The petitioners have all qualified the Central Teacher Eligibility Test conducted by the Central Board of Secondary Education. They belong to the Other Backward Caste Category. They have obtained 82 marks out of 150. Consequently, the percentage of their marks works out to be 54.67. 
According to the guidelines framed by the National Council for Teacher Education on 11.2.2011 read with the clarification issued on 1.4.2011, a candidate appearing in the test will be treated to have passed the test provided he scores 60% or more marks in the test. This percentage is reduced by 5% in relation to the reserved category candidates.

The purpose of providing these minimum marks have been indicated in clause 9 of the Notification dated 11.2.2011. It provides that even in the recruitment process weightage has to be given to the TET scores. 

The petitioners contend that they have been declared to have passed the CTET with only 82 marks and, therefore, according to the U.P. Basic Education Teachers Service Rules, 1981, they should be treated to be eligible as they possess the essential qualification of Teacher Eligibility Test.

However, the forms for applying to the post of Assistant Teacher which have to be uploaded on online basis, for which the last date is today, the minimum marks required for the reserved category candidate is indicated as 83 out of 150 which is 55.43%. 
Sri V. Singh, learned counsel for the petitioner, contends that if the petitioners have been declared to have qualified the Teacher Eligibility Test conducted by the Central Board of Secondary Education, then such eligibility should also be included in respect of such candidates, who have obtained 82 marks out of 150. He submits that there can be no discrimination, as the percentage of the petitioner which is 54.67% should be read as 55%. 
He contends that no candidate can obtain any fraction of marks because every question has one mark allotted in the answer-book. Consequently, if a candidate gets 82.6 marks, then only he will be able to score 55% and, therefore, on account of this anomaly existing, the Central Board of Secondary Education took a decision to treat such candidates to have qualified, who have obtained 82 marks. The reasons appears to be that no candidate can get half a mark or any fraction as on evaluation one gets full one marks or none. Thus, the CBSE which is the examining body has treated 82/150 = 54.67% as the pass percentage to qualify in the examination. Sri Singh, therefore, submits that the same criteria should be adopted by the State of U.P. while offering appointment to Assistant Teachers under the 1981 Rules.
Having considered the aforesaid submissions raised, primarily this is an issue of policy which has to be decided by the National Council for Teacher Education and it does not fall within the authority of the Central Board of Secondary Education to give any such decision in relation to calculation.
The reason is very simple inasmuch the National Council for Teacher Education is the Academic Authority defined and entitled to lay down the norms of minimum qualifications as per Section 23 of the the Right of Children to Free and Compulsory Education Act, 2009. The power, therefore, vests in the Academic Authority and not in the Central Board of Secondary Education.
There is nothing on record to indicate that the National Council for Teacher Education has considered this anomaly to be read in favour of the petitioners. In such a situation, the petitioners ought to have approached the National Council for Teacher Education for the redressal of their grievances. 
I am not inclined to issue any mandamus as prayed for in view of the fact that the existing norms clearly require the possession of 55% or more marks in relation to the reserved category candidates. The score of 82 out of 150 does not amount to 55% or more and the principles of rounding off will not be available in view of the fact that the prescription in clause 9 of the guidelines dated 11.2.2011 clearly recites, the minimum percentage or more as the score, which has to be obtained by a candidate. In such circumstances, less than 55% is not contemplated therein.
Accordingly, the writ petition is consigned to records with liberty to the petitioners to approach the National Council for Teacher Education for any such clarification.

The petitioners' case is not different from the same on merits.� The prayer in the present writ petition is for� mandamus commanding the respondent no.4 District Basic Education Officer, Lalitpur to consider the appointment of the petitioners on the post of Assistant Teacher� without having passed the TET. This claim cannot be accepted in view of the� Notification dated 23.8.2010 issued by the Academic Authority under the NCTE Act 1993 read with Section 23 of the 2009 Act.. 
The writ petition lacks merit and is accordingly dismissed.

The petitioner claims inclusion of the two years diploma course (D.Ed.) for the purpose of appointment as an Assistant Teacher as per the Notification dated 26.4.2013. The prayer in essence is to include this qualification also as a qualification for such appointment.
The court cannot exclude or include qualifications for such appointments merely becuase such a qualification is also recognized for the teacher eligibility test. The teacher eligibility test is another qualification that makes one eligible for consideration but such a qualification if not prescribed under the appointment rules, cannot be engrafted through a judicial intervention. The petitioner can approach the State Government for the redressal of his grievances.
The writ petition is dismissed with the said observation

Heard learned counsel for the petitioner and Sri Virendra Chaubey for the respondent. 
The petitioner appeared in the TET Examination, 2011. He contends that he is of the O.B.C. Category but in the OMR Sheet the correct marking could not be made as a result whereof the petitioner was treated to be a general category candidate and he was declared fail as he had not obtained the minimum of 60% marks
Learned counsel for the petitioner contends that if the petitioner is treated to be of the other backward category then there was an exemption of 5%, and according to that he had more than 55% marks therefore he may be declared successful. 
The petitioner appeared in the examinations in November, 2011. Fresh examinations are now going to be conducted very shortly. The petitioner has waited for more than one and a half years and therefore there is no valid reason to interfere at his instance. 

This alleged error which is being described as a human error has been discovered after one and a half years for approaching this court, therefore I am not inclined to exercise jurisdiction under Article 226 of the Constitution of India. It is open to the petitioner to apply for fresh examinations again. 
The writ petition is dismissed with the aforesaid observation.

Sri Khare contends that the government order dated 26.4.2013 issued for appointment as Assistant Teachers wrongly excludes the qualification of two years Nursery Teachers Training Course which is a course recognised as per the norms of the National Council for Teacher Education and is also a qualification indicated in the qualification of Teachers Eligibility Test. 

He therefore submits that the respondents have erroneously advertised the posts for recruitment without including the aforesaid training course which is possessed by the petitioners.He also places reliance on the amended Rule 8 of the 1981 Rules. 

Having heard Sri Khare it is relevant to mention that the qualifications that are prescribed for appointment are contained in U.P.Basic Education Teachers Service Rules, 1981 as amended up to the Sixteenth Amendment where no such qualification as indicated by the petitioner is mentioned.

The contention is that such qualifications are recognized by the National Council for Teacher Education both for appointments and for Teacher Eligibility Test. The same may be correct but the Court is unable to find out a generic nexus between the qualifications mentioned in Rule 8 of the qualifications prescribed under the 1981 Rules with the qualification of the petitioners. Thus even assuming for the sake of arguments that the prescription of the qualifications are not exhaustive yet in the absence of any specific mention of the said qualification� in the rules, the argument cannot be accepted.
It is relevant to mention that the petitioners are seeking recruitment as Assistant Teachers in Primary Schools. 

In the opinion of the Court a qualification cannot be read into by a judicial interpretation unless there is any material of equivalence available. The Court does not find any such material and therefore to accept the said qualification would fall within the realm of the policy decision or any executive decision by an appropriate induction of the said qualification in the rules by the Rule making authority.
For this the petitioners will have to approach the State Govt. namely the respondent No.1 for the redressal of their grievances. No mandamus can be issued as prayed for.
The writ petition is dismissed with liberty to the petitioners to approach the respondent no.1 for the rederessal of their grievances.

The petitioner holds the upper elementary TET Certificate which is for classes VI to VIII. This was detected and accordingly the petitioner has not been offered appointment in a Primary School of the level of classes I to V.
The petitioner has come up praying for a mandamus that since she has been successful in the examination, she is entitled for being appointed in a Primary School according to the directions of the Secretary of the U.P. Basic Education Board dated 8.3.2013.
The TET is held for both category of teachers namely those who want to apply for classes� I to V and those who want to apply for classes VI to VIII.
Once the petitioner does not possess the eligibility test qualification, which is required for classes I to V, she cannot compel the respondent to issue a letter of appointment to the petitioner.
There is no merit in the writ petition and is, accordingly, dismissed.

Heard learned counsel for the petitioner as well as the learned Standing Counsel and perused the record. 
The writ petition has been filed seeking suitable order or direction to the opposite parties to modify the eligibility conditions prescribed in the guidelines issued vide Government Order dated 17.4.2013 with respect to UP-TET. 
It is submitted by learned counsel for petitioner that in the graduation the petitioner has obtained less than 45% marks whereas in the post graduation she has obtained more than 50% marks. As per the eligibility criteria prescribed for admission, such as B.Ed. course run by the State Universities a candidate having graduation or post graduation with 50% marks shall be eligible for admission, however in the eligibility criteria for UP-TET laid down vide Government Order dated 17.4.2013 a candidate is required to have passed graduation with 50% marks. There is no provision for the candidates who have passed post graduation with 50% marks. 
It is further submitted that once the candidates having passed post graduation with 50% marks are eligible for admission in teachers course as such B.Ed. they shall also be eligible for appearing in UP-TET which is a Teachers Eligibility Test. 
It is also submitted that N.C.T.E. vide notification dated 23.8.2010,� modified on 1.4.2011� has modified� the eligibility conditions� for T.E.T. and relaxation of 5% in qualifying marks (Graduation) to the candidates belonging to the SC/ST etc. has been provided, however no relaxation in graduation marks for such candidates has been provided in UP-TET. 
Learned Standing Counsel on the basis of instructions submits that as per the eligibility criteria as provided� by the Government Order dated 17.4.2013 the requirement is that a candidate should have passed graduation with minimum 50% marks. The petitioner has not got minimum 50% marks in graduation, as such she is not eligible to appear in UP-TET. 
I have considered the submissions made by the parties' counsel. 
It appears that in the eligibility criteria as prescribed vide Government Order dated 17.4.2013, there is no provision for candidates who have passed post graduation with 50% or more than 50% marks. It is for the State Government to decide as to whether such candidates who have passed post graduation with 50% marks or more than 50% marks are to be treated eligible for appearing in UP-TET or not, as has been provided by the N.C.T.E. for B.Ed. course. 
Since the last date for filling Online application forms for UP-TET is 27.5.2013, the matter is relegated to the State Government to decide the aforesaid issue before the last date for filling the application forms. 
The petitioner may move appropriate representation in this regard before the opposite party no. 1/Principal Secretary, Basic Education, who may take appropriate decision in this regard in the light of the observations made hereinabove. 
With the aforesaid observations, the writ petition is disposed of.

It is also provided that 5 per cent relaxation in marks would be available to SC/ST/OBC/Handicap/Freedom Fighter dependents/Ex-defence personnel.
Submission is that the eligibility criteria of 50 per cent marks in post graduation has been left out from the eligibility for UP-TET.
It is also submitted that NCTE vide notification dated 23.8.2010 which was modified vide notification dated 1st April, 2011 has laid down eligibility for the purpose of B.Ed. course which provides relaxation of 5 per cent in the qualifying marks (graduation) to the candidates belong to SC/ST, etc. category, however, no relaxation in graduation marks for SC/ST/OBC etc has been provided in UP-TET.
The contention is that if the same criteria is applicable for UP-TET, the petitioner would become eligible.
Learned Standing Counsel is directed to seek instructions in the matter.

ये कुछ महत्वपूर्ण सवाल हैं जिन्हें हरजेंदर नगर इंटर कालेज में शिक्षक पदों पर नियुक्ति के लिए आवेदन करने वाले अभ्यर्थियों ने प्रबंधतंत्र व शिक्षा अधिकारियों के सामने उठाए थे परंतु उन्हें सही जवाब नहीं मिला। अब उच्च न्यायालय ने इसका जवाब मांगा है तो हड़कंप है। हुआ यूं कि सफीपुर की प्रतिमा द्विवेदी ने उच्च न्यायालय में एक याचिका दाखिल की जिसमें उन्होंने एक समाचारपत्र में 9 जुलाई 2011 तथा दूसरे समाचारपत्र में 14 जुलाई 2013 को प्रकाशित विज्ञापनों का हवाला देकर कहा कि एक में टीईटी की अनिवार्यता दी है और दूसरे में शासन के अधिनियम का जिक्र करते हुए जो अर्हता दी उसमें टीईटी का जिक्र नहीं है।

न्यायालय ने जिला विद्यालय निरीक्षक को जवाब लगाने का निर्देश दिया और कहा कि यदि इस बीच नियुक्ति प्रक्रिया की जाती है तो वह याचिका के निर्णयाधीन रहेगी। विद्यालय निरीक्षक कोमल यादव ने प्रबंधक को पत्र जारी करके इस बाबत स्पष्टीकरण मांगा है। उन्होंने यह भी कहा है कि इंटरमीडिएट शिक्षा अधिनियम में वर्णित परिषद के विनियम एक अध्याय 2 के परिशिष्ट क में इंटरमीडिएट अनुभाग से संलग्न प्राथमिक अध्यापकों की अर्हता केवल प्रशिक्षित स्नातक दी है। कालेज प्रबंधन ने पिछली दस जून को साक्षात्कार लिया था

टीईटी ः हेल्पलाइन से भी नहीं मिल रही हेल्प



लखनऊ। राजधानी के तेलीबाग निवासी प्रीति ने यूपी शिक्षक पात्रता परीक्षा-2013 (यूपी-टीईटी) में भाग लेने के लिए आवेदन किया था। उनका रजिस्ट्रेशन नंबर 2900013745 है। प्रीति ने परीक्षा का प्रवेश-पत्र पाने के लिए बेसिक शिक्षा परिषद की आधिकारिक वेबसाइट पर लॉग-इन किया तो उन्हें आवेदन निरस्त होने की सूचना मिली। कारण जानने के लिए उन्होंने टीईटी-2013 की हेल्पलाइन सेवा पर संपर्क किया पर उन्हें कोई जानकारी नहीं मिली।
प्रीति को बताया गया कि इस समस्या को लेकर प्रदेशभर से रोज 200 से ज्यादा कॉल आ रहे हैं। उनके पास इस संबंध में कोई जानकारी नहीं है। प्रीति की ही तरह राजधानी की सुषमा, अनुराग समेत दर्जनों आवेदक आवेदन निरस्त होने से परेशान हैं। 27 और 28 जून को आयोजित होने वाली इस परीक्षा के प्रवेश-पत्र अब तक उन्हें नहीं मिल पाए हैं।
अभ्यर्थियों की समस्याओं को दूर करने के लिए हेल्पलाइन सेवा की शुरुआत की गई है। यूपी परीक्षा नियामक प्राधिकरण इलाहाबाद से 0532-2466761 व 0532-2466769 पर संपर्क किया जा सकता है। वहीं, एसबीआई गवर्नमेंट बिजनेस शाखा में 9454713363, 8004923042 और 8004922875 पर सुबह 10:30 से शाम छह बजे तक संपर्क करने की सूचना जारी की गई। आवेदकों के अनुसार इन हेल्पलाइन नंबर पर फोन तक रिसीव करने वाला नहीं है।
