The first exercise to determine the surplus teachers was carried out in the year 2017. The said determination as well as transfer orders are subject matter of challenge before this Court in the present writ petition.
Shri Sanjay Aggrawal, Additional Chief Secretary, State of U.P. has filed his personal affidavit in pursuance of orders dated 28.05.2018 and 14.05.2018 of this Court.
In paragraph 5 of the said affidavit, it is specifically mentioned that fresh exercise of determining surplus teachers in Kanpur Nagar has been carried out.
In view of the aforesaid, the earlier determination of surplus teachers and transfer orders do not survive. The respondents and the authorities concerned are at liberty to issue posting orders as per fresh determination carried out by them for Kanpur Nagar. The respondents are at liberty to post the surplus teachers in other institutions as per requirement and as per the provisions of the Right to Education Act, 2009.
With the aforesaid observations/directions, this writ petition is finally disposed of.
