UPTET - टीईटी परीक्षा - पात्रता परीक्षा है या चयन का आधार
टीईटी मेरिट से चयन गलत है ये बात पहले भी कोर्ट में कही गयी थी -
उस पर कोर्ट नो बोला कि - इसमें कोई भी एन सी टी ई के नियम का उल्लंघन नहीं होता | और टीईटी मेरिट से भर्ती में कोई समस्या नहीं है |
एनसीटीई ने साफ़ शब्दों में लिखा था - टीईटी / सीटीईटी परीक्षा में अभ्यर्थी बार बार परीक्षा में बेठ सकते हैं अपने मार्क्स की वृद्दि हेतु | साथ ही इसके अंको को चयन में महत्व दीया जाये |
अगर ये सिर्फ पात्रता परीक्षा है तो बार बार परीक्षा देने से क्या फायदा | क्यों अभ्यर्थीयों के साथ खिलवाड़ की जा रही है |
प्रेस मीडिया में एनसीटीई के नियम छपवा कर सवाल पूछ लेने चाहिए
इसके बाद बार बार प्रेस मीडिया शायद बार बार कि - टीईटी सिर्फ पात्रता परीक्षा है , बोलना बंद कर देगा
कुछ हाई कोर्ट के अच्छे निर्णय , जो कि टीईटी अभ्यर्थीयों के हितों को देखते हुए दिए गए थे , को भी प्रेस मीडिया में पब्लिश कराना चाहिए
टीईटी अभ्यर्थीयों ने इतना बड़ा संगठन बनाया हुआ है तो उनके नेता सही जानकारी तो छपवा सकते हैं

Frequency of conduct of TET and validity period of TET certificate :-
11 The appropriate Government should conduct a TET at least once every year. The Validity Period of TET qualifying certificate for appointment will be decided by the appropriate Government subject to a maximum of seven years for all categories. But there will be no restriction on the number of attempts a person can take for acquiring a TET Certificate. A person who has qualified TET may also appear again for improving his/her score.

Learned counsel for petitioner, despite repeated query could not clarify as to why he has filed this writ petition and in what manner he intend to challenge the notification dated 7.9.2011 issued by Secretary, U.P. Government, Lucknow(Annexure 2 to writ petition). He contended that Teachers Eligibility Test conducted by Board of Secondary Education has not been conducted in accordance with guidelines laid down by National Council of Teachers Education along with its letter dated 11.2.2011
a generalized and vague manner said that all the persons who have passed the examination are neither qualified nor suitable candidates. This is clearly a derogatory remark not only against the examining body but also against lacs of people who participated in the examination and passed the same. The statement is made in a most careless and reckless manner which, in my view, clearly amounts to abuse of process of laws and, therefore, the writ petition must be dismissed with exemplary cost.
4. Since petitioner is not only guilty of making unfounded aspersions against examining body, but also against the persons who have passed the examination, he must pay exemplary cost. I quantify the cost to Rs. 4.5 lacs.
5. The aforesaid amount shall be paid by petitioner to respondent no. 3 who, after receiving the amount, shall distribute the same amongst all the candidate who have passed the examination finally paying Rs. 1/- to each successful candidate.

12th Amendment is illegal, inasmuch as, it makes the marks obtained in Teacher Eligibility Test (hereinafter referred to as "T.E.T.") as the basis for including a person in the list to be prepared by the appointing authority after advertisement issued for appointment which is to be submitted to the Selection Committee though T.E.T. is only eligibility qualification and cannot be a basis for making selection.
