आजमगढ़। अंबेडकर पार्क में शुक्रवार को बीएड बेरोजगार संघर्ष समिति की बैठक हुई। इस दौरान शिक्षक भर्ती प्रक्रिया में बिना टीईटी पास बीएड डिग्रीधारियों को शामिल न किए जाने पर असंतोष व्यक्त किया गया। बीएड बेरोजगारों ने विरोध में नारे-बाजी करते हुए प्रदेश सरकार का पुतला फूंका।
बैठक में संघर्ष समिति के अध्यक्ष सिकंदर कुमार ने कहा कि हाई सरकार बीएड बेरोजगारों के साथ अन्याय कर रही है। बैठक में बीएड बेरोजगार प्रह्लाद यादव, रामइकबाल यादव, महेंद्र यादव, प्रतिभा यादव, प्रीति यादव, विस्मिल्ला अली, विजय सिंह, अमित कुमार, रामजनम यादव, विरेंद्र यादव ने भाग लिया

KOLKATA: The Calcutta high court on Monday directed the state government to enforce guidelines under the Right of Children to Free and Compulsory Education (RCFCE) Act, 2009 in all schools except minority-run ones with immediate effect.

The division bench of Chief Justice Arun Mishra and Justice Joymalya Bagchi also directed that the registrations of schools that refuse to abide by the guidelines should be immediately scrapped.




The court was hearing a petition filed by Jatiyatabadi Paribartankami Shikshamonoshko Abhibhabak Mancha - an organization of parents from Jalpaiguri in North Bengal. The petitioners had claimed that several schools in Jalpaiguri do not abide by the guidelines though the RCFCE Rules, 2012, has already come into effect in the state.

They alleged that the schools in question continue to charge capitation fees or donations and not admit students from the economically weaker sections of society.

After hearing the petition on Friday, the court directed the state government to file an affidavit on what steps it has taken to enforce the act. This report was submitted on Monday. After going through the affidavit, the court noted that steps need to be taken so that schools in the state - not only in Jalpaiguri - but also in other parts of the state abide by the provisions under the act.

The act states that all children between the age of 6 and 14 have the right to free and compulsory education in a neighbourhood school. In order to abide by this, schools can't bar a student from being promoted till Class VIII.

Private schools (except minority-run ones) will also have to reserve 25% of the class strength for students from economically weaker sections and disadvantaged groups through a random selection process. The government is to remunerate the school for the education of such children.

No seats in this quota can be left vacant, the Act stipulates and those admitted through this process have to be treated at par with other students. The Act also states that no donation or capitation fee can be charged and no admission test or interview for children or parents can be held. Schools have to maintain a fixed student to teacher ratio. Local bodies like Panchayats and municipalities are to keep tabs on the numbers of children actually receiving primary education under the Act. State governments have also been directed to set up Commissions for Protection of Child Rights by the Act which also stipulates that all schools (except private unaided ones) have to set up management committees with 75% of parents and guardians being members.

New Delhi: A nationwide survey on status of education in rural India has revealed that there has been a decline in the education standards across the country. The Annual Status of Education Report (Rural) 2012, prepared by NGO Pratham and released by Union HRD Minister MM Pallam Raju on Thursday, also raises questions about whether the Right to Education Act has actually led to any improvement in India's literacy. (

According to the in the report, the basic learning levels of children in rural India have fallen; in 2012, just five out of 10 students in Class V across rural India, could solve a simple arithmetic problem, it says.

The report also says that there is a sharp decline in the reading ability of children, especially in government schools and that more and more parents seem to be depending on private schools in rural India. Last year, 45 per cent of students enrolled in Class I-VIII were attending private schools, the report says.

And in the same year, the enrollment rate of girls in schools showed a decline in a few states, the report says.

The report was based on a survey carried out in rural schools across 567 districts and covering about six lakh children in the age of 3-16.

Mr Raju said he was worried about the figures and hoped things will be better from next year. The minister also said, "We have been spending a lot of money on improving the reach of schools. All these are interventions. We are not unduly alarmed by parents sending their children to private schools, want to focus on improving standards in government schools."

The report is one of its kind in India as no other survey has been done so far to identify the status of education across rural India, either by the government or a private entity. Dr Rukmini Banerji, in-charge of the Pratham survey, said, "It's how you look at the way forward. The last couple of years have seen a big decline and that is very worrying. We have spent many years getting our children into school, now it is time to see what we learn from them."

Criticising the Right to Education Act (RTE), the report said it may have led to relaxation of classroom teachings since examinations and assessments are scrapped till a few classes.

The HRD Minister, however, defended the RTE act saying the focus since the introduction of the act has been on capacity and on getting more children on school. The minister also said that the time has now come to focus on learning outcomes. He also said that relaxation of norms is not a factor that could have affected the quality of education, as aspiration levels in rural India are also going up and hence people would not neglect studies.

According to social scientist Yogendra Yadav, who was also a part of a council for the act, said it is unfair to blame the RTE act. He said there could be other factors like the issue of recruitment of teachers and their quality.

But there are a few positives as well in the report. The Pupil-Teacher ratio in schools is up, and so is the proportion of schools with usable toilets. But the question is: how soon can the government act to ensure that this crisis in our education system be stemmed now?

लखनऊ (ब्यूरो)। प्राइमरी स्कूलों में शिक्षक भर्ती के लिए काउंसलिंग अब 29 जनवरी के बजाय चार फरवरी से शुरू होगी। जिलों में कट ऑफ सूची 30 जनवरी को जारी की जाएगी। इस संबंध में बेसिक शिक्षा परिषद की ओर से जिलों को जरूरी ब्यौरे 26 जनवरी तक भेज दिए जाएंगे।
बेसिक शिक्षा परिषद ने 72825 शिक्षकों की भर्ती के लिए पिछले दिनों रैंकिंग जारी करते हुए 29 जनवरी से काउंसलिंग शुरू कराने की बात कही थी। शुक्रवार को इस कार्यक्रम में संशोधन कर दिया गया। परिषद के सचिव संजय सिन्हा ने बताया, कट ऑफ सूची जारी करने की तैयारियां पूरी कर ली गई हैं।

लखनऊ (ब्यूरो)। प्राइमरी स्कूलों में शिक्षक भर्ती के लिए कटऑफ के जिलेवार डिटेल तैयार हैं। डिटेल्स छह सेटों में शनिवार तक सभी जिलों को भेज दिए जाएंगे।
बेसिक शिक्षा परिषद के सचिव संजय सिन्हा ने बताया कि जिलों में डीएम की अध्यक्षता में गठित जिला चयन समिति से कटऑफ का अनुमोदन कराकर 30 जनवरी को जारी किए जाएंगे जिसे जिलों की एनआईसी की वेबसाइट पर देखा जा सकेगा। उन्होंने बताया कि काउंसिलिंग अब 29 जनवरी के स्थान पर चार फरवरी से होगी। जानकारों के अनुसार काउंसलिंग तीन चरणों में कराए जाने की संभावना है

लखनऊ(ब्यूरो)। प्रशिक्षु शिक्षकों की भर्ती के लिए जिलों में कटऑफ भेजने की प्रक्रिया शुक्रवार से शुरू करने की तैयारी है। बेसिक शिक्षा अधिकारी इसके आधार पर विज्ञापन प्रकाशित करते हुए मेरिट में आने वालों को काउंसलिंग के लिए बुलाएंगे। बेसिक शिक्षा परिषद के सचिव संजय सिन्हा ने गुरुवार को काउंसलिंग के संबंध में विस्तृत दिशा-निर्देश भेज दिया है। इसके अलावा टीईटी में 55 फीसदी अंक पाने वाले स्वतंत्रता संग्राम सेनानी आश्रितों को पात्र मानते हुए उनकी सूची भी जारी कर दी गई है।
प्रदेश में 72 हजार शिक्षकों की भर्ती के लिए रैंक जारी किया जा चुका है। बेसिक शिक्षा परिषद ने गुणांक के आधार पर कटऑफ तय कर लिया है। इसे जिलों में भेजने की प्रक्रिया शुक्रवार से शुरू करने की योजना है। जिलों में बेसिक शिक्षा अधिकारी कार्यालय में इसे कब चस्पा किया जाएगा, इस पर फैसला अभी नहीं किया जा सका है। जिलों में कटऑफ भेजे जाने के बाद काउंसलिंग का कार्यक्रम तय किया जाएगा। विभागीय जानकारों की मानें तो कम से कम तीन बार काउंसलिंग की जाएगी। पहली काउंसलिंग से रिक्त बचने वाले पदों के लिए दूसरी और तीसरी काउंसलिंग की जाएगी।
 

काउंसिलिंग को जरूरी दस्तावेज
आवेदन के समय किया गया रजिस्ट्रेशन का प्रिंट आउट, बैंक में जमा की गई शुल्क की रसीद, ई आवेदन का प्रिंट आउट, शैक्षिक मूल प्रमाण पत्र, जाति, निवास, आरक्षण संबंधी प्रमाण पत्र, सभी अभिलेखों की दो सेट फोटो कापी, दो पासपोर्ट रंगीन फोटो, 10 रुपये के नान जूडिसियल स्टैंप पर शपथ पत्र, ई आवेदन में भरे गए पहचान पत्र मूल रूप, दो बिना टिकट लगा पता लिखा हुआ लिफाफा

इलाहाबाद : प्रशिक्षु शिक्षकों की भर्ती में शामिल किए जाने की मांग को लेकर अभ्यर्थियों ने मुख्यमंत्री अखिलेश यादव का पुतला फूंका। इस विरोध प्रदर्शन में बगैर टीईटी बीएड डिग्रीधारी अभ्यर्थी शामिल हुए। इस मौके पर अभ्यर्थियों ने तय किया कि वह शुक्रवार को मुख्यमंत्री के सोरांव दौरे के बीए उनसे मुलाकात करेंगे। इससे पूर्व अभ्यर्थियों ने कंपनी बाग में बैठक की। इसके बाद सभी ने सुभाष चौराहे तक जुलूस निकाला। इस दौरान जिलाधिकारी को एक पत्र भेजकर मुख्यमंत्री से समय मांगे जाने की घोषणा की गई। ज्ञापन भेजने वालों में सुशील रत्‍‌नाकर, विजय कुमार सरोज, रवींद्र कुमार, सुरेंद्र कुमार आदि मौजूद रहे। टीईटी 2011 उत्तीर्ण बीटीसी प्रशिक्षित 2010 बैच के अभ्यर्थियों ने भी मूल जिले में नियुक्ति की मांग की है। संयुक्त सचिव को ज्ञापन 2012 बैच के अपात्र बीएड अभ्यर्थियों को भर्ती से बाहर किए जाने की मांग को लेकर संयुक्त सचिव बेसिक शिक्षा परिषद भूपेंद्र कुमार सिंह को ज्ञापन भेजा। ज्ञापन में मांग की गई है 72825 प्रशिक्षु शिक्षकों की भर्ती प्रक्रिया में शामिल 2012 सत्र के उन बीएड अभ्यर्थियों जिन्होंने टीईटी परीक्षा 2011 आने के बाद बीएड की डिग्री प्राप्त की है को भर्ती से बाहर किया जाए। ज्ञापन भेजने वालों में संजय पांडेय, पवन मिश्र, नीरज मिश्र, शैलेश पांडे, पवन गुप्ता, हरेंद्र यादव, विमल तिवारी, मोहित यादव, शिवाकांत आदि शामिल रहे

प्रदेश में 72,825 प्रशिक्षु अध्यापकों की भर्ती के मामले में इस बार आयु सीमा से बाहर हो चुके अभ्यर्थियों का आवेदन स्वीकार नहीं करने पर हाईकोर्ट ने गहरी नाराजगी जताई है। हाईकोर्ट ने प्रदेश सरकार से पूछा है कि कोर्ट के आदेश के बावजूद बेसिक शिक्षा परिषद की वेबसाइट क्यों बंद कर दी गई।

कोर्ट ने 30 नवंबर 2011 के विज्ञापन में आवेदन करने वाले ऐसे सभी लोगों को शामिल करने का निर्देश दिया था जो इस बार आयु अधिक या कम हो जाने के कारण आवेदन करने की अर्हता से बाहर हो गए थे। बृहस्पतिवार को इस मामले में सुनवाई होगी।

9 जनवरी को दिए आदेश में न्यायालय ने ऐसे सभी लोगों का आवेदन 24 जनवरी तक स्वीकार करने का निर्देश दिया था। मगर बेसिक शिक्षा परिषद की आधिकारिक वेबसाइट बंद होने के कारण लोग आवेदन नहीं कर सके। न्यायालय ने पांच सौ रुपये प्रति जिले के हिसाब से शुल्क जमा करके आवेदन करने की छूट प्रदान की थी।

आदित्य त्यागी और अन्य की ओर से इस मामले में संशोधन प्रार्थना-पत्र देकर कहा गया कि कोर्ट के आदेश के बावजूद बेसिक शिक्षा परिषद ने अभ्यर्थी का आवेदन आयु सीमा अधिक होने के आधार पर निरस्त कर दिया। याचिका पर सुनवाई करते हुए न्यायमूर्ति अरुण टंडन ने प्रदेश सरकार से जवाब तलब करते हुए सुनवाई बृहस्पतिवार को नियत की है

दोहरे आरक्षण के विरोध में याचिका खारिज

प्रशिक्षु अध्यापकों की भर्ती में आरक्षित श्रेणी को दोहरा आरक्षण देने के विरोध में दाखिल याचिका हाईकोर्ट ने खारिज कर दी है। संजय कुमार आदि की याचिका में कहा गया था कि आरक्षित श्रेणी को टीईटी में पांच प्रतिशत की छूट गई है। अब नियुक्ति के समय भी उनको आरक्षण का लाभ दिया जाएगा, इस प्रकार से उनको दोहरे आरक्षण का लाभ मिल रहा है। ऐसा करना नियमानुसार गलत होगा।

याचिका खारिज करते हुए न्यायमूर्ति अरुण टंडन ने कहा कि टीईटी में पांच प्रतिशत की छूट देने को आरक्षण नहीं माना जा सकता है। इसी याचिका पर कोर्ट ने एक बार फिर कहा कि जिन आवेदकों को आयु सीमा के मामले में पुन: आवेदन करने की छूट दी गई है वह 24 जनवरी तक आवेदन कर सकते हैं

The Right of Children to Free and Compulsory Education (RTE) Act, 2009 has brought in several reform processes. States/UTs have inter-alia brought out notifications prohibiting corporal punishment, detention and board examinations in elementary education. The National Council for Teachers’ Education (NCTE) has laid down teacher qualifications and 22 States/UTs have conducted Teacher Eligibility Tests to improve the quality of teaching. 

In order to ensure free and compulsory education for all children in tribal areas, opening of new schools, residential schools/hostels, Kasturba Gandhi Balika Vidyalayas transport/escort facility, additional teachers, special training for out of school children and funds for improving learning and retention have been provided under the Sarva Shiksha Abhiyan (SSA) programme. 

For effective implementation of the RTE Act, 2009, Government of India has released Rs.19,332 crore in 2010-11, Rs.20,945 crores in 2011-12 and Rs.19,790 crore till date in 2012-13 to the States / UTs under the Sarva Shiksha Abhiyan programme which is the main vehicle for the implementation of the RTE Act.

Jharkhand has notified the State RTE Rules in order to implement the provisions of the Act. Since the notification of the RTE Act, 1,787 school buildings, 34,075 additional classrooms, 721 drinking water facilities and 4849 toilets have been completed in the State under the Sarva Shiksha Abhiyan. Also 4507 teachers have been recruited. Government of India has released Rs.89562.26 lakh in 2010-11, Rs.57903.45 lakh in 2011-12 and Rs.56183.85 lakh as on date in 2012-13 to Jharkhand under the SSA programme, towards meeting the RTE objectives.

In the present case petitioner before this Court is requesting for issuance of writ in the nature of certiorari by quashing the Clause 10 of the Government Order dated 5th December, 2012 (Annexure 10 to this writ petition) in so far as it specifies the quality point marks according to the percentage of marks obtained in the examination of High-school, Intermediate, Graduation and B.Ed.
On 5th December, 2012 a Government Order has been issued for making selection and appointment of Trainee Teachers from amongst candidates, who are B.Ed. degree holders and have passed Teacher Eligibility Test. Clause 10 of the aforementioned Government Order clearly proceeds to mention that Trainee Teachers shall be appointed strictly in consonance with the amended rules known as U.P. Basic Education (Teachers) Service Rules 1981 and further in the matter of selection appointment quality point marks shall be awarded as has been provided for. Petitioner at this juncture is submitting that no marks whatsoever has been prescribed for being awarded in lieu of post graduate degree and illegally marks of High-school, Intermediate and Graduation examination are being calculated.
Once selection and appointment is governed by statutory rules known as U.P. Basic Education (Teachers) Service Rules 1981 as amended up till date and therein Trainee Teacher has been defined as a candidate, who has passed B.Ed./B.Ed (Special Education)/D.Ed. (Special Education) and has also passed the Teacher Eligibility Test and has been selected for eventual appointment as Assistant Teacher in Junior Basic School after successful completion of six months special training programmee in elementary education recognized by National Council for Teacher Education (NCTE). Rule 14 deals with determination of vacancies and preparation of list. Under the aforementioned rules the Appointing Authority is to scrutinize the application received in pursuance of the advertisement and is to prepare the list of such persons as appear to possess the prescribed academic qualifications and be eligible for appointment. The names of candidates in the list so prepared is to be arranged in such manner that the candidates shall be arranged in accordance with the quality point marks specified in the Appendix 1. The names of candidates in the list prepared under Sub-rule 2 in accordance with Clause B of Sub-rule 1 of Rule 14 is to be arranged in such manner that the candidate shall be arranged in accordance with the quality point marks specified in Appendix 2.
The appendix in question clearly provides computation of quality point marks based on High-school, Intermediate, Graduation, B.Ed./B.Ed (Special Education) and D.Ed. (Special Education) examination. In the rules there is no criteria for providing any marks in lieu of post graduate degree. Once clause 10 of the Government Order dated 5th December 2012 is strictly in consonance with the rules, then there is no occasion for this Court to interfere and intervene. 
Consequently, writ petition is dismissed.

The petitioners who are stated to have obtained B.Ed. Degree after graduation and have passed TET Examination, seek a writ of Mandamus directing the respondent authorities to provide weightage to the candidates with reference to the marks obtained in TET Examination in the matter of appointment as Trainee Teachers. 
The case of the petitioners is that under Section 23 of the Right of Children to Free and Compulsory Education Act, 2009, the Central Government was conferred a power to authorize an authority for laying down the minimum qualification for appointment as teachers in the institutions where education imparted to children including institutions with Class 1 to 5.
The Central Government in exercise of powers under Section 23 authorized National Counsel for Teachers Training (hereinafter referred to as 'the NCTE') to act as the relevant authority for laying down minimum qualification. The NCTE issued notification on 23rd August, 2010, laying down the minimum qualifications for appointment of teachers in institutions where education is imparted from Class 1 to 5 as also in institutions where education is imparted from Class 6 to 8.
This case pertains to the first category of institutions and, therefore, facts pertaining to the first category alone are being stated.
The notification dated 23rd August, 2010, provides academic qualification and passing of TET Examination as essential qualification. It has been clarified that TET Examination shall be the one which is held by the State Government as per the guidelines framed by the NCTE.
According to the petitioner, guidelines for conducting TET Examinations have been provided under the letter of the Member Secretary, N.C.T.E. dated 11th February, 2011. Clause 9, provides for the minimum marks for qualifying TET Examination as 60%. Clause 9(b) provides that the State or the appointing authority may provide weightage as per the TET Score to the candidates in the recruitment process. It is further stated that the State Government has accepted the guidelines so framed by the NCTE as is apparent from its letter dated 7th September, 2011 and therefore, the State Government has to provide weightage with reference to the TET Score of the candidates. 
It is his case that the State Government, while publishing the advertisement for recruitment of Trainee Teachers, has completely ignored the Clause 9(b) of the guidelines, by not providing weightage to the TET Scores in the matter of selection of Trainee Teachers. Hence this petition.
In order to appreciate the contentions raised on behalf of the petitioners, it is necessary for this Court to examine as to what exact power was conferred upon the NCTE under the Right of Children to Free and Compulsory Education Act, 2009 (hereinafter, referred to as 'the Act of 2009') and for the purpose it is relevant to quote Section 23 of the Act of 2009:-
?23. Qualifications for appointment and terms and conditions of service of teachers.- (1) Any person possessing such minimum qualifications, as laid down by an academic authority authorised by the Central Government, by notification, shall be eligible for appointment as a teacher.
2.Where a State does not have adequate institutions offering course or training in teacher education, or teachers possessing minimum qualifications as laid down under sub-section (1) are not available in sufficient numbers, the Central Government may, if it deems necessary, by notification, relax the minimum qualifications required for appointment as a teacher, for such period, not exceeding five years, as may be specified in that notification : 
Provided that a teacher who, at the commencement of this Act, does not possess minimum qualifications as laid down under sub-section (1), shall acquire such minimum qualification within a period of five years. 
3.The salary and allowances payable to, and the terms and conditions of service of, teachers shall be such as may be prescribed.
NOTIFICATION
Ministry of Human Resource Development (Deptt. Of School Education and Literacy), Noti. No. S.O. 750(E), dt. 31.3.2010, published in the Gazette of India, Extra., Part II, Section 3(iii), dt. 5.4.2010.-In exercise of the powers conferred by sub-section (1) of Section 23 of the Right of Children to Free and Compulsory Education Act, 2009, the Central Government hereby authorises the National Council for Teacher Education as the academic authority to lay down the minimum qualifications for a person to be eligible as a teacher.?
From Clause 1 of Section 23 of the Act of 2009 it is clear that the academic authority, authorized by the Central Government by notification, has been conferred the sole power of laying down the minimum qualifications for appointment of teachers in the institutions, covered by the Act of 2009, and it is with reference to Section 23 of the said Act that the Ministry of Human Resource and Development, Central Government, vide notification dated 31.03.2010, declared the NCTE as academic authority to laydown minimum qualifications for the persons to be eligible for appointment as teachers.
From the simple reading of Section 23, alongwith the notification dated 31.03.2010, published in official gazette on 05.04.2010, it apparent that power of the NCTE is limited to laying down minimum qualifications and nothing beyond it. The process of recruitment and the manner of selection as Assistant Teacher in Primary Schools cannot be tinkered with by the NCTE in exercise of power of laying down minimum qualifications as flows from Section 23 of the Act of 2009. 
In my opinion the NCTE, except for laying down the minimum qualifications cannot direct that any particular marks should be granted weightage or that any particular method of selection should be adopted, in as much as it is not within the power of the NCTE to lay down any such condition.
Laying down of the minimum qualifications for particular post does not include within its ambit the power to lay down manner of selection and for weightage etc. be provided in respect of particular qualifying examination.
This Court may record that the guidelines which have been framed by the NCTE in respect of holding of TET Examination on 11th February 2011 are to be read in that context only.
So far as Clause 9 of the Guidelines for conducting Teacher Eligibility Test (TET) are concerned, it is worthwhile to record that Clause 9(b) itself provides that TET is only one of the qualifying criteria for appointment. Clause 9 of the Guidelines reads as follows:-
?Qualifying marks
9 A person who scores 60% or more in the TET exam will be considered as TET pass. School managements (Government, local bodies, government aided and unaided)
(a) may consider giving concessions to persons belonging to SC/ST, OBC, differently abled persons, etc., in accordance with their extant reservation policy;
(b) should give weightage to the TET scores in the recruitment process; however, qualifying the TET would not confer a right on any person for recruitment/employment as it is only one of the eligibility criteria for appointment.? 
It contemplates that passing of the TET Examination is only one of the eligibility criteria for appointment. The provision has to be read as a whole and in the background of the power conferred.
It is always open to the State Government, which is rule framing authority under Section 19 of the Basic Education Act, 1972, in the matter of appointment of teachers in Primary Schools to lay down the method of recruitment of Teachers as well as Trainee Teachers and while laying down such procedure for recruitment of Teachers and Trainee Teachers, the only obligation cast upon the State Governments under the Act of 2009 and the Notification of the NCTE is that the Teachers to be appointed in the institutions concerned must possess prescribed minimum qualifications and nothing beyond it.
The method of selection and the manner of selection is within the domain of the State Government the rule framing authority. In the facts of the case, the State Government under the 16th Amendment to the Rules of 1981 has provided for the appointment of Trainee Teachers. The State Government has decided to make selections for the post on the basis of the quality point marks obtained in various academic examinations throughout the career of the applicant concerned. If the State Government has decided not to give any weightage to the TET scores, it cannot be said that it has committed any violation of any statutory provision. The NCTE guidelines do not have any statutory force so as to over reach the power of the State Government as conferred under Section 19 of the Basic Education Act, 1972. 
In my opinion the Rule framed by the State under Rule 19, having taken care of, the minimum qualifications prescribed by NCTE cannot be said to have violated any of the provisions of Right of Children to Free and Compulsory Education Act, 2009 or the Notification of the NCTE issued there under. There cannot be a direction to the State to adopt a particular method of selection, as has been prayed by the petitioner before this Court. 
The writ petition lacks merit and is dismissed.

Weighatge of TET marks should be read along with background of power (i.e powers granted to selection authority.)
How much weighatge etc. given is in the hands of selection authority and NCTE is not selection authority.
NCTE lay down minimum qualification i.e eligibility. 

However I am unable to understand Basic Education Act point.

In the present case advertisement has been published for selection and appointment of Assistant Teachers, who have passed Teacher Eligibility Test (Primary Level) on 25th December, 2012. The advertisement in question deals with selection of Assistant Teachers for primary level and as far as petitioner is concerned, he has passed Teacher Eligibility Test (Upper Primary Level) and in view of this petitioner is ineligible to apply for consideration of his candidature.
Petitioner is contending before this Court that qualification for Teacher Eligibility Test, Class 1 to 5 and Teacher Eligibility Test (Upper Primary Level) are equal i.e. graduation and B.Ed. but respondents have not accepted the application form of petitioner.
Once precise eligibility criteria has been prescribed for being appointed as Assistant Teacher at primary level that an incumbent should pass the Teacher Eligibility Test (Primary Level), and the candidates who have passed Teacher Eligibility Test (Upper Primary Level) cannot claim as a matter of right that they should also be permitted to apply and their candidature be also considered.
Consequently, the issue in question being in the realm of policy decision, no relief or reprieve can be accorded by this Court, accordingly writ petition is dismissed.

लखनऊ (ब्यूरो)। बेसिक शिक्षा मंत्री रामगोविंद चौधरी ने शिक्षक भर्ती प्रक्रिया में मामूली गलती पर आवेदन निरस्त होने वालों को राहत दी है। प्रदेश के सभी डायट पर शिकायत निस्तारण प्रकोष्ठ का गठन कर दिया गया है। इस प्रकोष्ठ के माध्यम से अभ्यर्थियों की कठिनाइयों का निस्तारण किया जाएगा और दावा सही होने पर उनके चयन पर विचार किया जाएगा।
बेसिक शिक्षा मंत्री ने कहा है कि मामूली गलती के चलते आवेदन निरस्त होने वाले अभ्यर्थी समस्त अभिलेखों के साथ अपना प्रत्यावेदन डायट पर बनाए गए शिकायत निस्तारण प्रकोष्ठ में दे सकते हैं। परीक्षण के बाद यदि दावा सही पाया जाता है तो उनके चयन पर विचार किया जाएगा। अभ्यर्थियों से कहा गया है कि अपने गुणांक को सही प्रकार से आंकने के बाद कटऑफ से ऊपर होने पर ही संबंधित जिले में अपना प्रत्यावेदन प्रस्तुत करें। फर्जी चयन कराने की जानकारी मिलने पर एफआईआर दर्ज कराई जाएगी।
उन्होंने कहा है कि शिक्षक भर्ती प्रक्रिया में किसी प्रकार की गड़बड़ी नहीं होने दी जाएगी। पात्रों को शिक्षक बनने का पूरा मौका दिया जाएगा। इस संबंध में विभागीय अधिकारियों को स्पष्ट निर्देश दे दिए गए हैं। चयन प्रक्रिया में गड़बड़ी या फिर किसी प्रकार की अनियमितता पर दोषियों के खिलाफ कड़ी कार्रवाई की जाएगी

उरई : प्राथमिक विद्यालयों में प्रशिक्षु शिक्षकों की नियुक्ति हेतु जारी की गई रैंकिंग सूची सवालों के घेरे में आ गई है। इसने आवेदकों को सोच में डाल दिया है जिससे गलती, जुगाड़ या साजिश जैसे प्रश्न उनके मन में उठने लगे है।

केस-1

एक महिला अभ्यर्थी ने विकलांग कोटे से फार्म भरे है। 75 जिलों में करीब डेढ़ सौ फार्म भरे गये है। एक ही जिले से कई-कई फार्म डाले गये है। संभव है कि इसमें कुछ गलती हो परंतु लगभग हर जिले में हालत यह है कि रैक एक सीरियल में न होकर अलग-अलग है और इसमें भी 6-10 हजार तक का अंतर है। अब सवाल है कि आखिर हर फार्म में गलती हो रही थी या यह जानबूझकर किया गया या फिर किसी विशेष प्रयास के चलते, यह किसी की समझ में नहीं आ रहा। इसमें विकलांग कोटे से कई जगह चयन हो रहा है तो कई जगह सामान्य रैकिंग से ही चयन संभावित है।

केस-2

एक अभ्यर्थी की बरेली, बदायूं, पीलीभीत, शाहजहांपुर में सामान्य रैक सवा-डेढ़ लाख से ऊपर है परंतु सोचनीय यह है कि उसको श्रावस्ती, सोनभद्र जैसे जनपदों में सामान्य सूची में ही पचासवीं रैकिंग मिल रही है। अब इस पर किसी को यकीन नहीं है, क्योंकि अगर उसका गुणांक ज्यादा है तब अन्य जनपदों में भी रैक अच्छी होती।

केस-3

एक अभ्यर्थी के अंक आवेदन में सही भरे हैं परंतु उसका इन्हीं अंकों के आधार पर एक जनपद में चयन होता दिख रहा है जबकि अन्य जनपदों में उसकी रैकिंग काफी कम आ रही है। यह भी सवालों के घेरे में आ रही है।

बेसिक शिक्षा परिषद ने जिस तरह रैक सूची जारी की है उसको लेकर अभ्यर्थी काफी परेशान थे परंतु इस तरह के तमाम मामलों ने इस सूची पर यकीन करना मुश्किल कर दिया है। यही वजह है कि तमाम आवेदक गड़बड़ी की आशंका जाहिर करने लगे है। उनका कहना है कि किसी आवेदक के एक-दो फार्मो में गलती हो सकती है परंतु इतनी भी नहीं कि उसकी रैकिंग कहीं आसमान पर हो और कहीं जमीन पर। खासकर एक ही जिले से कई फार्म डालने वाले आवेदकों के मामले में कुछ आवेदकों ने कहा कि संभव है कि इन लोगों ने किसी जुगाड़ लगाने के चलते ऐसा किया हो। वहीं कुछ ने कहा कि यह चयन प्रक्रिया रोकने के लिए साजिश भी हो सकती है।

उरई : जिन आवेदकों ने गलती से या फिर जानबूझकर अपनी मेरिट ज्यादा दिखाने की कोशिश की, वे काउंसलिंग में बाहर हो सकते है क्योंकि तब मूल कागजात देखे जाएंगे। वैसे इसमें किसी तरह की धांधली होने की गुंजाइश नहीं है। यही वजह है कि उनके अरमानों पर पानी फिर सकता है
