A Message From the PM to be Read in Every School in The Country on National Education Day 

Shri Kapil Sibal Calls for Sustained Drive for Awareness on RTE

Chairs State Education Ministers’ Meet on Community Mobilisation and Public Awareness for RTE
There is a need for a sustained campaign to create awareness in every school, among those who need to be brought into school and among those who implement the Right to Education Act as to the various provisions of this Act. This was stated by Shri Kapil Sibal, Union Minister for Human Resource Development at a meeting of State Education Ministers on the subject of community mobilization and public awareness for Right to Education (RTE) held here today. Shri Sibal expressed confidence that he would get support from the State Governments in this effort. Shri Sibal underlined that the Central and the State Government have to work together so that RTE does not falter.

Shri Sibal outlined some of the work undertaken in the RTE in the country. Stating that 20 States have notified rules, he pointed out that in states which have not done so, it is the children who are suffering.
He has also said that the teachers’ eligibility test has been undertaken and eight years academic cycle has been brought in by the states. But he emphasized on the continuing need for the Government and the civil society to carry the message that education is a right to all people. The community mobilization and public awareness programme for RTE will commence from 11th November wherein a national event will be held in Nuh in Mewat in Haryana on 11th November. Similarly, events are expected to be held in every state and district of the country on that day.

An evocative message from the Prime Minister addressed to the children, with a covering letter from the Minister for Human Resource Development addressed to Head Teachers in all major languages will be mailed to each elementary school in the country and read out by the Head Teacher on 11th November 2011 in the school assembly in the presence of children/teachers/SMC members/Local Authority members, etc. during a day-long function in the school. This will be sent to all 13 lakh schools in the country. 

The national event will be a starting point for a yearlong campaign for making school RTE compliant. The approach for this includes:-

• State level meetings with national and state peoples’ networks, youth organizations and civil society organizations to participate in this massive national effort.

• Working Group consisting of Government and non-Government persons to carry forward the work at the State level.

• State Working Groups to identify around 30 volunteers in each of the 6000 blocks of the country.

• Block level volunteers to split into 10 groups of 3 persons each to visit all the 13 lakh schools.

• Carry the message of RTE and help the school plan how it would transform into an RTE-compliant school in the course of the next year.

जयपुर। मुख्यमंत्री अशोक गहलोत ने गुरुवार को स्पष्ट किया कि राज्य सरकार आरटेट मामले में सुप्रीम कोर्ट में एसएलपी दायर करेगी, जिससे चयनित शिक्षकों को राहत मिल सके। गहलोत ने कहा कि नौकरी कर रहे लोगों को राहत देने के लिए सुप्रीम कोर्ट जाएंगे।


हालांकि अभी हम फैसले की कॉपी का अध्ययन कर रहे हैं। उल्लेखनीय है कि मंगलवार को हाईकोर्ट ने तृतीय श्रेणी शिक्षक भर्ती परीक्षा में चयनित अभ्यर्थियों में से जिनके आरटेट में 60' से कम अंक थे, उन्हें आरक्षण के आधार पर दी गई शिथिलता को खत्म करने और नई चयन सूची बनाने के आदेश दिए थे। ऐसे में बड़ी संख्या में आरक्षित वर्ग के चयनित शिक्षक बाहर हो सकते हैं

बस्ती। उत्तर प्रदेश प्राथमिक शिक्षा मित्र संघ ने शिक्षामित्रों की समस्याओं को लेकर आंदोलन का ऐलान किया है। 18 जून को जंतर मंतर पार्क दिल्ली में शिक्षामित्र धरना प्रदर्शन कर विरोध जताएंगे।
टीईटी से मुक्ति, मानदेय में वृद्धि और समायोजन सहायक अध्यापक के पद पर करने की मांग को लेकर शिक्षा मित्रों ने आंदोलन की राह पकड़ ली है। इसी कड़ी में वह 18 जून को दिल्ली के जंतर मंतर पार्क में प्रदेश भर के शिक्षामित्र अपनी मांगों के समर्थन में धरना पर बैठेंगे। संघ के जिलाध्यक्ष प्रवीन कुमार श्रीवास्तव ने शनिवार को जारी बयान में कहा कि केंद्र और राज्य दोनों सरकारें शिक्षा मित्रों के साथ छलावा कर रही हैं। शिक्षामित्र अब और बर्दाश्त करने के मूड में नहीं है। केंद्र सरकार एक ओर कहती है कि राज्य सरकार जब चाहे शिक्षा मित्रों को सहायक अध्यापक के पद पर समायोजित कर सकती है, वहीं राज्य सरकार टालमटोल का रवैया अपना रही है। हम अपने हक की लड़ाई में पीछे हटने वाले नहीं हैं। जिला महामंत्री मुक्तेश्वर यादव ने शिक्षामित्रों का आह्वान किया है कि वे अपने अधिकारों की लड़ाई लड़ने के लिए बड़ी संख्या में दिल्ली पहुंचें और धरना प्रदर्शन को सफल बनावें।

At this time in UP , Approx 3 Lakh TET B. Ed qualified candidates are ready and a new batch of UPTET 2013 candidates (Exam on 27th and 28th June 2013) may create problems to them.

Recently Allahabad Highcourt Triple Bench passed an order that - TET exam is mandatory according to NCTE guidelines and for Quality Education. 

It creates worries for Shiksha Mitra in UP to become regular teacher in UP without TET exam.

बेसिक शिक्षा परिषद के कक्षा एक से पांच तक स्कूलों में सहायक अध्यापक पद पर भर्ती के लिए शिक्षक पात्रता परीक्षा (टीईटी) अनिवार्य है।


हाईकोर्ट की वृहद पीठ ने श्शिवकुमार शर्मा सहित कई अन्य की याचिकाओं व अपीलों को निस्तारित करते हुए अपने फैसले में 23 अगस्त 2010 के बाद शिक्षक भर्ती के लिए टीईटी को हर हाल में जरूरी माना है। दरअसल 16 जनवरी 2013 को हाईकोर्ट की डिवीजन बेंच ने प्रशिक्षु शिक्षक भर्ती में टीईटी की अनिवार्यता को खारिज कर दिया था। डिवीजन बेंच ने 50 फीसदी अंकों के साथ स्नातक और बीएड डिग्रीधारकों को बिना टीईटी पास किए ही शिक्षक भर्ती में मौका दिए जाने का आदेश दिया था। उसके बाद 72,825 प्रशिक्षु शिक्षकों की भर्ती में नया विवाद पैदा हो गया था।

विवाद पर लगा विराम

मृतक आश्रितों को नहीं मिली राहत
23 अगस्त 2010 के बाद सहायक अध्यापक भर्ती में टीईटी  से छूट मांग रहे मृतक आश्रितों को काई राहत नहीं मिली है। हाईकोर्ट ने माना है कि जो भी नियुक्तियां सहायक अध्यापक पद के लिए होंगी उन्हें टीईटी पास करना जरूरी है। भले ही ऐसे आवेदक मृतक आश्रित कोटे के दायरे में आते हों।

बगैर टीईटी नियुक्त 20 हजार को राहत
टीईटी की अनिवार्यता का वृहद पीठ का फैसला शिक्षामित्रों पर भी लागू होगा। शिक्षामित्रों को पत्राचार माध्यम से बीटीसी का प्रशिक्षण दिया जा रहा है। सहायक अध्यापक पद पर नियुक्ति होनी है। अधिकतर शिक्षामित्र नियुक्तित को समायोजन मानकर चल रहे हैं और इसलिए टीईटी से अपने को मुक्त मान रहे थे

As Allahaabd HC Triple Bench Strongly favours NCTE guidelines dated 11th Feb 2011 of TET exam , where weighate of marks is selction mentioned.


What Allahabad High Court Triple Bench  says -

We wish to clarify that the binding effect of the notifications and the guidelines is such that the weightage which is contemplated under the guidelines dated 11th February, 2011 cannot be ignored. The minimum score that is required of a candidate is 60% to pass the teacher eligibility test. A concession of 5% has been made in favour of the reserved category candidates including the physically challenged and disabled persons.

This norm therefore cannot be diluted. Apart from this, the State Government has to take notice of the fact that weightage has to be given in the recruitment process as well. It is for the State Government to suitably adopt the said guidelines and we do not wish to add anything further at this stage as we are only concerned with the essentiality of the qualification of the teacher eligibility test to be possessed by any candidate aspiring to be appointed as a teacher.

We wish to make it clear that the law has to be followed in the manner in which it has been legislated. It cannot be diluted on account of the inaction of the State. In such circumstances all teachers whose appointment relate to the period after 23.8.2010 have to be possessed of TET.

Subject: Application for seeking Information under Right to Information Act, 2005.

Kindly provide following information point-wise, as sought by the applicant in exercise of the rights conferred by the Right to Information Act, 2005, within stipulated time-limit;

1. Kindly provide the copy of the proposal of the State Government of Uttar pradesh to NCTE, seeking approval for conducting elementary teacher education programme of two years duration (Diploma in Elimentary Education or whatever name, it may have) through open and distance learning mode for training of untrained graduate 'Shiksha Mitra' appointed by the State Government in elementary schools.

2. Kindly provide the copy of the Order dated 14.1.2011 issued by the National Council for Teachers Education, according approval to the proposal of the State Government of Uttar Pradesh for conducting elementary teacher education programme of two years duration (Diploma in Elimentary Education or whatever name, it may have) through open and distance learning mode for training of untrained graduate 'Shiksha Mitra' appointed by the State Government in elementary schools.

3. Kindly provide Demand and Supply Estimates of Teachers and Teacher Educators at School Stage (2007-08 – 2016-17) in respect of state of Uttar Pradesh.

4. According to the “Norms and Standards for Bachelor of education programme leading to Bachelor of Education (B.Ed) degree” laid-down by NCTE, candidates with at least fifty percent marks either in the Bachelor’s Degree and/or in the Master’s degree or any other qualification equivalent thereto, are eligible for admission to the programme. In case of any proven violation of the same with regard to minimum marks required, what action is prescribed to be taken against the concerned candidate and the institution?

5. Accoring to the “Norms and standards for Diploma in elementary education programme through Open and Distance Learning System leading to Diploma in elementary education (D.El.Ed)” laid-down by NCTE, 

(i) Where one of the eligibility criteria for admission to subject programme is “Two years teaching experience in a Government or Government recognized primary / elementary school.”, whether “the tenure of expressly-declared non-employment-oriented, contractual, community-service engagement for teaching pupils of classes 1 & 2 in government-run primary school” may be considered as “teaching experience in a Government or Government recognized primary / elementary school” for the purpose?

(ii) Where, it is provided that the reservation for SC/ST/OBC and other categories shall be as per the rules of the Central Government / State Government, whichever is applicable and there shall be a relaxation of five percent marks in favour of SC/ST/OBC and other categories of candidates, 

(a) Can NCTE or the concerned Government offer/sanction/allow, whichever is applicable, admission to more than sixty-thousand candidates with absolute disregard to such provisions?

(b) In case the admissions to such programme are proved to have been offered/sanctioned/allowed with absolute disregard to the applicable reservation and relaxation as provided by NCTE, whether such admission or consequent award of dimploma shall stand void?

6. According to NCTE’s Notification dated 23.08.2010 as amended by notification dated 29.07.2011, one of the minimum qualification for a person to be eligibile for appointment as a teacher is “Pass in the Teacher Eligibility Test (TET), to be conducted by the appropriate Government in accordance with the guidelines framed by the NCTE for the purpose.”.
For the purpose, NCTE issued “Guidelines for conducting Teacher Eligibility Test (TET) under the Right of the Children to Free and Compulsary Education Act (RTE), 2009” to states vide its Letter No. 76-4/2010/NCTE/Acad dated 11.02.2011, specifying therein also the “Structure and Content of TET” in details, which also stipulates that “All questions will be Multiple Choice Questions (MCQs), each carrying one mark, with four alternatives out of which one answer will be correct. There will be no negative marking. The examining body should strictly adhere to the structure and content of the TET specified below.”
In this regard, please inform,

(i) Whether a state government is required as per the rules or law, to furnish details before the NCTE and seek prior permission before conduction a Teacher Eligibility Test?

(ii) Whether a state government is allowed to conduct Teacher Eligibility Test in deviation and/or contravention to the Guidelines issued by the NCTE for the perpose?

(iii) Whether the NCTE may grant permission to a particular state government to introduce and conduct in Teacher Eligibility Test, an additional Paper (For Language) with comprehension, essay –writing in place of typical NCTE-prescribed Paper with Multiple Choice Questions (MCQs) only?

(iv) Whether a state government, at it’s own discretion, is allowed to introduce and conduct in Teacher Eligibility Test (TET) a self-designed Paper (For Language), in addition to and totally different from NCTE-prescribed Paper-I (For Classes I-V) and Paper-II (For Classes VI-VII)? Whether such paper and consequent award of certificate shall be deemed valid by NCTE for the purpose of making a person eligible to be appointed as a teacher, as far as the necessity of passing TET is concerned?

7. Whether NCTE or Central Govt. has permitted certail states to consider the candidature of the persons having Gradution, who have neither undergone nor been enrolled in any NCTE-recognized Teacher Tarining Programme, meant for a person to be eligible for appointment as a teacher in class 1-5 and 2, for sitting in respective papers of Teacher Eligibility Test? If yes, kindly provide the copy of letter/circular/ notification/ communiqué, permitting thereby the state government of Uttar Pradesh to this effect.

According to Shyam Dev Mishra Ji 

1. In response to my RTI application dated 15.04.2013, NCTE sent me 2 letters dated 9th May and 14th May 2013 and asked me to deposit fees for the information which is spead in almost 500 pages.

2. On 17th May, I visited NCTE office, New Delhi and discussed the matter in length with their Officer, Mr. Siddharth.

3. When I explained the issue of Training to Shikshamitras and its legal aspects, issue of conducting a new kind of TET, designed by UP Govt itself, issue of not allowing B.Ed. Candidates for UPTET-2013 (Class 1-5), he expressed serious concern over the issue and assured me to consider it seriously and take necessary steps if I could submit in-writing complaint supported by relevant documents and evidences.

4. With a view to facilitate me , he assured me to share their records and entire file related to UPTET and SM-training including the 200+-paged Proposal sent by UP govt for such training and its sanction by NCTE, so that I can get complete information and point out misleading information and illegality therein, if any.

5. As their entire team was busy in preparation for their important meeting on 24th May, they have invited me on any day in last week of May 2013, so that their staff can spare enough time with me and help me find necessary information and documents.

6. Next week, I will be there again to find out the factual and legal status of the action and stand of UP Govt on the issues, raised in my application.

लखनऊ : बेसिक शिक्षा मंत्री राम गोविंद चौधरी ने मंगलवार को यहां शिक्षा अधिकारियों की राज्य स्तरीय संगोष्ठी में यह कहकर चौंका दिया कि सुनियोजित षडयंत्र के तहत सरकारी स्कूलों और शिक्षा व्यवस्था को बदनाम करने की साजिश हो रही है। उन्होंने कहा कि यूपी बोर्ड परीक्षाओं में नकल का हल्ला हर साल होता है लेकिन कोई यह नहीं जानता कि कब सीबीएसई की बोर्ड परीक्षाएं हो जाती हैं और कौन उनकी कॉपियां जांचता है। सरकारी स्कूलों की दुर्दशा पर उन्होंने केंद्र सरकार को पर्याप्त संसाधन मुहैया न कराने के लिए भी कठघरे में खड़ा किया। यह कहते हुए कि सिर्फ सस्ती लोकप्रियता हासिल करने के लिए योजनाओं को लागू कर देने भर से शिक्षा का भला नहीं होगा

बेसिक शिक्षा मंत्री नई दिल्ली के राष्ट्रीय शैक्षिक योजना एवं प्रशासन विश्वविद्यालय (न्यूपा) और राज्य शैक्षिक अनुसंधान एवं प्रशिक्षण परिषद (एससीईआरटी) की ओर से आयोजित दो दिवसीय संगोष्ठी के उद्घाटन सत्र को संबोधित कर रहे थे। उन्होंने कहा कि सरकारी स्कूलों में शिक्षा की गुणवत्ता पर तो बहस होती है लेकिन शिक्षा विभाग के अधिकारियों के पास वाहन ही नहीं हैं कि वे स्कूलों में जाकर पढ़ाई की निगरानी कर सकें। केंद्र यदि संसाधन मुहैया कराकर शिक्षा अधिकारियों को चिंतामुक्त कर दे तो समस्या का समाधान हो जाएगा। मंत्री ने कहा कि सरकारी स्कूलों के बच्चों की तो यूनिफॉर्म भी गरीब होती है। केंद्र सरकार एक सेट यूनिफॉर्म के लिए मात्र 200 रुपये स्वीकृत करती है जो नाकाफी है। केंद्रीय शिक्षा सलाहकार परिषद (कैब) की बैठक में यूनिफॉर्म की धनराशि बढ़ाने तथा बच्चों को टाई व जूता-मोजा उपलब्ध कराने की उनकी मांग को केंद्र ने अनसुना कर दिया। यदि केंद्र सरकार सिर्फ शत प्रतिशत सरकारी स्कूलों में विद्युतीकरण कार्य कराने के साथ शौचालय व पेयजल का प्रबंध करा दे तो हम पब्लिक स्कूलों को यह साबित कर देंगे कि प्रतिद्वंद्विता क्या होती है। वहीं उन्होंने यह भी कहा कि महकमे के अधिकारी यदि अपनी सोच बदलकर मनोयोग से जुट जाएं तो शिक्षा का बिगड़ा काम सुधारा जा सकता है।

माध्यमिक शिक्षा राज्य मंत्री विजय बहादुर पाल ने कहा कि मुख्यमंत्री अखिलेश यादव चाहते हैं कि बच्चे 'क' से कबूतर की बजाय 'क' से कंप्यूटर पढ़ें। वहीं बेसिक शिक्षा राज्य मंत्री योगेश प्रताप सिंह ने शिक्षा में गुणवत्ता के साथ नैतिकता पर भी जोर दिया। इससे पहले न्यूपा की प्रो.नजमा अख्तर ने बताया कि संगोष्ठी का उद्देश्य शिक्षा अधिकारियों में ऐसा प्रबंध और प्रशासकीय कौशल विकसित करना है जिससे कि वे अपने चुनौतीपूर्ण दायित्व का सफलतापूर्वक निर्वहन कर सकें। प्रमुख सचिव बेसिक शिक्षा सुनील कुमार ने कहा कि संगोष्ठी से निकलने वाले सकारात्मक निष्कर्षों को फील्ड में क्रियान्वित किया जाएगा।

सिस्टम को दोष देने से नहीं होगा सुधार : गोविंदा

न्यूपा के कुलपति प्रो.आर गोविंदा ने अध्यक्षीय भाषण में कहा कि स्कूलों में बच्चों के नामांकन पर जोर है लेकिन उपस्थिति पर ध्यान नहीं दिया जा रहा है। उप्र बेसिक एजुकेशन प्रोग्राम के लागू होने के 20 साल बाद भी आज 42 फीसद बच्चे ड्रॉप आउट होते हैं। यह जानने की कोशिश नहीं होती कि क्या आज शिक्षक बेहतर पढ़ा रहे हैं, क्या बच्चो के सीखने-समझने का स्तर बढ़ा है। शिक्षा में सुधार न आने के लिए सिस्टम पर दोष मढ़ने से काम नहीं चलेगा। निचले स्तर के अधिकारी भी इतने असहाय नहीं कि वे कुछ नहीं कर सकते। देश में 50 फीसद बच्चे आठवीं की पढ़ाई पूरी नहीं कर पाते। बच्चे आगे बढ़ना चाहते हैं लेकिन 19वीं-20वीं सदी की हमारी शिक्षा प्रणाली उन्हें पीछे धकेल रही है। शिक्षा के लिए बनायी गई नीतियों से लोग भले संतुष्ट हों लेकिन वे सुधार की रफ्तार से संतुष्ट नहीं हैं। वे योजनाओं के परिणाम जानना चाहते हैं। ब्रिटिशकाल से विरासत में मिली शैक्षिक प्रबंधन व्यवस्था में भी वे बदलाव चाहते हैं।

दूर होगी शिक्षकों की कमी

मुख्य सचिव जावेद उस्मानी ने कहा कि प्रदेश के परिषदीय स्कूलों में शिक्षकों के तकरीबन तीन लाख पद रिक्त हैं लेकिन 2013-14 के अंत तक यह कमी काफी हद तक दूर कर दी जाएगी। इनमें से 1.7 लाख पदों पर शिक्षामित्रों को प्रशिक्षण देकर समायोजित करने वाला उप्र पहला राज्य बनेगा। विधिक अड़चनें दूर होने के बाद 72,825 पदों पर शिक्षकों की भर्ती प्रक्रिया भी दो तीन महीने में पूरी कर ली जाएगी। डायट में प्रवक्ताओं और वरिष्ठ प्रवक्ताओं के खाली पदों को शीघ्र लोक सेवा आयोग के जरिये भरने के लिए कार्यवाही के निर्देश दिये गए हैं। 38 जिलों के अल्पसंख्यक व अनुसूचित जाति बहुल ब्लाकों में ब्लॉक इन्स्टीट्यूट ऑफ टीचर्स एजुकेशन की स्थापना की जा रही है

होगी अच्छे स्कूल की तलाश

प्रो.आर.गोविंदा ने बताया कि देश में ऐसे हजारों सरकारी स्कूल हैं जो अच्छा काम कर रहे हैं। न्यूपा 'अच्छे स्कूल की तलाश' नामक प्रोजेक्ट शुरू करने जा रहा है। इस प्रोजेक्ट के तहत अच्छा काम करने वाले 1000 स्कूलों को हर साल चुनकर उनकी उपलब्धियों का प्रचार-प्रसार किया जाएगा। जमीनी स्तर पर काम करने वाले शिक्षा अधिकारियों का मनोबल बढ़ाने के लिए न्यूपा एक और प्रोजेक्ट शुरू करने जा रहा है। इस प्रोजेक्ट के तहत कठिन परिस्थितियों में भी शिक्षा में नवाचार लाने वाले ब्लॉक और न्याय पंचायत स्तर के अधिकारियों को चिन्हित कर उन्हें राष्ट्रीय स्तर पर सम्मानित किया जाएगा

लखनऊ। उत्तर प्रदेश में पर्याप्त संख्या में सरकारी स्कूल हैं। बजट की कमी नहीं है। कमी है तो शिक्षकों और बेहतर मैनेजमेंट की। राज्य सरकार को शिक्षा में सुधार के लिए निगरानी प्रणाली के साथ बेहतर मैनेजमेंट की व्यवस्था करनी चाहिए। यही नहीं एक शिक्षा मिशन का अलग से गठन किया जाना चाहिए। यह मिशन शिक्षा में सुधार के साथ निगरानी व्यवस्था और गुणवत्तायुक्त शिक्षा के बारे में सुझाव दे, जिसे सरकार अमल में लाए। यह कहना है राज्य शैक्षिक योजना एवं प्रशासन विश्वविद्यालय नई दिल्ली के कुलपति प्रो. आर. गोविंदा का। वे सोमवार को यहां पत्रकारों से बातचीत कर रहे थे। उन्होंने कहा कि शिक्षा के क्षेत्र में जितना काम यूपी में होना चाहिए, नहीं हो पा रहा है।
प्रो. आर. गोविंदा ने कहा कि शिक्षा का अधिकार कानून इसलिए बनाया गया कि बच्चों को शिक्षा का हक मिल सके। इसके बावजूद सभी बच्चे इस हक से वंचित हैं। केवल स्कूल खोलने और शिक्षक नियुक्त करने से काम नहीं चलेगा। इसके लिए बेहतर निगरानी प्रणाली की जरूरत है। शिक्षक स्कूलों में क्या करता है, बच्चों को पढ़ाने के लिए उसे सामग्री मिल रही है या नहीं, इसे भी देखने की जरूरत है। सरकार यह कहकर नहीं बच सकती कि उसके पास संसाधन की कमी है। शिक्षा का अधिकार अधिनियम कानून नहीं बल्कि उम्मीद है। इसको ध्यान में रखकर ही इसका खाका तैयार किया गया है। बच्चों को गुणवत्तायुक्त शिक्षा मिले, इसके लिए शिक्षक पात्रता परीक्षा (टीईटी) अनिवार्य की गई है, लेकिन इसमें बैठने वाले अधिकतर फेल हो रहे हैं
कॉलेजों में शिक्षकों की कमी का कारण अलग ःप्रो. आर. गोविंदा कहते हैं कि प्राइमरी स्कूलों में शिक्षकों की कमी का कारण कुछ और है तो डिग्री कॉलेजों में कुछ और। डिग्री कॉलेजों में शिक्षकों की नियुक्ति की प्रक्रिया काफी जटिल है। इस प्रक्रिया में भी सुधार की जरूरत है, ताकि उच्च शिक्षण संस्थाओं में भी शिक्षकों की कमी दूर हो सके

एन सी टी ई ने अपने नोटिफिकेशन में दो पैरा ग्राफ मैं अलग अलग बात कही है -

प्राइमरी शिक्षक भर्ती की मिनिमम क्वालिफिकेशन मैं - टेट को अनिवार्य बताया गया है (क्लाज़ -1)
वहीँ दूसरी तरफ क्लाज -3 मैं  भर्ती की ट्रेनिंग मैं  लिखा है -
प्राइमरी शिक्षक भर्ती के लिए वे बी .एस सी /बी .ए 50% + बी .एड भी पात्र हैं जो कि 1 जनवरी 2012 तक  नियुक्ति के बाद 6 महीने का विशेष अनिवार्य प्रशिक्षण प्राप्त कर लें 
दोनों ही क्लाज एक दुसरे के विरोधाभासी हैं 





प्रश्न जो उठे हैं - 
1.क्या क्लाज़ -3 पूर्ण रूप से अलग है क्लाज़ -1 से 
2. योग्य शिक्षकों की कमी होने अगर पर राज्य सरकार टेट से छूट दे तो क्या क्लाज -3 उस परिस्थति के लिए है 


सर्व शिक्षा अभियान के तहत सारे हिंदुस्तान में टीईटी परिक्षयायें हो रही हैं और एन सी टी ई की गाइड लाइन का विवाद सुलझना बेहद जरूरी है

Cabinet Decision 

The Union Cabinet today approved a proposal from the Ministry of Human Resource Development to amend the National Council for Teacher Education Act, 1993 to clarify its applicability to matters relating to norms for minimum qualification for appointment of school teachers and clarify its applicability to schools and school teachers

The National Council for Teacher Education Act, 1993 came into force on 1st July 1995 with an objective to achieve planned and coordinated development of teacher education system in the country and ensure proper maintenance of norms & standards in the above system.

The Act mandates the NCTE to lay down guidelines on minimum qualifications for a school teacher with a view to ensure uniform quality of teaching in the schools. The NCTE has framed regulations to discharge this function which are binding on all States in the matter of appointment of teachers.

Recently it came to the notice of this Department that Supreme Court in the case of Basic Education Board, U.P. Vs. Upender Rai & others, held that NCTE Act does not deal with educational institutions like primary schools, etc and thus in the matter of laying minimum qualification for appointment as teachers, the NCTE Regulations will not be applicable, and the State Legislation/Rule on the subject will prevail. 

In the above judgement a Central Law was interpreted by the Supreme Court, but neither the NCTE nor the Union of India was impleaded in the case. A review Petition filed by NCTE in the Supreme Court was also not admitted. Therefore, a decision has been taken to amend the NCTE Act in order to clarify that the Act applies to schools, teachers and the NCTE is empowered to lay down the minimum qualifications for a person to be eligible as a teacher in schools. 

The National Council for Teacher Education (Amendment) Bill 2009 will be moved in Parliament for consideration

Heard learned Counsel for the parties.
The petitioners who are stated to have obtained B.Ed. Degree after graduation and have passed TET Examination, seek a writ of Mandamus directing the respondent authorities to provide weightage to the candidates with reference to the marks obtained in TET Examination in the matter of appointment as Trainee Teachers. 
The case of the petitioners is that under Section 23 of the Right of Children to Free and Compulsory Education Act, 2009, the Central Government was conferred a power to authorize an authority for laying down the minimum qualification for appointment as teachers in the institutions where education imparted to children including institutions with Class 1 to 5.
The Central Government in exercise of powers under Section 23 authorized National Counsel for Teachers Training (hereinafter referred to as 'the NCTE') to act as the relevant authority for laying down minimum qualification. The NCTE issued notification on 23rd August, 2010, laying down the minimum qualifications for appointment of teachers in institutions where education is imparted from Class 1 to 5 as also in institutions where education is imparted from Class 6 to 8.
This case pertains to the first category of institutions and, therefore, facts pertaining to the first category alone are being stated.
The notification dated 23rd August, 2010, provides academic qualification and passing of TET Examination as essential qualification. It has been clarified that TET Examination shall be the one which is held by the State Government as per the guidelines framed by the NCTE.
According to the petitioner, guidelines for conducting TET Examinations have been provided under the letter of the Member Secretary, N.C.T.E. dated 11th February, 2011. Clause 9, provides for the minimum marks for qualifying TET Examination as 60%. Clause 9(b) provides that the State or the appointing authority may provide weightage as per the TET Score to the candidates in the recruitment process. It is further stated that the State Government has accepted the guidelines so framed by the NCTE as is apparent from its letter dated 7th September, 2011 and therefore, the State Government has to provide weightage with reference to the TET Score of the candidates. 
It is his case that the State Government, while publishing the advertisement for recruitment of Trainee Teachers, has completely ignored the Clause 9(b) of the guidelines, by not providing weightage to the TET Scores in the matter of selection of Trainee Teachers. Hence this petition.
In order to appreciate the contentions raised on behalf of the petitioners, it is necessary for this Court to examine as to what exact power was conferred upon the NCTE under the Right of Children to Free and Compulsory Education Act, 2009 (hereinafter, referred to as 'the Act of 2009') and for the purpose it is relevant to quote Section 23 of the Act of 2009:-
?23. Qualifications for appointment and terms and conditions of service of teachers.- (1) Any person possessing such minimum qualifications, as laid down by an academic authority authorised by the Central Government, by notification, shall be eligible for appointment as a teacher.
2.Where a State does not have adequate institutions offering course or training in teacher education, or teachers possessing minimum qualifications as laid down under sub-section (1) are not available in sufficient numbers, the Central Government may, if it deems necessary, by notification, relax the minimum qualifications required for appointment as a teacher, for such period, not exceeding five years, as may be specified in that notification : 
Provided that a teacher who, at the commencement of this Act, does not possess minimum qualifications as laid down under sub-section (1), shall acquire such minimum qualification within a period of five years. 
3.The salary and allowances payable to, and the terms and conditions of service of, teachers shall be such as may be prescribed.
NOTIFICATION
Ministry of Human Resource Development (Deptt. Of School Education and Literacy), Noti. No. S.O. 750(E), dt. 31.3.2010, published in the Gazette of India, Extra., Part II, Section 3(iii), dt. 5.4.2010.-In exercise of the powers conferred by sub-section (1) of Section 23 of the Right of Children to Free and Compulsory Education Act, 2009, the Central Government hereby authorises the National Council for Teacher Education as the academic authority to lay down the minimum qualifications for a person to be eligible as a teacher.?
From Clause 1 of Section 23 of the Act of 2009 it is clear that the academic authority, authorized by the Central Government by notification, has been conferred the sole power of laying down the minimum qualifications for appointment of teachers in the institutions, covered by the Act of 2009, and it is with reference to Section 23 of the said Act that the Ministry of Human Resource and Development, Central Government, vide notification dated 31.03.2010, declared the NCTE as academic authority to laydown minimum qualifications for the persons to be eligible for appointment as teachers.
From the simple reading of Section 23, alongwith the notification dated 31.03.2010, published in official gazette on 05.04.2010, it apparent that power of the NCTE is limited to laying down minimum qualifications and nothing beyond it. The process of recruitment and the manner of selection as Assistant Teacher in Primary Schools cannot be tinkered with by the NCTE in exercise of power of laying down minimum qualifications as flows from Section 23 of the Act of 2009. 
In my opinion the NCTE, except for laying down the minimum qualifications cannot direct that any particular marks should be granted weightage or that any particular method of selection should be adopted, in as much as it is not within the power of the NCTE to lay down any such condition.
Laying down of the minimum qualifications for particular post does not include within its ambit the power to lay down manner of selection and for weightage etc. be provided in respect of particular qualifying examination.
This Court may record that the guidelines which have been framed by the NCTE in respect of holding of TET Examination on 11th February 2011 are to be read in that context only.
So far as Clause 9 of the Guidelines for conducting Teacher Eligibility Test (TET) are concerned, it is worthwhile to record that Clause 9(b) itself provides that TET is only one of the qualifying criteria for appointment. Clause 9 of the Guidelines reads as follows:-
?Qualifying marks
9 A person who scores 60% or more in the TET exam will be considered as TET pass. School managements (Government, local bodies, government aided and unaided)
(a) may consider giving concessions to persons belonging to SC/ST, OBC, differently abled persons, etc., in accordance with their extant reservation policy;
(b) should give weightage to the TET scores in the recruitment process; however, qualifying the TET would not confer a right on any person for recruitment/employment as it is only one of the eligibility criteria for appointment.? 
It contemplates that passing of the TET Examination is only one of the eligibility criteria for appointment. The provision has to be read as a whole and in the background of the power conferred.
It is always open to the State Government, which is rule framing authority under Section 19 of the Basic Education Act, 1972, in the matter of appointment of teachers in Primary Schools to lay down the method of recruitment of Teachers as well as Trainee Teachers and while laying down such procedure for recruitment of Teachers and Trainee Teachers, the only obligation cast upon the State Governments under the Act of 2009 and the Notification of the NCTE is that the Teachers to be appointed in the institutions concerned must possess prescribed minimum qualifications and nothing beyond it.
The method of selection and the manner of selection is within the domain of the State Government the rule framing authority. In the facts of the case, the State Government under the 16th Amendment to the Rules of 1981 has provided for the appointment of Trainee Teachers. The State Government has decided to make selections for the post on the basis of the quality point marks obtained in various academic examinations throughout the career of the applicant concerned. If the State Government has decided not to give any weightage to the TET scores, it cannot be said that it has committed any violation of any statutory provision. The NCTE guidelines do not have any statutory force so as to over reach the power of the State Government as conferred under Section 19 of the Basic Education Act, 1972. 
In my opinion the Rule framed by the State under Rule 19, having taken care of, the minimum qualifications prescribed by NCTE cannot be said to have violated any of the provisions of Right of Children to Free and Compulsory Education Act, 2009 or the Notification of the NCTE issued there under. There cannot be a direction to the State to adopt a particular method of selection, as has been prayed by the petitioner before this Court. 
The writ petition lacks merit and is dismissed.

Weighatge of TET marks should be read along with background of power (i.e powers granted to selection authority.)
How much weighatge etc. given is in the hands of selection authority and NCTE is not selection authority.
NCTE lay down minimum qualification i.e eligibility. 

However I am unable to understand Basic Education Act point.

पिछले सालों की तुलना में इस वर्ष सीटीईटी का रिसल्ट बेहद कम रहा  है , और  अब तक की समस्त राज्यों की टीईटी परीक्षाओं के परिणाम में सर्वाधिक कम रहा है |
सबसे बेहतर टीईटी परीक्षाओं के परिणाम में उत्तर प्रदेश प्रमुख रहा है जहाँ लगभग 45 प्रतिशत अभ्यर्थी (लगभग 3 लाख अभ्यर्थी ) उत्तीर्ण हुए हैं 


शिक्षक प्रशिक्षण संस्थानों से पास हो रहे शिक्षकों की गुणवत्ता के स्तर का पता इस बात से लगाया जा सकता है कि एक प्रतिशत से भी कम उम्मीदवार पिछले साल हुई केंद्रीय शिक्षक योग्यता परीक्षा (सीटीईटी) पास कर पाए हैं। 

मानव संसाधन मंत्रालय ने शिक्षा के अधिकार कानून को लागू करने के बाद वर्ष 2011 में सीटीईटी परीक्षा की शुरूआत की थी ताकि स्कूलों में शिक्षा की गुणवत्ता को सुधारा जा सके। सूत्रों ने बताया कि पिछले साल नवंबर महीने में आयोजित परीक्षा के परिणाम, इससे पहले हुई परीक्षा से ज्यादा खराब रहे। इससे पिछली परीक्षा में करीब सात प्रतिशत छात्र इस परीक्षा में सफल हुए थे। उल्लेखनीय है कि नवंबर में सीबीएसई द्वारा आयोजित परीक्षा का परिणाम 27 दिसंबर, 2012 को घोषित किया गया था। 

यह परीक्षा करीब सात लाख 95 हजार उम्मीदवारों ने दी थी लेकिन इसमें से एक प्रतिशत से भी कम उम्मीदवार सफल हुए हैं। सूत्रों ने बताया कि परीक्षार्थियों में अंग्रेजी, गणित और पर्यावरण विज्ञान की जानकारी की कमी निकलकर सामने आई है। (एजेंसी)

New Delhi: In a shocking revelation, 99.55% of candidates of all the candidates, who had appreaed for CTET, 2012, have not scored enough marks to be eligible to become a teacher.  And those who cleared the exams have not scored high marks. They have just managed to score the passing marks. 

The Central Teacher Eligibility Test (CTET) was introduced in 2011 by the human resource development ministry to improve the quality of teaching in schools after the enactment of the Right to Education Act. The exam was conducted by Central Board of Secondary Education (CBSE).

For this exam 9.40 lakh candidates had registered for the test. The exam took place in November 2012. A total 7.96 lakh appeared for the test. They appeared for two papers. First paper was mandatory in which only 0.91% passed the exam. In the second paper it worsened and only 0.45% cleared it. Their knowledge in English, mathematics and environmental science was not up to the mark.

As per the results announced on December 27, 2012, a total 7.95 lakh appeared for the exam. They were the aspirants to pass the exam to teach class VI to VIII students. But less than 4,800 got pass percentage.

The situation is of concern as the pass percentage has been going down every year. In the first CTET, pass percentage was around 9%. It went down to around 7% in the subsequent test, held on January 2012.
