Breaking News Transfer -कोर्ट ने आज फिर दोहराया कि 13.06.2017 का शासनादेश पति पत्नी सरकारी सेवा पर लागू नहीं, 5 वर्ष सर्विस जरूरी नही और सचिव स्थानांतरण पर विचार करें 6 हफ्ते का टाइम - HIGH COURT OF JUDICATURE AT ALLAHABAD, LUCKNOW BENCH ?Court No. - 19 Case :- SERVICE SINGLE No. - 1034 of 2018 Petitioner :- Shashi Prabha Pandey Respondent :- State Of U.P. Thru Appar Mukhya Sachiv/Prin.Secy.Basic & Ors Counsel for Petitioner :- Sakha Ram Tiwari Counsel for Respondent :- C.S.C.,Ajay Kumar,Shobhit Mohan Shukla Hon'ble Vivek Chaudhary,J. The petitioner is an Assistant Teacher. She is presently posted atPrimary School, Sita Rasoi Vikas Khuand Kasmanda, District-Sitapur. Her husband is posted at Babu Banarsi Das University, Lucknow, as Assistant Lecturer. She has made a representation for her transfer from Sitapur to Lucknow, where her husband is posted as T.G.T. Teacher. A copy of her application is on the record as annexure-3 to the writ petition. Learned counsel for the petitioner submits that Uttar Pradesh Basic Education (Teachers) (Posting) Rules, 2008 deals with the posting and transfer of the teachers working in Junior Basic Schools and Senior Basic Schools run by the Board. The Rule 8(2)(d) of the Rules, 2008 provides that in normal circumstances the applications for inter-district transfers can be entertained of only those teachers who have completed five years of their posting, however, the exception is provided that an application of a female teacher for her transfer at the place of her husband or in-laws would be entertained. It is contended by learned counsel for the petitioner that in case the petitioner is directed to submit on-line application in terms of Government Order dated 13.6.2017, in that event the petitioner would not be eligible for transfer as she has not completed five years of requisite service. Learned counsel for the petitioner has placed reliance on a judgment of Full Bench of this Court in the case of R.B. Dixit v. Union of India and others, (2005) 1 UPLBEC 83. Sri Shobhit Mohan Shukla, learned Advocate, who has put in appearance on behalf of the District Basic Education Officer submits that the State Government has issued guidelines on 13.6.2017 in respect of inter-district transfer of the assistant teachers of Junior Basic Schools and Senior Basic Schools for the session 2017-18. He further submits that on-line applications would be accepted from 16th to 31th August, 2018 and the procedure has been laid down under the said guidelines. I have heard learned counsel for the parties. With their consent the writ petition is being disposed of finally at this stage in terms of the Rules of the Court. The Uttar Pradesh Basic Education (Teachers) (Posting) Rules, 2008 have been framed under Section 19(1) of the U.P. Basic Education Act, 1972. The Rule 8(2)(d) provides as under: "(d) In normal circumstances the applications for inter-district transfers in respect of male and female teachers will not be entertained within five years of their posting. But under special circumstances, applications for inter-district transfers in respect of female teachers would be entertained to the place of residence of their husband or in law's district." From a reading of the aforesaid Rule it is evident that under the special circumstances an application of a female teacher can be entertained for her transfer at the place of residence of her husband or in-law's district. In such cases the requirement of five years of posting has been relaxed. It is a well settled law that the Government Order cannot supplant the law, it can only supplement it. Indisputably, an executive order cannot override the Rules which have been framed by the rule making authority in exercise of powers conferred upon it by the Act. In case of any inconsistency with the delegated legislation, executive instructions or the Government Order, the Rule cannot be ignored. The same issue fell for consideration before a Division Bench of this Court in R.B. Dixit (supra) in the following terms: "6. We have held in Smart Chip v. State of U.P., 2002 (49) ALR 419, that in every legal system there is a hierarchy of norms as noted by the eminent jurist Kelson in his Pure Theory of Law. In the Indian Legal System this hierarchy is as follows: 1. The Constitution. 2. Statutory law, which may either be made by the Parliament or by the State legislature. 3. Delegated legislation, which may be either in the form of Rules, Regulations or Statutes made under the Act. 4. Executive instructions or Government Orders. 7. In the above hierarchy if there is conflict between a higher law and a lower law then the higher law will prevail. The executive instructions are part of the fourth layer in the hierarchy, which is at the lowest level, whereas an Act is part of the second layer and the Statutes made under the Act are delegated legislation and hence part of the third layer. The letters dated 31.8.1998 and 30.3.1999 are only executive instructions and hence they belong to the fourth layer. Hence they are neither Act nor Statutes. Hence in our opinion the age of retirement of an employee of the Indian Institute of technology is 60 years and not 62 years vide Section 13(2). We, therefore, respectfully disagree with the decision in Raja Ram Verma's case." This issue has been considered by this Court in the case of Sarita Gupta v. State of U.P. & Others, Writ-A No. 7096 of 2010, decided on 30.7.2010. The Court had occasion to deal with the similar arguments and at that time a Government order was issued imposing certain restrictions on transfer. The Court has expressed its view in the following terms: "The ban is general in nature. However, the provision of transfer for the purposes of placing husband and wife in the same district is a special provision which will normally prevail upon general temporary restriction on transfer. Accordingly, writ petition is allowed. Impugned order is set aside. Secretary, U.P. Basic Shiksha Parishad, Allahabad is directed to decide the matter ignoring the ban order dated 6.6.2009. The decision shall be taken positively within three weeks from today." It is trite that in most of the services of the Central Government and the State Governments, there is provision in their transfer policy that an endeavour should be made that husband and wife may be posted at the same place. In view of the said principle, under the Rules 2008 the provision of the couple posting has been incorporated. The intention of rule making authority is very clear and it needs no elaboration.Relevant it would be to mention that in transfer policy of State Government for Government employees there is provision only for husband and wife but in Rule 8(2) (d) of the Rules, 2008 the in-laws of the female teachers have also been included. Hence, in my view, in spite of the Government Order dated 13.6.2017 a female teacher's application for her transfer on the ground of couple posting or in-laws can be entertained notwithstanding some of the contrary provisions of the said Government order. For the above-mentioned reasons, there is no legal bar in considering the representation of the petitioner in terms of Rule 8(2)(d) of the Rules, 2008. Accordingly, a direction is issued upon the second respondent i.e. Secretary, Basic Education Board, U.P., Allahabad to consider the representation of the petitioner in the light of the observations made herein-above and pass appropriate order expeditiously, preferably within six weeks from the date of communication of this order. UP Teacher Transfer - अजब गजब यू पी शिक्षक ट्रांसफर : क्या पति पत्नी को 5 वर्ष दूर रह कर नोकरी करनी होगी ?, और यू पी सरकार केस हारते समय कोर्ट में क्यों नही बोली जब पति पत्नी को भी 5 वर्ष की सर्विस जरूरी होने पर ही ट्रांसफर मान्य था तो यह बात कोर्ट में सरकार ने क्यों नही बोली। हालांकि हाईकोर्ट पहले ही उस तर्क को नकारते हुए पति पत्नी, और महिलाओं को विशेष परिस्थिति वश ट्रांसफर हेतु मिनिमम सेवा अवधि से छूट दे चुकी है। लेकिन उसके बावजूद भी बेसिक शिक्षा विभाग ने कोर्ट के आदेश को ध्यान में रखकर कोई रियायत महिलाओं को नही दी, अब शिक्षिका पत्नी को 5 वर्ष की सर्विस पूरी करने के बाद ही पति के जिले / ससुराल में ट्रांसफर ले पाएंगी। जिन महिलाओं के बच्चे छोटे हैं, या कोई तकलीफ है, तो इन हालातों में भी जहां सर्विस कर रही हैं, वहां 5 साल पूरे करें तब ही आवेदन करें। या फिर शिक्षिका की नोकरी छोड़ें। महिलाओं ने आत्म सम्मान और अपने पैरों पर खड़े होने हेतु इस शिक्षिका नोकरी को चुना, लेकिन बच्चों के क्या कसूर जिन्हें अपने माता पिता का संरक्षण एवं प्यार नही मिल पाए

UP Teacher Transfer - - *अफसर, शिक्षक व कर्मचारियों पर कठोर कार्रवाई के निर्देश, तबादलों हेतु अभी 10 फीसद शिक्षक व कर्मियों का डाटा अपलोड न होने शासन हुआ सख्त, वेतन रोकने के निर्देश * राज्य ब्यूरो इलाहाबाद : शासन के आदेश व बेसिक शिक्षा परिषद मुख्यालय के निर्देशों के बाद भी अफसरों की कार्यशैली में बदलाव नहीं हुआ है। यही वजह है कि जिलों में मानव संपदा की वेबसाइट पर 10 फीसद शिक्षक व शिक्षणोतर कर्मियों का डाटा अभी अपलोड नहीं किया गया है। इस कार्य में रोड़ा बनने वाले खंड शिक्षा अधिकारियों, शिक्षक व शिक्षणोतर कर्मियों का वेतन रोकने और उन पर विभागीय कार्रवाई करने के निर्देश हुए हैं। बेसिक शिक्षा परिषद में मानव संपदा की वेबसाइट पर सभी शिक्षक व शिक्षणोतर कर्मियों का पूरा डाटा अपलोड करने की प्रक्रिया लंबे समय चल रही है। शासन ने सभी को अनिवार्य रूप से आधार से जोड़ने को भी कहा गया है। यह भी निर्देश रहे हैं कि जो शिक्षक व कर्मचारी आधार नंबर मुहैया नहीं कराते हैं उनका वेतन रोक दिया जाए। इस संबंध में शासन, विभागीय अफसरों व परिषद ने अनेकों पत्र बेसिक शिक्षा अधिकारियों को भेजे हैं। यही नहीं अगले सप्ताह से शिक्षकों का अंतर जिला तबादले की प्रक्रिया शुरू होनी है। इसमें ऑनलाइन आवेदन लिए जाने हैं। यह तबादले सभी का डाटा पूरा अपलोड हुए संभव नहीं होंगे। इस बीच जांच में सामने आया है कि अब भी जिलों में करीब दस फीसद शिक्षक व कर्मियों के डाटा वेबसाइट पर अपलोड नहीं है। इस पर परिषद मुख्यालय ने कड़ी नाराजगी जाहिर की है। परिषद सचिव संजय सिन्हा ने बीएसए को भेजे आदेश में कहा है कि आठ फरवरी, 2016 से लेकर 16 अगस्त, 2017 तक अनेकों पत्र व दूरभाष पर इस प्रक्रिया को पूरा करने के निर्देश दिए गए, फिर भी कार्य अधूरा है। इसे हर हाल में एक सप्ताह में पूरा करें। इसमें यदि खंड शिक्षा अधिकारी, शिक्षक या फिर शिक्षणोतर कर्मचारी की ओर से विलंब होता है तो उनका वेतन रोका जाए। उनके विरुद्ध विरुद्ध विभागीय कार्रवाई की जाए उससे परिषद को भी अवगत कराया जाए। UPTET / टीईटी / TET - Teacher EligibilityTest Updates / Teacher Recruitment / शिक्षक भर्ती / SARKARI NAUKRI NEWS UP-TET 2011, 72825 Teacher Recruitment,Teacher Eligibility Test (TET), 72825 teacher vacancy in up latest news join blog , UPTET , SARKARI NAUKRI NEWS, SARKARI NAUKRI

*9892 एलटी ग्रेड शिक्षक भर्ती, लिखित परीक्षा के आधार पर ही होगी यह शिक्षक भर्ती, आवेदन लिए जाएंगे * डाइट लेक्चररों की भर्ती का मामला भी लटका पड़ा है राज्य ब्यूरो इलाहाबाद : प्रदेश के राजकीय इंटर कालेजों में 9892 एलटी ग्रेड शिक्षकों (सहायक अध्यापक) की भर्ती का पाठ्यक्रम उप्र लोकसेवा आयोग में बनकर तैयार हो गया है। शासन में पाठ्यक्रम भेजकर इसका अनुमोदन मिलने के बाद आवेदन लिए जाएंगे। पहले यह परीक्षा मेरिट के आधार पर प्रस्तावित थी लेकिन, अब आयोग से लिखित परीक्षा होगी। अपर शिक्षा निदेशक माध्यमिक के नेतृत्व में बनी कमेटी को पहले यह परीक्षा मेरिट के आधार पर कराने की जिम्मेदारी सपा शासन में मिली थी। कुल 9342 पदों पर भर्ती के लिए आवेदन 26 दिसंबर 2016 से 26 जनवरी 2017 तक मांगे गए थे। इस बीच विधानसभा चुनाव की आचार संहिता लागू होते ही परीक्षा की प्रक्रिया थम गई और प्रदेश में नई सरकार बनते ही इस पर रोक भी लगा दी गई। इसके बाद प्रदेश सरकार ने एलटी ग्रेड शिक्षकों का चयन मेरिट से न कराकर आयोग से लिखित परीक्षा के आधार पर कराने का फैसला किया। 31 मार्च 2017 तक कई शिक्षकों के सेवानिवृत्त होने पर उनके खाली पदों पर भी रिक्तियां भरने को जोड़ते हुए पदों की संख्या बढ़ाकर 9892 कर दी गई। आयोग में इस परीक्षा के लिए पिछले साल से ही बनाया जा रहा पाठ्यक्रम पूरा होने को है। सचिव जगदीश ने बताया कि पाठ्यक्रम पर शासन से अनुमोदन मिलते ही आवेदन पत्र मांगे जाएंगे। कोशिश होगी कि परीक्षा समय पर हो। दिसंबर में ही होनी थी परीक्षा : शासन से 9892 पदों का अधियाचन मिलने के बाद आयोग को यह परीक्षा दिसंबर 2017 में ही करानी थी लेकिन, पाठ्यक्रम में लेटलतीफी के चलते परीक्षा 2018 में कराने की रणनीति बनी और छह मई को इसकी तारीख घोषित की गई। नए सिरे से लिए जाएंगे आवेदन : सपा शासनकाल में विज्ञापन जारी कर आवेदन पत्र आमंत्रित किए थे जिसमें सवा पांच लाख अभ्यर्थियों ने आवेदन किया था। अब आयोग की ओर से हो रही परीक्षा में नए सिरे से विज्ञापन जारी करने के बाद आवेदन लिए जाएंगे। कक्षा छह से 10 तक के विद्यार्थियों को पढ़ाने के लिए एलटी ग्रेड शिक्षकों की भर्ती आयोग से पहली बार होने जा रही है UPTET / टीईटी / TET - Teacher EligibilityTest Updates / Teacher Recruitment / शिक्षक भर्ती / SARKARI NAUKRI NEWS UP-TET 2011, 72825 Teacher Recruitment,Teacher Eligibility Test (TET), 72825 teacher vacancy in up latest news join blog , UPTET , SARKARI NAUKRI NEWS, SARKARI NAUKRI

In this regard, she has already made representations to the first respondent on 9.11.2017 and 14.11.2017. Learned counsel for the petitioner has placed reliance upon decision rendered by this Court in Bibha Singh Kushwaha Versus U.P. Basic Education Board and others (Writ-A No. 30808 of 2017) decided on 19 July 2017. Shri Y.S. Petitioner as well as her husband Shri Anurag Gupta both are teachers in Schools run by Basic Shiksha Parishad, Allahabad. At present petitioner is posted as Assistant teacher in primary school Jhawar Hardopatti, Block ? Lalganj, District, Raibarelly. In February, 2009 petitioner has married with Shri Anurag Gupta who is Assistant teacher in Primary school, Mirzapur, Sunahari Block Purwa District Unnao. Petitioner has applied for her transfer to some school run by Basic Shiksha Parishad situate in district Unnao. Earlier also petitioner had filed a petition for her transfer being writ petition no.63444 of 2009 which was disposed of on 24.11.2009 with the direction to Secretary U.P. Basic Shiksha Parishad, Allahabad to decide the matter. Secretary rejected the representation through order dated 6.1.2010 on the ground that through order dated 6.6.2009 the government had imposed restriction on transfer. The said order has been challenged through this writ petition. Shri C.N.Tripathi, learned counsel appearing for Basic Shiksha Parishad states that except the ban mentioned in the impugned order there is no other hindrance in posting both husband and wife at one place. The ban is general in nature. However, the provision of transfer for the purposes of placing husband and wife in the same district is a special provision which will normally prevail upon general temporary restriction on transfer. Accordingly, writ petition is allowed. Impugned order is set aside. Secretary, U.P. Basic Shiksha Parishad, Allahabad is directed to decide the matter ignoring the ban order dated 6.6.2009. The decision shall be taken positively within three weeks from today. Office is directed to supply a copy of this order free of cost to Shri C.N.Tripathi, learned counsel for Basic Shiksha Parishad (Chamber No.141) by 3.8.2010. On 14.7.2015 following order was passed by this Court: "This contempt application has been filed for punishing the opposite party for willful disobedience of the order dated 29.05.2014 passed by this Court in Writ - A No. 28686 of 2014 (Brahm Dev Yadav and 5 others Vs. State of U.P. and 4 others) and judgment and order dated 12.06.2014 passed by this Court in Special Appeal No. 561 of 2014 (Alok Kumar Dixit Vs. State of U.P. and 8 others), judgment and order dated 07.04.2015 passed by this Court in Special Appeal No. 622 of 2014 (Anil Kumar Singh Vs. State of U.P. and 8 others), order dated 08.05.2015 passed by this Court in Writ - A No. 28686 of 2014 (Brahm Dev Yadav and 5 others Vs. State of U.P. and 4 others), order dated 30.04.2015 passed by this Court in Writ - A No. 24818 of 2015 (Santosh Kumar Mishra And 4 others Vs. STate of U.P. & another) and order dated 15.05.2015 passed by this Court in Special Appeal (Defective) No. 363 of 2015 (Bharat Suman Vs. State of U.P. & 6 others). Sri Bhanu Pratap Singh, who appears for the opposite party no. 1 has filed an application praying therein that at least four weeks' further time may be granted for compliance of the aforesaid orders passed by this Court in various writ petitions which has been opposed by Sri Shailendra. Learned counsel for the applicant states that it is a delaying tactics of the opposite parties as the entire proceeding for appointment of the applicant and other similarly situated persons are held up due to which teaching work of the Junior Basic School throughout the State is suffering. Considering the facts and circumstances of the case, four weeks' further time is allowed to opposite parties to comply with the aforesaid orders passed by this Court in its letter and spirit. List on 17.08.2015. In case, by that time the aforesaid orders are not complied with and affidavit of compliance is not filed, the opposite parties shall remain present before the Court for framing the charge." Even after intimation given to the opposite party the order of the writ Court dated 29.5.2014 has not been complied with in its letters and spirit. The matter was again taken up on 21.8.2015 and the following order was passed: "An affidavit has been filed duly sworn by Sri Sanjay Sinha, Secretary, U.P.Basic Education Board Allahabad. In paragraph 3 of the affidavit, it is stated that appointment letters to the eligible candidates will be issued by 15th September, 2015. In view of the aforesaid situation, framing of charge is deferred till 15th September, 2015. List this case on 16th September, 2015. In case, appointment letters are not issued to the all eligible candidates by 15th September, 2015, the opposite parties no. 1 and 2 shall remain present before the court for framing the charge." The matter was again taken up on 16.9.2015 and the case was adjourned on the request of the learned counsel for the parties fixing 23.9.2015.� Today a supplementary affidavit of compliance has been filed duly sworn by Sri Sanjay Sinha Secretary, U.P. Basic Education Board, Allahabad. In paragraph 4 of the affidavit following averments have been made: "4. That in compliance of the judgment/order passed byt his Hon'ble Court as many as 15098 eligible candidates have been appointed as Assistant Teacher (Science and Maths) in Parishadiya Junior High Schools in different districts of State out of 29334 vacancies; however the appointment against remaining/ relevant vacancies is under process." Sri Shailendra, learned counsel for the applicant submits that it has wrongly been stated that 15098 candidates have been appointed. In his submission none of the candidates has yet been permitted to join.� On the contrary a stand has been taken in paragraph 4 of the supplementary affidavit of compliance that 15098 eligible candidates have been appointed and remaining candidates are not eligible. The submission is how this stand can be taken by the opposite party when this was the subject matter of the special appeal and special leave to appeal before the Apex Court.� Earlier the opposite parties vide order dated 14.7.2015 were directed to remain present before the Court. Thereafter an impleadment application was filed by Shri Shailendra, Advocate to implead Smt. Dimple Verma, Principal Secretary, U.P. basic Education, Lucknow, which was allowed and notice was issued.� Sri Bhanu Pratap Singh, learned counsel who appears for the remaining opposite parties was directed to accept notice.� Pursuant thereto an affidavit of compliance has been filed duly sworn by Smt. Dimple Verma,Principal Secretary, U.P. basic Education, Lucknow. adopting the stand taken by the Secretary, U.P. Basic Education Board, Allahabad as has been discussed above which he has stated in paragraph 4 of the affidavit.� Prima facie, alleged compliance of the writ Court's order appears to be an eye wash and the opposite parties are misleading the Court. Taking note of that both the opposite parties are directed to remain present before the Court on 12th October, 2015 pursuant to the order of this Court dated 29.5.2015. They are also directed to file their detailed affidavits, day to day steps taken by them after the order dated 29.5.2015 List on 12th October, 2015.� Order Date :- 24.9.2015 samz
