Heard Shri S.C. Dwivedi, learned counsel for the petitioner and Shri Vikram Bahadur Singh, learned counsel for the respondent no. 2 and Shri K.K. Rai, learned standing counsel for the respondents no. 1,3,4,5,6 and 7.
The petitioner is seeking a direction to the respondents to accept her application form for selection for the post of Assistant Teacher in Science and Mathematics and to call her in the counselling.
As stated in paragraph 18 of the writ petition the petitioner lives in a rural area and therefore she was not aware of the advertisement for filling up the post of Assistant Teacher in Science and Mathematics and there are no facilities in the rural area of internet and electricity and therefore she could not submit her application form.��
In my opinion, the reasons given by the petitioner for not submitting her application form cannot be accepted inasmuch as if the petitioner wanted to apply for the said post she should have been alert and vigilant that a selection is going to be held.� She cannot take a stand that there is no electricity in her house and no internet facility and therefore she could not submit her application form.�
The writ petition is thoroughly misconceived, devoid of merit and is accordingly dismissed.
