Heard Shri Gopal Jee, the petitioner in person.
Learned Standing Counsel has received notice on behalf of respondent nos. 1 and 2.
Shri R.B. Pradhan has received notice on behalf of respondent no.3.
All the respondents may file counter affidavit within the period of one month.
The petitioner claims to be grandson of freedom fighter Sri Bihari Rai being his daughter's son. Pursuant to the advertisement issued on 30.11.2011, the petitioner has appeared in Teacher Eligibility Test (T.E.T.) 2011 and has obtained 108 marks in the examination. Petitioner has applied as general category candidate and as cut off merit of general category candidate was above the marks obtained by the petitioner, he was not called for counselling. Petitioner is claiming benefit of descendant of the freedom fighter being daughter's son in view of Division Bench judgement of this Court in Writ Petition No. 41279 of 2014 ( Isha Tyagi Vs, State of U.P. and others) and submits that he is entitled for the benefit of horizontal reservation of 2% provided to the descendants of a freedom fighter. Petitioner informs that counselling in district Kushinagar is scheduled from 9th January 2015 and cut off merit of descendant of the freedom fighter under 2 % horizontal reservation is below the marks obtained by the petitioner.
As the counselling process is underway , the court is of the opinion that subject to due verification of claim of the petitioner being descendant of the freedom fighter and fulfilment of other eligibility criteria, if petitioner is qualified for counselling in the category of descendant of freedom fighter, he may be allowed to participate in the counselling .
However, the appointment of the petitioner, if any, shall be subject matter to the final outcome of the present writ petition.
