Heard Sri Anurag Srivastava, learned counsel for the petitioner, Sri Ghaus Beg for opposite party No.s 4 to 6 and learned Standing counsel for the State. 
Petitioner was granted compassionate appointment after the death of his father on the post of Assistant Teacher vide order dated 30.9.2011. He says that the same is being sought to be taken away vide annexure No.2 dated 9.7.2012. Counsel for the opposite party says that that the petitioner has not qualified the Teachers' Eligibility Test (in short T.E.T). Petitioner says that once an appointment has been given to her in pursuance of a statutory law, the same can not be taken away. It is further argued that T.E.T. is a written test, which should not be forced upon the petitioner for compassionate appointment.
On the other hand, learned counsel for opposite parties has placed before this Court judgment and order of this Court passed at Allahabad in a petition bearing Writ-A No.33828 of 2012. He says that benefit of this appointment can not be given to the petitioner unless he has qualified T.E.T. as has been held in aforesaid judgment. 
Learned counsel for the petitioner has, however, submitted that the said order is under challenge in special appeal and the special appeal is pending before this Court at Allahabad. He says that compassionate appointemnt is a benevolent law which should be interpreted in all possible ways to help a person whose bread earner has been snatched away by the cruel hands of death. The sudden penury which strikes the family is sought to be nullified by the authorities under Dying in Harness Rules. 
Under the circumstances, the petition is finally disposed of with a direction to the opposite parties to consider the case of the petitioner for the compassionate appointemnt on another suitable post for which the petitioner is eligible under Dying in Harness Rules applicable for appointment. The same shall be decided expeditiously, say within a maximum period of one month from the date a certified copy of this order is placed before him. 
The termination of petitioner's services shall remain subject to the final decision of the special appeal which is pending before this Court at Allahabad.

Petitioners have approached this Court with a request to declare the UPTET Certificate 2011 of such candidates invalid, who have taken admission in their B.Ed. Course after the last date of filling of the application forms of examination of UPTET 2011 i.e. 18.10.2011 for which the examination has been held on 13th November, 2011 in view of the eligibility rules framed for UPTET 2011 and further prayer has been made that such candidates be not considered for appointment on the post of teachers in primary schools in pursuance of advertisement dated 7th December, 2012.
Under the Right of Children to Free and Compulsory Education Act 2009, the National Council for Teachers Education (NCTE) was authorized to lay down the qualifications and as per the qualification laid down by NCTE, a candidate for the recruitment on the post of Assistant Teacher in Government schools is required to possesses TET qualification in addition to his academic and training qualification. The Central Government enacted the Right of Children to Free and Compulsory Education Act 2009 on 26.08.2009 in which under Section 23 it is provided that any person possessing such minimum qualification as laid down by the Academic Authority authorized by the Central Government by notification shall be eligible for appointment as a Teacher. While exercising power under Section 23 (1) the Central Government issued notification on 31.03.2010, by which, the Central Government authorized the NCTE as Academic Authority to lay down the minimum qualification for a person to be eligible for appointment as a Teacher.
After getting authorization under Section 23 (1) of the Act of 2009, the NCTE issued notification dated 23.08.2010 whereby the qualification was prescribed for the recruitment on the post of Assistant Teacher in Government schools in which in addition to the academic qualification and training, another qualification which is Teachers' Eligibility Test (TET) has been inserted and in the notification it has been specifically provided that candidates should pass the TET to be conducted by the appropriate Government in accordance with the guidelines framed by NCTE for the said purpose. After issuance of the aforesaid notification, another notification dated 29.07.2011 was issued by the NCTE whereby certain amendments were made in the qualification by the NCTE, but the eligibility of passing TET remained the same.
Appointment as Assistant Teacher to Junior Basic Schools is made in accordance with the procedure prescribed under U.P. Basic Education Teachers Service Rules 1981. In pursuance of the guidelines prescribed by NCTE aforesaid rules have been amended by the State Government vide notification dated 09.11.2011, which is a basis of selection for appointment as Assistant Teacher. The aforesaid amendment is apart from other qualifications specified for the appointment. The candidate must have passed U.P. Teachers Eligibility Test as an essential qualification for getting such appointment as Assistant Teachers. The NCTE issued guidelines vide letter dated 11.02.2011 for introducing TET as an essential qualification for appointment as Assistant Teachers in classes I to VIII under the provisions of Section 23 of Right of Children to Free and Compulsory Education Act 2009. In pursuance of the aforesaid guidelines dated 11.02.2011 issued by NCTE, the State Government has issued Government Order dated 07.09.2011 for conducting TET examination in the state of U.P. In pursuance of the aforesaid Government Order, U.P. Madhyamik Shiksha Parishad at Allahabad issued advertisement dated 26.09.2011 seeking applications for the TET examination from the eligible candidates, who have passed B.Ed. course. The educational qualification required for appearing in TET examination 2011 was having obtained graduate degree with B.Ed.
The State Government made several amendments regarding the TET examination 2011 including the amendment notification dated 24.09.2011 stating therein again the eligibility qualification of graduate followed by certificate of B.Ed. course. Thereafter, the State Government had issued another notification dated 04.10.2011 making some amendments in the minimum qualification for appearing in UPTET examination, where a new amendment has been made that such candidates, who are appearing in the B.Ed. examination are also permitted to appear in the U.P. Teacher Eligibility Test Examination 2011.
Petitioners' submission is that due to misinterpretation of the amendment introduced on 04.10.2011 thousands of candidates, who were not entitled even to appear in U.P. Teacher Eligibility Test Examination 2011, have been allowed to appear in the said examination and have also been issued the UPTET certificate for the year 2011. Petitioners submit that such issuance of certificate is against the spirit of amendment dated 04.10.2011 as well as against the eligibility criteria required for Teacher Eligibility Test. Petitioners in this background submit that the merit of the selected candidates would be raised on a higher side. Petitioners have submitted that only the B.Ed. certificate obtained in the session 2010-11 can be accepted to be valid degree and the B.Ed. certificate obtained in the session 2011-12 could not have been entertained and accordingly requisite relief be accorded. At this juncture present writ petition has been filed with the prayer mentioned above.
Shri Jagdish Pathak, learned counsel for the petitioners, submits that as per the amendment, which has been so made only appearing candidates were permitted to appear in U.P. Teacher Eligibility Test 2011 and accordingly the candidates of academic session 2011-12 cannot be accepted as appearing candidates, and in view of this, such candidates were ineligible for undertaking U.P. Teacher Eligibility Test 2011 and accordingly requisite relief be accorded by this Court.
Countering the said submission learned Standing Counsel on the other hand contended that Teacher Eligibility Test is merely an essential qualification to enable incumbents to be appointed as a teacher and in view of this once a conscious decision has been taken to permit such incumbents also, who were in the process of acquiring B.Ed. degree i.e. who were in the process of undertaking examination, then to non-suit their certificate of Teacher Eligibility Test on said grounds cannot be accepted and specially in the background that candidates who have passed BA/BSc with 50% and are B.Ed. are fully eligible for appointment as Assistant Teacher without having passed TET examination, as per the judgment of this Court in Special Appeal No. 2366 of 2011, Prabhakar Singh and others Vs. State of U.P. and others, delivered on 16.01.2013.
After respective arguments have been advanced the factual situation which is so emerging in the present case that the eligibility criteria which has been so prescribed for undertaking Teacher Eligibility Test, a candidate was required to have B.Ed. degree to his credit along with graduation degree. The said eligibility criteria had been subsequently modified on 04.10.2011 and as per the same, apart from an incumbent, who has to his credit graduation degree along with one year B.Ed. degree incumbents, who were to appear in the examination of B.Ed. were also entitled to apply. Petitioners submit that in this background the candidates, who have got degree of B.Ed. in the year 2011-12 cannot be said to be appearing candidates at the time of filling up the application form of U.P. Teacher Eligibility Test 2011 and accordingly cannot be accepted as eligible. Candidates, who have obtained their B.Ed. Degree after passing TET examination 2011 should be restrained from participating in process of selection in pursuance of Advertisement dated 07.12.2012. As of date, said arguments are neither here nor there, as candidates having passed BA/BSc with 50% and B.Ed. have been accepted as eligible, as they have been accorded relaxation from TET upto 31.03.2014 by the Central Government. Said aspect of the matter has been examined at length in Special Appeal No. 2366 of 2011, Prabhakar Singh and others Vs. State of U.P. and others, decided on 16.01.2013. Accordingly, no relief or reprieve can be given to petitioners and present writ petition is dismissed accordingly.

In the present case petitioner has requested to quash Para-10 of the Government Order dated 05.12.2012 regarding selection process on the basis of academic qualification and marks is concerned.
Challenge which has been so made cannot be entertained for the simple reason that the criteria in question has been prescribed under U.P. Basic Education (Teachers) Service Rules 1981. Once criteria which has been mentioned in the Government Order dated 05.12.2012 is backed and based on the aforesaid Rules in question then challenge as has been made by the petitioner cannot be entertained. In view of this prayer no. 1 cannot be accorded by any means.
As far as prayer no. 2 is concerned, wherein request� has been made to prepare the list of eligible candidates for Apprentice Teacher in the Primary School Governed by the Uttar Pradesh Basic Shiksha Parishad on the basis of marks obtained by the petitioner in U.P. Teacher Eligibility Test 2011 is concerned suffice is to mention that prescribed procedure for making selection and appointment has also been provided under U.P. Basic Education (Teachers) Service Rules 1981 wherein Rules 14 clearly proceeds to mention that marks in question are to be computed as per Appendix-II and therein prescribed criteria has also been prescribed providing� the way and manner in which marks is to be computed.�
Once such is the factual situation that selection and appointment is governed by statutory Rules then relief as has been claimed by means of prayer no. 2 cannot be subscribed.
Consequently, present writ petition is dismissed.

Petitioners by means of the present writ petition have requested before this Court to issue writ, order or direction in the nature of mandamus commanding the respondents not to consider the candidature of the candidates, who have passed their B.Ed. Examination after 25th November, 2011 or 1st January, 2012.
Petitioners' submission is that due to misinterpretation of the amendment introduced on 04.10.2011 thousands of candidates, who were not entitled even to appear in U.P. Teacher Eligibility Test Examination 2011, have been allowed to appear in the said examination and have also been issued U.P. TET Certificate for the year 2011, in view of this, as they were ineligible to appear in U.P. TET Examination 2011, accordingly, such a restriction be imposed upon them.
The request, as has been made by petitioners, cannot be accepted as of now and the arguments, which have been advanced, is of no avail for the simple reason that in Special Appeal No. 2366 of 2011 (Prabhakar Singh and others Vs. State of U.P. and others) decided on 16th January, 2013 following directions have been issued.
"In the result all the Special appeals are disposed of with the following directions:

(i)The appellants/other eligible candidates who have passed BA/BSc with 50% and are B.Ed being fully eligible for appointment as Assistant Teacher to teach Classes I to V as per Clause 3 of the notification dated 23rd August, 2010, as amended from time to time, are entitled for consideration for their appointment on vacant posts of Assistant Teachers in Classes I to V. The State authorities including the concerned District Basic Education Officers are directed to consider the claim of such persons while considering the appointment on the post of Assistant Teacher in institutions to teach Classes I to V.

(ii)The State is directed to issue a corrigendum so that all eligible candidates as per clause 3 of the notification dated 23.8.2010 as amended i.e. candidates having 50% marks in B.A./B.Sc. with B.Ed. should also be permitted to participate in the ongoing process of appointment of trainee teachers. At least 15 days time be allowed to submit applications by abovementioned candidates.

(iii)The prayer of the appellants possessing BTC/Special BTC qualifications obtained after 23.8.2010 to issue direction to appoint them giving benefit of paragraph 5 of the notification dated 23rd August, 2010 cannot be accepted.

Parties shall bear their own costs."
Once such is the factual situation that candidates, who have passed B.A./B.Sc. with 50% and are B.Ed. being fully eligible for appointment as Assistant Teacher to teach classes 1 to 5 as per Clause 3 of the notification dated 23rd August, 2010, as amended from time to time, are entitled to be considered for their appointment on vacant posts of Assistant Teachers in classes 1 to 5, even they have not cleared TET examination.
In view of this, request of petitioner, as has been made in the present writ petition cannot be accepted by this Court and writ petition is dismissed accordingly.

पटना: अगली बार से शिक्षक नियोजन में शिक्षक पात्रता परीक्षा (टीइटी व एसटीइटी) के प्राप्तांक के आधार पर ही अभ्यर्थियों की मेधा सूची बनेगी. इसके लिए शिक्षक नियोजन नियमावली में संशोधन किया जायेगा. शिक्षा विभाग के पदाधिकारी इसे लेकर गंभीरता से मंथन कर रहे हैं. जल्द ही नियमावली में संशोधन का प्रस्ताव तैयार होगा. इसके बाद कैबिनेट से स्वीकृति ली जायेगी.
वर्तमान नियमावली के अनुसार मैट्रिक, इंटर,स्नातक व शिक्षण प्रशिक्षण के प्राप्तांक के आधार पर मेधा सूची बनती है. नियमावली में संशोधन के बाद मैट्रिक, इंटर, स्नातक व शिक्षण प्रशिक्षण के प्राप्तांक के आधार पर मेधा सूची नहीं बनेगी. टीइटी व एसटीइटी में जिस अभ्यर्थी के अधिक अंक होंगे, वही मेधा सूची की वरीयता सूची में ऊपर होगा. अक्तूबर-नवंबर में होनेवाली टीइटी में नये नियम लागू होंगे.
शिक्षक नियोजन नियमावली में और भी कुछ संशोधन किये जाने हैं. शिक्षक संघों की मांग पर नियोजित शिक्षकों की वेतन वृद्धि व इनके स्थानांतरण को लेकर शिक्षा विभाग प्रस्ताव बना रहा है. इन सभी बातों पर निर्णय लेने के बाद नियोजन नियमावली में संशोधन की आवश्यकता पड़ेगी.
दूसरी टीइटी होगी
अक्तूबर-नवंबर में दूसरी टीइटी होगी. इसके बाद एसटीइटी होगी. इन दोनों परीक्षाओं में सिर्फ प्रशिक्षितों को ही शामिल किया जायेगा. पहली टीइटी वर्ष 2011 व एसटीइटी वर्ष 2012 में हुई थी, जिनमें प्रशिक्षित व अप्रशिक्षित दोनों तरह के अभ्यर्थी शामिल हुए थे. इन परीक्षाओं में उत्तीर्ण अभ्यर्थियों की नियुक्ति प्रक्रिया चल रही है. 18 मार्च तक मेधा सूची के आधार पर अभ्यर्थियों को नियोजन पत्र निर्गत कर दिया जायेगा. उच्च माध्यमिक शिक्षकों की नियुक्ति प्रक्रिया अभी नहीं चल रही है. इसके लिए मार्च बाद आवेदन लिया जायेगा

Many candidates says that TET is simply a eligibility test due to their IGNORANCE.

However many states used weight-age of TET marks in Selection. NCTE already cleared in its NOTIFICATION that marks of TET should be used in Selection Process.(Else NCTE not says Candidates can reappear in TET exam to improve SCORE.)

I think Assam also uses TET marks in making merit.

However it depends on Selection Authority - How much weightage of TET marks can be used in Selection. And base of selection is in the hands of Selection Authority.

Therefore matter is not like - TET marks/ merit can be used in Selection.

NCTE clears that passing TET is MUST for Eligibility Criteria for PRIMARY/UPPER PRIMARY Teachers. But only after passing it, they can not claim for their SELECTION.

आजमगढ़ : उत्तर प्रदेश टीईटी उत्तीर्ण संघर्ष मोर्चा की बैठक रविवार को मेहता पार्क में हुई। इसमें मेरिट के आधार पर शिक्षक नियुक्ति की मांग की गई। मांग पूरी न होने पर अभ्यर्थियों ने आंदोलन की चेतावनी भी दी।

रवींद्रनाथ यादव ने कहा कि देश व समाज का विकास योग्य नागरिकों द्वारा होता है। योग्य नागरिक के निर्माण में प्राथमिक विद्यालय के शिक्षकों की भूमिका महत्वपूर्ण होती है। इसलिए सरकार को बिना किसी भेदभाव के टीईटी मेरिट के आधार पर शिक्षक नियुक्ति का रास्ता साफ करना चाहिए। अरविंद यादव ने कहा कि सरकार को समझना चाहिए कि यदि टीईटी मेरिट के आधार पर नियुक्ति नहीं हुई तो अयोग्य लोग व्यवस्था को प्रभावित करेंगे। उमेश कुमार ने कहा कि मामला न्यायालय में विचाराधीन है। हमें विश्वास है की जीत हमारी होगी। बस जरूरत है कि टीईटी उत्तीर्ण अभ्यर्थी एकजुट होकर संघर्ष करें। इस मौके पर राजेश, उमेश कुमार, उमेश वर्मा, सुभाष चंद्र तिवारी, बृजभान चौहान, राजेश, शिवानंद, अखिलेश, मिथिलेश, संतोष कुमार, सत्यप्रकाश, भोला, मनोज, सूर्यभान, भारत भूषण आदि उपस्थित थे

(संत कबीर नगर) : पौली क्षेत्र के प्राथमिक विद्यालयों में कार्यरत करीब एक सौ पांच शिक्षा मित्रों ने मुख्यमंत्री को रजिस्टर्ड पत्र भेजा है। पत्र में मानदेय 7300 रुपये निजी खाते के माध्यम से देने की संस्तुति के साथ विगत 28 जनवरी को बेसिक शिक्षा मंत्री के साथ हुए समझौते को अमल में लाने की मांग की गयी है ।

उक्त बातें रविवार को आदर्श शिक्षा मित्र वेलफेयर एसोसिएशन के ब्लाक अध्यक्ष दुर्गा प्रसाद यादव ने शनिचरा मे आयोजित ब्लाक पदाधिकारियों की बैठक में कही। उन्होंने बताया कि प्रदेश अध्यक्ष जितेन्द्र शाही के निर्देश पर प्रदेश के समस्त शिक्षा मित्र अपनी पीड़ा को पत्र के माध्यम से मुख्यमंत्री तक पहुंचाने का प्रयास कर रहे है, क्योंकि नौकर शाह शिक्षा मित्रों को गुमराह कर रहे है। ब्लाक मंत्री अहमद खान ने कहा कि मुख्यमंत्री का ध्यान आकर्षित करने हेतु उनके गृह जनपद इटावा से पचीस हजार शिक्षा मित्र साइकिल रैली निकालेंगे।

बैठक में हनुमंत यादव, श्यामलाल, नित्यानंद तिवारी, मधुकर यादव, हीरालाल, संजय कुमार, राजेन्द्र प्रसाद, महेन्द्र प्रसाद ,ममता मिश्रा, उर्मिला, गुलाब, अखिलेश तिवारी, शशिभूषण सहित तमाम लोग मौजूद रहे

निज प्रतिनिधि, एटा: समस्याओं और उत्पीड़न को लेकर शिक्षामित्रों में रोष पनपने लगा है। रविवार को उत्तर प्रदेश प्राथमिक शिक्षामित्र संघ के प्रांतीय नेतृत्व के निर्देश पर शहीदपार्क में शिक्षामित्रों ने बैठक कर समस्याओं पर चिंतन किया। यही नहीं नेतृत्व द्वारा शिक्षामित्रों के हितों के लिए किए जा रहे प्रयासों पर भी चर्चा की।

इस अवसर पर शिक्षामित्र संघ के प्रांतीय उपाध्यक्ष सुशील तिवारी एवं जिलाध्यक्ष मनोज यादव ने कहा कि किसी भी कीमत पर शिक्षामित्रों का उत्पीड़न बर्दाश्त नहीं किया जाएगा। उनकी समस्याओं के समाधान के लिए हर संभव प्रयास किए जाएंगे। महामंत्री आलोक मिश्र तथा सुधोतकर यादव ने बताया कि संघ द्वारा बीटीसी और विशिष्ट बीटीसी में प्रशिक्षण प्राप्त कर चुके शिक्षामित्रों के समायोजन के लिए नेतृत्व द्वारा प्रयास किए जा रहे हैं। उन्होंने चेतावनी दी कि प्राथमिक विद्यालय पृथ्वीराजपुर में शिक्षामित्र मोहनप्रताप पर लगे झूठे हरिजन एक्ट के मुकदमें को अविलंब वापस लिया जाए। महिला मोर्चा अध्यक्ष अनीता शाक्य और रूबी यादव ने कहा कि शिक्षामित्रों का मानदेय 7300 करने के लिए संघ लगातार शासन स्तर पर दवाब बनाए है और उनके मानदेय को आनलाइन खाते में भेजने की व्यवस्था की जा रही है।

इसके अलावा ब्लाक अध्यक्ष सुनील चौहान, एसके राजपूत, संतोष यादव, रंजना सिंह, ईश्वरदेव ने भी बैठक को संबोधित किया। इस दौरान राजेश यादव, होशियार सिंह, पंकज, धर्मेन्द्र यादव, विजेन्द्र यादव, गिर्राजकिशोर, प्रदीप, किरन शर्मा, सैब्या, शशि, मीना, निशा, नीरज कुमारी, रीना यादव, गीता, संध्या गौतम, भूपेन्द्र यादव, सुखवीर, रामवीर, ब्रजलता, नीलम, अंजना श्रीवास्तव, सुरजीत, लक्ष्मीकांत, दिनेश कुमार, दुष्यंत कुमार, दुर्वीन सिंह, विजय तिवारी, प्रेमलता, रजनेश कुमार, राजीव यादव, लालसिंह, अतेन्द्र सिंह सहित अनेक शिक्षामित्र मौजूद थे। बैठक की अध्यक्षता सुनील यादव, संचालन मो. इशहाक ने किया

चार माह से शिक्षा मित्रों को नहीं मिला मानदेय

   

विकासनगर : शिक्षा मित्र महासंघ की बैठक में विगत चार माह से मानदेय न मिलने पर रोष प्रकट किया गया। शिक्षा मित्रों का कहना था कि सरकार ने मानदेय बढ़ाने की घोषणा मात्र की है, मानदेय दिया नहीं है। आक्रोशित शिक्षा मित्रों ने एक मार्च से जिला शिक्षाधिकारी कार्यालय पर धरना देने की चेतावनी भी दी।

यहां आयोजित शिक्षा मित्रों की बैठक में नवंबर से मानदेय न मिलने से आक्रोशित शिक्षा मित्रों ने सरकार को एक मार्च से धरना प्रदर्शन करने की चेतावनी दी। शिक्षा मित्र संघ के जिला अध्यक्ष संदीप कुमार ने कहा कि नवंबर में बढ़े हुए मानदेय की घोषणा के बाद से सरकार की ओर से शिक्षा मित्रों को वित्त विभाग की ओर से बजट निर्गत न होने का बहाना बनाकर मानदेय न दिया जाना, उनके साथ विश्वासघात करने के समान है। उन्होंने शासन को चेताया कि यदि फरवरी में भी मानदेय आवंटित नहीं हुआ तो समस्त शिक्षा मित्र एक मार्च से जिला शिक्षा अधिकारी कार्यालय पर धरना प्रदर्शन करेंगे।

इस दौरान महासंघ के मंत्री खुशीराम पांडे, गजेंद्र सिंह, रणवीर सिंह, अनीता चौहान, महावीर सिंह, बलदेव सिंह, सुरजीत सिंह, बलदेव सिंह, संजय डोभाल, खजान राणा, कमल सुयाल, गुलाब सिंह, पूर्णिमा शर्मा, मीरा राणा, शिखा सक्सैना आदि मौजूद थे

SSC Petition alleges TET answers evaluated wrongly

The Calcutta High Court on Wednesday stayed the selection process to recruit teachers in the secondary and higher secondary schools by the School Service Commission (SSC) till March 21. The examination was held on July 29 last year to recruit teachers in secondary and higher secondary schools for filling up around 55,000 posts.

M D Kamruzzaman and 40 other candidates, who appeared in the SSC examination, filed a writ petition challenging the examination process. They alleged in the petition that the answer script of the Teachers Eligibility Test (TET) had been evaluated according to the wrong answers. The candidates who wrote the right answers on the basis of text books did not secure any marks. So the selection process should be stopped.

Hearing the allegation, Justice Debasish Kargupta referred the dispute to the principal of David Hare BEd College to look into the matter. The principal will verify the claim made by the candidates and file a report within three weeks.

The petition explained that the candidates had appeared for two written tests — one TET and another test on main subjects. On securing 60 per cent marks in the TET, their answer scripts of main subjects would be examined by the SSC. But the two written tests were taken on the same day. After publication of TET result, answer script of main subjects would be evaluated.

On December 1 last, the SSC published the result of TET and also disclosed the model answers of the questions of the TET on its website. The petitioners noticed that some answers in the model answers were different according to popular text books and the answer scripts were evaluated on the basis of the these model answers.


Advocate Bikash Ranjan Bhattacharjee, counsel of the petitioner argued that the candidates who wrote the right answers according to the text book, got zero and the candidates who wrote the wrong answers on the basis of the model answers secured got marks. As a result, he petitioner did not secure the requisite 60 per cent to qualify the TET, the petition alleged.

Though the results of the TET were published, the results of the main subjects are yet to some out. Justice Kargupta said that the result of the main subjects can not be published now for the stay order. The case will come up for hearing on March 21.

Teacher Recruitment in UP : एक और भर्ती के इंतजार में अभ्यर्थी

इलाहाबाद : प्रशिक्षु शिक्षक भर्ती पर इलाहाबाद हाईकोर्ट द्वारा रोक लगाए जाने के बाद अभ्यर्थियों को अंशकालिक अनुदेशकों की भर्ती शुरू होने का इंतजार है। प्रदेश में कुल 41307 अंशकालिक अनुदेशकों की भर्ती 25 फरवरी से शुरू होने जा रही है। इसमें कला शिक्षा, स्वास्थ्य एवं शारीरिक शिक्षा, कार्यानुभव में प्रत्येक के 13769 पद शामिल हैं।

छह से 14 साल के बच्चों को निश्शुल्क और अनिवार्य शिक्षा दिलाने के लिए एक अप्रैल 2010 से निश्शुल्क एवं अनिवार्य बाल शिक्षा का अधिकार अधिनियम 2009 लागू किया गया है। इस अधिनियम के अनुसार सौ से अधिक छात्र संख्या वाले उच्च प्राथमिक विद्यालयों में प्रति 35 छात्रों पर एक अध्यापक, एक प्रधानाध्यापक और कला, स्वास्थ्य एवं शारीरिक एवं कार्य शिक्षा के एक-एक अंशकालिक अनुदेशक तैनात किए जाएंगे। इसके तहत 13769 उच्च प्राथमिक विद्यालयों में 41307 अनुदेशकों के पद स्वीकृत किए गए हैं। इन्हें 11 महीने तक सात हजार रुपए प्रतिमाह मानदेय दिया जाएगा। यह मानदेय सीधे उनके खातों में भेजा जाएगा। संविदा पर तैनाती के लिए 30 अक्टूबर 2012 की छात्र संख्या के आधार पर सौ से ज्यादा छात्र संख्या वाले विद्यालयों का चयन किया गया है। ऐसे विद्यालयों की सूची दस फरवरी तक राज्य परियोजना कार्यालय में भेजी जानी है।

सबसे ज्यादा पद सीतापुर में

अंशकालिक अनुदेशकों के सबसे ज्यादा पद सीतापुर जिले में हैं। यहां 1695 पद घोषित किए गए हैं। हरदोई में 1380, लखीमपुरखीरी में 1269, आजमगढ़ में 1122, इलाहाबाद में 1059, सुल्तानपुर में 1020 और जौनपुर में 1014 पद घोषित किए गए हैं। इलाहाबाद में प्रत्येक वर्ग मे 353 पद रिक्त हैं।

25 फरवरी से होंगे आवेदन

तीनों पदों के लिए अलग-अलग आवेदन किए जाएंगे। अभ्यर्थी को अपने ही जिले में आवेदन करने की छूट दी जा रही है। सभी आवेदन सिर्फ ऑनलाइन होंगे। सामान्य अभ्यर्थी को दो सौ रुपये और अनुसूचित जाति व अनुसूचित जनजाति के अभ्यर्थियों को सौ रुपये का आवेदन शुल्क देना होगा। इसके लिए 25 फरवरी से विज्ञापन और आवेदन शुरू हो रहे हैं। ई-चालान द्वारा आवेदन शुल्क जमा करने की अंतिम तिथि 21 मार्च निर्धारित की गई है। 23 मार्च तक आवेदन किए जा सकेंगे। आठ अप्रैल को मेरिट सूची और तीस अप्रैल को काउंसिलिंग कराई जाएगी। 15 मई को तैनाती और 16 मई से 30 जून के बीच अंशकालिक अनुदेशकों को प्रशिक्षण दिलाया जाएगा। सभी अंशकालिक अनुदेशक एक जुलाई 2013 को विद्यालयों में कार्यभार ग्रहण कर लेंगे

आज जिस तरह से हिंदुस्तान पेपर में टी ई टी अनियमितता को लेकर न्यूज़ आयी उससे फिर ये बात प्रबल होने लगी है की टी ई टी मेरिट इस अनियमितता को दूर कर सकती है ।

हिंदुस्तान पेपर में छपा की कुछ प्रश्न गलत छपे थे और बार बार रिसल्ट संसोधित हुआ ।

इस अनियमितता को दूर करने के लिए सामान्य सा हल टेट मेरिट ही है ।
उदहारण के लिए , मान लीजिये की अनुज को टी ई टी परीक्षा में 87 मार्क्स मिले और मोहन को 110 मार्क्स ।
5 प्रश्न गलत थे और इस कारन सबको 5 मार्क्स अतिरिक्त दिए गए ।

अब अनुज (सामान्य श्रेणी) के मार्क्स बढकर 92 हो गए और वह इस प्रकार उसने भर्ती के लिए पात्रता हासिल कर ली ।
वहीँ दुसरी तरफ मोहन के मार्क्स बढ कर 115 हो गए ।

लेकिन इस अनियमितता को दूर करने के लिए अब चयन प्रक्रिया का बेस बदल जाता है - अकादमिक अंक 
मान लीजिये कि अनुज के अकादमिक गुणांक 72 हैं और मोहन के 65
तो नयी प्रक्रिया में मोहन को तो सीधा नुक्सान है ।

अगर इस अनियमितता के प्रभाव को नगण्य करने के 
लिये टी ई टी मेरिट का सहारा लिया जाता है तो दोनों को मिले अतिरिक्त अंक का कोइ प्रभाव इस चयन पर नहीं पडेगा ।

हालाँकि अभी कुछ कहा नहीं जा सकता की धांधली / अनियामित्तात्यां और भी हैं की नहीं, किस प्रकार की धान्ध्लीयाँ / अनियमितताएं और हैं । धांधली में कितने लोग संलिप्त हैं , और क्या धांधली हटाई जा सकती है की नहीं ।

ये सब बातें भी भर्ती प्रक्रिया पर प्रभाव डालेंगी ।
नियोक्ता सरकार है और न्याय कोर्ट को देना है ,
सभी लोग धेर्य रखें और आगे बढने के प्रयास (अन्य कोई परीक्षा की तयारी / नोकरी ) जारी रखें
