आदेश का सटीक हिंदी अनुवाद 

याचिकाओ पर सुनवाई करते हुए 4 फ़रवरी 2013 को दिए गए आदेश में कहा गया:

हमने एक ही तरह की इन याचिकाओं में याचियों के अधिवक्ताओं तथा राज्य की ओर से अतिरिक्त महाधिवक्ता को सुना। सभी याचिकाएं एक बंच के रूप में 11 फरवरी को सुनवाई के लिए एकसाथ सूचीबद्ध की जाएँ।

सभी अभ्यर्थियों ने अध्यापक पात्रता परीक्षा उत्तीर्ण की है . यहाँ इन मामलों में उठने वाले बुनियादी सवालों में से एक यह है कि अगर चयन का आधार TET मेरिट है, तो फिर भले चयन प्रशिक्षण के पहले हो या बाद में, नतीजा एक ही होना है। विज्ञापन (पुराने) का अनुच्छेद 10 कहता है कि NCTE से मान्यता प्राप्त प्रशिक्षण की सफलतापूर्वक समाप्ति के बाद 1981की नियमावली एवं 12वें संशोधन, 2011के अनुसार मौलिक नियुक्ति दी जाएगी। किसी मामले का निस्तारण करते समय हमेंमौलिकता (वास्तविकता, किसी चीज के वास्तविक प्रभाव) के अनुसार चलना होता है। उदाहरण के लिए, यदि (पुराने विज्ञापन के प्रभावी रहने की दशा में)चयनित अभ्यर्थी "प्रशिक्षु शिक्षक" नकहे जाते, परन्तु योग्यता के अनुसार केवल "वेतन के बराबर छात्रवृत्ति या मानदेय के साथ प्रशिक्षण"

के लिए चुन लिए जाते, और सफलतापूर्वक प्रशिक्षण पूरा करने के बाद पुनः उनकीटेट-मेरिट (जो उस समय चयन का निर्धारित आधार था) के आधार पर उनको चयन-प्रक्रिया से गुजरना होता, तो भी नतीजा वास्तविकता में एक ही होता। और ऐसी स्थिति में (किसी निर्णय का) यह आधार नहीं रह जाता कि "प्रशिक्षु शिक्षक का कोई पद ही नहीं!"

पुरानी चयन-प्रक्रिया को रद्द करने के आधार, जैसा कि 26.07.2012 के (सरकार के) आदेश में उल्लेख है, दो तरह आधार (अवधारणा/ मान्यता) हैं।

पहला आधार कहता है कि TET के आयोजन में कुछ अनियमितताएं, जैसा कि आरोप लगाया गया है। प्रतीत होता है कि मुख्य सचिव की अध्यक्षता में किसी हाईपावर कमेटी ने एक रिपोर्ट दी, जिसके आधार पर समूची चयन-प्रक्रिया, जिसमे TET में प्राप्तांक ही चयन-निर्धारक थे, को रद्द किया गया।

एकल न्यायाधीश ने अपने प्रश्नगत आदेश में स्पष्ट किया है कि अगर (TET में) कुछ जगहों पर कुछ अनियमितताएं पाई गई थी तो इसके ख़राब हिस्से से TET के अच्छे हिस्से को अलग किये जाने के प्रयास किये जाने चाहिए थे, परन्तु समूची चयन-प्रक्रिया को रद्द नहीं किया जाना चाहिए था।

अबतक राज्य की ओर से ऐसा कुछ देखने को नहीं मिला है (जिस से पता चल सके) कि अच्छे हिस्सों, मतलब वे जगहें या क्षेत्र, जहां TET में कोई अनियमितता नहीं थी, को खराब हिस्सों, मतलब उन जगहों या क्षेत्रों, जहां अनियमितताएं हुईं थीं, से अलग किया जा सका या नहीं किया जा सका।

अतिरिक्त महाधिवक्ता के निवेदन के अनुसार हाई पावर कमेटी की रिपोर्ट जवाबी-हलफनामे के जरिये कोर्ट में रखी जा सकती है, उस रिपोर्ट या अन्य पूर्ववर्ती दस्तावेजों के आधार पर (इस बात का भी ) एक तर्क-संगत कारण भी इंगित होगा कि (कैसे) अच्छे हिस्से को खराब हिस्से से अलग किया जाना संभव थाया नहीं था।

26.07.2012 के आदेश का दूसरे प्रकारका आधार यह इंगित करता है कि (सरकार केस्तर पर) ऐसा अनुभव किया गया था कि चयनहेतु योग्यता निर्धारण के लिए TET में प्राप्त अंकों के आधार पर बने पैमाने को हटाकर TET-मेरिट को नजर-अंदाज़ करके, चयन हेतु योग्यता-निर्धार ण के लिए पुराने शैक्षणिक प्रदर्शन पर आधारित गुणांक के आधार परपैमाना बनाया जाना चाहिए। बाद में मन में उपजे किन्ही ख्यालात के कारण ऐसा माना गया कि यह नया पैमाना बेहतर होगा। उसी के मुताबिक नियमावली में परिवर्तन किये गए।

माननीय एकल न्यायाधीश ने अपने प्रश्नगत निर्णय में स्पष्ट किया है कि चयन के मानकों में होने वाले ऐसे कोई भी बदलाव अग्रगामी प्रभाव वाले होंगे (बदलाव के बाद शुरू होने वाली किसी प्रक्रिया पर) और पूर्ववर्ती चयन को प्रभावित नहीं कर सकते।

इसके भी आगे बढ़कर, हमारा प्रथम-दृष्टया विचार है कि (सरकार के) विचारों में (आया) बदलाव, "कि योग्यता के निर्धारण के लिए पुराने पैमाने को हटाकर बेहतर प्रतीत होने वाले पैमाने को लागू किया जाये", किसी समूची चयन-प्रक्रिया को रद्द करने का कारण नहीं हो सकता। यदि राज्य की ओर से पेश किये गए इस प्रकार के आधार या कारण स्वीकार किये जाते हैं तो कल को इस बात की भी सम्भावना बन जाएगी कि कोई और सरकार या अन्य अधिकारी सोच ले कि (अब) शायद यह नया लागू किया गया पैमाना(गुणांक) हटाकर वह पैमाना लागू किया जा सकता है जिसे वह इस पैमाने (गुणांक)से भी बेहतर मानता है, तो वह फिर से एक चल रही चयन-प्रक्रिया को कचरापेटी में डालने का आधार तैयार कर सकता है।

नयी चयन-प्रक्रिया में, बहुत ही बड़ी संख्या में अभ्यर्थी शामिल हुए हैं जिनकी काउंसिलिंग आज से शुरू हुई है।

स्वाभाविक है कि काउंसिलिंग (की प्रक्रिया) समय लेगी, और सभी पक्षों की सहमति के साथ हमारा इरादा इन सभी याचिकाओं को स्वीकार करने के चरण में ही अंतिम रूप से निस्तारित करने का हैजिसके लिए हमने 11.02.2013 की तिथि निर्धारित की है। अतएव, हमारा मत है किइतने सारे अभ्यर्थियों को काउंसिलिंगकी परेशानी में नहीं डालना चाहिए, जो (काउंसिलिंग) कि इन सभी याचिकाओं के अन्ततः स्वीकार होने (याचियों की मांग मान लिए जाने) की स्थिति में निरर्थक कार्यवाही भर रह जाएगी। इसलिए, इस मामले से जुड़े सभी पक्षों केबृहत् और समग्र हितों सहित उन अभ्यर्थियों के हितों को, जो हमारे सामने एक पक्ष के रूप में नहीं हैं, कोध्यान में रखते हुए हमारा यह मत है कि (07.12.2012 के विज्ञापन के अनुसार) चल रही चयन प्रक्रिया को 11.02.2013तक स्थगित रहना चाहिए। (इसी के) अनुसरण में आदेश (किया जाता है)

चकिया (चंदौली): प्राइमरी स्कूल में टीचर बनने का ख्वाब पाले ट्रेंड बेरोजगारों के सामने आर्थिक संकट खड़ा हो गया है। बेरोजगारी का दंश झेल रहे युवकों ने जैसे तैसे जुगाड़ करके 25 हजार से 50 हजार रुपये तक खर्च कर दर्जनों जिलों से आवेदन किया था। लेकिन काउंसिलिंग के ऐन वक्त पर भर्ती प्रक्रिया के ठप पड़ जाने से उन्हें मायूसी ही हाथ लगी है। शिक्षक भर्ती प्रक्रिया में बार-बार आ रहे व्यवधान से संसाधनों से कमजोर आवेदकों की आर्थिक रीढ़ कमजोर हो रही है। दो साल से चल रही शिक्षक भर्ती प्रक्रिया में कई बार पेंच फंस जाने से आवेदकों में व्यापक निराशा घर करती जा रही है। शिक्षक बनने की राह में लगातार ठोकरें खा रहे बेरोजगार किस्मत को धिक्कारते हुए व्यवस्था की खामियों को कोस रहें हैं। बेरोजगारों की इस उम्मीद में उस वक्त पंख लग गए जब शिक्षक पात्रता परीक्षा (टीईटी) को पास कर लिए। शासन की ओर से 72,825 पदों का विज्ञापन जारी होने पर गत वर्ष लाखों आवेदकों ने फार्म भरा। लेकिन भर्ती प्रक्रिया पटरी पर आती इसके पहले ही बेपटरी हो गई। रजनी कांत त्रिपाठी राजू ने 40, अशोक सिंह यादव ने 60, अजय सिंह ने 40 तो उनकी बहन ने 50 जिलों में आवेदन किया। आरके त्रिपाठी, विनय मौर्य, श्रवण कुमार जैसे बेरोजगारों ने 40 से 45 जिलों में आवेदन किया है। इसमें श्वेता को जहां करीब 90 हजार खर्च करना पड़ा वहीं अन्य आवेदकों को 35 हजार रुपया खर्च करना पड़ा है। गरीबी में आटा गीला वाली कहावत को चरितार्थ कर रही शिक्षक भर्ती में ऐसे हजारों आवेदक है जिनको यदि इस बार मौका नहीं मिला तो फिर से ओवर एज (उम्र दराज) हो जायेंगे तथा सरकारी नौकरी पाने का सपना पूरा नहीं हो पाएगा

In this news I am confused, How Shweta spends 90 thousand rupees.
90 Thosand Rupees = Applying in 180 districts.
If above money includes applied in both previous advt and new advt and in all districts of UP along with other expenditure then still 90 thousand rupees may not possible because most of candidates spend money for 5 districts.

Either above is typo mistake OR Shweta spend extra money due to some confusion.

Candidates are waiting this job from a long time and delay creates confusion and tension about their future.
It is better to not think about this job all time and search alternative jobs as well. If  in future they got this PRT job then they can resign from alternatove job.

लखनऊ । भत्ते के लिए बढ़ रही बेरोजगारों की लाइन ने जहां अधिकारियों की नींद उड़ा दी है वहीं, प्रदेश सरकार भत्ते के लिए बजट को लेकर मंथन करने में जुट गई है। पिछले वर्ष नौ लाख बेरोजगारों के लिए 1105 लाख रुपये का प्रावधान किया गया था, लेकिन वर्ष 2013-14 के लिए दो हजार करोड़ से ज्यादा के बजट के अनुमान को लेकर सरकार सांसत में है।

प्रदेश में पंजीकृत बेरोजगारों की संख्या 62 लाख के करीब है। उनमें से भत्ते के लिए निर्धारित 25 से 40 वर्ष बीच की आयु सीमा वाले करीब 30 लाख बेरोजगार हैं। पंजीयन की निर्धारित तिथि बढ़ते ही करीब 10 लाख और बेरोजगार भत्ते के लिए आवेदन करेंगे। सूत्रों का कहना है कि बढ़ते बजट को देखते हुए पंजीयन की निर्धारित तिथि को बढ़ाने से पहले सरकार मंथन करेगी।

पंजीयन की तिथि का निर्धारण न होने तक सेवायोजन विभाग ने सरकार से भत्ता के एवज में 1200 करोड़ की डिमांड भेजी है। बेरोजगारी भत्ता योजना-2012 सरकार के गले की फांस बनने लगी है। योजना को चालू रखने के लिए सरकार को जहां पिछले वर्ष के मुकाबले दो गुना से ज्यादा बजट का इंतजाम करना पड़ेगा, वहीं बेरोजगारों की लाइन अधिकारियों के लिए मुसीबत से कम नहीं होगी। 17 मई 2012 को बेरोजगारी भत्ते के लिए जारी शासनादेश के बाद से भत्ते के लिए बेरोजगारों की भीड़ उमड़ पड़ी। नौ लाख के मुकाबले 11 लाख से अधिक बेरोजगारों ने भत्ते के लिए आवेदन करके सरकार को भत्ता देने की चुनौती क्या दी, सरकार की नींद ही उड़ गई।

प्रदेश में प्राइमरी स्कूलों में शिक्षक भर्ती की योग्यता स्नातक और दो वर्षीय बीटीसी है। विशेष परिस्थितियों में राष्ट्रीय अध्यापक शिक्षा परिषद (एनसीटीई) से अनुमति लेकर बीएड वालों को छह माह की विशिष्ट बीटीसी की ट्रेनिंग देकर सहायक अध्यापक बनाया जा सकता है। उत्तर प्रदेश की सरकारों ने वोट बैंक की राजनीति के लिए बीएड वालों को विशिष्ट बीटीसी की ट्रेनिंग देकर शिक्षक बनाने का खेल शुरू किया। यह सिलसिला अनवरत जारी है।

यहां हुई चूक

शिक्षक भर्ती प्रक्रिया के लिए ऑनलाइन आवेदन लिए गए। आवेदन को जांचे-परखे बिना ही मेरिट जारी कर दी गई। नतीजा वरिष्ठता क्रम में सबसे ऊपर ऐसे नाम आ गए जिनके पूर्णांक और प्राप्तांक एक समान थे। इसका सबसे बड़ा असर मेरिट पर पड़ा। न्यूनतम मेरिट 68.23 गई। इसके चलते 60 फीसदी से अधिक अंक में पास होने वालों का नाम तक नहीं आया।

यह है पेंच

प्रदेश में शिक्षकों की भर्ती में सबसे बड़ा पेंच बार-बार बदला जाने वाला नियम है। वर्ष 2011 में शिक्षक भर्ती के लिए मानक टीईटी मेरिट को रखा गया। सत्ता बदलने के बाद सरकार ने टीईटी मेरिट को समाप्त कर उसे केवल पात्रता परीक्षा माना और भर्ती शैक्षिक मेरिट पर करने का निर्णय किया। टीईटी पास 2.71 लाख बीएड डिग्रीधारकों में कुछ का मानना है कि भर्ती टीईटी मेरिट पर ही होनी चाहिए, तो कुछ इसके पक्ष में नहीं हैं।

मेरिट वाले आरक्षित वर्ग से अभ्यर्थियों को सामान्य वर्ग में मौका

शिक्षकों की भर्ती में सामान्य वर्ग के खाते में आरक्षण के हिसाब से भले ही 36 हजार 412 सीटें रखी गई हों, पर इससे भी कम सीटें आएंगी। कुल 72 हजार 825 सीटों में अनुसूचित जाति के हिस्से में 21 प्रतिशत 15 हजार 299, अनुसूचित जनजाति के हिस्से में दो प्रतिशत 1455 तथा अन्य पिछड़ा वर्ग के हिस्से में 27 प्रतिशत 19 हजार 660 सीटें आएंगी। टॉप मेरिट वाले आरक्षित वर्ग के अभ्यर्थियों को सामान्य वर्ग की सीटों पर भी मौका मिलता है।

इसलिए हो रहे मुकदमे

शिक्षक भर्ती के लिए बार-बार मानक बदले जाने को लेकर ही मुकदमे हो रहे हैं। टीईटी पास कुछ बीएड डिग्रीधारकों का मानना है कि पूर्व में तय मानक के आधार पर ही भर्ती की जानी चाहिए। सरकार बार-बार मानक क्यों बदल रही है। कुछ ने सरकार द्वारा निर्धारित फीस पर भी आपत्ति उठाई। कहा कि एक ही पद के लिए हर जिले के लिए अलग-अलग शुल्क क्यों

About Recruitment Process -

Selection process started with TET merit in BSP Govt. and it was opposed in Highcourt. At that time court OK it by saying that it is not contrary to NCTE guidelines.

After some time stay happens. And new Govt of SP formed and selection process is changed due to irregularities ( recommendation of High Power Committee ).And selection rules are amended.

There is some points added like CTET qualified etc. can also apply.
Now a new funda comes that - B.Ed 2012 passed candidates are eligible OR not.

(In terms of  previous advt, may be B.Ed 2012 candidates are not eligible as their B.Ed is not completed.
But in terms of new advt. B.Ed 2012 candidates may be applicable as in TET-  B. Ed appearing candidates can apply. When new candidates of CTET can come selection process then why B. Ed 2012 are not eligible.
These I found in debates of TET candidates, And B. Ed appearing definition are explained different different by different different candidates. Some are saying appearing is those who are giving exams etc., Some are saying base is of - School Attendance.

All these happenings made different different groups of TET merit holderd -

B. Ed 2012 etc.

Many candidates interpreted BEST SELECTION criteria in their OWN WAY.

������� In this bunch of similar appeals, we have heard learned counsel for the appellants and the learned Additional Advocate General for the State. Connect these appeals and list them together as a bunch on 11.02.2013. 
������ All candidates have cleared the TET. One of the basic questions that arises in these cases is that if the criteria for selection is the TET merit, then whether the selection had taken place before the training, or after the training, the result would have been the same. Clause No. 10 of the Advertisement says that after successful completion of training (approved by the NCTE) the substantive appointments would be made as per 1981 Rules and Twelfth amendment 2011. While deciding a case we have to go by the substance. By way of example if the selected candidates had not been called 'apprentice teachers', but had been selected on merits merely for 'training with scholarships equivalent to salary', and after successful completion of training again subjected to selection as per their merit in TET (which at that time was the prescribed criteria), the result in substance would have been the same as obtaining today. And in such case the ground that there was no post of 'apprentice teachers' would not be available. 
������� The basis for cancellation of the earlier selection process as mentioned in the order dated 26.07.2012 consists of two kind of grounds. The first ground says that some alleged irregularities were found in conducting of the Teacher Eligibility Test (TET for short). It appears that some High Powered Committee under the Chairmanship of the Chief Secretary gave a report. On the basis of that report, the entire selection process, wherein the merit of the TET was the determining�criteria, was canceled. 
������� The learned Single Judge has held in the impugned order that if some irregularities were found at some places, the good part of the TET should have been attempted to be separated from the bad or vitiated part, but the entire selection should not have been canceled. 
����� �� So far as there is nothing to show from the side of the State that the good part that is to say places where there was no irregularity in the TET could or could not be separated from the bad part that is from places or areas where irregularities had taken place. 
�������� As prayed by the learned Additional Advocate General, the report of the High Powered Committee may be placed on record by means of a counter-affidavit, which will also indicate with cogent reasons, on the basis of that report or other previous records, whether it was, or was not, possible to separate the good part from the bad part. 
����� � The second kind of ground of the order dated 26.07.2012 indicates that it was felt that the criteria for determining the merit for selection on the basis of merit in the TET should be replaced by the criteria of determining the merit on the basis of quality point marks as calculated on the basis of past academic record, ignoring the merit of TET. This substituted criteria was believed to be better by way of some after-thought. Accordingly Rules were amended. 
������� The learned Single Judge has held in the impugned order that such change of criteria can only be prospective and cannot affect the previous selections. 
������� Moreover, we are also prima facie of the opinion that this change of thought namely that the previous criteria could be replaced by seemingly better criteria for determining merit cannot be a ground for canceling the entire selection process. If that kind of ground urged by the State is accepted, it is equally possible that tomorrow some other Government or some other official may think that perhaps the new suggested criteria (of quality point marks) could be replaced by what he believes to be a still better criteria, could again form the basis of scrapping the fresh selection process which is ongoing. 
������� In the fresh selection process, there is an extremely large number of candidates whose counseling is said to have started from today. 
�������� Obviously, the counseling will take time, and we intend, with the consent of the parties, to finally dispose of all these appeals at the admission stage, for which we have fixed 11.02.2013. Therefore, we are of the opinion that so many candidates should not be put to the trouble of counseling, which may, if these appeals are ultimately allowed, be reduced to a futile exercise. Therefore, keeping in view the larger overall interest of all parties involved, including the interest of those candidates who are not parties before us, we are of the opinion that the ongoing selection process should remain suspended till 11.02.2013.

I think court said that - If counselling allowed and appeal of candidate (i.e demanding selection through TET merit ) ultimately allowed then counselling has no meaning.

A big point is - Changes in selection process is prospective (aage ke leeye) OR retrospective ( peeche bhrtee ke niyamon ke leeye ) honge, aur UPTET ka kya hoga, lakhon candidates ka kya hogaa.

फर्जी आवेदनों के कारण प्रथम काउंसलिंग वाले अभ्यरथियो को कई समस्यों से जूझना पड़ रहा है
कई अभ्यर्थीयो को ग्रह जनपद छोड़कर बाहर के जिलों में नंबर आने पर , अपनी सीट सुरक्षित करने के लिए ग्रह जनपद छोड़ कर अन्य जिलों का भी चुनाव करना पड़ सकता है
अगर सभी तरह के फर्जी आवेदनों को बाहर रखा जाए और उसके बाद काउंसलिंग की कट-ऑफ़ जारी की जाती तो इससे प्रथम काउंसलिंग में ऊँचा स्थान रखने वालों को राहत मिल सकती थी ।
टी ई टी अभ्यर्थीयों में भी कई मत हैं -
1. एक धड़ा बी . एड 2012 वालों को नियुक्ति से बाहर देखने के मत में है , क्योंकि उनके अनुसार- वे नियुक्ति के पात्र नहीं है
वे टी ई टी परीक्षा के भी पात्र नहीं थे । टी ई टी एपीरिंग के बारे में उनके अपने मत हैं
2. जबकि बी . एड 2011 वालों का कहना है कि उन्होंने आवेदन सरकार द्वारा जारी किये गए विज्ञापन के अनुरूप किया है
और पिछला विज्ञापन रद्द किया जा चुका है
3. कई लोगो का मानना है कि भर्ती टी ई टी मेरिट से होनी चाहिए और इसके लिये वह सुप्रीम कोर्ट जा रहे हैं ।
आखिर उनका क्या दोष , उन्होंने तो परीक्षा मेहनत से पास की थी ।
4. कई लोगो का मानना है कि भर्ती सरकार का कार्य है और हाई कोर्ट इस पर मुहर लगा चुका है
ये भर्ती प्रक्रिया काफी लम्बे समय से चल रही है और काफी तरह के उतार चडाव सामने आते रहे , यू पी टी ई टी परीक्षा
के बाद जारी विज्ञापन में बदलाव और आये दिन कोर्ट में नए नए मामले आते रहना , अभ्यर्थीयों के मन में शंकाएं उत्पन्न करता रहता है

Petitioners have rushed to this Court with request to direct the respondents to consider only those candidates belonging to OBC,SC,ST category, who have secured 60% marks in the Teacher Eligibility Test Examination-2011 for the post of assistant teacher under general category in each of the district where the petitioners have applied and prepare the merit list accordingly.
Petitioners claim that they have qualified Teacher Eligibility Test which is required for being offered appointment on the post of Assistant Teacher at Primary School run and manage by the Board of Basic Education. Petitioners claim that they are from general category and minimum percentage required for qualifying teacher eligibility test is 60% for general candidate and 55% for O.B.C. category candidates. Petitioners submit that one thousand post of assistant teachers in the primary school run and maintain by the Board of Basic Education in District Allahabad were advertised by means of an advertisement of Assistant Teacher of District Mirzapur in daily news paper "Dainik Jagaran" dated 7.12.2012. Similar advertisement� has been issued for other district of State of Uttar Pradesh. The petitioners have applied for consideration of their candidature on the post of Assistant Teacher in Primary School run and maintain by the Board of Basic Education under general category.
The State Government has formulated a procedure for selection of an assistant teacher by calculating the merit list on the basis of the marks obtained by the candidate in his High School, Intermediate, Degree and Training qualification. The merit is prepared by adding 10% of High School marks of 20% of Intermediate marks 40% of Degree marks and 30% of B.Ed marks. Grievance of the petitioners is that they are being made to compete with OBC category candidates against the post of assistant teacher which are meant for candidates belonging to general category. 
Petitioners' further submission is that State Government having lowered the marks for qualifying the T.E.T. Test for O.B.C. candidates has clearly earmarked two classes of candidates namely candidates belonging to general category and candidates belonging to O.B.C. category and further for reservation of 50% of the post of assistant teacher for O.B.C. candidates and rest 50% only for general candidate. Petitioners in this background submit that such action is totally discriminatory and does not provide equal opportunity for being considered against the post of assistant teacher in general category and accordingly requisite relief be accorded. 
Sri. Arvind Srivastava, learned counsel for the petitioners contended with vehemence that in the present case State Government having lowered the marks for qualifying the T.E.T. test for O.B.C. candidates has clearly earmarked two classes of candidates belonging to general category and candidates belonging to O.B.C. category and in view of this the reserved category candidates should not be permitted to consider against the general category seats and as such accordingly writ petition should be allowed.
Countering the said submission, learned Standing Counsel on the other hand contended that T.E.T. Test is mere eligibility test and merit of T.E.T. test is not at all to be seen and relevant criteria of selection would be by calculating merit list on the basis of marks obtained by the candidates in High School, Intermediate, Degree and Training qualification and as such writ petition deserves to be dismissed.
After respective arguments have been advanced, factual situation which has so emerged that T.E.T. test is a test� required to be passed for being appointed as Assistant Teacher after enforcement of U.P. Right of Children to Free and Compulsory Education Rules, 2009. In reference to general category candidate, eligibility criteria has been provided for as 60% and in reference to OBC/SC/ST category candidates minimum eligibility criteria is 55%. Said criteria has been prescribed strictly as per guidelines of� National Council For Teacher Education. Selection is not at all based on the basis of marks obtained in T.E.T. test, rather candidate has to merely pass the aforementioned qualifying test and thereafter, selection is accordingly governed by procedure as provided under Rule 14 of U.P. Basic Education Teacher Services Rules, 1981 wherein� marks are to be competed on the basis of marks obtained by candidate in High School, Intermediate, Degree and Training qualification. Contention of petitioners is that candidates� who have secured 55% marks in T.E.T. examination should not be considered in open market, cannot be accepted, inasmuch as reservation has a purposes and here only in order to see that candidate has passed T.E.T. criteria of 60% for General category� and 55%� for OBC/SC/ST category� candidate has been prescribed and thereafter, selection in question is to be made strictly as per Rule 14 of U.P. Basic Education Teacher Services Rules, 1981. 
In view of this, challenge made is misconceived and� present writ petition is accordingly dismissed.

Jo log keh rahe hain kee 2012 vale out. I am not sure about this. (Kisee bhee sambhavna se inkaar to nahin kiya ja sakta).

I think - Agar Purana vala advt. exist hotaa tab to 2012 vale out the. Lekin advt. badal gayaa, usmen aur bhee naye log jude including CTET qualified candidates etc.

TET ke leeye B.Ed etc. appearing is required. Ab yeh clear nahin kee exam appearing vale appraring. Jo bhee log FINAL YEAR mein hain, ve B.Ed appearing mein hee to aayenge.
Koee mujhe tarkon / niyamon dwara bataye kee aisa kaise ho sakta hai.

Haan sarkaar / court , agar purane advt. kee baat maante hue. 30.11.2011 tak B. Ed karne vaalon kee chance de saktee hai. Kyonki Nokri ke leeye Degree aavashyak hai. Parantu is advt. tak ve qualify ho chuke hain to 5.12.12 kee condition lagu hongee.
HOW CAN 2012 is EXCLUDED ????

इलाहाबाद। 72825 सहायक अध्यापकों की भर्ती के मामले में स्थिति को स्पष्ट करते हुए एकल न्यायपीठ ने कहा कि सहायक अध्यापक भर्ती के लिए टीईटी उत्तीर्ण करना अनिवार्य है। यह अनिवार्य अर्हता है। बिना टीईटी बीएड डिग्री धारकों का चयन मात्र आपात परिस्थिति में तभी किया जा सकता है जबकि टीईटी उत्तीर्ण अभ्यर्थी उपलब्ध न हों और शिक्षकों के पद भरना आवश्यक हो। ऐसी स्थिति में ही बिना टीईटी उत्तीर्ण बीएड डिग्री धारकों पर विचार किया जा सकता है।

16 जनवरी 2012 को प्रभाकर सिंह केस में न्यायमूर्ति अशोक भूषण की अध्यक्षता वाली खंडपीठ द्वारा दिए आदेश की व्याख्या करते हुए एकल पीठ ने कहा है बीएड डिग्री धारकों के संबंध में खंडपीठ की टिप्पणी को आदेश नहीं माना जाना चाहिए। बीएड उर्तीर्ण अभ्यर्थी संजय कुमार सहित 42 याचियों की याचिका को खारिज करते हुए यह आदेश न्यायमूर्ति अरुण टंडन ने दिया है।

उल्लेखनीय है कि 16 जनवरी 2013 के आदेश में खंडपीठ ने बिना टीईटी उत्तीर्ण बीएड अभ्यर्थियों को भी सहायक अध्यापक भर्ती की आवेदन प्रक्रिया में शामिल करने का निर्देश दिया है। खंडपीठ का यह आदेश एकल न्यायाधीश के 11 नवंबर 2011 के आदेश के खिलाफ दाखिल विशेष अपील पर आया है। विशेष अपील में एनसीटीई द्वारा 23 अगस्त 2010 को जारी अधिसूचना पर विचार किया गया। इस अधिसूचना में एनसीटीई ने परिषदीय विद्यालयों में कक्षा एक से पांच तक तथा कक्षा छह से आठ तक अध्यापकों की भर्ती के लिए न्यूनतम योग्यता निर्धारित की है। इसके मुताबिक परिषदीय विद्यालयों में अध्यापक की नियुक्ति हेतु विभिन्न अध्यापक शिक्षा पाठ्यक्रमोें के साथ ही टीईटी उत्तीर्ण करना आवश्यक है। अधिसूचना के सब क्लाज तीन में एनसीटीई ने कहा है कि बिना टीईटी उत्तीर्ण बीएड डिग्री धारक कक्षा एक से पांच तक के विद्यालय में अध्यापन के लिए अर्ह होंगे बशर्ते नियुक्ति के पश्चात् छह माह का विशेष प्रशिक्षण कराया जाए। इन अभ्यर्थियों की नियुक्ति एक जनवरी 2012 तक की जा सकेगी।

16 जनवरी के आदेश में खंडपीठ ने भी इस बात को स्पष्ठ किया है। खंडपीठ ने कहा है कि उत्तर प्रदेश सरकार ने 20 जुलाई 2012 को केंद्र सरकार को प्रस्ताव भेजकर कहा था कि एनसीटीई द्वारा निर्धारित न्यूनतम योग्यता के अनुसार पर्याप्त संख्या में अभ्यर्थी नहीं मिल पा रहे हैं इसलिए सब क्लाज तीन के अनुसार बीएड डिग्री धारकोें की भर्ती के लिए समय सीमा को एक जनवरी 2012 से आगे बढ़ा दी जाए। केंद्र सरकार ने इस स्वीकार करते हुए समय सीमा 31 मार्च 2014 तक इस शर्त के साथ बढ़ा दी कि सहायक अध्यापक भर्ती में प्राथमिकता टीईटी उत्तीर्ण अभ्यर्थियों को दी जाएगी। इसके बाद सब क्लाज तीन के अनुसार बीएड डिग्री धारकों के संबंध में विचार किया जा सकता है

UPTET : ऑन लाइन प्रशिक्षु शिक्षक भर्ती प्रक्रिया की खुली कलई

उत्तरप्रदेश में प्रशिक्षु शिक्षक भर्ती के लिए काउंसलिंग की कट आफ घोषित होते ही ऑन लाइन भर्ती प्रक्रिया की कलई खुल गयी है.

कट आफ के बाद जारी की गयी पूरी मेरिट की गड़बड़ियों को देखते हुए अब कई जिलों ने कट आफ लिस्ट को ही वेबसाइट से हटा लिया है, सिर्फ कट आफ प्रतिशत को ही विज्ञप्ति के रूप में जारी कर रहे हैं.

 ऐसे में अभ्यर्थियों को अपनी कट आफ की स्थिति जानने के लिए आवेदित जिलों की  परिक्रमा करनी होगी. अभ्यर्थियों ने गड़बड़ियों को लेकर पहले ही सवाल खड़े किये थे, लेकिन खामियों की यही स्थिति रही तो प्रशिक्षु शिक्षक भर्ती पूरी करना किसी यक्ष प्रश्न  से कम न होगा. अब बेसिक शिक्षा परिषद के अफसर इन गलतियों के लिए जिलों पर जिम्मा थोप रहे हैं.

काउंसलिंग के लिए सबसे पहले कट आफ मेरिट घोषित करने में बाजी मारने वाले कुशीनगर की लिस्ट पर नजर दौड़ते ही खामियों की भरमार मिल जा रही है. सामान्य अभ्यर्थियों की सूची में पहला स्थान बनाने वाले अन्य पिछड़े वर्ग के ममतेश ने तो कमाल ही कर दिया. स्नातक में दस अंकों का पूर्णाक दिखाने वाले ममतेश को 73 अंक मिले हैं, कुछ आवेदक तो इसके आगे भी निकल गये हैं. सामान्य वर्ग के चन्द्रभान की मेरिट 100 फीसद है, तो ओबीसी के ममतेश की 2971.28 है.

100 अंकों के योग तक पहुंचने वाले चार और आवेदक हैं जो हाईस्कूल से लेकर बीएड तक में 100 फीसद अंक लाये हैं, यानि हाईस्कूल में 500 में 500, इंटरमीडिएट में 600 में 600, स्नातक में किसी का पूर्णाक 900 का है तो किसी का 2200 का. मेरिट में 14वें स्थान पर रहे प्रदीप कुमार पाण्डेय के भी स्नातक में 1350 में 1350 अंक मिले हैं, तो बीएड में पूरे अंक लेकर मेरिट कट आफ में 87.51 फीसद पर हैं. 15वें स्थान पर आने वाले धम्रेन्द्र सिंह स्नातक में 1200 में 1200 व बीएड में 1000 में 1000 अंक लाने वाले मेधावी प्रशिक्षु भर्ती की कतार में हैं.

अब सवाल एक और भी है कि यह गलती ऑन लाइन आवेदन में अभ्यर्थियों ने की तो उनके आवेदन पत्रों को खारिज क्यों नहीं किया गया. गलती कम्प्यूटर की प्रक्रिया में हुई तो फिर इसको जारी करने से पहले जांचा क्यों नहीं गया और अगर आवेदन पत्रों को खारिज कर दिया गया था तो उन्हें मेरिट कट आफ में स्थान क्यों दिया गया. इन गलत अभ्यर्थियों को बाहर रखा गया होता तो कम मेरिट वाले अभ्यर्थी काउंसलिंग में आने के लिए जगह पा सकते थे. कुशीनगर की कट आफ मेरिट में इन खामियों को उजागर होने के बाद भर्ती प्रक्रिया अब सवालों के घेरे में आ गयी है.

इन खामियों की आहट दूसरे जिलों तक में हुई है. लखनऊ मण्डल के ही कई जिलों ने कट आफ तो घोषित कर दिया गया, लेकिन आवेदकों का ब्योरा सार्वजनिक नहीं किया है, उसे वेबसाइट पर डालने के बाद कुछ जिलों ने हटा लिया है. गलतियों का पुलिंदा बनी कट आफ मेरिट कहीं मेधावियों के भविष्य से खिलवाड़ न साबित हो जाए. सूत्रों का कहना है कि कुशीनगर की कट आफ मेरिट में पहला स्थान बनाने वाले ममतेश को इसी रिकार्ड से 30 से ज्यादा जिलों में पहला स्थान मिला है जबकि सीतापुर से लेकर सभी जिलों में उनके ब्योरा में स्नातक में पूर्णाक दस व प्राप्तांक 743 दिखाया गया है.

इन गलतियों के उजागर होने के बाद तो चयन प्रक्रिया की मॉनीटरिंग करने वाले बेसिक शिक्षा परिषद के सचिव संजय सिन्हा गलतियों का जिम्मा जिलों पर डाल रहे हैं. गलती जिले की है तो भी उसको दूर करने की जिम्मेदारी से परिषद के अफसर कैसे बच सकते हैं. उल्लेखनीय है कि सूबे में आरटीई लागू होने के बाद टीईटी अनिवार्य कर दी गयी है. प्रदेश सरकार को शिक्षकों की कमी पूरी करने के लिए एक-दो मौके मिले हैं, लेकिन लगता नहीं है कि चयन प्रक्रिया समय से पूरी हो सकेगी

उत्तर प्रदेश में प्रशिक्षु शिक्षक बनने के लिए आवेदन करने वालों का इंतजार खत्म हो गया है। तमाम झंझावतों के बाद भी बेसिक शिक्षा परिषद के निर्देश पर बेसिक शिक्षा अधिकारियों ने मंगलवार को शिक्षक चयन की कटऑफ जारी करने की प्रक्रिया शुरू कर दी है।

कटऑफ जारी करने में बाजी कुशीनगर ने मारी है। कटऑफ में आने वालों की काउंसिलिंग 4 से 9 फरवरी के बीच होगी। सामान्य और आरक्षित वर्ग के लिए जितने पद होंगे, उतने अभ्यर्थियों को बुलाया जाएगा जबकि विशेष आरक्षित वर्ग निशक्त, स्वतंत्रता संग्राम सेनानी के आश्रित और भूतपूर्व सैनिक कोटे के पदों को भरने के लिए तीन गुना अभ्यर्थियों को काउंसिलिंग के लिए बुलाया जाएगा।

बेसिक शिक्षा परिषद के सचिव संजय सिन्हा ने बताया कि सभी जिलों को कटऑफ जारी करने का निर्देश भेज दिया है। जिलों में आए हुए आवेदन के आधार पर प्रतिशत निकाला गया है। इस आधार पर अभ्यर्थियों को काउंसिलिंग के लिए बुलाया गया है।

पहले चरण में सामान्य, अनुसूचित जाति, जनजाति और पिछड़ा वर्ग के अभ्यर्थियों की काउंसिलिंग की जाएगी। इसके बाद विशेष आरक्षित वर्ग के लिए, जिसमें निशक्त, स्वतंत्रता संग्राम सेनानी के आश्रित और भूतपूर्व सैनिकों को काउंसिलिंग के लिए बुलाया जाएगा।

काउंसिलिंग में शामिल होने वालों का चयन न होने पर उनका प्रमाण पत्र 11 फरवरी को वापस कर दिया जाएगा और 12 फरवरी को पदों का आवंटन किया जाएगा। काउंसिलिंग में शामिल होने मात्र से अभ्यर्थी शिक्षक नियुक्ति के लिए दावा नहीं कर सकेंगे। काउंसिलिंग में शामिल न होने वाले को दुबारा मौका नहीं दिया जाएगा।

बेसिक शिक्षा परिषद ने 72 हजार 825 प्रशिक्षु शिक्षकों की भर्ती के लिए 5 दिसंबर 2012 को शासनादेश जारी करते हुए ऑनलाइन आवेदन मांगा था। टीईटी पास बीएड डिग्रीधारकों को सभी जिलों में आवेदन की छूट होने की वजह से 69 लाख आवेदन आए। बेसिक शिक्षा परिषद ने पहले 29 जनवरी से काउंसिलिंग की तारीख निर्धारित की थी, लेकिन आवेदनों की संख्या अधिक होने के चलते कटऑफ जारी न हो पाने की वजह से काउंसिलिंग 4 फरवरी से कर दी गई। 

एसएलपी दाखिल करने की तैयारी

राज्य सरकार आयुसीमा के कारण शिक्षक भर्ती प्रक्रिया से बाहर हो चुके अभ्यर्थियों को 31 जनवरी तक आवेदन का मौका दिए जाने संबंधी हाईकोर्ट के आदेश के खिलाफ शीघ्र विशेष अनुज्ञा याचिका (एसएलपी) दाखिल कर देगी। बेसिक शिक्षा विभाग ने न्याय विभाग से सहमति ले लिया है

UPTET - शिक्षक भर्ती में ‘गड़बड़झाला’

सपा नेता ने सीएम से की शिकायत
•कहा, अन्य प्रदेशों के युवा भी कर रहे आवेदन

मथुरा। वर्तमान में प्रदेश में 72,826 पदों पर शिक्षकों की भर्ती प्रक्रिया चल रही है। इन पदों के लिये लगभग 69 लाख आवेदन हुए हैं। सपा के वरिष्ष्ठ नेता तुलसी राम शर्मा ने मुख्यमंत्री को लिखे पत्र में कहा है कि उक्त नियुक्ति के लिए आवेदक का प्रदेश का मूल निवासी होने की शर्त भी शामिल है लेकिन अन्य प्रदेशों के युवक भी जुगाड़ से इस भर्ती के लिए आवेदन कर रहे हैं। इसकी जांच होनी चाहिए।

इन पदों के लिए बड़ी संख्या में हरियाणा और राजस्थान के युवाओं ने भी आवेदन कर दिया है। इस बीच मूल निवास प्रमाणपत्र का जुगाड़ किया गया। पत्र में अवगत कराया गया है कि नियुक्ति में इस बात की अनदेखी प्रदेश के युवाओं में रोष पैदा कर देगी। ऐसे में नौकरी देते समय उन्हीं युवाओं को तरजीह दी जाए जिनकी शिक्षा मैट्रिक से लेकर स्नातक तक प्रदेश में ही हुई हो
