Heard Shri Abhishek Tripathi holding brief of Shri Prabhakar Awasthi for the petitioner, Shri Adarsh Bhushan for the respondent no. 2 and the learned Standing Counsel appearing for the respondent no. 1.
By means of this writ petition the petitioner has challenged the order by which the selection list has been revised.
The petitioner had applied for selection of L.T. Grade Teacher in Mathematics for intermediate colleges conducted by the U.P. Secondary Education Service Selection Board pursuant to Advertisement No. 1 of 2010.
It appears that the model answer to certain questions were held to be doubtful, therefore, this Court in another Writ Petition No. 14110 of 2012 directed the Selection Board to call for expert opinion from the Mathematics Department of the Allahabad University and it is submitted that the Board will thereafter take necessary action as per the expert's report.
It is submitted that considering the expert's report now the result of the selection has been revised and the petitioner is now held not to be selected although he was given appointment as per unrevised result and he is functioning in the institution.
It is further submitted that upon the revised result the petitioner's appointment is being cancelled and some other person is being appointed in his place.
Since upon the revised result the action has been taken and the same is being done pursuant to order of this Court dated 27.3.2012 in Writ Petition No. 14110 of 2012, I am not inclined to interfere at this stage.
Shri Adarsh Bhushan represents respondent no. 2. Learned Standing Counsel represents respondent no. 1.
Issue notice to respondent no. 3 returnable at an early date, for which steps will be taken within a week.
The respondents may file counter affidavit within one month.
