The present petition has been filed by the petitioner praying inter alia
that the appointment of the respondent No.4 be declared as bad in law and her appointment to the post of TGT (Hindi) be quashed.
2. Briefly stated, the facts of the case are that the IAF Educational and
Cultural Society had issued an advertisement dated 31.01.2012 for
recruitment of teaching and administrative staff, including the appointment of teachers to the post of TGT (Hindi), which is the subject matter of the present petition. The required qualification for the post of TGT (Hindi) was graduation in Hindi (Hons.) with 50% marks and Bach
elors Degree in Education. The applicants were expected to submit their forms to the respondents by 09.02.2012. The eligible candidates
had to undergo a written test on 09.02.2012 and those, who would qualify in the written test, were to participate in a personal interview.
3. It is the petitioner’s case that she had appeared in the written examination on the date and time mentioned in the advertisement and she had successfully cleared the said examination. Vide intimation dated
24.02.2012, the petitioner was called to appear for an interview on
02.03.2012. The petitioner had appeared before the Selection Board on the assigned day for an interview, whereafter she kept waiting for the results to be declared by the respondent No.1/School. However,
when the petitioner accessed the website of the respondent No.1/School,she discovered that her name was not included as one of the successful candidates.
4. Aggrieved by the results declared by the respondent No.1/School for
the post of TGT (Hindi), the petitioner had a legal notice dated 9.4.2012
issued to the respondent No.1/School stating inter alia that she possessed the desired educational qualifications and had also cle
ared the written examination and participated in the interview but was not selected, in violation of the rules and regulations. It was also stated that as per the Notification dated 23.08.2010 issued by the Nationa
l Council for Teacher Education (in short ‘NCTE’), it is mandatory for a
candidate to qualify in the Teacher Eligibility Test (in short ‘TET’) which is conducted by the appropriate Government in accordance with the Guidelines framed in that regard and if the School had appointed a teacher, who did not qualify the TET, then such an appointment was invalid.
5. When the petitioner failed to receive any response from the
respondent No.1/School, she filed a writ petition in this Court, registered as W.P.(C) 3025/2012 praying inter alia that the respondent No.1/School be directed to appoint her to the post of TGT (Hindi).
6. The aforesaid petition was disposed of vide order dated 18.05.2012,
with directions to the respondent No.1/School that it should respond to the legal notice dated 09.04.2012, by passing a speaking order and the same should be communicated to the petitioner. The aforesaid order was passed at the stage of admission and at that time, the School
was not represented before the court. In the meantime, the respondent
No.1/School on its own sent a reply dated 19.5.2012 to the legal notice issued by the petitioner, denying the allegations leveled against it and stating inter alia that the petitioner was not found fit for selection to the p
ost of TGT (Hindi) and was therefore, not selected. It was also stated that the Selection Committee had considered the candidature of all the candidates objectively and thereafter, selected the eligible candidates. Aggrieved by the aforesaid stand taken by the respondent No.1/School, the petitioner has filed the present petition.
7. The leitmotif of the arguments advanced by the counsel for the
petitioner to challenge the appointment of the respondent No.4 to the subject post is that the NCTE Notification dated 23.08.2010
prescribes that a school cannot appoint teachers to the post of Primary Regular Teacher (PRT) or TGT (Class I to VIII) when they do not possess the TET certificate. He submits that the petitioner herein possesses the TET certificate issued by the Haryana Education Board, but the respondent No.4, who has been selected to the subject post, does not possess the said qualification and therefore her
appointment ought to be quashed.
8. Ms. Palli, learned counsel for the respondent No.1/School disputes the submission made by the counsel for the petitioner and draws the attention of the Court to the Circular dated 06.03.2012 issued b
y the respondent No.2/CBSE, wherein it is stated that the TET conducted by the Central Government would apply to schools under the Central Government and Union Territories without Legislature, and that the Managements of the schools affiliated to the Boards such as CBSE, ICSE etc. may also opt for the TET conducted by the Central Government. Learned counsel states that the Notification dated 23.08.2010 issued by the NCTE was directed to be implemented by the CBSE only on 06.03.2012, whereas the subject advertisement was issued prior thereto, on 31.01.2012 and the selection process was completed by 02.03.2012, which was also prior in time and
therefore, possession of a TET certificate was not mandatory for the
candidates at that point in time.
9. Supporting the aforesaid submission, learned counsel for the
respondent No.4 adds that though possession of a TET certificate was not mandatory prior to issuance of the Circular dated 6.3.2012, his client had passed the Uttar Pradesh Teacher Eligibility Test held in November, 2011, as stipulated in the Notification dated 23.8.2010 issued by the NCTE. In support of the said submission, learned counsel refers to page 215 of the paper book, where he has filed a copy of the Certificate dated 25.11.2011 issued by the Board of High School and Intermediate
Education, Allahabad, Uttar Pradesh, in favour of the respondent No.4, certifying inter alia that she had passed Uttar Pradesh Teacher Eligibility Test held in November, 2011 (Upper Primary Level). He further states that subsequently in the year 2013, the respondent No.4 had passed Central Teacher Eligibility Test (in short
‘CTET’) and was issued a Certificate dated 02.09.2013, that is placed at
page 216 of the paper book.
10. In view of the documents placed on record by the respondent No.4
that include a TET certificate of Upper Primary Level issued in her favour
by the State of U.P. and a CTET certificate issued in her favour by the CBSE, it is manifestly clear that she satisfies the requirements of the Notification dated 23.08.2010 issued by the NCTE. Moreover as is apparent from a perusal of the advertisement enclosed with the writ
petition, at the time when the subject advertisement was issued by the respondent No.1/School, inviting applications to fill-up the posts of TGT (
Hindi), it was not mandatory for the candidates to possess the TET certificate. The only qualifications that a candidates was required to po
ssess was graduation in Hindi (Hons.) with 50% marks and a Bachelor’s degree in Education and the respondent no.4 fulfilled both the qualifications.
11. The submission of the counsel for the petitioner that the copies of the certificates filed by the respondent No.4 ought to be verified by the
respondent No.1/School, is found to be rather incongruent in the light of the fact that on her part, the petitioner has chosen not to file any such certificate to substantiate her claim that she possesses a TET
certificate purportedly issued by the State of Haryana. This demand is all
the more discordant when the sole argument advanced on behalf of the petitioner to assail the appointment of the respondent No.4 is non-possession of the TET certificate by her. Had the petitioner wanted to file the said certificate, she had an opportunity to do so alongwith the writ petition and having failed to do so at that stage, she could have done so while filing the rejoinder to the counter affidavits filed by the respondent no.1/School and respondent No.4.
However, for reasons best known to her, the petitioner elected not to do so.
Therefore, counsel for the petitioner cannot insist that the respondent No.4 be directed to produce her original certificates for purposes of verification.
12. In view of the aforesaid facts and circumstances, this Court is of the
opinion that the appointment of the respondent No.4 to the post of TGT
(Hindi) does not suffer from any illegality or arbitrariness for interference in the present proceedings. The writ petition is dismissed as being devoid of merits while leaving the parties to bear their own costs.

LPA  No.223/2015,  LPA  No.225/2015  and  LPA  No.227/2015,  lay  a
challenge  to  a  common  judgment  and  order  da
ted  February  25,  2015,
allowing   W.P.(C)   No.1944/2014,   W.P.(C)   No.2112/2014   and   W.P.(C)  No.1845/2014  filed  by  Manju  Nautiyal,  Shayam  Dutt  and  Anita  Soharu  Guleria  respectively  :  the  contesting  respondent  No.1  in  the  three  appeals. 
LPA No.314/2015 lays a challenge to a judgment and order dated April 27,  2015 allowing W.P.(C) No.6180/2013 filed by Renu Barrot : the contesting respondent No.1 in the said appeal.  LPA No.347/2015, LPA No.348/2015, LPA   No.353/2015,   LPA   No.355/2015   and   LPA   No.356/2015   lay   a challenge  to  a  common  judgment  and  order  dated  April  29,  2015  allowing LPA 223/2015, 225/2015, 227/2015, 314/2015, 347/2015, 348/2015, 353/2015, 355/2015 & 356/2015 exploited.    In  spite  of  vacant  posts  being  available  contract  appointment  is
being resorted to and this results in deterioration in the quality of education being imparted in Delhi. 
15. It  ill lies  in  the  mouth  of  the  appellant  to  argue  that  if  all  the
respondents   are   regularized   by   being   made   permanent   the   quality   of
education   in   the   two   schools   established   by   appellant   No.1   would
deteriorate.  If such respondents who are teachers are found good teachers to
teach as
contract employees we see no deterioration taking place if they are
made   permanent.      Of   course,   the   issue   of   the   necessary   educational
qualifications  is  a  different  matter  and  we  would  deal  with  the  same  while
deciding individual appeals.
16.To  put  the  law  in  its  correct  perspective  we  hold  that  recognized
private  schools  in  Delhi  cannot  resort  to  temporary,  tenure  or  contractual
appointments  save  and  except  where  a  vacancy  is  available  for  a  limited
duration.    To  give  some  examples.    A  teacher  has  proceeded
on  child  care leave  for  a  period  of  one  year.    The  lien  being  retained  to  the  post,  a  short term  vacancy  for  one  year  ensues  and  can  be  filled  up for  said  period.    A
teacher,  on  being  unwell,  applies  for  and  is  sanctioned  medical  leave  for
three months.  The lien being retained to the post, a short term vacancy for
three  months  ensues  and  can  be  filled  up  for  said  period.    A  teacher  may
suddenly resign.  The process to fill up the vacancy is likely to consume say
6 months.  Teaching would suffer if no teacher is available immediately.  It
would be a situation of a short term vacancy pending regular selection and it
would  be  permissible  to  recruit  a  teacher  without  following  the  process  of
selection  and  limiting  the  tenure  till  when  a  regular  teacher  is  appointed. 
But  where  a  vacancy  exists  it  would  be  a  fraud  on  the  statute  to  resort  to
LPA 223/2015, 225/2015, 227/2015, 314/2015, 347/2015, 348/2015, 353/2015, 355/2015 & 356/2015 short term tenure appointment and that too endlessly.
17.We  now  turn  to  individual  cases.    We  transpose  ourselves  back  to paragraph  2  of  our  opinion,  where  we  have  noted  the  different  tenures  of appointment of the nine respondents in the nine captioned appeals. 
18.Manju  Nautiyal  has  a  post  graduate  degree  in  Botany  as  well  as  a
Bachelor’s  Degree  in  Education.    Appointed  as  a  Primary  Teacher  on
September  01,  2009  she  worked  as  a Primary  Teacher  till  March  31,  2010
and after a break of one year, three months and seven days was appointed as
a  Trained  Graduate  Teacher  on  July  08,  2011  and  with  short  breaks  in
service  of  less  than  30  days  she  continued  to  be  employed  till  March  26,
2014.  Her  appointment at every stage was preceded by a selection process
being  resorted  to.    Qua  her  it  is  not  the  case  that  there  was  no  regular
vacancy.  The defence is that she does not possess a two years’ diploma in
Elementary  Education,  a  mandatory  requirement  as  per  the  Rules.    When
questioned as to why was she appointed on a tenure if she was not qualified,
learned  counsel  for  the  appellant  had  no  answer.  
We  find  that  the requirement of two year diploma in Elementary Education was prescribed as per a notification dated July 29, 2011.  Her appointment as a TGT preceded
said  notification
.    We  therefore  concur  with  the  reasoning  of  the  learned
Single Judge that in the peculiar facts and circumstances concerning Manju
Nautiyal she would be entitled to be made permanent.   
19.Right  to  Shayam  Dutt  is  questioned  on  the  ground  that  there  was  no
permanent  post  of  either  Assistant  Estate  Supervisor  or  Estate  Supervisor. 
We find that his appointment was preceded by a selection undisputedly one
Mr.Nayyar had worked as an Estate Supervisor from 1995 to the year 2000
and  thereafter  one  Mr.Shekhawat  till  the  year  2003.    Shayam  Dutt  was
LPA 223/2015, 225/2015, 227/2015, 314/2015, 347/2015, 348/2015, 353/2015, 355/2015 & 356/2015 appointed as an Assistant Estate Supervisor on December 01, 2009 and with
short  breaks  tenure  was  extended  till  May  23,  2011,  but  in  between,  on
November 01, 2010 the post was designated as Estate Supervisor and he was re
-appointed  with  breaks  of  between  7  and  10  days  till  March  31,  2014.
Facts  belie  the  defence  of  the  appellant  that  they  do  not  require  on
permanent basis an Estate Supervisor and thus we hold against the appellant
and in favour of Shayam Dutt. 
20.Anita  Soharu  Guleria’s  claim  was opposed on  she  not  clearing  a
Teacher’s Eligibility Test notified as per NCTE notification dated July 02,
2011.    That  she  possesses  the  requisite  educational  qualifications  was
conceded  to.    We  find  that  Anita  Soharu  Guleria  was  appointed  as  a  TGT

way  back  on  July  14,  2007  and  with  a  short tenure  as  a  primary  teacher  in
the  year  2009  she  was  once  again  taken  back  as  a  TGT  and  continues  to
work  as  a  TGT.    The  NCTE  notification  does  not  have  any  retrospective
operation and
thus we hold in favour of Anita Soharu Guleria. 
21.Concerning Renu Barrot the plea was that she was overage.  The plea
overlooks  that  when  she  was  appointed  as  a  TGT  on  August  02,
2010  she was  39  years  of  age.    The  maximum  age  for  female  teachers  is  40  years. 
The defence qua her is also rejected. 
22.Vikram  Singh  and  Shatrughan  Thakur  were  appointed  as  Drivers. 
The former in the year 2005 and the latter in the year 2006.  The two a
re ExServicemen and had a past experience of driving.  It may be true that they do
not  possess  the  matriculation  degree,  but  keeping  in  view  the  fact  that  the
educational  degree  is  otherwise  having  no  concern  with  the  duties  to  be
performed  by  the  two,  we hold  that  the  learned  Single  Judge  has  correctly
decided in their favour by directing their services to be regularized. 
LPA 223/2015, 225/2015, 227/2015, 314/2015, 347/2015, 348/2015, 353/2015, 355/2015 & 23.Ravi     Kumar     was     appointed     as     a     Computer     Laboratory
Helper/Attendant  on  May  14,  2013  and  his  services  were  continued  till
September  30,2015.    As  per  the  appellant  there  is  no  sanctioned  post  of  a
Computer  Laboratory  Helper/Attendant.    Ravi  Kumar  has  not  given  any
proof  of  a sanctioned  post of  a  Computer  Laboratory  Helper/Attendant and
keeping this in mind as also the fact that he worked on contract for only two
years and when he was appointed the process of selection was not followed. 
We hold against him and in favour of the appellants. 
24.As regards Sheeja Benoy we find that she has continued to work as a
Nursing Assistant since August 08, 2008.  The defence qua her is that there
is no sanctioned post of a Nursing Assistant, but since the school where she
was  employed  and  continues  to  be  employed  has  a  sick  room  we  hold  that
the  nature  of  job  performed  by  her  requires  permanency  and  thus
repel  the challenge to the relief granted to her by the learned Single Judge. 
25.Bir  Singh  was  appointed  as  a  LDC  Account  Clerk  in  October,  2005
and was reengaged with artificial breaks till November, 2015.  He had a past
experience of working as a Clerk in the Indian Army of 17 years.  He may
not  be  qualified  as  per  the  Recruitment  Rules  but  since  the  appellant
themselves  waived  said  requirement  when  they  gave  him  appointment  on
contract in October, 2005 and continued with the same for 10 years we are
of the opinion that it has to be held that the appellant has deemed waived the
requirement of educational qualification qua Bir Singh.  It is not the case of
the appellants that a permanent post of an Account Clerk does not exist. 
26.Thus,  LPAs  No.223/2015,  225/2015,  227/2015,  314/2015,  348/2015,
353/2015,  355/2015  and  356/2015  are  dismissed.    LPA  No.347/2015  is
allowed.    Writ  petition  filed  by  Ravi  Kumar  is  dismissed  and  impugned
LPA 223/2015, 225/2015, 227/2015, 314/2015, 347/2015, 348/2015, 353/2015, 355/2015 & 356/2015
order dated April 29, 2015 in so far it has allowed the writ petition filed by
Ravi Kumar is set aside. 
27.Concerning  directions  issued  by  the  learned  Single  Judge  that  the
Director  of  Education  should  look  into  the  working  of  the  two  schools
established by the first appellant, we agree with the same for the reason we
find that large number of employees of the two Army Public Schools are in
litigation with their Managing Committee and we find that the appellants are
indiscriminately    resorting    to    contract    appointments    notwithstanding
existence  of  permanent  posts.    In  some  cases  like  that  of Sheeja  Benoy,
notwithstanding the nature of the work being perennial the appellants are not
sanctioning  a  permanent  post.    The  Director  of  Education  would  look  into
the   strength   of   students   and   keeping   in   view   the   applicable   norms
determined  the  number  of posts  of  teachers  in  various  categories  to  be
sanctioned.  The Director of Education would also look into repeated tenure
appointments  made  and  extended  for  periods  between  5  to  10  years.    We
would  expect  the  visit  by  the  Director  of  Education  to  be  frien
dly  and intended to guide the appellants through the allays of the law and not to find
false  to  take  action  against  the  management.    We  would  also  hope  and
expect that the appellants would work with transparency and as per law. 
28.Parties shall bear their own costs all throughout.

MAHARASHTRA TET  : 

Less than 6% Pune candidates clear TET


A total of 1,24,434 candidates registered for Paper II (meant for secondary school teachers), out of which only 7,078 students cleared the test.


Candidates in the English medium performed the worst with a disappointing pass percentage of 2.23, followed by Urdu medium with 3.23, and Marathi medium with 5.9 pass percentage.


The abysmal plight of education in the state has been laid bare once again as the results of Paper II of the Teacher Eligibility Test (TET) showed a mere 5.69 pass percentage, which means that only about one in 20 candidates who appeared for the test were able to clear it.

A total of 1,24,434 candidates registered for Paper II (meant for secondary school teachers), out of which only 7,078 students cleared the test. The test is conducted in three mediums. Candidates in the English medium performed the worst with a disappointing pass percentage of 2.23, followed by Urdu medium with 3.23 pass percentage, and Marathi medium with 5.9 pass percentage. Paper I of TET was cancelled after the paper leak case. A re-examination was scheduled initially on May 18, but officials later said that the date is yet to be decided.


As per the Right to Education Act, 2009, all states have to conduct TET for recruitment of teachers for all types of schools and only those candidates who have qualified the exam are eligible for teaching jobs. However, since it’s introduction, TET results have been consistently low. While this year saw a slight improvement compared to 4.16 pass percentage last year, but even then the improvement was not on par with the pass rate of Central Teachers Eligibility Test (CTET) conducted by CBSE, which was also started in 2011.

Ask officials why the results continue to be dismal and they blame various factors. “I think the basic difference is that our candidates are not used to application-based questions. Even if all the questions come from the secondary school syllabus, these are not straight questions and are often based on understanding. I think candidates must try to study the subjects from the point of view of their applicability,” said RV Godhane, commissioner, Maharashtra State Council of Examinations (MSCE) which conducts TET.

A senior official of Maharash-tra State Council of Educational Research and Training (MSCERT) blamed the quality of teaching in D.Ed and B.Ed colleges in the state. “The standard of teaching in these colleges is very poor and this is why candidates are ill prepared,” he said.

However, principals of teaching colleges do not agree with the assessment. Sujata Adamuthe, principal, Arihanta College of Education, said most candidates complained of the exam being too ‘content oriented’.

“In B.ED colleges, we don’t just focus on the syllabus. Other aspects like psychology and teaching methodologies are given equal importance. The content or syllabus gets sharpened on the job and that’s why it would be better if objective-type questions in TET focused on other aspects besides syllabus-oriented questions,” Adamuthe said.

Telangana TET Exam 2016: Download admit cards now at tstet.cgg.gov.in

The admit cards of the Telangana Teachers Eligibility Test (TET) has been released by the Government of Telangana State School Education Department on the official website, tstet.cgg.gov.in
TS TET Revised Hall Ticket 2016 Released

The admit cards of the Telangana Teachers Eligibility Test (TET) has been released by the Government of Telangana State School Education Department on the official website, tstet.cgg.gov.in.

All the candidates are requested to download same as soon as possible.

The examination is scheduled to take place at various centers in the state of Telangana and Andhra Pradesh on May 22.

Earlier, the board announced to conduct the examination on May 1.

The Teacher Eligibility Test (TET) is mandatory for students who are willing take the profession of teaching in government schools from classes 1 to 8.

Steps to download the admit card:

    The candidates need to log on to the official website, www.tstet.cgg.gov.in

    Click on the link"Download the admit card"

    Enter the registration number and date of birth

    Download and take print out of the same

Paper pattern:

The TET examination will consist of two papers.

Paper-I:  All the candidates who are willing to be teacher for Class 1 to Class 5 will appear for this examination.

Paper-II: The candidates who intend to be teachers of Class 6 to Class 7.

Exam time:

Paper-I: 9.30 am to 12.00 noon

Paper-II: 2.30 pm to 5.00 pm

Important dates:

All written examination will be held on May 22.


Applicants who had registered can obtain the TS TET Revised Hall Ticket 2016 from the direct link given in below. Teacher Eligibility Test is called as TET is an Indian entrance test for teachers. The examination is compulsory for attainment teaching profession in TS government schools from Class first to Class eight. Paper 1 is supposed for teachers to choose for Class first to Class five and Paper 2 for Class six to Class eight.
Telangana TET Admit Card 2016 will be accessible from today onwards, Lakhs of Telangana applicants who are waiting for the teacher jobs for the classes 1 to 8 in the schools of Telangana registered for the exam. TS applicants who had registered can download the call letters from the direct link given in below. Without admit card candidate is not authorized to write the exam. TS TET (Telangana State Teacher Eligibility Test) is going to conduct on May 22nd, 2016 at various centers of 10 Districts.
Candidates can download Call letter from the official website: tstet.cgg.gov.in by using their date of birth or registration number. Teacher Eligibility Test is conducted every year state wise to select qualified teachers for appointing in different government Primary and Higher Secondary Schools
