Notice on behalf of opposite party nos. 1 to 3 has been accepted by the learned Chief Standing Counsel whereas notice for opposite party no. 5 has been accepted by Mr. M.M. Asthana, Advocate.

Learned counsel for petitioners submits that petitioners are the students of final year B.T.C. Course. An advertisement for UP-TET was issued on 17.4.2013. As per the said advertisement, the last date for online registration and submission of form is 13.5.2013.
Submission is that as per the guidelines issued for conducting TET by the NCTE vide letter dated 11th February, 2011, a person who is pursuing any of the Teacher Education Course (recognized by NCTE or the RCI, as the case may be) specified in the NCTE notification dated 23rd August, 2010 shall be eligible to appear in the TET Examinations. The Central Government Agencies such as Central Board of Secondary Education, Delhi in consonance with the aforesaid guidelines is permitting all such candidates who apart from having graduation degree with 50% marks and pursuing two years diploma course and are in final year to appear in the TET Examinations.
It is also submitted that till last year the State Government had permitted the candidates pursuing Teacher Education Course such as B.Ed., B.T.C., etc. and are in final year to appear in UP-TET.
However, since the Government Order dated 17.4.2013 does not include the candidates pursuing Teacher Education Course to appear in UP-TET Examinations, as such, the petitioners are not being permitted in the UP-TET and their forms are not being accepted to register them online.
Prima facie, it appears that the TET Examinations are to be held as per the guidelines issued by the Governing Body such as NCTE which provides that all such candidates who are pursuing Teacher Education Course shall be eligible to appear in TET Examinations, as such, as an interim measure, it is hereby provided that the opposite parties shall permit the petitioners to appear provisionally in UP-TET, 2013 and for that purpose register their online application forms. The result of the same shall be subject to further orders of the Court.
The opposite parties shall file counter affidavit within four weeks. In case counter affidavit is filed, petitioners may file rejoinder affidavit, if any, within two weeks thereafter.
