Petitioner is stated to have dispatched her form for the examination to be held for the T.E.T. Examination, 2011 by Registered Post on 28.12.2011 along with Bank Draft of Rs.200/- dated 16.12.2011. The last date for the receipt of the application was mentioned as 09.01.2012, therefore, the application is stated to have sent within reasonable period expecting the due delivery. It may be recorded that under the Advertisement only one mode for dispatch is mentioned i.e. Registered Post.
In the facts and circumstances of the case, this Court is of the opinion that the application of the petitioner ought not to have been rejected on the ground that post office had delivered the application subsequent to 09.01.2012.
Let the application of the petitioner be entertained and processed in accordance with law provided the petitioner files the application along with the envelope, which has been returned by the post office, along with a certified copy of this order before respondent no. 3 (Principal, D.I.E.T., Gonda), within two weeks from today.
Writ petition is disposed of.
