Notice on behalf of opposite party nos. 1 and 2 has been accepted by learned Additional Chief Standing Counsel.
Learned counsel for the petitioners submits that vide impugned order dated 12.12.2017 the transfer of the petitioners has been cancelled although they have already joined at the transferred place in pursuance of the transfer order dated 30.6.2017. It is further submitted that under similar facts and circumstances this court has stayed the operation of the impugned order and has listed the matter on 5.1.2018, vide order dated 20.12.2017, passed in Writ Petition No.31056 (SS) of 2017. Copy of order dated 20.12.2017, passed in Writ Petition No.31056 (SS) of 2017 has been placed before the court, same is taken on record.
Learned Additional Standing Counsel does not dispute that the case of the petitioners is similar to the above case.
Learned Additional Chief Standing counsel prays for and is allowed three weeks time to file counter affidavit. Rejoinder affidavit, if any, may be filed by learned counsel for the petitioner within a week thereafter.�
List along with Writ Petition No.31056 (SS) of 2017 on the date fixed.
Till next date of listing, the operation of impugned order dated 12.12.2017 to the extent it relate to the petitioners shall remain stayed.
