1. Submission of learned Counsel for the petitioner is that the government order dated 11.07.2013 is contrary to the U.P. Basic Education (Teachers) Service Rules, 1981 and U.P. Basic Education (Teachers) (Sixteenth Amendment) Service Rules, 1981 (as amended by Sixteenth Amendment Rules, 2012). He further submits that the amended Rule 15 provides that each vacancy should be advertised in two newspapers.
2. The grievance of the petitioner is that by the impugned government order dated 11.07.2013 and the advertisement dated 19.08.2013 the selection process has been initiated only in respect of two subjects (i) Mathematics and (ii) Science, whereas there are large number of vacancies in other subjects also. He further submits that the government order and the advertisement will cause serious prejudice to the interest of the candidates other than Mathematics and Science as they would become junior to the persons selected in pursuance of this advertisement.
3. Learned Standing Counsel seeks time to get instructions.
4. Put up this case in Additional Cause List on 07.10.2013, before appropriate Bench.
