Shri K.S.Kushwaha, learned Standing Counsel made an attempt to suggest to this Court that in view of Section 2 (n) read with Section 23 and Section 38 of the Right to Free and Compulsory Education Act, 2009 along with the notification issued by the Central Government dated 31.03.2010 appointing National Council for Teachers Education (N.C.T.E.) as the academic authority to lay down the minimum qualifications for a person to be eligible to be appointed as teacher along with Rule 15 of the U.P. Right to Free and Compulsory Education Rules, 2011 submits that no teacher in any institution covered within the definition of School under Section 2(n) of the Act, 2009 which will include all institutions run by the Basic Shiksha Parishad namely Junior Basic Schools and Senior Basic Schools as well as recognised and aided Junior High School, can be appointed unless he has passed teacher's eligibility test. In view of the recital in the notification dated 27.07.2011 pertaining to the Rules, 2011 all earlier Rules on the subject with regard to the qualification of teachers in Schools stand superceded. Therefore, the district level authorities are justified in refusing to nominate a nominee to the Selection Committee to be constituted under the Rules, 1978 for the Junior High Schools concerned in as much as in the Advertisement it had not been mentioned that the persons with T.E.T. qualification alone can apply. 
This Court will address to the contentions so raised later. But on reading of Section 23 of Act, 2009 proviso, this Court finds that it has further been provided that if a teacher already working and is not possessed of the minimum qualification as is laid down under Section 23 shall acquire minimum qualification within a period of five years.
The question, therefore, arises as to whether the State after framing the Rules of 2011 has issued any direction/notification to all education authorities of the State of U.P. asking them to ensure that the teachers already working in various institutions run and managed by the Basic Shiksha Parishad as well as those which are recognized and aided Junior High Schools are made aware of the said requirement of passing the TET examination within five years from the date the said qualification has come into force.
Let the Secretary (Secondary Education) file his personal affidavit disclosing whether any such letter/circular with reference to Section 23(3) has been issued by the State till date and, if not, reasons for the same must be stated. He also explain as to how the statutory Rules framed in exercise of powers under Section 19 of the U.P. Basic Education Act can be superceded by framing of Rules in exercise of powers under Section 38 of Act No. 35 of 2009. 
Prima facie this Court is of the opinion that both the Acts operate in separate fields. 
Put up for further hearing on 01.05.2012.

The petitioner is claiming salary for the period he has worked on the ground that the petitioner was not aware of any such Rule applying the TET to the petitioner as well. It is undisputed that the petitioner was appointed after 23.8.2010 which is date of the Notification of the National Council for Teacher Education.
In the circumstances, ignorance cannot be pleaded in law by the petitioner. If his appointment was void without having possessed the qualifications prescribed then in that event, the petitioner cannot claim salary as a matter of right.
The petitioner has relied on the order passed by the Coordinate Bench on 14.12.2012 in Writ Petition No.65146 of 2012. I am unable to persuade myself to accept the view expressed therein and, therefore, the matter may require a reference. However, Sri Sanjay Chaturvedi informs that this Court has already entertained a Special Appeal No.1467 of 2012 in such a matter and the same is pending consideration.
List after the judgment in the aforesaid Special Appeal.

प्रदेश में प्राइमरी से पहले उच्च प्राइमरी स्कूलों में विज्ञान और गणित के सहायक अध्यापक पदों पर भर्ती की जाएगी। बेसिक शिक्षा परिषद इलाहाबाद कार्यालय के सचिव ने इस संबंध में संशोधित प्रस्ताव भेज दिया है। उच्च प्राइमरी स्कूलों में पहले रिक्त सीटों के 50 फीसदी पदों पर पदोन्नति की प्रक्रिया पूरी की जाएगी। इसके बाद शेष 50 फीसदी पदों पर सीधी भर्ती की जाएगी। इस बारे में शीघ्र ही शासनादेश जारी होने की तैयारी है। उत्तर प्रदेश में इस समय 46,000 उच्च प्राइमरी स्कूल हैं। इनमें विज्ञान व गणित शिक्षक के 58,666 पद रिक्त हैं। राज्य सरकार विज्ञान व गणित की पढ़ाई को बढ़ावा देना चाहती है। इसलिए उच्च प्राइमरी स्कूलों में इनके शिक्षकों के पदों पर सीधी भर्ती की योजना बनाई गई है। इस संबंध में शासन ने बेसिक शिक्षा परिषद से संशोधित प्रस्ताव मांगा था। इसमें कहा गया था कि पदोन्नति से कितनी सीटें भरी जाएंगी और कितनी सीधी भर्ती होगी। परिषद ने संशोधित प्रस्ताव भेज दिया है। इसके मुताबिक रिक्त 58,666 पदों में से आधे यानी 29,333 को पदोन्नति से पहले भरा जाएगा। इन पदों पर प्राइमरी स्कूल के प्रधानाध्यापकों को पदोन्नति दी जाएगी। बेसिक शिक्षा अध्यापक सेवा नियमावली के मुताबिक प्राइमरी स्कूलों में सहायक अध्यापक के पद पर नियुक्त शिक्षकों को तीन साल की सेवा पर प्राइमरी स्कूलों में प्रधानाध्यापक या उच्च प्राइमरी स्कूलों में सहायक अध्यापक बनाया जाता है। प्रदेश में इस समय पदोन्नति प्रक्रिया चल रही है। इसलिए पहले आधे पदों को पदोन्नति से भरा जाएगा। इसके बाद रिक्त आधे पदों पर सीधी भर्ती की जाएगी।

ग्रेटर नोएडा : बेसिक शिक्षा परिषद के शिक्षकों के समायोजन की नई नीति बनाई जा रही है। देर से ही सही परिषद शिक्षक-छात्र अनुपात को सुधारने की तैयारी में है। इसके तहत समायोजन के लिए शिक्षकों की काउंसलिंग होगी। इसमें अध्यापकों को पात्रता के तहत डिग्री के विषयों का विकल्प भरना होगा। इसके तहत ही शिक्षकों नियुक्ति एक से दूसरे स्कूलों में हो सकेगी।

इसका मकसद जिले के विद्यालयों में विज्ञान-गणित के शिक्षकों नियुक्ति में असमानता को दूर करना है। विषय विशेषज्ञ शिक्षकों को विज्ञान के शिक्षकों की कमी झेल रहे स्कूलों में भेजना होगा। उन्हें संबंधित स्कूलों में जाना ही होगा। शासन ने इस संबंधित निर्देश जारी कर दिए हैं। जल्द ही जिले में इसकी प्रक्रिया प्रारंभ हो सकती है। समायोजन के तहत बड़ी संख्या में शिक्षक इधर से उधर होंगे। उनकी नियुक्ति एक ब्लॉक से दूसरे ब्लॉक में भी हो सकती है गौतम बुद्ध नगर के अधिकांश जूनियर हाईस्कूल विज्ञान-गणित के शिक्षकों का टोटा झेल रहे हैं, साथ ही शिक्षक-छात्र अनुपात भी गड़बड़ है। बेसिक शिक्षा अधिकारी का कहना है कि समायोजन के तहत पिछड़े ब्लॉकों में शिक्षकों की कमी झेल रहे प्राथमिक और उच्च प्राथमिक विद्यालयों को शिक्षक उपलब्ध कराना है। साथ ही विज्ञान-गणित के शिक्षकों की नियुक्ति पर विशेष बल होगाशासन ने प्रत्येक स्कूल विज्ञान के शिक्षक की तैनाती अनिवार्य कर दी है

जौनपुर: जिलाधिकारी सुहास एलवाई ने बताया है कि वर्ष 2009 में लेखपाल के रिक्त पदों पर भर्ती हेतु आवेदन पत्र आमंत्रित किए गए थे। उनके विज्ञापन को शासन द्वारा निरस्त कर दिया गया है। अभ्यर्थियों के आवेदन पत्रों के सापेक्ष प्राप्त परीक्षा शुल्क की धनराशि को वापस करने का निर्णय लिया गया है।

उन्होंने बताया कि वर्तमान में लेखपाल के रिक्त पदों पर भर्ती करने हेतु अलग से विज्ञापन प्रकाशित कराए जाएंगे, जिसमें अभ्यर्थियों की उम्र बाधक नहीं होगी, क्योंकि वर्ष 2009 में लेखपाल के भर्ती के लिए सामान्य वर्ग के अभ्यर्थियों की अधिकतम आयु सीमा 35 वर्ष से बढ़ाकर 40 वर्ष एवं आरक्षित वर्ग को नियमानुसार आयु सीमा में शिथिलता प्रदान की गई है।

जिन अभ्यर्थियों द्वारा 2009 में लेखपाल के रिक्त पदों पर भर्ती हेतु आवेदन पत्र भेजे गए थे वह एक माह के अन्दर जिलाधिकारी कार्यालय में आवेदन की प्राप्ति रसीद/डाक रसीद/प्रवेश पत्र दिखाकर आवेदन शुल्क प्राप्त कर सकते हैं

दिल्ली में नौकरी की इच्छा रखने वालों के लिए खुशखबरी है। दिल्ली अधीनस्थ सेवा चयन बोर्ड राजधानी में 12 हजार सरकारी नौकरियों के लिए भर्ती प्रक्रिया शुरू करने जा रहा है। 

इसमें अधिकांश पद शिक्षकों के होंगे। यह प्रकिया जून के अंतिम सप्ताह से लेकर जुलाई तक चलेगी।

बोर्ड की बैठक में सोमवार को तय किया गया कि दिल्ली में सरकारी नौकरियों के लिए आवेदन पूरी तरह से ऑऩलाइन लिए जाएंगे और नौकरी के लिए होने वाली परीक्षा का प्रवेश पत्र भी ऑऩलाइन जारी किया जाएगा।

भर्ती प्रक्रिया को ऑऩलाइन करने के कई फायदे होगे। एक तो इस प्रकिया को तेजी मिलेगी और ई-गवर्नेंस वे पारदर्शिता के मापदंड भी लागू हो सकेंगे।

एवं इससे कई प्रकार के खर्चे भी कम हो जाएंगे। क्योंकि अभी तक इस तरह की परीक्षाओं के लिए आवेदन पत्र संभालने और डाक खर्च आदि में काफी पैसा खर्च होता था।

ये भर्तियां लंबे समय से पेंडिंग थीं क्योंकि मैन्युअल भर्ती प्रक्रिया में गड़बड़ी की आशंका के चलते परीक्षा आयोजित नहीं हो पा रही थी।

शिक्षकों के अलावा फॉरेंसिक साइंस लेबोरेटरी में सहायक, वरिष्ठ सहायक, वैज्ञानिक सहायक, महानिदेशक जेल कार्यालय में मैट्रन, वार्डन, अस्सिटेंट सुपरिंटेंडेंट आदि पदों के लिए भी भर्तियां की जाएंगी।

जुलाई तक करीब 10 हजार शिक्षक और करीब डेढ़ हजार अन्य पदों के लिए भर्तियां निकलेंगी, जिसमें अस्पतालों में तकनीकी सहायक और अन्य विभागों मे क्लर्क व दमकल विभाग में रिक्त पद शामिल हैं

इलाहाबाद। यूपी शिक्षक पात्रता परीक्षा (यूपीटीईटी-2013) के आवेदन में लापरवाही करना कुछ अभ्यर्थियों को भारी पड़ गया। फार्म भरने में हुई गलती की वजह से एक लाख 28 हजार आवेदन निरस्त कर दिए गए। शिक्षक बनने की राह में बाधा आती देख अभ्यर्थियों ने सचिव परीक्षा नियामक प्राधिकारी कार्यालय की दौड़ लगानी शुरू कर दी है। सोमवार को सैकड़ों अभ्यर्थियों ने आवेदन में सुधार के लिए प्रार्थना पत्र दिए। हालांकि अभ्यर्थियों को मौका मिलने की संभावना कम है।

The petitioners have all qualified the Central Teacher Eligibility Test conducted by the Central Board of Secondary Education. They belong to the Other Backward Caste Category. They have obtained 82 marks out of 150. Consequently, the percentage of their marks works out to be 54.67. 
According to the guidelines framed by the National Council for Teacher Education on 11.2.2011 read with the clarification issued on 1.4.2011, a candidate appearing in the test will be treated to have passed the test provided he scores 60% or more marks in the test. This percentage is reduced by 5% in relation to the reserved category candidates.

The purpose of providing these minimum marks have been indicated in clause 9 of the Notification dated 11.2.2011. It provides that even in the recruitment process weightage has to be given to the TET scores. 

The petitioners contend that they have been declared to have passed the CTET with only 82 marks and, therefore, according to the U.P. Basic Education Teachers Service Rules, 1981, they should be treated to be eligible as they possess the essential qualification of Teacher Eligibility Test.

However, the forms for applying to the post of Assistant Teacher which have to be uploaded on online basis, for which the last date is today, the minimum marks required for the reserved category candidate is indicated as 83 out of 150 which is 55.43%. 
Sri V. Singh, learned counsel for the petitioner, contends that if the petitioners have been declared to have qualified the Teacher Eligibility Test conducted by the Central Board of Secondary Education, then such eligibility should also be included in respect of such candidates, who have obtained 82 marks out of 150. He submits that there can be no discrimination, as the percentage of the petitioner which is 54.67% should be read as 55%. 
He contends that no candidate can obtain any fraction of marks because every question has one mark allotted in the answer-book. Consequently, if a candidate gets 82.6 marks, then only he will be able to score 55% and, therefore, on account of this anomaly existing, the Central Board of Secondary Education took a decision to treat such candidates to have qualified, who have obtained 82 marks. The reasons appears to be that no candidate can get half a mark or any fraction as on evaluation one gets full one marks or none. Thus, the CBSE which is the examining body has treated 82/150 = 54.67% as the pass percentage to qualify in the examination. Sri Singh, therefore, submits that the same criteria should be adopted by the State of U.P. while offering appointment to Assistant Teachers under the 1981 Rules.
Having considered the aforesaid submissions raised, primarily this is an issue of policy which has to be decided by the National Council for Teacher Education and it does not fall within the authority of the Central Board of Secondary Education to give any such decision in relation to calculation.
The reason is very simple inasmuch the National Council for Teacher Education is the Academic Authority defined and entitled to lay down the norms of minimum qualifications as per Section 23 of the the Right of Children to Free and Compulsory Education Act, 2009. The power, therefore, vests in the Academic Authority and not in the Central Board of Secondary Education.
There is nothing on record to indicate that the National Council for Teacher Education has considered this anomaly to be read in favour of the petitioners. In such a situation, the petitioners ought to have approached the National Council for Teacher Education for the redressal of their grievances. 
I am not inclined to issue any mandamus as prayed for in view of the fact that the existing norms clearly require the possession of 55% or more marks in relation to the reserved category candidates. The score of 82 out of 150 does not amount to 55% or more and the principles of rounding off will not be available in view of the fact that the prescription in clause 9 of the guidelines dated 11.2.2011 clearly recites, the minimum percentage or more as the score, which has to be obtained by a candidate. In such circumstances, less than 55% is not contemplated therein.
Accordingly, the writ petition is consigned to records with liberty to the petitioners to approach the National Council for Teacher Education for any such clarification.

The petitioners admittedly have not passed the Teachers Eligibility Test.
In identical circumstances this court has dismissed� writ petition No.13155 of 2013 decided on 8.3.2013. The petitioners' case is not different from the same on merits.� The prayer in the present writ petition is for� mandamus commanding the respondent no.4 District Basic Education Officer, Lalitpur to consider the appointment of the petitioners on the post of Assistant Teacher� without having passed the TET. This claim cannot be accepted in view of the� Notification dated 23.8.2010 issued by the Academic Authority under the NCTE Act 1993 read with Section 23 of the 2009 Act.. 
The writ petition lacks merit and is accordingly dismissed.

The petitioner claims inclusion of the two years diploma course (D.Ed.) for the purpose of appointment as an Assistant Teacher as per the Notification dated 26.4.2013. The prayer in essence is to include this qualification also as a qualification for such appointment.
The court cannot exclude or include qualifications for such appointments merely becuase such a qualification is also recognized for the teacher eligibility test. The teacher eligibility test is another qualification that makes one eligible for consideration but such a qualification if not prescribed under the appointment rules, cannot be engrafted through a judicial intervention. The petitioner can approach the State Government for the redressal of his grievances.
The writ petition is dismissed with the said observation

Heard learned counsel for the petitioner and Sri Virendra Chaubey for the respondent. 
The petitioner appeared in the TET Examination, 2011. He contends that he is of the O.B.C. Category but in the OMR Sheet the correct marking could not be made as a result whereof the petitioner was treated to be a general category candidate and he was declared fail as he had not obtained the minimum of 60% marks
Learned counsel for the petitioner contends that if the petitioner is treated to be of the other backward category then there was an exemption of 5%, and according to that he had more than 55% marks therefore he may be declared successful. 
The petitioner appeared in the examinations in November, 2011. Fresh examinations are now going to be conducted very shortly. The petitioner has waited for more than one and a half years and therefore there is no valid reason to interfere at his instance. 

This alleged error which is being described as a human error has been discovered after one and a half years for approaching this court, therefore I am not inclined to exercise jurisdiction under Article 226 of the Constitution of India. It is open to the petitioner to apply for fresh examinations again. 
The writ petition is dismissed with the aforesaid observation.

In the meantime, Principal Secretary, Basic Education Government of U.P. Lucknow may consider the cause of the petitioner and pass� an appropriate speaking� order, if possible, within two� weeks from the date of communication of this order. 
Let a copy of this order be supplied to Sri J.K.Tiwari, learned Standing Counsel� without any charge for communication of this order to the authority concerned.
