On 17.11.2014, the Bench presided over by Hon'ble Chief Justice has proceeded to pass an order mentioning therein for extension of three weeks' time to file counter affidavit and it was also mentioned that counter affidavit, if any, shall be filed on or before next date of hearing.
On the matter being taken up today, neither there is any counter affidavit on behalf of union of India nor on behalf of State, however, National Council for Teacher Education has proceeded to file counter affidavit.� Same is accepted and taken on record.
Consequently, as a last opportunity three weeks' and no more time is allowed to State as well as Union of India to file counter affidavit as already directed by this Court vide order dated 17.11.2014.� List on 05.01.2015.� Absorption of Shiksha Mitras shall abide by final order passed by this Court.

Since an issue pertaining to vires is to be adjudicated upon, the petition was earlier placed before the learned single Judge. It appears that during the pendency of the present proceedings before the learned single Judge, a counter affidavit was required to be filed within three weeks, by an order dated 6 September, 2014. No counter affidavit has been filed by the State, National Council for Teacher Education or Union of India.
We grant an extension of three weeks to file a counter affidavit. Counter affidavit, if any, shall be filed on or before the next date of hearing.

In pursuance of the direction of this Court dated 9.10.2014, the matter is listed today before this Court.
Before hearing could commence, Sri M.M. Asthana, learned counsel appearing on behalf of N.C.T.E. points out that in view of recent order of Hon'ble the Chief Justice, this matter and connected Writ Petition No.3194 (SS) of 2014 and Writ Petition No.3248 (SS) of 2014, would be cognizable by Division Bench, as vires of Rule 16-Ka of Uttar Pradesh Nishulka Aur Anivarya Bal Shiksha Ka Adhikar (Pratham Sanshodhan) Niyamavali, 2014 is under challenge. He further points out that even at Allahabad, similar matters were placed before a learned Single Judge, but were directed to be laid before the appropriate Division Bench.
The said fact has not been disputed by learned counsel for the petitioners.
It is pointed by learned counsel for the petitioners that hearing of the writ petition was expedited by the orders passed in special appeal and therefore, some early date may be fixed.
On joint request of the parties, let the matter be placed before the appropriate Division Bench in the next cause list peremptorily.

The petitioners are seeking quashing of the Government Order dated 7.2.2013 to the extent it provides for absorption of the Shiksha Mitra on the post of Assistant Teacher in the primary schools run by the Basic Shiksha Parishad, U.P.��� The petitioners are also challenging the vires of Rule 16-Ka inserted in the U.P. Nishulka Aur Anivarya Bal Shiksha Ka Adhikar (Pratham Sanshodhan) Niyamavali, 2014 as well as seeking quashing of the G.O. dated 19.6.2014 prescribing the schedule for absorption of Shiksha Mitra as Assistant Teachers has been laid down commencing the process on 30th June, 2014 and concluding the same with the issuance of Appointment Letters by 31st July, 2014 and further quashing the Notification dated 30.5.2014 Uttar Pradesh Basic Shiksha (Adhyapak) Seva (Unnisava Sanshodhan) Niyamavali, 2014 amending the definition of Shiksha Mitra to be allowed to apply and compete for the post of Assistant Teachers without even having the requisite qualification of TET and have prayed for a writ of mandamus directing the respondents not go effect the Samayojan (Absorption) of Shiksha Mitra on the post of Assistant Teachers in the Primary Schools run by the Basic Shiksha Parishad, U.P.

Heard Shri Himanshu Raghav,� learned counsel for the petitioners, Shri M.M. Asthana, learned counsel appearing for the respondent no. 3, learned standing counsel for the respondents no. 1 and 2, Shri Ghaus Beg for respondent no. 4 and Shri Abhishek Srivastava and Shri Rajiv Tripathi for the newly impleaded respondent no. 5.

All the respondents may file their counter affidavit within three weeks. The petitioners will have one week thereafter to file the rejoinder affidavit.

Connect with W.P. No. 3194 (S/S) of 2014 and list thereafter.
In the meantime it is provided that the appointments of the Shiksha Mitra so made shall be subject to the outcome of the writ petition.

Shri D.R. Mishra, learned counsel states that he has filed caveat application No. 2765 of 2014 on behalf of Adarsh Shiksha Mitra Welfare Association U.P. but the same has not been reported. Office is directed to place the said caveat application on record.

Shri Ved Prakash Shukla also states that he has filed caveat application no. 3082 of 2014 in the office but the same has not been reported by the office. Office is directed to place the same on record.

Learned counsel for the petitioners shall serve a copy of the writ petition upon Shri Abhishek Srivastava, Shri D.S. Mishra and Shri Ved Prakash Shukla within 24 hours.

It was heard that in Previous Hearing NCTE Gives big trouble to Shiksha Mitra , And says TET Pass is Mandatory to Become Teacher.


यू पी में लगभग 3 लाख से ज्यादा पद प्राइमरी शिक्षकों के खाली पड़े हैं ,
और एन सी टी ई नियमानुसार शिक्षक बनने के लिए टी ई टी पास होना जरूरी है ।

वहीँ दुसरी तरफ लगभग 3 लाख से ज्यादा  बी एड , बी टी सी पास अभ्यर्थी  टी ई टी परीक्षा पास कर चुके हैं , वहीँ शिक्षा मित्र गिने चुने ही टी ई टी परीक्षा पास कर पाये हैं ।
लेकिन शिक्षा मित्रों का कहना है की वह पहले से कार्यरत हैं , और उन्हें टी ई टी से छूट मिलनी चाहिए
उनकी शर्तों के आधा पर नियुक्ति तो हो गयी , लेकिन इलाहबाद हाई कोर्ट में केस अभी भी चल रहा है
और मामला बहुत पेचीदा है ।

आर टी ई नियमानुसार टी ई टी से छूट किसी राज्य को कुछ शर्तों पर ही मिल सकती है , जिसमें अगर राज्य के अंदर टी ई टी पास अभ्यर्थी निर्धारित संख्या में मौजूद न हों या फिर प्रशिक्षण संस्थान की कमी हो इत्यादि ।

यू पी में 3 लाख टी ई टी पास अभ्यर्थी पहले से मौजूद हों , ऐसे में टी ई टी से छूट एक बड़ी मुश्किल है ।
कुछ और भी समस्याएं हैं जैसे की  शिक्षा मित्रों की भर्ती के समय आरक्षण के नियमो का पालन नहीं हुआ , उनकी ट्रेनिंग प्रशिक्षण नौकरी के साथ हुआ इत्यादि

अब देखते हैं की कल क्या होता है

लो टेट मेरिट के नेता बातें तो बहुत बड़ी-बड़ी करते हैं लेकिन टेट पास बीएड डिग्रीधारकों के हित में जो असली काम किया जाना चाहिए उसके बारे में सोचते तक नहीं हैं ..... 5 तारीख को लखनऊ हाईकोर्ट की डिवीजन बेंच में अरशद नामक किसी अनजान व्यक्ति की याचिका पर शिक्षा मित्रों का मामला सुना जाना है जिसमे ncte ने अपना जवाब दाखिल कर दिया है जबकि न्यायमूर्ति वी के शुक्ला द्वारा आखिरी मौका दिए जाने के बावजूद ना तो केंद्र सरकार ने अपना जवाब दाखिल किया है और ना ही प्रदेश सरकार ने ,,,,, होना तो यह चाहिए था कि इस केस में किस btc वाले की ओर से IA डालकर कोई अच्छा सा वकील खड़ा किया जाता क्योंकि अरशद की याचिका सरकार ने नहीं कराई इसकी कोई गारंटी नहीं है ,,,, अपने ही आदमी से अपने विरुद्ध याचिका कराकर अपना हित सिद्ध कर लेना बहुत पुरानी परंपरा है .... उधर इलाहाबाद में तो खरे साहब की सरकार से सेटिंग हो चुकी है जिसका लाभ उठाकर सरकार ने शिक्षा मित्रों को conditional सहायक अध्यापक तो बना ही दिया है ,,, यदि कोई कहता है कि सेटिंग नहीं है तो वो मुझे बताये कि क्या खरे साहब इस छोटी सी बात को नहीं जानते थे कि किसी क़ानून को अल्ट्रा वायरस कराने की याचिका डिवीजन बेंच में सुनी जाती है ,,, जाहिर है खरे साहब अपने क्लाइंट्स को हमेशा की तरह उल्लू बना रहे थे जिससे सही बहस गलत कोर्ट में होती रहे और सरकार अपने प्रिय शिक्षा मित्रों को समायोजित करके कोर्ट के सामने मानवीय आधार पर रिलीफ देते हुए sm को निश्चित समयावधि में टेट पास कराने का आदेश करा ले .... सुप्रीम कोर्ट ने 3 लाख रिक्त पदों की बात की तो है लेकिन जिनका 72825 में नहीं हो रहा उन्हें जॉब लेने के लिए अपने हिस्से के पदों को खाली करवाना होगा .....
लो टेट मेरिट वालों की बेवकूफी और काहिली का इससे बड़ा प्रमाण और क्या होगा कि उन्होंने शिक्षा मित्रों को रोकने की जिम्मेदारी दी शिव कुमार पाठक 126 नंबर ,अवनीश यादव 123 obc और निरहुआ 119 obc ..... नतीजा आपने देख ही लिया होगा ......my dear friends ये कोई छोटा मोटा खेल नहीं है जो आप उन लोगों पर भरोसा कर लेते हो जिनके हित और आपके हित एक समान ना हों ..... ये जो फेसबुक पर नकली लडाइयां आप देखते हो वो सिर्फ इसलिए की जाती हैं जिससे आप एक को हटाकर दूसरे को ले भी आओ तो वो भी पहले से ही बिका हुआ हो ....
अभी भी मौका है ,,,, इलाहाबाद के संजीव मिश्रा और कानपुर के कमलेश पाठक के 113 नंबर हैं तथा ये दोनों लोग टेट मोर्चे के निष्ठावान और सक्रिय कार्यकर्ता रहे हैं ,, इन दोनों को चाहिए कि sm को रोकने के लिए आगे आयें और लखनऊ हाईकोर्ट में IA डालने का प्रबंध करें ..इस IA का सबसे बड़ा फायदा यह होगा कि हाईकोर्ट से मनमाफिक आदेश ना होने पर सुप्रीम कोर्ट में आसानी से अपील की जा सकेगी 105 gen/97 रिजर्व के आदेश का यह मतलब नहीं है कि बिना कुछ किये धरे ही जॉब मिल जायेगी ,,,,आपको ना सिर्फ लड़ना होगा बल्कि सही जगह और सही तरीके से लड़ना होगा ,,,,
जो लोग सुप्रीम कोर्ट में IA या PIL की बात कर रहे हैं उन्हें बता दीजिये कि सुप्रीम कोर्ट 17 तारीख को दिए आदेश से बेहतर आदेश नहीं दे पायेगा ,,,,साथ ही यह भी बता देना वो आदेश किसी वकील ने नहीं कराया है ,,, यदि सहायक अध्यापक बन चुके शिक्षा मित्रों को वापस शिक्षामित्र ना बना पाना तो सहायक अध्यापक बनने का सपना देखना भी छोड़ देना ,,,,
मोर्चे के पैरवीकार बिक चुके हैं इस बात का इससे बड़ा सबूत और क्या होगा कि जिस अभिषेक श्रीवास्तव को दलाली करने के लिए दिल्ली ले जाया जाता है वही शिक्षामित्रों की ओर से लखनऊ और इलाहाबाद दोनों जगह खड़े होते हैं ....

The Central Board of Secondary Education, Delhi will be conducting the Central Teacher Eligibility Test (CTET) for a person to be eligible for appointment as a teacher for classes I to VIII on 22.02.2015 (Sunday). Candidates can apply only On-line for CTET-FEB 2015 on CTET website.
Educational Qualification: The candidates having the following minimum educational qualification are eligible for appearing in CTET.
Minimum Educational Qualifications for becoming Teacher for Classes I-V (Primary Stage):
Senior Secondary (or its equivalent) with at least 50% marks and passed or appearing in final year of 2- year Diploma in Elementary Education (by whatever name known). OR
Senior Secondary (or its equivalent) with at least 45% marks and passed or appearing in final year of 2-year Diploma in Elementary Education (by whatever name known), in accordance with the NCTE (Recognition Norms and Procedure), Regulations, 2002. OR
Senior Secondary (or its equivalent) with at least 50% marks and passed or appearing in final year of 4-year Bachelor of Elementary Education (B.El.Ed). OR
Senior Secondary (or its equivalent) with at least 50% marks and passed or appearing in final year of 2-year Diploma in Education (Special Education). OR

Online Application has to be submitted by accessing the following CTET website www.ctet.nic.in. The candidate should supply all the details while filling up the ‘On-line’ Application. After depositing fee in Bank, Candidates are required to take a print out of the computer generated Confirmation Page after successful submission of data. (if fees paid through Challan) and keep it for records and future reference if required.
The fee can be remitted in the following ways:
  •   Through Challan by deposit of prescribed fees in CBSE Account with Syndicate Bank or Canara Bank in favour of Secretary, Central Board of Secondary Education, Delhi.
  •   By Debit/Credit Card.
Procedure for submission of Online Application Form of CTET-FEB 2015 Application for Upload Images Fee Payment / Payment updation Confirmation Page
1. Please read the Information Bulletin of CTET FEB 2015 carefully before you start filling the Online Application Form.
2. Candidates can apply for CTET-FEB 2015 ‘ON-LINE through website www.ctet.nic.in. Candidates can apply on-line at CTET website ww.ctet.nic.in. The candidate should supply all details while filling the ONLINE FORM. Candidates are required to take a print out of the computer generated Confirmation Page with Registration Number after successful submission of data upload of images and payment of fees for record and future reference. The confirmation page SHOULD NOT be sent to CBSE.
3 The application for CTET-FEB 2015 has been made completely online with the facility to upload photograph and signature of the applicant. The particulars will be filled online and the scanned images of photograph and signature (in JPG format
only) will be uploaded at the time of filling the application form. The candidates/facilitation centres are advised to keep the scanned images of photograph and signature of the candidates ready in JPG format before applying online.
4 The candidate should mention their own Mobile No., E-mail ID, Photograph and Signature while submitting their On-Line application as the CTET alerts will send to the candidates on their registered Mobile Number and E-mail ID.
Application Procedure: 4 Simple Steps to be followed to apply online.

Upload Scanned Images of Photograph and Signature.

  •   The scanned images of photographs and signature should be in jpg format.
  •   Size of the photo image must be greater than 4 kb and less than 100 kb.
  • Size of the signature image must be greater than 1 kb and less than 25 kb.
  •   Image Dimension of photograph should be 3.5 cm (width) x 4.5 cm (height) only.
  •   Image Dimension of signature should be 3.5 cm (length) x 1.5 cm (height) only.
