Heard learned counsel for the parties.
The petitioner claims to be a duly selected candidate for being appointed as LT Grade Teacher. A litigation arose with regard to quality point marks being extended to the candidates who had passed their Post Graduate Examination in a subject which was not there in their Graduation Course. In a bunch of writ petitions wherein the leading case was Writ Petition No.6333 of 2013, Ravindra Babu Shriwas and others vs. State of U.P. and others, this court passed an interim order dated 5.3.2013 whereby a restrain was put on the respondents for issuing appointment letters to candidates who were extended the benefit of quality point marks on the basis of Post Graduate Degree in a subject other than the subject at the Graduation level. It has been stated by learned counsel for the petitioner that the bunch of the petitions referred to above is still pending.
According to learned counsel for the petitioner, the petitioner is not covered by the said interim order inasmuch as he is a post Graduate in Hindi and at the Graduation level Hindi Literature was one of the subjects. Further reliance has been placed upon the Government Order dated 4.10.2013 which has clarified the position that the candidates who had been selected and have been extended quality point marks of the Post Graduate Degree where the candidates who are Post Graduates in one of the subjects which was part of the Graduation level study, their appointment letters may be issued. In these circumstances the petitioner has prayed for that a writ of mandamus be issued to the respondents to issue appointment letter to the petitioner as he is a duly selected candidate for LT Grade Teacher in a Government College and is not covered by the interim order passed by this court on 5.3.2013.
Considering the facts and circumstances of the case, this petition is disposed of with liberty to the petitioner to represent to the Joint Director of Education, Moradabad Region, Moradabad (respondent no.3) annexing all such material as the petitioner may deem fit along with a certified copy of this order, whereupon the said Authority shall pass appropriate orders strictly in accordance to law taking into consideration the material that may be placed by the petitioner within a period of four weeks from the date of filing of the representation along with a certified copy of this order.
This order should not be interpreted to mean that the court has issued a mandamus to issue appointment letter to the petitioner. It would be open for the Joint Director of Education, Moradabad Region, Moradabad to pass appropriate orders strictly in accordance to law keeping in mind the status of other candidates similarly situate as the petitioner.
