाब देह / सरकारी पक्ष ) द्वारा एक सप्लीमेंट्री काउंटर एफिडेविट दिया जाये , जिसमें सपोर्टिंग / प्रासंगिक जरुरी दस्तावेजों के साथ पूरी जानकारी हो व अलग अलग इस प्रकार दिया जाये कि -
सभी तरह की अनियमितताएं जो की हाई पवार कमेटी द्वारा संदर्भित हों
.

प्रत्येक अनियमितता को अलग अलग तरीके से विश्लेषणात्मक तरीके से हल किया जाएगा ।
बहस को सुनने के दोरान , हमने अतिरिक्त महाधिवक्ता को कहा कि - कमेटी की रिपोर्ट जो की काउंटर एफिडेविट के साथ दी गयी है -
क्या कमेटी ने आरोपों और सामग्री को विश्लेषणात्मक तरीके से जांचा या ये मामले का एक सतही / सुपर फ़िसिअल दृष्टी कोण है।
उदहारण के लिए - रिपोर्ट के नोट में कहा गया है कि टी ई टी परीक्षा करने वाली एजेंसी के आफिस से 3493 ओ एम् आर शीट की कार्बन कोपीस जब्त की गयी ।
एक हार्ड'डिस्क भी जब्त की गयी जो की एस ऍफ़ एल लखनऊ को भेज दी गयी है । उसके बाद ये कहा गया कि -
एस पी रमा बाई नगर ने एक रिपोर्ट दिनांकित 10 -04 -2012 दी , जो खुलासा करती है की -
बजाय मूल ओ एम् आर शीट की जांच के , ओ एम् आर शीट की कार्बन कोपीस की जांच की गयी

केवल कार्बन प्रतियां एजेंसी के कार्यालय से पाया जाने का यह मतलब नहीं की उनकी मूल ओ एम् आर प्रति नहीं मिली ।
कमेटी ने इसके बारे में स्पष्टीकरण नहीं दीया। और इस बात का निष्कर्ष एस पी जी ने कहाँ से लिया कि -
कंप्यूटर स्केनर ने मूल उत्तर पत्रिका प्रति के बजाय कार्बन प्रति की जांच की ।

याची की तरफ से प्रस्तुत किया है की - मूल ओ एम् आर उत्तर पत्रिका में एक बार कोड है जिसके बिना स्केनर ओ एम् आर शीट को जांच नहीं सकता ।
यह भी तर्क दिया कि (हालाँकि अदालती बहस में इसका प्रभाव नहीं है ) - कि कार्बन प्रति को परीक्षा के बाद अभ्यर्थीयों को वापिस भी किया गया था

हमारी राय है की -
की जब सम्बंधित अभ्यर्थीयों को सुनवाई का कोई अवसर नहीं मिला और यह 70 हज़ार से ज्यादा अभ्यर्थीयों का भाग्य बदल सकता है तो
हाई पवार कमेटी की बड़ी जिम्मेदारी बनती है कि वह पूर्ण विवरण इकठ्ठा करे और प्राप्त सामग्री (जो अब तक मिली है ) का विश्लेषण व जांच करे और कमेटी की रिपोर्ट का परिक्षण करे - जिस पर कमेटी ने अपना निर्णय दिया है

ऊपर दिए गए विवरण को देखते हुए -
राज्य के रेस्पोंदेंत (जवाब देह ) द्वारा एक सप्लीमेंटरी काउन्टर एफिडेविट दिया जाना चाहिए
सभी केसेस को 20 फरवरी 2013 (जैसा की अतिरिक्त महाधिवक्ता द्वारा प्रार्थना की गयी ) को लिस्ट किया जाये
अंतरिम आदेश अगली लिस्टिंग की तिथी तक जारी रहेगा

�� In this bunch of similar appeals, we have heard learned counsel for the appellants and the learned Additional Advocate General for the State. List these appeals together again as a bunch on 20.02.2013. By that time, a supplementary-counter-affidavit will be filed by the respondents giving full details, and enclosing therewith copies of all the supporting/relevant documents, separately on each of the alleged irregularities referred to in the report of the High Powered Committee.
�� Each of irregularities will be dealt with separately in an analytical manner. During the course of arguments, we have pointed out today to the learned Additional Advocate General that the report of the Committee, which has been enclosed with the counter-affidavit raises the basic question whether the Committee has applied its mind to the allegations and material by way of analytical scrutiny, or has taken too supercficial a view of the matter. By way of an example, the report notes that 3493 carbon copies of OMR Sheets were seized from offices of the Agency conducting the test (TET). A hard disk was also seized and sent to the SFL, Lucknow. Thereafter it says that the SP, Ramabai Nagar has given a report dated 10.04.2012 saying that the investigation so far, has revealed that instead of getting the original OMR Sheets being examined by the Computer, carbon copies of the same had been examined.
�� Merely because the carbon copies were found from the Agency's Office will not necessarily mean that the original OMR Sheets of those carbon copies were not found. This should have been got clarified by the Committee. Further, it has not been considered as to what is the material on the basis of which the S.P. has inferred that the Computer Scanner examined the carbon copies instead of the original Answer Sheets.
�� From the side of the appellants, it has been submitted that the original OMR answer-sheets contain a "Bar Code", without which the Scanner will not examine the OMR sheet. It has been argued, although there is no pleading to that effect, that the carbon copies do not contain the 'bar code', because the carbon copies are to be given back to the candidates after the examination.
�� We are of the opinion that when no opportunity of hearing is being afforded to the concerned selected candidates, and because the decision is likely to alter the fate of more than seventy thousand candidates, a much greater responsibility lay upon the High Powered Committee to elicit full details, to examine and analyse the material so obtained, and to test the reports on the basis of which the Committee is giving its decision.
�� In the above light, a supplementary-counter affidavit should be filed by the State-respondents.
List all these cases on 20.02.2013, as prayed by the learned Addl. Advocate General.
Interim order will continue till the next date of listing.

अभी हाल ही में इलाहबाद हाई कोर्ट ने धांधली आदि के बारे में जानकारी मांगी ।
यह सभी टी ई टी उम्मीदवारों (जिन्होंने मेहनत से परीक्षा उत्तीर्ण की ) के लिये खुशी का पैगाम लेकर आया ।

मेहनती अभ्यर्थी गलत फ़हमी में धांधली की बदनामी से जूझ रहे थे और अगर कोर्ट कह देता है की धांधली नगण्य है या या हटाई जा सकती है तो ये उत्तर प्रदेश शिक्षा विभाग के लिये भी अच्छी बात है कि उन्हें योग्य टी ई टी उत्तीर्ण अभ्यर्थी अपने विभाग के लिये मिल रहे हैं ।

क्योंकि कम समय में इतनी बड़ी परीक्षा शीघ्रता से कराया जाना बहुत मुश्किल है ।

फ़िलहाल मामला अदालत में है , सरकार और अभ्यर्थी न्यायालय से जल्द फैसले की अपेक्षा में है जिससे सर्व शिक्षा अभियान
शीघ्रता से लागु हो और सरकार की इस कल्याण कारी शिक्षा अभियान से उत्तर प्रदेश के लाखों /करोड़ों बच्चों को मुफ्त शिक्षा मिल सके ।

उत्तर प्रदेश में 72,825 सहायक अध्यापकों की भर्ती प्रक्रिया को लेकर प्रदेश सरकार द्वारा दाखिल जवाब से हाईकोर्ट असंतुष्ट है। कोर्ट ने भर्ती प्रक्रिया पर रोक की अवधि अगले आदेश तक के लिए बढ़ाते हुए प्रदेश सरकार से पूरक शपथपत्र दाखिल करने को कहा है।

UPTET : हाईकोर्ट ने मांगी निर्देश के अनुपालन की जानकारी

- सहायक अध्यापक भर्ती मामला

- मामले की सुनवाई 18 को

जागरण ब्यूरो, इलाहाबाद : हाई कोर्ट ने बीएड डिग्रीधारक अभ्यर्थियों को सहायक अध्यापक भर्ती प्रक्रिया में शामिल करने को लेकर कोर्ट के जारी निर्देशों का पालन करने के संदर्भ में राज्य सरकार से कृत कार्रवाई के बारे में जानकारी मांगी है। कोर्ट ने स्पष्ट किया कि इस बीच संपन्न हुई चयन प्रक्रिया की कार्रवाई याचिका के अंतिम फैसले पर निर्भर करेगी। यह आदेश न्यायमूर्ति वीके शुक्ला ने संदीप मिश्रा व अन्य की याचिका पर दिया है।

गत 16 जनवरी को कोर्ट की खंडपीठ ने प्रभाकर सिंह व अन्य के मामले में 50 प्रतिशत स्नातक के साथ बीएड डिग्री धारकों को भी सहायक अध्यापक भर्ती प्रक्रिया में शामिल करने को कहा था। इसके लिए सरकार को 28 अगस्त 2010 के नोटिफिकेशन के अभ्यर्थियों को चयन प्रक्रिया के लिए आवेदन करने के लिए 15 दिन का अतिरिक्त समय का निर्देश दिया था। याची का तर्क है कि राज्य सरकार को कोर्ट के 16 जनवरी के आदेश का अनुपालन करना चाहिए इसके बाद ही चयन प्रक्रिया आरंभ करनी चाहिए। मामले की अगली सुनवाई 18 फरवरी को होगी
