This appeal along with other connected matters were heard and judgment was reserved on 16th October, 2012.
One of the issues, which has been raised in some of the appeals, is regarding the interpretation of Clause 3 of notification dated 23rd August, 2010 issued in exercise of power conferred by sub-section (1) of Section 23 of the Right of Children to Free and Compulsory Education Act, 2009. Although some of the appellants have contended that without they having passed Teacher Eligibility Test, are eligible for appointment as Assistant Teacher to teach Class I to V but the stand of the State has not been clarified during the submissions regarding Clause 3 of the notification dated 23rd August, 2010. Thus it is necessary to further hear the learned counsel for the parties in above context. It is also necessary to note the steps taken by the State regarding appointment of teachers of basic schools during pendency of the appeal for deciding the appeals.
Put up this appeal and other connected matters for further hearing on 10th January, 2013.
Learned counsel for the parties be informed of the date fixed accordingly.
