TET MARKS 82 WANTS COUNSELING IN 29334 JUNIOR SCINCE MATH REACRUITMENT,

Sri R.A. Akhtar, learned counsel appears for respondent no. 4, learned Standing Counsel for respondent No. 1,and 3 and Sri A.K. Yadav learned counsel for respondent No.2.
Sole prayer of the petitioners is to direct the respondents to issue pass certificate/marksheet of UP TET Examination, 2011 (primary level). The petitioners have secured 82 marks in TET Examination, 2011.
� A Government Order dated 29.4.2014 was issued by the State Government to treat the reserved category candidates who have secured 82 marks, as pass in the TET Examination 2011.
Learned Standing Counsel submits that on account of certain enquiries going on, the entire record pertaining to TET examination, 2011 has been kept in a sealed cover and it is not possible for respondents to issue the marksheet at this stage.
Learned counsel for the petitioners submits that on the information available on the website of respondent No.2, the provisional pass certificate can be issued to the petitioner. wherein on 12.5.2014 a direction has been issued to the respondents to treat 82 marks obtained by the reserved category candidates as pass marks in the TET Examination, 2011.
Learned Standing Counsel for respondent nos. 1 and 3 could not dispute the said submission. In view thereof, the writ petition� the following directions are issued:-
(1) The petitioners shall submit an application before respondent No.2 disclosing their Roll Numbers and marks obtained within two weeks alongwith certified copy of this order.
2) In the event of such an application is moved, the respondent No.2 shall issue provisional certificate/marksheet on the basis of information available on the website within 15 days of the date of application.
(3)Learned counsel for the petitioners submits that petitioners have applied against the 29,000 vacancy of Assistant Teacher(Science and Maths) in Upper Primary Level run by Basic Shiksha Parishad, Allahabad. The counseling is going to be held on 6th and 7th, February, 2015. Petitioners have not been able to obtain pass certificate/marksheet of TET Examination, 2011. They apprehend that they will not be allowed to participate in the counseling. Petitioners may approach respondent no.2 along with certified copy of this order and application within three days enclosing the marks statement displayed on the website. Respondent no.2 shall allow the petitioners to participate in the counseling as per their merit. However appointment of the petitioners would be subject to submission of the provisional marks statement issued by the Madhyamik Shiksha Parishad, Allahabad.
With the above directions, the writ petition is disposed of.
