This Special Appeal arises out of a writ petition filed by the appellant for the relief that they may be exempted from appearing in Teacher Eligibility Test on the ground that they have already done two years BTC or six months Special BTC.

In this Special Appeal, the respondents were granted one week time for filing counter affidavit on 8.12.2011. On their request, put up this case as fresh case on 20.12.2011. In the meantime the order dated 8.12.2011 may be complied with.

The counsel for the respondents states that the similar case namely Special Appeal No. (1176) of 2011 is tied up with a bench presided over by Hon. Ashok Bhushan J.

In our opinion, it would be appropriate to decide all special appeals together.

लखनऊ (एसएनबी)। नियुक्ति सहित आठ सूत्री मांग को लेकर शुक्रवार को यूपीटीईटी उत्तीर्ण संघर्ष मोर्चा के बैनर तले हजारों अभ्यर्थियों ने शुक्रवार को विधानभवन के सामने धरना दिया और बाद में 37 अभ्यर्थी आमरण अनशन पर बैठ गये। धरने का नेतृत्व करते हुए प्रदेश अध्यक्ष विवेकानन्द ने टीइटी अभ्यार्थियों की तरफ से म्ा ु ख् य्ा म्ां र्त्ाी अखिलेश यादव को बधाई देते हुए कहा कि प्रदेश में टीईटी उत्तीर्ण अभ्यार्थियों की संख्या लगभग तीन लाख है। उन्होंने कहा कि अभ्यर्थी अपनी योग्यता के अनुसार 60 फीसद व 90 फीसद तक के अंक अर्जित करने के बावजूद भेदभाव किया जा रहा है। अनशनकारियों ने चेतावनी दी है कि जब तक सरकार उनकी मांगों को पूरा नहीं करती उनका आमरण अनशन जारी रहेगा। मीडिया प्रभारी सुरेशमणि त्रिपाठी का कहना है कि धरना स्थल तो विधानभवन के सामने कर दिया गया लेकिन अभी तक जरूरी सुविधाओं का इंतजाम भी नहीं है। बिजली व्यवस्था नहीं और न तो पानी की। सरकारी हैण्डपम्प लगा तो है लेकिन खराब पड़ा है। मांगों को लेकर आमरण अनशन पर बैठने वालों में मो. गुलजार, इमरान, नीतिन शुक्ल, सतेन्द्र शर्मा, सुधाकर सैनी, उमाशंकर मृत्युंजय सिंह, अमरेन्द्र, संजय कुमार, अशोक कुमार यादव, सतेन्द्र मिश्र सहित 37 अभ्यर्थी आमरण अनशन व हजारों लोग धरने पर मौजूद है। उधर दूसरी ओर अनशन कर रहे टीईटी अभ्यर्थियों का प्रतिनिधि मण्डल बेसिक शिक्षा विभाग के सचिव सुनील कुमार से मिला। उन्होंने आश्वासन दिया कि पूर्व में प्रेषित ज्ञापन में उठाये गये बिन्दुओं एवं आज की बैठक में उठाये गये बिन्दुओं पर अन्तिम निर्णय के समय विचार किया जाएगा और एक माह के अन्दर इस पर निर्णय कर लिया जाएगा। वार्ता विफल धरना स्थल पर बिजली पानी का नहीं है कोई इन्तजाम धरने में दर्जनों की संख्या में लड़किया भी शामिल विधान भवन के सामने धरना देते टीईटी अभ्यर्थी। फोटो : एसएनबीby......rastriya sahara

As per NCTE Guidelines B.Ed Degree Holders are eligible for PRT (Primary Teachers ) Jobs upto 1st Feb 2012.
Rajasthan Highcourt gave a interim order that TET (for Leverl I , Primary Teacher) can apply for PRT Jobs in Grade III Teacher which is recently advertised i.e. after deadline of NCTE.
But now you can see CTET/TET (for PRT Level -I ) closes its door for B.Ed holders. And no court order / amendment in guidelines issued.
CTET close doors for B.Ed Degreee Holder to apply for CTET (Level-I , PRT ) already.

Therefore if UPTET 2011 exam not cancelled then most of B. Ed holders can have a Government Job / Reputed Profession of Teacher.
As some of B. Ed holders can move Upper Primary Jobs / Higher Jobs. And in next 5 years is B.Ed holders are not eligible for TET (Level -I , PRT Job) , then UPTET 2011 passed candidates having a high chance to get PRT jobs.

लखनऊ (ब्यूरो)। टीईटी उत्तीर्ण अभ्यर्थियों का आंदोलन शुक्रवार को और भी उग्र हो गया। मेरिट के आधार पर भर्ती की मांग पर अड़े अभ्यर्थी विधानसभा के सामने स्थित दारूलशफा में अनशन पर बैठ गए है। अभ्यर्थी लगातार भर्ती प्रक्रिया को पूर्व में प्रकाशित विज्ञप्ति के अनुसार कराए जाने के संबंध में लिखित आश्वासन की मांग कर रहे हैं। जबकि, बेसिक शिक्षा सचिव इस संबंध में कोई भी निर्णय लेने में अपनी असमर्थता जताते हुए अभ्यर्थियों से 13 अप्रैल तक समय मांगा है।

आश्वासन देकर अभ्यर्थियों का आंदोलन समाप्त कराने के लिए शुक्रवार को प्रशासन ने उनकी वार्ता बेसिक शिक्षा सचिव से कराई लेकिन वार्ता असफल रही। वार्ता में टीईटी उत्तीर्ण महासंघ के प्रदेश अध्यक्ष विवेक मिश्र ने सरकार से पूर्व प्रकाशित विज्ञप्ति के अनुसार भर्ती प्रक्रिया शुरू किए जाने की लिखित मांग है। ऐसे में सचिव ने अभ्यर्थियों से 13 अप्रैल तक लिखित कुछ भी दिए जाने के लिए समय देने को कहा है। इस पर भड़के अभ्यर्थियों ने आंदोलन तेज करते हुए अनशन पर बैठ गए हैं।

GUWAHATI: The Teachers' Eligibility Test ( TET) has run into rough weather after the website containing the names of candidates was disabled following confusion in the list.

Now, the entire procedure would be manual. The final list will be out after Bihu.

Earlier, the final list was supposed to be out on March 31. Although the list would now be out on the same date, it will be considered as the second provisional list.

The provisional list of candidates was out on March 26.

On March 27 and 28, the candidates were supposed to fill up the names of the final district out of the three which they had put as options. But, the website being an automatic one, the moment a candidate cancels the two optional districts, the position of the candidates name gets updated automatically.

So, if a candidate chooses a wrong option and wants to correct it later, they cannot access their name in the list again. This system seemed confusing to most of the candidates. So, the committee decided to disable the website for the time being.

Explaining the situation, state education minister Himanta Biswa Sarma said "The list changes each time a candidate cancels the optional districts. People said they were getting confused; therefore we decided to disable the website temporarily."

He added, "The website would now be a manual one, where candidates have to log in to check their names. They can lodge complaints till April 10. Other than that, the candidates would now have the option of going to the Sarva Shiksha Abhiyaan (SSA) office and lodge their complaint. They can also do so by registered post."

Though the deadline of the final list is supposed to be April 10, the minister said if it is seen that the complaint list of the candidates is long, then a few more days would be given and the list would be out after Bihu.

Bihu committees urge CM to ban liquor sale on four days of festival

Guwahati: Bihu celebration committees in the city have jointly urged chief minister Tarun Gogoi to declare the four days of Rongali Bihu, which begins on April 13, as dry days in the state.

The co-ordination committee, named Brihattor Guwahati Bihu Sanmilanee Samannay Rakhi Samiti met the chief minister and state cultural affairs minister Pranati Phukan on Wednesday and submitted their memorandum.

The newly floated co-ordination committee comprising 17 organizing committees said the city wants a nuisance-free Bihu celebration this year.

Expressing hope that the chief minister would consider the committees' request to ban sale of liquor across the state during the four days of Rongali Bihu, general secretary of the committee, Pranab Goswami on Thursday said, "Liquor is the prime cause of nuisances created by some sections during Rongali Bihu programmes.

These people create a chaos during Bihu functions after getting drunk."

He said the co-ordination committee will launch a campaign appealing to people to abjure tobacco-related products and liquor during Rongali Bihu. "We have also appealed to the chief minister to ensure that buses run by the Assam State Transport Corporation ply on city roads till 12 at night from April 13 to 16 so that people can return home from one part of the city to another after watching Bihu functions. Our co-ordination committee will also talk to the motor transport associations and urge them to run private buses till midnight," Goswami added.

In a memorandum submitted before chief minister Tarun Gogoi, the co-ordination committee also urged the Assam government to invite folk cultural groups from other parts of Assam and outside through its directorate of culture to perform during Bihu.

The committee further urged the government to stop trucks from plying inside Guwahati from 7 pm to 5 am for the convenience of the commuters and instruct the district administration and police to keep strict vigil during Bihu.

आज हर जगह उत्तर प्रदेश में टी ई टी अभ्यर्थी अपनी भर्ती को लेकर चिंतित हैं |

कुछेक का मानना है की अगर उन्होंने भर्ती की सभी शर्तें नियमानुसार पूरी की हैं तो आगे भर्ती प्रक्रिया होने के बजाये , भर्ती के नियम बदलने जैसी बातें क्यूँ हो रही हैं अगर कहीं घोटाला हुआ है तो उसकी जाँच कराकर सिर्फ दोषीओं को सजा दी जानी चाहिए |

कुछ लोग न्यायलय में भी जाने का मन बना रहे हैं और तर्क दे रहे हैं की उन्होंने भर्ती की शर्तें पूरी की हैं और उनको नोकरी दी जाये |

उन्होंने कोई घोटाला / बेईमानी नहीं किया है | ये मामला भी सीधे सीधे जनहित / लाखों लोगों से जुदा है और या कहें की करोड़ों भारतीओं से क्योंकी शिक्षा का अधिकार लागु होने के बाद भी

हर साल लाखों बच्चे शिक्षा के अधिकार से वंचित रह जाते हैं क्योंकी विद्यालय में योग्य शिक्षकों का आभाव है | कई सालों से प्राथमिक शिक्षकों की भर्ती नहीं हुई , जबकी शिक्षा का अधिकार आने से मांग कई गुना बड गयी है

अगर ये मामला न्यायलय में जाता है तो नियम परिवर्तन और भी ज्यादा मुश्किल है जो की अभी भी सरकार के लिए ये एक मुश्किल से कम नहीं |

और ऐसा नियम परिवर्तन होना भी नहीं चाहिए अन्यथा ये तो अभ्यर्थीओं के भविष्य से खिलवाड़ होगा |

शिक्षा विभाग को नियम तय करने से पहले सोचना चाहिए था की चयन का आधार क्या हो , न्यायलय ने भी टीईटी के पक्ष में टिपण्णी दी हैं और इसके विरुद्द याचिकाओं को निरस्त भी किया है |

(अकादमिक वर्सस टीईटी, टीईटी मार्क्स के चयन को आधार न बनाये जाने के विरोध मैं - जिसमें लोगों ने दलील दी थी की टीईटी सिर्फ पात्रता परीक्षा है और इसके आधार पर चयन गलत है )

न्यायलय ने ये भी कहा की टीईटी अभ्यर्थीओं को संदेह की नजरों से नहीं देखा जाना चाहिए

एन सी टी ई ने भी कहा की टीईटी सिर्फ पात्रता परीक्षा नहीं है इसके अंकों को चयन में महत्व दीया जाना चाहिए , लेकिन आज भी इस तरह के बयान आते हैं की टीईटी सिर्फ पात्रता परीक्षा है,

क्या यह न्यायलय की अवमानना नहीं है और टीईटी मेरिट होल्डर्स का मजाक नहीं है | ऐसा कहाँ की जहाँ टीईटी अंकों को चयन में कोई महत्व नहीं दीया जा रहा है चाहे - के वी एस की भर्ती हो , एस एस ए चंडीगढ़ या राजस्थान ग्रेड थ्री अध्यापक भर्ती हो |

अकादमिक परीक्षा में यु पी बोर्ड , सी बी एस ई बोर्ड से सालों से पिछड रहा है तो अकादमिक अंकों पर चयन तर्क न्याय संगत नहीं हैं | डिपार्टमेंट ऑफ़ साइंस एंड टेक्नोलोजी ( केंद्र सरकार ) ने तो यु पी बोर्ड , सीबीएसई बोर्ड को बराबर न मानते हुए स्केलिंग व्यस्था कर रखी है जो सालों से चल रही है आप खुद देखीए -

At the time of LT Grade Teacher Recruitment - Candidates / People say : यूपी में ही फेल हुआ यूपी बोर्ड कट ऑफ लिस्ट देखकर अभ्यर्थियों ने यही बात कही (published in jagran)

तो यु पी सरकार अपने ही बोर्ड के छात्रों के साथ ऐसा भेदभाव क्यों करती है , क्या ऐसा है की जो नियम बनाते हैं ( आई ए एस , पी सी एस ) उनके बच्चे सीबीएसई बोर्ड में पद रहे हैं |

हाल में ही कुछ फर्जी युनीवर्सिटीओं के घोटाले सामने आये जिसमें सम्पूर्णानन्द , माध्यमिक शिक्षा मंडल प्रमुख हैं देखीये न्यायलय ने क्या टिपण्णी की है -

तो क्या अकादमिक को आधार बनाना तर्क संगत होगा हालांकी कुछ श्रेणी, उच्च शिक्षा आदि को वेटेज ( अगर इंटरव्यू नहीं हो रहे हैं ) दिया जा सकता है लेकिन ये नियम भर्ती से पहले स्पष्ट होना चाहिए | और युपी बोर्ड , सीबीएसई बोर्ड के अंकों को स्केलिंग पद्दति से ले कर बराबरी का मोका तो कम से कम देना चाहिए

अदालत में जो स्टे लगा है वो विज्ञापन के अधिकार को लेकर है न की चयन के आधार को लेकर (अगर किसी को और अधिक जानकारी है तो वह कमेन्ट के माध्यम से सूचित कर सकता है )

अगर टीईटी अभ्यर्थी न्यायलय जाते हैं तो उनका तर्क है की जीत संभावित है , पर न्यायिक प्रक्रीयाओं में समय काफी लगता है पर ये मामला जनहित से जुड़ा होने के कारण हो सकता हैं की फेसला जल्दी भी आ जाये |

पर टीईटी अभ्यर्थीओं का प्रयास है की सरकार बातचीत से राजी हो जाये और इस कारण हजारों अभ्यर्थी लखनऊ में धरने पर बेठे हैं

अब आगे देखना ये है की ये मामला किस और जाता है
