Ground of the Complaint:
The complainant is not satisfied with the information received from PIO and hence the complaint.

Relevant Facts emerging during Hearing:
The following were present

The PIO admits that information on query-1 & 2 would be available with the Department. There is no apparent reasons as to why this information was not provided by the then PIO Ms. Nalini Rajotya.
Decision
:
The complaint is allowed.

The present PIO Mrs. Reetu Singh is directed to provide the information to the Complainant on query-1 & 2 as per available record before 30 July 2011.

The issue before the Commission is of not supplying the complete, required information by the then
PIO Ms. Nalini Rajotya within 30 days as required by the law.
From the facts before the Commission it is apparent that the then PIO is guilty of not furnishing
information within the time specified under sub-section (1) of Section 7 by not replying within 30 days, as per the requirement of the RTI Act. It appears that the then
PIO’s actions attract the penal provisions of Section 20 (1). A show cause notice is being issued to her, and she is directed give her reasons to the Commission to show cause why penalty should not be levied on her.
The then PIO Ms. Nalini Rajotya will present herself before the Commission at the above address on
11 July 2011 at 2.30am alongwith her written submissions showing cause why penalty should not be
imposed on her as mandated under Section 20 (1). She will also submit proof of having given the
information to the appellant.

If there are other persons responsible for the delay in providing the information to the Appellant the PIO is directed to inform such persons of the show cause hearing and direct them to appear before the Commission with her.
This decision is announced in open chamber.
Notice of this decision be given free of cost to the parties.
Any information in compliance with this Order will be provided free of cost as per Section 7(6) of RTI Act.

चंडीगढ़. शिक्षक भर्ती घोटाले में सीबीआई ही पर्दा डालने में लगी हुई हैकेंद्रीय सूचना आयोग ने सीबीआई की चंडीगढ़ ब्रांच को शिक्षक भर्ती घोटाले की प्रारंभिक जांच रिपोर्ट छिपाने पर फटकार लगाते हुए 10 दिन के भीतर अपनी जांच रिपोर्ट और सिफारिश के दस्तावेज सामाजिक कार्यकर्ता हेमंत गोस्वामी को उपलब्ध कराने को कहा है। 

गोस्वामी ने आरटीआई के तहत यह जानकारी मांगी थी। सीबीआई की चंडीगढ़ ब्रांच ने शिक्षक भर्ती घोटाले की अपने ही एक अधिकारी से जांच करवाई थी। इसमें कई चौंकाने वाले तथ्य सामने आए थे। रिपोर्ट में सीबीआई ने प्रशासन के चीफ विजिलेंस कमीशन और डोएक सोसाइटी को अपने स्तर पर कार्रवाई करने को कहा था

इस रिपोर्ट के आधार पर कोई ठोस कार्रवाई के बजाय सीबीआई मामले में पर्दा डालने में लगी हुई थी। हेमंत गोस्वामी ने आरटीआई के तहत सीबीआई से इस जांच रिपोर्ट की कॉपी मांगी तो उन्हें 200 पेज की जांच रिपोर्ट के रुपये जमा कराने के बाद भी रिपोर्ट की कॉपी नहीं सौंपी

जांच प्रभावित होने का बहाना

सीबीआई के अधिकारी पहले जहां हाईकोर्ट में केस लंबित होने के कारण रिपोर्ट नहीं दे रहे थे। वहीं अब हाईकोर्ट द्वारा दिल्ली सीबीआई को जांच सौंपे जाने के बाद जांच प्रभावित होने का बहाना बनाया जाने लगा। सीबीआई के अधिकारियों ने सूचना आयोग के समक्ष पक्ष रखा कि सीबीआई को सेकंड शेड्यूल में शामिल किया जा चुका है, ऐसे में सूचना का अधिकार उन पर लागू नहीं होता

देनी ही होगी जानकारी
आयोग ने सीबीआई को यह कहकर फटकार लगाई कि वह पहले ही प्रशासन और डोएक सोसाइटी को अपनी जांच के दस्तावेज उपलब्ध करा चुकी है, तो फिर जांच प्रभावित होने का सवाल ही नहीं उठता। सीबीआई को सेकंड शेड्यूल में शामिल किए जाने से पहले आवेदक द्वारा यह जानकारी मांगी गई थी। इसलिए सीबीआई की चंडीगढ़ ब्रांच को यह जानकारी आवेदक को देनी होगी

SSC, HSC students can use RTI to see answer sheets


The state education board is set to usher in a more transparent evaluation system: starting this year, students sitting for the Class X state board exam and the Higher Secondary Certificate (HSC) will be able to get a copy of their corrected answer booklets under the Right To Information (RTI) Act. In the past, the state board did not entertain RTI applications from students who wished to see their evaluated papers, but will now have to do so in accordance with an August 2011 SC ruling. Education officials said a circular has been sent to all city SSC schools and junior colleges directing faculty to ensure that students are aware of this new feature. The state board is yet to inform students of the procedure and deadlines.

"Students have every right to know where they went wrong and how they were marked. The SC order was announced a couple of months ago and we have decided to implement it this year itself," said Ravindra Bhise, divisional secretary of the state board. This new rule will also bring in a measure of accountability. The circular said that if the board finds fault in the marking process of a paper, which a student has submitted for revaluation, the examiner and moderator of that paper will be held responsible.

In August 2011, the SC had announced that "any student aggrieved by the marks awarded to him/her in the exams can now make an application and have a look at how the marks have been awarded". Principals believe that other boards, too, should adopt this rule. "Though we haven't been notified by the Council for the Indian School Certificate Examinations, the ICSE board being a national board comes under the purview of the RTI Act. Our students should be able to avail of this feature," said Carl Laurie, principal of Christ Church School.

This is a year of many firsts for the state board, which has announced that the final Science practicals for SSC students can be evaluated by the school itself. With a change in the Science and Math curriculum, the evaluation process for these subjects has also changed. SSC students will appear for a 60-mark theory (Science) paper at the examination centre. The remaining 40 marks are divided into 20-mark practicals and a 20-mark objective-type question paper, which will be conducted and evaluated by the school itself.

"As the internal marking for the rest of the subjects is handled by the school, we decided that even the Science practicals for Class X students can be held without the need for an external examiner," said an official from the state board, Pune. "We aim to ensure that students get through the examination season with as little tension as possible. We are doing everything in our capacity to help our students," added Bhise. HSC exams will begin on February 21, while the SSC examination will start on March 1.

पाली। औद्योगिक प्रशिक्षण संस्थान में अनुदेशकों की अतिरिक्त ड्यूटी अन्य कार्योü में लगाने से परीक्षा परिणाम प्रभावित हो रहा है। अनुदेशक चुनावी व जनगणना कार्य पर लगे होने से छात्रों को शिक्षण नहीं करा पाते हैं। नतीजतन कई छात्र अनुत्तीर्ण हो जाते हैं। वर्ष 2009-2010 में भी अनुदेशकों के इसी तरह के कार्योü में जुटे होने से वैल्डर व्यवसाय का परीक्षा परिणाम खासा प्रभावित रहा। सूचना के अधिकार के तहत दी गई जानकारी में प्रशिक्षण संस्थान के अधीक्षक ने यह बात स्वीकारी।
शिक्षकों को अतिरिक्त कार्योü में लगाए जाने का सीधा प्रभाव शिक्षण कार्य पर पड़ रहा है। इससे न केवल परीक्षा परिणाम प्रभावित हो रहा है, बल्कि विद्यार्थियों का भविष्य भी दांव पर लगा है। ऎसे में अनुदेशकों का उचित मार्गदर्शन नहीं मिलने से छात्रों को स्वयं के स्तर पर ही तैयारी करनी पड़ती है।
