Heard learned counsel for the parties.
The petitioners herein earlier appeared in the counselling for Trainee
Assistant Teacher in Primary School and deposited their original
testimonials in the office of the Basic Education Officer, Sultanpur.
Subsequently, they were also eligible for appearing in the counselling for
the post of Assistant Teacher (Math and Science) in Upper Primary School
for which original testimonials were required to be deposited by
31.10.2015.
However, according to them, they could not appear in the subsequent
counselling before the Basic Education Officer and submit the original
testimonials as they were already deposited with the Basic Education
Officer, Sultanpur in respect of earlier selection.
Considering the facts of the case, it is provided that if the counselling
for Assistant Teacher (Math and Science) in Upper Primary Schools is still
going on then the petitioners shall be allowed to appear therein if
otherwise eligible, subject to them producing the duly self attested photo
copies of the original testimonials before the concerned authority with
notarized affidavit categorically stating therein that the self attested
photo copies of the original testimonials are true and correct.
However, the petitioners shall submit the original testimonials as soon as
the same are received back by them with respect to the earlier selection.
As the documents are said to be deposited before the same authority, the
concerned authority may look into the original testimonials which are
already in his possession. The benefit of the order shall be available, if
the counselling is not over.
With the aforesaid observations, the writ petition is disposed of.
Let a copy of this order be given to learned counsel for the petitioners
within 24 hours on usual charges.
