The petitioners have appeared in TET Examination 2011 for appointment on the post of Assistant Teacher at primary level/junior basic level. The contention of the petitioners is that the petitioner no. 1 has obtained 94 marks and petitioner no. 2 has obtained 95 marks. However, on account of preparation of separate merit list for two categories namely Science and Arts stream artificially created by the respondent no. 2, the petitioners have not been allowed to participate in the counseling as the merit for the OBC (female) candidate in Arts stream is higher than the marks obtained by the petitioner whereas the merit list for OBC (female) candidate in Science stream is less than 90 marks.
Submission is that as per the rules, educational qualification i.e. minimum eligibility criteria for appointment on the post of Assistant Teacher in Junior Basic School is Bachelor's degree with teachers training test, BTC (Visisth BTC)� etc. and the eligibility test conducted by the Government of U.P. There is no justification for preparation of separate merit list for two stream namely Science and Arts at the level of Junior Basic� School i.e. Clause 1 to 5. The criteria for appointment of assistant teachers in Senior Basic School cannot be applied for appointment of Assistant Teacher at primary level/Junior Basic School.
The matter requires consideration.

All the respondents may file counter affidavit within three weeks.
Connect and list with Writ Petition No. 64079 of 2014 on 4.2.2015.
In the meantime, the petitioner shall be allowed to participate in the ongoing counseling, however, appointment of the petitioner, if any, shall be subject matter of the result of the writ petition.
