The petitioners who are thirteen in number. They have been selected as Trainee Teachers in Junior Basic Schools. Now they are working as Assistant Teachers after completing their training in Junior Basic Schools. 
The petitioners have also applied for the posts of Assistant Teacher (Mathematics and Science) in Senior Basic Schools. It is stated that they have been selected therein also. 
The grievance of the petitioners is that their claim against the higher post i.e. Assistant Teacher in Senior Basic School may not be cancelled on the basis of instruction in the appointment letter to the effect that the applicants will have to join the post of Assistant teacher (Maths & Science) within stipulated period failing which their appointment shall automatically be cancelled , till the last counselling is conducted, as the they want to join the said post. The petitioners have brought on record their appointment letters as annexure-3 to the writ petition. 
Learned Standing Counsel has accepted notice on behalf of respondent nos. 1 & 2, and the learned Counsel of respective District Basic Education Officers have accepted notice on their behalf. 
As prayed by them, six weeks' time is granted to file counter affidavit. Rejoinder affidavit, if any, may be filed within a week thereafter. 
List after expiry of the said period.

Learned counsel for the petitioners is permitted to implead the Director, SCERT, Lucknow as one of the respondents during the course of the day. 
All the 8 petitioners are working as Assistant Teachers (Mathematics and Science) in the Senior Basic Schools. 
Previously, an advertisement was made on 30.11.2011 for recruitment of the Assistant Teachers in the Junior Basic Schools against 72825 vacancies. Later on, vide advertisement dated 11.07.2013, the respondents called applications for the appointment of 29334 Assistant Teachers (Mathematics and Science) in Senior Basic Schools. 
It is stated that the petitioners have applied against both the advertisement and they have been selected as Assistant Teachers (Mathematics and Science) in the Senior Basic Schools and as Trainee Teachers in the Junior Basic Schools. The petitioners have completed their six months training as Trainee Teachers in the Junior Basic School but at present they are working as Assistant Teachers (Mathematics and Science) in the Senior Basic Schools. 
Their grievance is that the entire recruitment process pursuant to the advertisement dated 11.07.2013 is under cloud as various writ petitions and special appeals in this Court are pending. 
In the meantime, fourth round of counselling is going on for the Trainee Teachers wherein the petitioners have been directed to submit their original educational testimonials within 15 days, failing which, their selection as Trainee Teachers in the Junior Basic School shall stand cancelled. 
Learned counsel for the petitioners further submit that the original educational testimonials have been deposited with the authorities of the Senior Basic Schools, therefore, they are unable to produce it for their appointment as Trainee Teachers. 
It is submitted by Learned Standing Counsel and Sri B.P. Singh, learned counsel for the respondents that in case any interim order is granted, it would cause serious prejudice to complete the selection of the Training Teachers in compliance of the order of Supreme Court. 
Learned counsel for the petitioner in rejoinder submits that there are still large number of vacancies of the Trainee Teachers even after completing the present counselling for the Training Teachers. 
Having regard to the facts and circumstances of the case, a direction is issued to respondents to complete the present counselling and the selection in compliance of the order of the Supreme Court but the petitioners shall be considered in the last round of the counselling, if the post remains vacant. 
Learned Standing Counsel is granted six weeks time to file counter affidavit. Rejoinder affidavit, if any, may be filed within a week thereafter.

जूनियर विज्ञानं गणित में चयनित शिक्षकों को नहीं देना होगा प्रशिक्षु शिक्षक पद से इस्तीफ़ा 


मित्रों ,
भ्रामक ख़बरों पर ध्यान न दें ,

कोर्ट ने याचीयों को रहत दी है की 23 नवम्बर की अगली सुनवाई तक प्रशिक्षु शिक्षकों को इस्तीफे के लिए बाध्य न किया जाए । 

हाई कोर्ट आर्डर के अनुसार सरकार कोर्ट को यह नहीं बता पाई कि किन कानून प्रावधानों के तहत प्रशिक्षु शिक्षकों से इस्तीफ़ा लिया जाए । 

याची का कहना था की वह 72825 शिक्षक भर्ती में प्रशिक्षु शिक्षक में चयनित हुए , उसके बाद 29334 गणित विज्ञानं शिक्षक में भी चयनित हुए । 

लेकिन जब वह अपने ओरिजिनल दस्तावेज को प्रशिक्षु शिक्षक भर्ती से निकाल कर जूनियर विज्ञानं गणित शिक्षक में जमा कराने के लिए पहुंचे तो 
उनसे प्रशिक्षु शिक्षक पद से इस्तीफ़ा माँगा जा रहा है / बाध्य किया जा रहा है । 
जबकि ऐसा कोई कानूनी प्रावधान ही नहीं है , कोर्ट ने याची के पक्ष को सही पाते हुए सरकारी पक्ष को बुलाकर पूछा तो वह भी ऐसा कोई दस्तावेज नहीं पेश कर सके की प्रशिक्षु शिक्षकों से किस आधार पर इस्तीफ़ा लिया जाए । 

और इस प्रकार दोनों पक्षों को रेजोइंडर व काउंटर एफिडेविट अगले ४ हफ़्तों तक देना है , और अगली सुनवाई 23 नवम्बर तक प्रशिक्षुओं को इस्तीफे के लिए बाध्य न करने का आदेश सरकार को दे दिया है । 

कुछ लोगो का सोशल मीडिया पर कहना है की तथ्यों को छिपा कर ऑर्डर कराया गया , काउंसलिंग की परमिशन के नाम पर ओरिजिनल डॉक्यूमेंट का चक्कर है । 
ऐसे लोगो को कहना है की ऑर्डर ध्यान से पढ़ें।  अगर उनके पास कोई प्रामाणिक जानकारी है तो लोगो को बताये । 

जूनियर विज्ञानं गणित शिक्षको ने अपनी कंडीशनल नियुक्ति देख कर यह कदम उठाया है , और किसी को शौक नहीं की प्रशिक्षु / प्राइमरी शिक्षक के पद पर भी बना रहे । 
वैसे स्थाई प्राइमरी शिक्षक लाइन ले कर प्राइमरी व जूनियर दोनों शिक्षकों के पद पर बने हुए हैं , पर यहाँ सवाल कॅरियर का है 4 साल बाद नियुक्ति मिली और कोई अपना भविष्य दांव पर कैसे लगा दे , इसलिए वह सभी सही रास्ते चुनने को स्वतंत्र है 

कोर्ट ने एक और ऑर्डर दिया है उसमे भी जूनियर व प्राइमरी शिक्षक दोनों पद है , लेकिन ऑरिजिनल दस्तावेज निकलने की छूट नहीं दे रहे थे ,
कोर्ट ने आदेश दिया है की ऐसे केस में अटेस्टेड कॉपी से काम चलाया जाए , और वेरिफिकेशन के टाइम पर ऑरिजिनल दस्तावेज लिए जाएँ

Supplementary affidavit, filed today, is taken on record.

The petitioners are fifty one in number. They have preferred this writ petition for a direction upon the respondents not to insist them to tender their resignation from Primary Schools, and allow them to join as Assistant Teachers (Mathematics or Science) in the respective Schools.

This Court in a matter of similarly placed persons i.e. Writ-A No. 57107 of 2015 (Pooja and others v. State of U.P. & others) has granted an interim protection to the petitioners therein by an order of the date i.e. 13th October, 2015, which reads as under:

"The petitioners are twenty two in number. They claim that they have been selected as Trainee Teachers in pursuance of an advertisement dated 30th November, 2011, wherein 72825 posts were advertised. It is stated that thereafter another advertisement was issued on 11th July, 2013 calling applications for 29334 posts of Assistant Teachers (Mathematics & Science) in Senior Basic Schools, which are in the higher pay scale.

The grievance of the petitioners is that being eligible for the posts of Assistant Teachers (Mathematics & Science) they had applied in pursuance of the subsequent advertisement also, wherein they have been selected. However, the respective District Basic Education Officers are not returning the original documents/educational testimonials of the petitioners unless the petitioners resign from the posts of Trainee Teacher.

It is contended that the said condition is arbitrary as there is no statutory requirement.�

Learned Counsel for the respondents has failed to point out any statutory provision or the executive order imposing such type of condition.

Matter needs consideration.

Learned Standing Counsel has accepted notice on behalf of the State functionaries, Sri P.D. Tripathi, learned Advocate appears for respondent nos. 3 & 9, and District Basic Education Officers of various districts i.e. respondent nos. 4 to 14 are represented by their respective Counsel.

As prayed by learned Standing Counsel, six weeks' time is granted to file counter affidavit. Other respondents may also file their counter affidavit within the same period. Rejoinder affidavit, if any, may be filed within a week thereafter.�

List this case on 23rd November, 2015.

The respondents will not insist the petitioners to tender their resignation as trainee teacher till the next date of listing."

The petitioner herein submitted the original testimonials while applying for appointment to the post of Assistant Teacher in Senior Basic School. Thereafter, the post of Assistant Teacher in Primary School was advertised wherein also the condition of submission of original testimonials existed.

In these compelling circumstances when the petitioner approached the concerned authority for returning of the original testimonials deposited in respect to earlier advertisement pertaining to Senior Basic School, he was required to submit an affidavit that he will not seek appointment against the post of Assistant Teacher in Senior Basic School and then the original testimonials were returned.

The contention of the counsel for the petitioner is that in such an arbitrary manner, the petitioner is being deprived of his right of consideration for appointment on the post of Assistant Teacher in the Senior Basis School based on the affidavit submitted by the petitioner.

Considering the facts of the case, this Court is of the view that a right of consideration for employment is a fundamental right under Article 16 of the Constitution of India. The same can not be denied based on the alleged affidavit submitted by the petitioner under compelling circumstances, on the demand of the opposite parties which in the first place was quite objectionable and illegal.

In these circumstances, it is provided that any such affidavit or application submitted by the petitioner, shall not be taken into cognizance, if the petitioner is otherwise eligible and entitled to be considered for appointment to the post of Assistant Teacher in Senior Basic School in pursuance to the advertisement issued in this regard.

At best the opposite parties can demand the petitioner to produce the original testimonials for verification at a later stage after submission of duly attested photocopies of the said testimonials.

With the aforesaid observations, the writ petition is disposed of.

Learned counsel for the petitioner, for the purpose of interim relief, submits that in an identical matter, this Court has passed an order dated 17.10.2014 in Writ Petition No.6013 (SS) of 2014 which on reproduction reads as under :-
"Heard counsel for the petitioners, learned standing counsel appearing on behalf of respondent Nos. 1 to 3 & 5 to 9, Sri Neeraj Chaurasiya for respondent Nos. 4 & 14, Sri Vindhyawashini Kumar for respondent No. 12, Sri S.K. Yadav for respondent No. 10, Sri Ajay Kumar for respondent No. 13 and Sri Ghaus Beg on behalf of respondent No. 11.
They pray for and are granted four weeks for filing counter affidavit. The petitioners shall have two weeks thereafter to file rejoinder affidavit.
List immediately thereafter.
The petitioners herein have applied for appointment on the post of Assistant Teachers (Mathematics and Science) in Senior Basic Schools (for short SBS). They were called for counselling. At the time of counselling, they submitted their original testimonials. In the meantime, the petitioners received intimation for counselling, as trainee teachers in Primary Schools, pursuant to another advertisement, for filling up vacancies of Assistant teachers in Primary Schools, run by the Board. In the said counselling, the condition was that the candidate has to submit his original certificates and testimonials. In order to participate in the said counselling, the petitioners requested the authorities, who have held the selection SBS to return their original testimonials. For returning the documents, the authorities imposed a condition for submitting affidavit to the effect that the petitioners will not stake claim for appointment in SBS. The case of the petitioners is that under compelling circumstances, they have furnished such an undertaking and whereupon, their original testimonials were returned to them. It is the admitted case of the petitioners that, thereafter, they have participated in the counselling for the trainee teacher in Primary Schools, where they had deposited their original testimonials.
In the meantime, a number of writ petitions were filed before this Court wherein, several directions were issued, one of which dated 26th September 2014 in Writ Petition No. 6390 (S/S) of 2014 - Neha Singh Versus State of U.P., mandated the Principal Secretary, Basic Education, to issue direction to Principals, DIET and District Basic Education Officers of the State to permit the candidates to participate in the counselling for trainee teachers on the basis of attested testimonials. The case of the petitioners is that pursuant to the said directions, the Principal Secretary, Basic Education, U.P. had issued a Circular, entitling the candidates to appear in the counselling for trainee teachers on basis of attested testimonials.
The petitioners, after having come to know of such general direction issued by this Court and the Circular issued in this regard by the Principal Secretary, Basic Education, U.P., has approached this Court by way of instant writ petition for a mandamus directing the respondents to consider their candidature for appointment as Assistant teachers in SBS on basis of counselling already held.
Learned counsel appearing on behalf of respondent Nos. 2 & 4 submitted that the petitioners have already appeared in the counselling for appointment in SBS and have thereafter submitted their affidavit, giving up their claim. Now, they can not resile from the undertaking given by them.
It is not disputed that under the general direction issued by this Court on 26th September 2014 in Writ Petition No. 6390 (S/S) of 2014, the Principal Secretary, Basic Education, U.P. has issued a Circular whereunder, the candidates are now being permitted to participate in the counselling for the post of trainee teachers on basis of certified testimonials. Evidently, the petitioners have submitted their affidavit under compelling circumstances. Prima facie, I am of the opinion that in the aforesaid facts and circumstances, the petitioners rightly contend that their claim for appointment on the post of Assistant teachers (Maths and Science) in Senior Basic Schools, can not be forfeited. As such, interest of justice would be served in providing that the claim of the petitioners for appointment on the post of Assistant teachers (Maths and Science) in Senior Basic Schools, shall remain alive till further orders of this Court. Such of the petitioners as are willing to appear in the next round of counselling, shall be permitted to appear provisionally, on the basis of attested testimonials, without prejudice to their rights. The selection made, in the meantime, shall be subject to the decision of the writ petition."
Accordingly, he requests that the same benefit may be given to the present petitioner also.
Learned counsel for the respondent does not dispute the said facts.
Thus, after hearing learned counsel for the parties and going through the records as an interim measure, it is provided that opposite party no.6/District Basic Education Officer, Unnao shall� allow the petitioner to participate in the counseling for the post in question on production of her education testimonials duly attested. Her selection shall abide by the result of the writ petition.
Learned State Counsel prays for and is granted four weeks' time to file counter affidavit, rejoinder affidavit, may be filed within two weeks thereafter.
List thereafter.

Heard learned counsel for petitioner and Sri A.P.Shukla, learned Standing Counsel.
A large number of writ petitions are being filed by the candidates aspiring for the post of trainee teachers. These petitioners have appeared in counselling for appointment as Assistant Teacher wherein their testimonials were deposited in different districts. In such matters, interim orders have been passed to the effect that candidates should be allowed to participate in counselling for trainee teachers on the basis of attested testimonials and final decision of their appointments shall be made after verification from originals.
Since petitioners are clogging the Court for this issue, in order to avoid multiplicity of cases and in order to check rising number of cases which are already burdening the Court, I direct Principal Secretary (Basic Education), to issue necessary directions to Principals, DIET and District Basic Education Officers of the State to permit such candidates to participate in the counselling for Trainee teachers who have already participated in the counselling for appointment of Assistant Teachers, on the basis of attested copy of testimonials. Selection would be made subject to verification from original certificates.
Principal Secretary (Basic Education), U.P. is directed to issue this instruction without any delay. This instruction would obviate the need of candidates to come to High Court unnecessarily.
So far as petitioner's case is concerned, Principal, DIET, Unnao is directed to permit the petitioner to participate in its counselling for trainee teachers on the basis of attested testimonials. Final selection of petitioner would be made subject to verification from original testimonials.
Writ petition is disposed of accordingly.
