Heard Sri Ashok Kumar Tiwari, learned counsel for the petitioners, Sri Mohd. Shere Ali, learned counsel for the respondent nos. 3 and 5 and Sri Mata Prasad, learned Additional Chief Standing Counsel for respondent nos. 1, 2 and 4.
Petitioners are seeking quashing of the order dated 25.05.2015 whereby their appointment on the post of Assistant Teacher has been withheld on the ground that the petitioners have failed to qualify the TET test within a period of five years from the date of their appointment which they were required to clear by 31.03.2015. The second prayer that they may be given one more opportunity to appear in the T.E.T. test and till then they may be allowed to continue a Assistant Teacher.
The relief claimed by the petitioners is thoroughly misconceived since they have admittedly failed to complete the T.E.T. test, therefore, they cannot be allowed to continue as Assistant Teacher.This issue has already been settled by a Full Bench decision of this Court in Shiv Kumar Sharma Vs. State of U.P. and others reported in 2013 (3) ESC 1436 ALD wherein it has been held that qualifying the T.E.T. examination is mandatory.
In this view of the matter I do not find any infirmity or illegality in the order dated 25.05.2015 and the prayer that petitioners may be given one more opportunity to clear the test is also utterly misconceived.
In view of the aforesaid, writ petition lacks merit and is accordingly, dismissed.
