Heard Sri Ashok Khare, learned Senior Advocate assisted by Sri R.D.Yadav,� learned counsel appearing for the petitioners, Sri K.K.Chand, learned counel appearing for respondents no.3 and 4 and Sri A.K.Yadav,� learned Standing Counsel appearing for the State-respondent no.1 and 2.
By means of this writ petition the petitioners have come up to this Court seeking a direction for appointment in Primary Schools on the post of Assistant Teacher. The petitioners were initially appointed as Shiksha Mitra in the year 2004. They continued as such� and pursuant to Government Order dated 14.5.2010 under 10% quota� reserved for Shiksha Mitra� for BTC Training the petitioners have completed their BTC Training� in the year 2014.
It appears that on 19.6.2014 (Annexure-3 to the writ petition) another Government Order was issued� for appointment of such Shiksha Mitra, who have completed their BTC Training� through distant mode or otherwise to be appointed� as Assistant Teacher in Primary Schools.
Learned counsel for the petitioners submits that in other Districts such appointments have been made. For example, they have annexed an order for selection and appointment of such Shiksha Mitra in District Lucknow. The petitioners belong to District Jalaun. The petitioners have already made a representation for being considered for selection and appointment� as Assistant Teacher but the same has not been considered so far.
Learned counsel appearing for the respondents submits that the said appointments are being made� only of such trained candidates, who have obtained their BTC Training through Distant Mode� and it is not for training through regular BTC or Special BTC.
This issue can be looked into by the Director of Education (Basic) U.P.-respondent no.2 before whom the petitioners may make a representation. If such a representation is filed, the Director of Education (Basic), U.P.-respondent no.2� will consider the claim of the petitioners and pass appropriate orders�� in accordance with law within a� period of three months from the date a certified copy of this order along with such representation is� presented� before it.
With the aforesaid direction, the writ petition is finally disposed of.�
